here's what people are talking about. two people shot in cold blood. mike hellgren has the latest on their conditions. >> reporter: officer jerome sharratt went through another surgery this morning. the other officer has been released. police say sean sinclair fired directly into the patrol car of officer jerome sharratt. officer sharratt responded after a fell he low officer called for backup. sinclair has an extensive arrest record. he's also faced allegations of domestic violence. eyewitnesses say the gun battle in west baltimore was frightening. >> it is really a shootout. we never experienced this. >> it was like something out of law and order, a movie, walk up to the police driver and just let loose. >> reporter: police say the violent incident began when

sinclair assaulted two women. one of them may have filed this protective order against sinclair. >> to assault the women is cowardes is. to be running around the streets of baltimore, he established himself as a menace, and then backed it up with his cowardly acts on the scene. >> reporter: wjz obtained home video taken minutes after the incident showing sinclair on the ground. police shot him twice. >> i have very few apologies to make about his condition or the outcome of this incident. >> reporter: there's a peace order that's still in effect against sinclair to stay away from an ex-girlfriend. at shock trauma, mike hellgren, wjz eyewitness news. >> police say sinclair used a 9- millimeter semiautomatic handgun. new at 5:00, eyewitness news talks with the suspect's family. baltimore county police are investigating an incident at the white marsh chick-fil-a restaurant. weijia jiang is live tin

newsroom with what police are saying. >> reporter: the call came into police as a kidnapping and robbery at the chick-fil-a in white marsh. the store's manager tells police he was taking yesterday's receipts to the bank when a suspect got into his car and ordered him to drive. the victim says the suspect bailed out of the car at king avenue and franklin square drive with the money. the victim then drove to the hampton inn hotel and called police. >> weijia, thank you. police have a suspect description and are actively searching for that person. a frederick county man is under arrest charged with a crash that took the life of a carroll county teen. police say 42-year-old kevin smith struck and killed 15-year- old indicate lynn boss ler on francis scott key highway in carroll county last night. bossler was hit while standing outside the driver's side door of a vehicle on the shoulder of the road when it happened. smith faces charges for driving under the influence. much more at 5:00. the u.s. military says it's

survivors of the deadly virginia tech attacks are speaking out against a proposed national standard for carrying concealed weapons. tech student seung-hui cho killed 31 people before committing suicide in 2007. about 30 families of the victims urged a rejection of the concealed carry amendment. it would allow people to carry concealed weapons outside their own state if they are licensed in their state. three men are safe from a large fishing boat moments before it sinks off the coast of southern jersey when the

fire broke out in the engine. a nearby fishing boat saved the men from their lifeboat as the coast guard moved in to put out the flames. the men were all okay, but the boat could not be saved. a former boston trolley operator has pleaded not guilty accused of texting during a crash that injured more than 60 people. the operator says he's very afraid of the charges he's facing. >> reporter: 24-year-old adan quinn faced a judge for the first time since the may 8th green line crash pleading not guilty to charges of gross negligence by a person in control of a train. prosecutors say the former trolley operator admitted typing a text message moments before the crash. >> he's very afraid about the situation he finds himself in. his life has been shattered, and he's doing the best to deal with the situation in which he is facing potentially going to state prison. putting this man in prison is not going to fix any of the injuries but that's what we're

facing. >> reporter: he faced a judge for the first time since the may 8th green line crash pleading not guilty to charges of gross negligence by a person in control of a train. prosecutors say the former trolley operator admitted typing a text message moments before the crash. over 60 people were injured. $9 million in damage done. today we learned quinn allegedly made a phone call as well before the text message. >> the recipients of that phone call never received that phone call, but there was an attempt to make the phone call, then there was an attempt to draft a text message. >> reporter: quinn has since been fired. did he not say anything after the hearing but his attorney challenged the gross negligence charge. >> they've chosen to charge him under a statute which is 135 years old that's never been used before to prosecute somebody, to my knowledge. it applies to chew choo-choo trains. >> wall street picked up where it left off last week.

