boulevard store setting off an alarm. >> and on upon entering the store, the suspect lunged at the police with a knife like object. >> reporter: the officers shot him in the head and the medics arrived. >> he was presented with no vital signs of life, they said. >> reporter: there was a second call for the emt's for the same time after the officers saw the suspect move, obviously, not dead. >> the patient indicated he may still be arrive. >> reporter: he was brought to shock trauma and he's in critical condition. it's not clear how the delay in treatment effected the man. >> reporter: two emt's are reassigned as the investigation continues into the incident and the suspect has a criminal history of assault, robbery and car theft. he was using a screwdriver and they felt like they had to

shoot him. okay, kelly, thank you. the 34-year-old officer who shot the suspect has been with the office for 16 years. >> and nearly a dozen are hospitalized after a carbon monoxide leak in baltimore county. >> reporter: well, ten including four children were taken to bay view and fire county arrested two on chip brand road at 1:00 this morning fire officials believe that hot water heaters caused the carbon monoxide leak. all of the people sick are going to be okay. the owner of the complex said it's in the process of having a contractor conduct inspections of all of the townhouse units. a man and woman are accused of filming child porn with children ages 2 to 13.

weijia jiang beam has the latest on the charges they face. >> reporter: a couple used their medical backed to subdue and terrorize children. >> reporter: the couple faces charges of filming, distributing and promoting child pornography. >> it's gross, it's indecent. there's no term other than a foul term to describe this. >> reporter: the suspects are in a romantic relationship and they live in this row house. and inside, the detectives discovered movie files and six cds. and inthem, the couple is seen performing sex acts on three victims, i think -- ages 2-13. >> i just can't believe it. >> it makes me want to vomit.

i have children and it's ridiculous. >> reporter: according to the documents, they filmed the videos at their house and right now, the police don't know who the children are. >> we know there's children, they're seen and they're abused. and they're on the film. that film has been given to the internet and we want to find out who the kids are. >> reporter: one victim is unconscious in the video. they have paramedic backgrounds. >> they're sick. they're sick. there's no other word for it. >> reporter: investigators aren't sure how long they've been making the child porn. essex may not be the only location. one video is entitled "fun in atlanta." >> i feel sorry for the kids. i'm glad they got them before they got any further, you know,

roof off. >> i turned to close the garage door from the house to the garage and i couldn't close it and it blew me back and i fractured my wrist. >> reporter: her wrist is fractured, but her home is broken. the walls buckled and huge holes mean she'll be out of the house for months. >> my sons and i didn't know it was bad until we were in the basement. we heard water and once i realized everyone was accounted for, we were fine. >> reporter: her home, one of the hardest hit in the star view estate's community of finksburg. >> reporter: needless to say, assurance adjustors have spent their day here assessing the damage. a lot of the homeowners are giving credit to the fire department for what they say is an excellent response to a damaging storm. we're live in finksburg, derek

valcourt, eyewitness news. thank you, first weather warning conditions continue with bernadette woods. bernadette? well, it's been a really wild week. we'll take you back on a broad brushed picture. it's been a few different days and over the entire week, we've had warnings and thunderstorm warnings. as far as the tornado warnings go, we've highlighted the counties with the warnings. official touchdowns weren't in all of the counties and we haddowned power lines and trees. during the wild weather, we started to up our rainfall again. after a dry start and basically 3/4 of the month in july, we've gotten 3.15 inches and that brings us up to 3.42 above average for the year. bob's going to have a forecast coming up shortly. remember, wjz is always on, go to eyewitness news for instant updates on the forecast and live radar any time, go to

wjz.com. some of michael jackson's last wishes are being granted in a los angeles court. a judge awarded his mother permanent custody of his children and there are so many unresolved issues with the case. >> reporter: michael jackson's 79-year-old mother kathryn will be raising a family once again. a judge declared her the guardian of her son's three children. the two oldest children signed declarations stating who they wished to raise them. their mother, debbie rowe will get to visit, but receives no money. >> today's result, 5 1/2 weeks after the tragic death of michael jackson eliminates uncertainty and offers stability to the lives of the children. >> reporter: kathryn and the kids will get a monthly allowance from the estate and

