are learning whether police are investigating a sex assault investigation involving the gunman was mishandled. jonathan: devin kelley once escaped from a mental institution. that is the same time he was thrown out of the air force jailed for domestic violence. that he haven't been able to crack the password on his phone. the community in texas is still trying to and will for some time process what happened. devin kelley spent 12 months in a military prison for abusing his wife and stepson in 2012. federal law says domestic violence conviction made him ineligible to buy any guns. >> that is a disconnect there that has to be looked into. >> the d.c. military legal expert. >> the military has their own way of handling how things get disclosed. or

>> the air force admitting the own way failed to alert the f.b.i. about the conviction. he believes it could be simple as getting computer systems to talk to each other. >> we have the military level, different than the civilian level where we are all interconnected. >> it wasn't just one data base. three different data bases were never alerted by the air force. >> as recent as 2015 the inspector general from pentagon reported hundreds of military convict fingerprints were not submitted to the f.b.i. database. jonathan: thank you. the man who chased and shot the gunman said he took action after hearing rapid gunfire coming from across the street. realizing that each shot he heard represented somebody's death. >> i grabbed a handful of ammunition. and started loading my magazine.

take time to put my shoes on and i ran across the street looking for it. he had a pistol in his hand. we exchanged gunfire. jonathan: he is a former shooting instructor and also a plumber and he feels guilty he didn't get there sooner. michelle: tonight we have an update to breaking news we have been following all evening for you. former major league pitcher roy halladay has been killed in a plane crash. the 40-year-old cy young winner was flying his own plane off the coast of tampa when it plunged in the gulf of mexico. no one else was on board. it's not clear what caused the crash. jonathan: so sad. all right. the rain we were talking about. you see right there both men vying to be governor of virginia. they were out voting for themselves. miserable day. raining most of the day. there is always the concerned about the rain and the role it will play in this election. asf as bringing people out to vote. the clock is ticking for others who do want t

and get out to vote. michelle: that is right. the polls in virginia are closed tonight at 7:00. less than an hour from now. governor's race is just one of four important statewide races that we are watching tonight that could include wish party controls the state house. richard reeve joins us from a polling location in fairfax with what kind of turnout we are seeing tonight. rich? richard: yeah, the clock is running as you said. but also the weather is a big issue. bill kelly talking about that. look behind me. and you can see a few people out here. the stakes are high. look at governor, lieutenant governor, the a.g.'s office and delegate races. 47% of the voters here have come out to vote. 47 in alexandria and 40% in arlington. that is high considering the horrible weather we are having. talking to the voters, very passionate. a lot of folks

michelle: we return with more breaking news tonight. this time from northeast d.c. where two firefighters are hurt after a fire that cost four people their homes. this all unfolding in the past two hours on 14th place northeast. we are told several cats also died. no word on a cause. jonathan: more animals killed in a fire in burtonsville. this fire here. the family says they lost their home and the three dogs. firefighters say some sort of electrical problem is what set it off. it happened on schubert drive. no people were hurt in the fire. investigators say that somebody intentionally started this deadly house fire last thursday in seat pleasant. two men in the supposedly vacant home on not street died from smoke inhalation. they were found on the second floor. they identified the men and are not releasing the identity. they haven't identified an arsonist. no arrest has been made. michelle: former teacher is accused of sexually abusing a

student. grand jury indicted 40-year-old latoya parker with sex abuse, sex solicitation and displaying obscene material involving a student. court document say the incident happened late last year and early this every year. parker is no longer teaching and has been released on bond. now crime alert for a group of men suspected of attacking someone in an attempted robbery in the district. take a look. you see a man lunge off a capital bike share bike and begin attacking that man. this all happened wednesday outside succotash. security cameras at a nearby convenient store caught clear images of the summit. here it is. see them clear as day. jonathan: still ahead. making old look like new. metros attempt to upgrade rail cars without buying new ones. michelle: the moment the floor givings way. fl

a high-speed chase in los angeles. you see the stolen ford mustang speeding down the highway there. that is what an officer gets in just the right position. spins out the mustang. that is enough to make the driver put it in park and surrender to police. jonathan: new at 6:00, the school websites recruiting for isis? hackers managed to get in to every school at four districts nationwide including one in southeastern virginia. so more two hours yesterday, those sites showed what is believed to be isis recruitment video. the company that runs the site now say that beefing up security. michelle: disciplinary panel has found baltimore police officer caesar goodson not guilty on all administrative charges tied to the freddie gray case. he drove the police van carrying grey after the 2015 arrest is in custody death sparked riots across the city. goodson later acquitted of criminal charges in gray's death. jonathan: first on 7, security guards

in silver spring accused of selling certification to other guards to pass weapons test. we learned four employees of the north american security have now been arrested. authorities say that the fraud took place at a gun range in upper marlboro. investigators say the scheme went on for three years until somebody reported it to the commercial department inspector general. michelle: the belle of metro's ball, the newiest, shiniest and the cleanest cars. 7000 series is what we are talking about. you could get the new car experience in the older rail cars. sam sweeney shows us the work to wrap older cars in vinyl to save money and the environment. >> this green line train is 11 years old but you wouldn't know it by looking at it. when you walk in it, it even smells new. >> the fresh new smell. >> metro wrapping some of the 3000 and the 6000 cars in