extending the rally into a second week, the dow is up 104 points, the s & p up 11, the nasdaq up 23 over the 100 mark. let's go to new york for money watch update. >> reporter: investors went on a buying spree pushing the market higher for the 6th day in row. an upbeat forecast of u.s. economic activity drove the rally. the index sleegd economic indicators which includes building permits, jobless claims and stock prices rose more than expected in june. it was the third straight monthly increase. the financial markets were also able to finally exhale about c it group. the commercial lender was teetering on the edge of bankruptcy but found a life line over the weekend. its major bond holders reportedly agreed to provide the company with adds 3 billion rescue loan. c it lends money to thousands of small and mid-sized businesses. wall street is also combing through earnings reports for signs of recovery in the business world. has bro was one of the big ones

well, it's definitely feeling stickier, like it wants to rain, bern dre. we going to see some? >> the moisture is starting to creep up in the atmosphere. so dry over this weekend, so it's take some time. want to show you radar. to answer your question, some people are seeing the rain, and the rest of us have a pretty decent chance of it with all of this to the south moving northward. right around cumberland a couple of thunderstorms. right around oakland, but not on top of you in deep creek. down to the south this is the other round that's coming our way. southern maryland, we're seeing some thunderstorms right now making their way up toward prince frederick, passing through leonard town, making their way into charlotte hall.

hoopersville, a couple thunderstorms. the same thing for the beaches. doesn't look like it's on the boardwalk quite yet but this is moving in that direction. so we'll switch is it over and show you what we've got going on temperature-wise. it's been cold today, only 82 degrees for our high. below the average of 88 degrees. we pointed this out yesterday, but this is usually the warmest time of year for us, but it's not really happening right now. we're coming in at that 82. 79 with the thunderstorms in cumberland. i didn't tell at the ocean. the dew points are on the way up, and as that happens, it's going to start to moisten our atmosphere, so when the rain comes in, it's going make it all the way to the ground. we may after couple of rounds of this before we're done with the storm. the winds have turned around to the southeast. that's tapping into the moisture bringing in that ocean air that is keeping us cooler. so you see the clouds in place. here are some of the thunderstorms and rain moving our way. this is going to continue on

and off tomorrow. it's a coastal storm. so the bulk of the precipitation is going to be more so on the eastern shore and along the beaches. the farther south you go, the better chance you have at seeing anything, but as you can see by the pictures right there, all of us do after chance. here's the low just off to the south, making its way north, passing through tonight, into tomorrow. it gets offshore on wednesday. there still is a slight chance for a pop-up shower or thunderstorm on wednesday, because just as soon as we get rid of one storm here comes the next one right behind it. that's going to come in on thursday again with the chance for showers and storms and get out of here on friday. so the forecast looks like this. out on the waters winds out of the northeast tomorrow at 10 to 15 thoughts with that storm passing through. tonight we are going down into the sick. scattered showers and thunderstorms. tomorrow the same idea with that storm passing through but take a look at that temperature, only topping out at 78 degrees in july.

it is 4:28, 82 degrees. thanks for staying with eyewitness news. i'm denise koch. vic is o. here's would people are talking about. breaking news in the steve mcnair investigation. sally is in the newsroom with more on the toxicology report. >> reporter: police have released that mcnair's blood- alcohol limit was twice the legal limit at the time of his death. police believe he was asleep when he was shot in a murder- suicide. the medical examiner says there is no way to tell from the report how long before mcnair's death he had been drinking. those same tests also show that sahel kazemi, mcnair's girlfriend, had a trace amount of marijuana in her system when she shot mcnair, then killed

herself. neighbors risk their lives to save a mother and her child in a burning suv. the entire scene was captured on tape. here's our report on the frantic rescue from milwaukee. >> reporter: this suv hit a tree and burst into flames with a mother and her two young children trapped inside. people from the milwaukee neighborhood raced to the burning vehicle to try and save the family as a bystander caught the entire rescue on tape. neighbors used stakes and pipes too break the front window and pull the mother and her two- year-old daughter out of the infer no. >> i'm still shaken up. thank god we were there and the off-duty firefighters were there. >> reporter: with a four-year- old boy still trapped, two off- duty firefighters reached the scene after getting a call from their wives. >> the child was screaming, then it went silent, i didn't hear anything, and for that

