about tonight. >> right now, we have scattered thunderstorms moving in through maryland. let's take a live look outside right now. we have clouds moving in. bob turk is in the tropical weather center. >> tropical air mass. take a look at radar. we have a little batch west of the city there. you can see the activity moving off to the east and northeast. just went through westminster. and around sykesville, heavy rain now, portions of northern howard county. just to the west of columbia. and all that was activity is moving to baltimore and northern portions of maryland. we'll see some of these showers. have to watch because some of these areas are picking up a half inch to inch of rain in 45 minutes or less. visibility is reduced if you're driving out there. be very, very careful. looks like things will be all right. but remains on the humid side.

>> thank you, bob. a prestigious harvard university professor is arrested as he tries to get into his own home. but the white police officer who arrested the prominent african american scholar is not backing down. >> reporter: president obama is jumping into the debate over the controversial arrest. >> the cambridge police acted stupidly in arresting somebody when there was already proof that they were in their own home. >> reporter: the police showed up at gates' home last week, after two african american men were seen trying to force the front door open. gates was already upset. when he demanded a badge number. >> there is a long history of

condition today. his breathing tube has been removed and he is breathing on his own. sharet is 44 years old and is a 17-year veteran of the force. he was shot three times. mcmillen was hit once. the officer returned fire, striking the suspect, sean sinclaire. sinclaire remains hospitalized. commissioner fred bealefeld called sinclaire a maniac. he describes the officers as incredible heroes. >> both officers were wearing protective vests. an internal city police investigation is under way now after a city police officer who just finished his shift, shot a suspect he says was trying to rob him at ray bus stop. -- at a bus stop. the officer says he was approached by two men. one of them had a gun. and the officer fired his service weapon, hitting one suspect in the arm. that suspect is in the hospital. a second is in police custody. a family has just filed a lawsuit against a local pool

for millions of dollars. they claim management was negligent, leading to their son's permanent brain damage. >> reporter: this is a copy of that lawsuit the family says negligence was involved. the incident happened about three years ago at the woodcroft swimming club in parkville. >> we'll see you in the morning. have a nice evening. >> reporter: 18-year-old james becker wasn't always confined to this wheelchair. three years ago, he was an athletic 15-year-old, on summer break from arch archbishop curly high school when he and his mother decided to spend a hot afternoon at the pool. tragedy struck. >> i looked over and saw my son with his head bobbing up and down. and i dove and pulled him out of the water. when he was pulled out, there was no heartbeat, he wasn't breathing, nothing. >> reporter: when the emergency crew got there, they used a defibrillator to restart his

heart. but critical minutes passed. his brain suffered damage. now his family is filing a lawsuit against the swimming club. they say that money will provide for expensive medical treatment he will need for the rest of his life. >> we have had this case reviewed by multiple national aquatic safety experts throughout this country, as well as many, many world renowned physicians. all of them have come to the unanimous conclusion that what happened to james becker was absolutely preventable. >> reporter: a lawyer for d.r.d., the pool management company, believes james had a heart attack in the water and denies claims of negligence. >> i sympathize with the family, of course. but in terms of liability, this was a situation where everything was done correctly. >> reporter: james becker's family is also pushing for more legislation, including requiring more lifeguards at large public pools and lifeguards trained to use defibrillators. mike hellgren, we'll eyewitness

news. >> -- wjz eyewitness news. >> the family says james was deprived of oxygen for more than 10 minutes. >> a furious ben roethlisberger made statements today about allegations that he sexually assaulted a woman. >> reporter: today, ben roethlisberger did not take questions. instead, he read a short statement, calling the accusations reckless and false. >> i did not sexually assault andrea mcnolte. saturday was the first that i learned of her accusations. her false and vicious allegations are an attack on my family and on me. i would never, ever force myself on a woman. >> reporter: andrea mcnolte claims roethlisberger raped her following a golf tournament last year. she has not filed a criminal complaint. instead, she's filed a civil lawsuit against him. nevada police are not investigating the incident. the pittsburgh steeler says he

plans to fight to protect his reputation and he will fight in a legal forum. >> he says he will remain focused on the upcoming pittsburgh steelers, champions. detectives seized documents from michael jackson's doctor and a nutritionist. the nutritionist, a registered nurse, is cooperating. >> evidence of manslaughter. that's what they were looking for when they searched the office of conrad murray. they took 21 documents and a copy of the computer hard drive. >> it is clearly a criminal investigation, looking at manslaughter. that raises the stakes substantially. >> reporter: a law enforcement source tells cbs news, that the search warrant was based on a preliminary autopsy report, pointing to propofol, also known as diprivan. the drug was found in the pop