media waited to grab a snapshot of the family and debbie rowe. she didn't come to court and kathryn jackson and her doubter and son were driven to the courthouse. there are also many issues that need to be worked out regarding jackson's fortune two co-executors have already received millions of dollars of the singer's money, property and a life insurance pay yacht. kathryn jackson will receive 40%, but she wants to be co- executor. in los angeles, wjz-13 eyewitness news. the amount that -- that they'll receive is not yet disclosed. here's a live look outside. is it going to heat up as the week goes on? bob has the forecast. well, a few days, the temperatures will be above

normal. the normal high is 86, 87. taking a look at radar, there's nothing around here, we're at 85 and the humid is down and out to the west, however, there's another front beginning to take shape from about chicago through detroit and st. louis, that's heading our direction with showers breaking out and we'll start seeing more of the activity and by wednesday afternoon, we have a chance of getting more showers and thundershowers and not until wednesday. until then, a little bit warmer and more humid as well. he's back! raven's wide receiver derek mason comes back. and mark viviano has more from mason on the decision to stay with the team. >> reporter: he did give serious thought to ending his 12 year career, now, he's ready to play at least one more season.

>> reporter: derek mason caught everyone off guard when he announced his desire to retire last month. family matters were at the thoughts of quitting, he said. >> it was a decision i made from the heart and it had nothing to do with anything else but things that were goingen. i had a opportunity to reevaluate it and think about it. we felt it was best for me to finish this thing out. >> reporter: the decision came after days after the death of steve mcnair, a passing that factored into his thoughts of retirement. >> it makes you think about certain things and where your life is heading and your football career. so, you know, that was a factor. >> reporter: he insists that his desire for a contract extension didn't factor into the talks and he is certain he wants to play now.

a woman wants to massage horses. alex demetrick has more. >> reporter: she's spent most of her life around horse. >> good girl. >> when she extended her massage therapy from people to horses, the board ordered her to stop. >> i've spent my life with horse. it was the perfect job for me and to be told i couldn't do it any more, for no good reason, that was horrendous. courted she -- >> reporter: she sued and won. >> the board had no authority to regulate at all. >> reporter: it took 17 months to win in court and 17 months of lost business. i'm glad it happened and it could have gone into next year. >> reporter: matty is content

form, it will be warmer and the humidity will be creeping back taking a look at the temperatures, plenty of sunshine and we had a tiny shower north east of salisbury and it's dissipate and we'll have rain into the next few i minutes -- minutes. 64 in oak -- dew point is way down. and it's down to 62. a few days ago, we were talking low 70s and that's when you feel the humidity. it feels like 92 degrees. and tomorrow, the highs may get up to 90 degrees. the dew point in the 60s. it will be sticky. 81 in annapolis and 80 in west minutesser -- westminster. >> winds light and in most places, we've had a west, northwest wind and they brought in dryer, more comfortable air and it put a cap on the clouds

and the only acception, we found a tiny shower around the area of salisbury. around the west of us, this is another front coming in from the northwest. they're unusual. this front, there's cooler and dryer air coming into the latter part of the week and wednesday, we'll deal with the front coming through the air y. it will bring us showers and thundershowers and if the timing's right, it will get warm enough and some could be strong and severe. right now, not a will the of energy with this. most of this is heading towards canada and down here towards indiana and ohio. it will be more juiced up tomorrow, we'll have to watch it as it forms. by wednesday afternoon and wednesday night, look for more activity and it will pass through the region wednesday and thursday and thursday, late in the day and friday, probably dryer air moving in. at least, there's hope for

chopping block. >> reporter: the police tried to keep the information quiet, but tonight, we've confirmed that the mounted patrol is in danger of shutting down in 12 weeks and possibly less. >> reporter: money to care for half a dozen horses in the mounted patrol unit eliminated and the budget cuts targeting the police unit. >> i would hate to see anything happen to the unit. >> reporter: this lieutenant wonders why they can't find the money somewhere else in the budget. >> when they go into a crowd, it doesn't matter, when they walk up, everyone disappears. one horse is worth 15 officers in a crowd control situation. i've seen them at work, they do great work. >> reporter: some of the officers are planning on taking the horses home and trying to find alternative horses for them in the country, they're hoping it doesn't come to this.

wjz.com. the u.s. postal service is considering closing a thousand branch offices nationwide in order to cut costs. they've been struggling in the decline in mail volume as people switch to e-mail. five branch offices in baltimore may close including the locations listed. also, the branch offices at mount washington station and the towson center. police are hunting for an armed robber who held up an employee at a mall last night. he held up a woman at gunpoint after she walked to her car. they'll release his name when he's -- he's in custody. turbulence on a flight was so bad, dozens were injured.

