father when she was shot. >> she loved life and the people in it and she loved us and we miss her greatly. >> reporter: in a 2015 jailhouse interview garcia zarate admitted shooting steinle. >> did you shoot kate steinle, the lady who was down on pier 14? >> yes. >> reporter: but claimed he found that gun and when he picked it up it fired. accident or intentional the case supercharged the presidential election's debate over ill league immigration. he was a convicted felon previously deported five times. >> we're going to shut down the sanctuary cities have that led to preventible deaths of so, so many. >> reporter: just before the shooting garcia zarate was in jail on drug charges but those charges were dropped and san francisco officials set hi free ignoring a federal i.c.e. request to hold him. overnight theagency said this

criminal aliens led to the preventible and heartbreaking death of kate steinle. sessions said that the suspect would not have been on the streets of san francisco if the city had worked with immigration officials to remove him. law enforcement officials tell me that the justice department may pursue federal charges in the steinle case. >> the family is going to wait and see about that. in other news, concerning the russian investigation and you have new reporting, exclusive new reporting on what mueller and his team are up to. >> reporter: yes, abc news learned that the special counsel's office has incurred total expenses in excess of $5 million in the first months of the investigation. those expenses include money for staff and travel involved in investigating whether associates of the trump campaign colluded with the russians in a 2016 election. a more detailed breakdown will soon be released but those numbers give you a sense of how broad and aggressive the probe has been which also includes targets like former trump campaign chairman paul manafort recently indicted and trump's former national security

six-year $102 million contract last year has yet to respond to the lawsuit. josh's estranged wife catherine did not respond to our request for comment and the pair are separated. >> alienation of affection, only available in, what, seven states. >> only in a handful of states and you have to prove there was love in the marriage, that the marriage was broken and the defendant in some way caused that. >> how do you prove that. >> divorce proceedings. >> an affair is part of that. but then there are things he can use to defend that. he can say, for example, i didn't know they were married. things like that but you're talking about $9 million in one case. $1.4 million in another case in 2001. a million in another. >> why wouldn't he sue for more? >> there's been a movement to reduce the penalties from it and that might have happened here or he might just simply trying to say this is my costs. this is what i feel i suffered and that's what i'll try to get and on the books in a couple of different stas.

gratitude, gratitude to francia and everybody else who has helped her through it and said i respect the platform i have so deeply because of how it's allowed her to help others in having gone through this herself. >> i think what we all respect we loved how open she's been throughout this entire ordeal. she hasn't stopped sharing it to help others out there. >> this is someone who is otherwise very private but chose to go public with her diagnosis in 2015 because she wanted to be an advocate for the disease and is clearly being open about her surgery and everything she went through and that process and now even talking about her surgical scar. she said in a recent interview with billboard that she was self-conscious about it but she says, you know what, now i look at my body, i've learned to appreciate it and she says i feel like i'm wonderfully made which is just such a beautiful thought, i think for anybody who has felt self-conscious about our body and so many have. >> it seemed like she teased us. >> a lot was dedicated to women obviously because of the event and said she was very grateful to all the older wind, her

t the undocumented immigrant who killed a woman in san francisco and put focus on sanctuary cities and back to clayton sandell now. he is in san francisco. good morning, clayton. >> reporter: hey, good morning, george. this case which has fanned the flames of a politically charged immigration debate began right here, kate steinle was a 32-year-old tourist enjoying the san francisco waterfront here with her father when she was shot and killed in 2015. now a jury has found jose ines garcia zarate not guilty. the case caused such a firestorm because zarate garcia is also an undocumented immigrant. he had been previously reported five -- deported, that is, five times. shortly before the shooting he was in jail on drug charges that were dropped so san francisco officials set him free despite a federal i.c.e. request to hang on to him. overnight president trump tweeting the verdict -- calling it disgraceful. garcia zarate admitted to shooting steinle but the defense has always claimed that the shooting was accidental.

on a minor weapons charge and will serve some jail time. however, i.c.e. officials say after that he will be deported for a sixth time, george. >> okay, clayton sandell, thanks very much. we'll take a look at an incredible piece of video from the oswego police in illinois. officers responding to a hit-and-run accident. they come upon this car engulfed in flames and rush to the scene. they notice the driver is still trapped inside. now, despite the intense heat, the officers manage to reach in, pull him to safety. >> fantastic. >> i know. two officers are rushed to the hospital with smoke inhalation and another suffered burns on his arms and legs but that is another fine example they are so selfless, they think of others first going in. >> absolute heroes. big-time heroes. knew to help in tech colliding in a big way for your heart. the fda just cleared the first medical device accessories for the apple watch, an ek