split second i thought that we were too late. >> reporter: they needed a knife to cut the seat belt off the four-year-old and had help with the flames from an off- duty police officer who had two fire extinguishers in his truck. >> you just do what you have to do and think about it later. >> reporter: they freed the boy, and doused him with a neighbor's garden hose. >> i told him he's the toughest little boy. >> it was emotional. >> reporter: both firefighters and the officers suffered second and third-degree burns. the four-year-old suffered burns over 30% of his body and is in critical condition. >> to me, we saved a life. >> reporter: the city's mayor says the bravery of milwaukee citizens saved the family. cbs news. >> officials say the driver may have fallen asleep before slamming into the tree, but the cause is still under investigation. well, here at home 10 people were hurt in anne arundel county as a man was fleeing from police and crashed his car. police say they had the man pulled over on a traffic stop, but he attempted to flee before

it was completed as officers followed him down the road they say he and another vehicle crashed. one man suffered life- threatening injuries and was flown to shock trauma. the suspect has been identified as 22-year-old calvin leeander curtis. charges have been filed against him for theft. two men thought to be homeless became trapped as the vacant rowhome they took cover in quickly went up in flames. firefighters tempted a frantic rescue. one of the men has dade, the other is clinging to life. >> in a neighborhood pockmarked with vacant houses 2 south perry street stands out. it's here two presumably homeless men sought shelter. >> a second victim was found on the third floor of this location as well in the front room, unconscious, nonresponsive, in cardiac arrest. >> reporter: that man was later pronounced dead. earlier the city boarded 2 south kerry to prevent just such a fair and death.

baltimore looking donate bone marrow to this man. 32-year-old jonathan has been battling a rare form of leukemia. doctors say his only chance of survival is to find a man. so far 500 people have registered. a special swimmer in the waters near havre de grace. kai is in the newsroom with more on the unusual find. >> denise, the national aquarium is concerned that there is a manatee swimming in those waters. a marine animal rescue team has confirmed the presence of a manatee and even taken these picture of it. it's believed it swam all the way here from florida, which is where manatees are more commonly found. boaters are being advised to slow down and don't approach the manatee. and don't under any circumstances attempt to feed it. >> if you should see the man nay tee you should call the maryland national resources police. they have a special hotline on

a driver causes a three-car accident and then flees, leaving two children behind. police in south florida say the driver tried to maneuver in between two cars. he struck a truck which hit an suv and caused the suv to overturn. the four-year-old and the six- year-old left at the scene are fine. the suspect was caught a short time later. a union official says the san francisco light rail operator blacked out seconds before saturday's crash. the driver's train crashed into the back of a park train. -- parked train. investigators are sometime working to determine why the operator turned off auto pilot. the suspect in this weekend's deadly shooting rail page appears in court for the

virginia now. a little bit of activity around ocean city. most of it appears to be moving pretty much from southeast to northwest. so it's hard to say exactly who will get the best rain, but right now there is a frit good batch across southern maryland. you see this batch. hopefully we'll get some of this tonight. there's some thunder and lightning as well. most of it seems to be moving up towards la plate tan the washington area. some areas will see some decent showers. some areas will be totally ripped off, but we hope to get some rain. let's take a look at temperatures. 82, the dew point is only 57. certainly not that high. humidity up to 42%. east winds at 9. the barometer 30.10 inches right now, just beginning to fall. around the state, only 68. some reign oakland, 8 4 in elkton, ocean city is patuxent at 80. so these temperatures are five to seven degrees cooler than average. dew point slowly coming up tomorrow. it will be in the 60s which will bring us a better chance of rain and thundershower

activity. upper 70s, lower 80s. very cloudy down around virginia, and out to the west, the mountain areas could see half inch or more of rain. for us, a quarter inch of rain perhaps, maybe some pocket of heavier rain, all because of the disturbance out here in georgia. moving up the coast, it's going to bring all this moisture up along the east coast. the heaviest appears to be either just east of the region, up along the atlantic coast area, new jersey, connecticut. looks impressive here but we're not getting anything at this moment. we'll see some rain. by wednesday, most of it should be over, so kind of in between systems. then thursday, again another chance for picking up some more