>> reporter: the injured passengers from continental flight 128 were treated on the tarmac at miami international airport. the crews used whatever vehicles they could find to treat the people from the plane to the ground. >> we used the elevators from the feeding trucks to bring the patients down. >> reporter: 20 were injured, four seriously. they hit turbulence and some were taken to the hospital. . >> all of a sudden,the plane takes a dip and rises up. people were screaming and little kids crying and people screaming, please, ow! help! >> reporter: 168 were on board this morning and the pilot had to land in miami. because of customs and regulations, the uninjured had to stay on the plane for three hours.

buried at arlington. and police are investigating a sky diving accident that killed a fort meade soldier. he was found near west point virginia. he went missing saturday night after jumping from a plane from a training mission. if the senate doesn't say yes by friday, the cash for clunkers program will be hitting the end of the road. the program encourages car owners to trade in gas guzzlers for fuel efficient cars. >> reporter: with time and money running out, they're refueling the cash for clunkers program before the lawmaker's summer break. >> we think that another $2 billion can take the program through september and then, it's a good fit. >> reporter: the white house and the auto dealers want the senate to extend the government's car buying program that already burned through most of the $1 billion. >> reporter: the republicans

argue that's more proof that it's badly managed and doesn't deserve an extension. >> we were told it would last several months and it ran out in a week. >> reporter: the overwhelming success for the cash for clunkers program meant a surge in car sales and ford boasting the first monthly sales in increase in two years. new buyers are eager to trade in their gas hogs for $4500 towards a fuel efficient car. >> a good month we'll do $250 or so. 39 cars in a week, looking at what it could be, that's 120 in a week extra. >> reporter: nearly 1/4 million new cars were sold in the first week and the white house says that fuel efficiency standards increased 60%. the numbers that they'll hope will keep the lawmakers keeping the cash for clunkers on the road.

temperatures are heading our way. that's right, it's coming our way tomorrow. when we started out the day, not bad. temperatures in the 60s and into the afternoon, the humidity will build and so actually temperatures. we could break 90 degrees tomorrow into the afternoon and evening hours. now, for the rest of the five day, here's bob. and we've had four days of 90 degrees all summer. maybe getting up to 92 and mostly sunny and more humid wednesday afternoon. look at for thunderstorms and a few could be strong to severe with winds and rains. 90 and 68. and a few showers thursday and it will dry out. down to 84 friday and 89 and back to start the weekend with that. well, a major crash west of phoenix leaves one dead. earlier this morning, a big rig collided with an suv. the highway was closed down for several hours while the police investigated the seen.

at one point, the traffic was backed up for three miles. the mother of the homeless man accused of carrying a fake bomb into the laguardia airport over the weekend says he has a psychiatric disorder. he allegedly brought a phony bomb into the airport. he suffered from a form of schizophrenia. untiles -- millions of children are at risk for developing bone problems. most aren't getting enough vitamin d. get out in the sun is the advice. >> reporter: cross country runner stephanie has three stress fractures and the doctor say she's not getting enough vitamin d.. >> some of the children may take longer to heal fractures or they may prefracture. >> reporter: she's one of millions of youngsters with the

problem. in fact, seven of ten american kids from toddlers and teens don't have enough vitamin d. weakened bones is one of the affects. two new studies show that they have an increased of cardiovascular disease and diabetes. >> reporter: children aren't getting out in the sun enough and not drinking enough milk. a child would need to drink a quart a day and other foods have vitamin d.. one of the doctor's admits, it's hard to eat the foods. >> things like fish have a will the of vitamin d and i don't know about other kids, but mine aren't a fan of fish. >> reporter: and lifestyles have to change. kids need to leave the it have and -- the tv and computer screens and get outside. >> 10 to 15 minutes a day for light skinned individuals. >> and for darker skinned