star's rented mansion. >> the doctor was in the house. we're told there was a lot of evidence in the house that's linking the doctor to what happened to michael jackson. >> reporter: murray has not specifically denied giving jackson the powerful anesthetic. but says he did nothing that should have led to his death. in a statement, murray's attorney said the doctor should not be a target of criminal charges. >> authorities are tracking jackson's medical history on several fronts. >> i'm not under investigation. i knew they were coming. >> reporter: his former nurse, sherrillin lee. lee told the early show, the singer begged her for the anesthetic. >> he suffered from a really bad case of insomnia. and was told that this medication, diprivan, would help him to sleep. >> reporter: the focus seems to be, was dr. conrad murray responsible for michael

jackson's death. patty kaufman, cbs news, los angeles. >> the coroner's office is expected to release an autopsy report next week. a water main break is causing headaches for at least one baltimore neighborhood. this is closed today. a 12-inch water main broke today. a county road crew is at the scene, working to restore the scene. slick streets from this morning's rain may be the result of the collision between an ambulance and a car. the crash happened this morning. the medic was traveling down green spring to sinai hospital when it collided with a taxi. the ambulance ended up resting against a tree. let's check in on the roads now with sharon gibala at wjz traffic control. i'm happy to report that there is not too much going on the roads this afternoon. in fact, the biggest issue that we did have which was an accident on the top side of the beltway is cleared. there are still some lingering

christoforous with tonight's money watch update. the dow industrials are back over 9,000 for the first time in nearly seven months. positive economic numbers drove the stock surge. existing home sales, the third increase in three months. the army price of -- average price of a home rose to $182,000. but that is still down 15% from a year ago. first time unemployment claims jumped by 30,000 last week to 550,000. that was slightly worse than expected. the labor department says auto plant closings pushed the number of claims higher. automaker says profit jumped to $2.3 billion, ending a year-long losing streak. and the dow, heavyweight 3- m also came in with better-than- expected profits. $1.12 a share, well above the 94 cents that was predicted.

we have tropical air. we have some severe weather, technically out to the west. heavy rain, over frederick county, and southern portions of washington county. they have a warning there. take a look at the activity, moving off to the east/northeast at around 20 miles an hour. around the city now, one cell from finksburg down to columbia, moving up toward the northern sections of our region. just going to brush the region. the heaviest activity, around just to the south of frederick, moving across harpers ferry, brunswick. out in west virginia? a little bit of washington county the next hour. south of our region, there you see it. moving through, just north of columbia, toward the southern suburbs of baltimore.

we have showers and thunderstorm activity. very heavy rain in a very short time. some areas may get an inch of rain and gusty winds between now and 5:30, 6:00. most of the activity will be done, we think, about 8:00 tonight. take a look at temperatures around the region. rain temperatures back in the 70s. didn't get that hot. but the dew points are high at 68. 81 here. 82 in ocean city. in oakland. generally 70s to low 80s. most places only got to around 80. this morning, heavy showers north. some spots in baltimore, howard, carroll county. picked up an inch and a quarter. and right now that, activity, creating heavy showers and really heavy downpours. ocean city, out of the east at 9. this morning, showers in the southern bay. this morning, we were pretty clear. this stuff moved up through the region.

now is getting healthcare reform done. in washington, joel brown, wjz eyewitness news. >> now, house speaker nancy pelosi has not ruled out going into august to get the bill done. but said it might not be necessary. heavy rains are moving through the state now. there is a severe thunderstorm warning for two counties. outside right now, in our area, clouds are dominating the skies. it's a pretty tropical area right now. let's go to bob in the first warning weather center. >> looks like miami, florida out there. that's pretty typical of those kind of skies. we have showers in the region. heavy downpours to the west of the city. and also to the west of us, around frederick. there you see it. these have been diminishing. 83 to cockeysville. to the west of the beltway. down to about columbia. that's where the heaviest activity is. watch out there for heavy rain there. heaviest activity by far, from middletown into portions of washington county, just through harpers ferry, west of the frederick area. that's moving to the north and northeast around 20 miles an hour.

the service for a man who told america the way it was, through each the most turbulent of times. karen brown, wjz eyewitness news. >> cronkite will be buried in missouri next to his wife. a separate public memorial will be held in a few weeks at new york's lincoln center. today, family and friends of private first class bo brigdiagonal held a-- brigdoll held a vigil. tonight, president obama says the military is doing everything it can to rescue broogdoll. it has been two weeks since a massive grave-digging was uncovered. ministers, priests and rabbis traveled to the cemetery to reconsecrate what was once sacred ground. they gathered together in prayer to bless the grave sites as investigators gathered together at the scene.

four workers are accused of digging up hundreds of bodies to resell the burial plots. the national rifle association is warning senators that it will consider their votes on supreme court nominee sonia sotomayor as part of its influential annual ratings of senators. they say the high court nominee has a hostile view of the second amendment, the right to bear and keep arms. it is opposing her nomination, although her confirmation in early august is almost guaranteed. >> the nra's threat comes one day after the gun lobby suffered a big loss in the september, with a concealed weapon bill. a public apology is issued to a musician, falsely accused of e-mailing a bomb threat.

two large passenger ferries collided in sweden today, sending 12 people to the hospital. rescue workers say the 640-foot- long ferry hit another vessel, tearing a hole in its side. only one person was seriously hurt, while the other suffered minor injuries. police are searching for two robbers who attacked a restaurant employee in sacramento, california. take a look at the surveillance video. the man walked into the china buffet and pull the out a -- pulled out a gun. they forced an employee behind the counter, pistol-whipped him

in the face. police hope someone will recognize the men from the video and turn them in. six people are hurt after a series of drive-by shootings. sally is live in the newsroom with details on how the violence unfolded. >> reporter: the first shooting happened outside of the school's stadium. witnesses say one car drove by a blocked party taking place in the parking lot and opened fire on the crowd of people. a houston city councilman was there. but he was not hurt. two are the shootings happened nearby, just off campus a short time later. the victims are all young. police say their injuries are not life-threatening. vic? >> thank you very much. texas southern university officials believe the shootings are gang-related. the suspects remain at large. police have arrested three mayors of three new jersey cities as well as several rabbis as part of a sweeping corruption investigation. fbi agents escorted the 44, handcuffed suspects to a police

there are pockets of heavy shower activity and thunder and lightning activity as well. we have moderate to heavy shower activity. just to the northwest of baltimore. and around columbia. it has weakened considerably. we still have some heavy rain. the heaviest by far, frederick down to east of brunswick, some areas picking up a quick half inch or inch of rain. you folks in northeast frederick county, it's right on your doorstep. also, southwest of the city, around ellicott city in columbia, and now another shower, just to the south of annapolis now, moving through upper marlboro. south of annapolis, toward shady side. and southern portions of aa county. so we've got these showers and thundershowers. some areas with the eastern shore, not seeing a drop east of the city now very, very quiet. some areas picked up an inch to an inch and a half of rain

today, while the airports only had about two-tenths or less. some areas north of the city, literally and even downtown, picked up an inch and a half of rain with heavy showers this morning. this is tropical rain. a lot more to the north and west as well. southwest of us, this going to the east. not much more here in virginia. we pretty much finish with much of the rain. take a look at temperatures around the region. temps have dropped quickly. look how warm in cumberland. 88 out there. 82 in ocean city. obviously, 4:00 numbers at 5:00. a lot of these will be much more because of the showers. east winds continue to bring in moisture. whether there's a good deal of rain this morning down there, in between nothing. and out to the west, pretty good showers. now, that batch of rain, moving through. i think by 7:00, or 8:00, this is going to be probably history. offshore, a lot of rain going to affect new england, new york.

could see, two to three to four inches of rain. not really a tropical system. but ray lot of moisture with it. for us, that looks like the last batch. tomorrow afternoon, maybe a pop- up shower or thundershower. although looks like they the probably pop up for us. and temperatures go up a little bit for the weekend. maybe heading into 90 on saturday, believe it or not. and that's just one or two above normal. northwest winds. bay temp still at around 78 degrees. tonight, showers and heavy downpours. 66 tomorrow. sun, clouds, maybe an isolated shower. perhaps some thunder. tomorrow's high, up to 86 degrees. watch out for heavy downpours. they really reduce your visibility quickly. still to come on eyewitness news tonight. james becker is a far different man today than before he nearly drowned in a pool three years ago. his family has now filed a $40 million lawsuit. i'm mike hellgren.
