this is video of a shooting that left a five-year-old fighting for her life. another shooting hit as woman inside their home. reaction to all the street violence. hello again. i'm don so the. that's what people are talking about today, this latest shooting that wound add leader in the cherry hill community. eyewitness news mike hellgren is live. >> reporter: good afternoon. the latest victim is shirley fouts. she's very active and has been for a long time in cherry hill. a 58-year-old woman who was simply watching tv inside her home on carver road last night was shot. her bullet hit her shoulder after going right through the window. the mayor is outraged. >> what's disturbing is the woman is very active, community person in that area. so thank god it wasn't worse and of course the police are

going to step up in that area. >> reporter: police have made no arrests. they spoke to wjz last night. >> she should be okay. at this point detectives don't have much to go on. what we do know is there was some type of discharge outside this woman. >> reporter: the shooting followed the release of video in another high profile case of random violence in baltimore. this was the scene last month on south polaski street when a stave bullet -- stray bullet hit a five-year-old girl in the head. she continues to fight for her life. you can see the suspect run firing indiscriminately into the street. authorities arrested 17-year- old lamont davis and charged him as an adult with attempted murder. his lawyer released this video yesterday saying his client who was wearing a gps ankle monitor at the time of the shooting is innocent. he says the monitor is not visible on the tape and he hopes the video will clear the teenager. davis pleaded not guilty in

court yesterday. the mayor and police commissioner of both said they have a focus on getting illegal guns off the streets. as for the injuries to miss fouts, authorities do not believe that she was targeted in that shooting in cherry hill, don. >> thank you very much. wjz is always on. go to wjz.com for updates on both of these investigations. all charges dropped this noon. a man is no longer facing multiple rape counts. he is cleared of raping a charles village woman. he was arrested last may after being identified in a photo lineup by a woman followed home by a masked attacker. there are also new developments in the case of several counselors charged in connection with the death of a teen at a school for troubled juveniles. we have the latest on this. >> reporter: good afternoon. maryland's second highest court has upheld the dismissal of

reckless endangerment charges against five counselors at bowling brook preparatory school. the court of special appeals has ruled that a carroll county circuit court judge did not ear when he dismissed the -- err indictments. they were accused of waiting 40 minutes to dial 911 after the student was restrained and became unresponsive. he later died. lawyers argue that the law doesn't allow for charges to be brought for not doing something. the attorney general's office will now decide whether to take the case before the court of appeals which is maryland's highest court. back to you. >> thank you very much. the national and very loud debate about health care reform continues today. tempers flared in pennsylvania yesterday where senator arlen specter was greeted by a taunted crowd. today hundreds packed into a penn state university ballroom as opponents occasionally drowned out the republican turned democrat. in less than an hour maryland senator ben cardin will host his second town hall meeting this week on the irk of health care reform -- issue of health

care reform. we sat down with him yesterday and asked him about why health care reform is necessary and about facing further crowds. >> there's been a lot of information that's been put out that's clearly false. >> reporter: senator ben cardin sits down with eyewitness news for a one on one interview following this. a rowdy town hall meeting at towson university monday. >> let me ask a question. >> reporter: packed with people who oppose current health care reform efforts. >> we have the best health care in the world. >> he says we have the best health care in the world. >> reporter: do we? >> we do. but we need to make it available to more people and make it more affordable. >> reporter: how you can say we have the best health care in the world, though, when our life expectancy is much lower than many industrialized nations. >> the medical center, n.i.h., they're the best facilities in the world. people come from all over the world to get health care needs met and train their doctors. what's broken in our system is

where people can't get access to that quality care. they have affordable care. they get prevented health care. they stay healthy and we can do better. >> he protests have been heated, at times issue. one sign depicted president obama as hitler. another called democrats including cardin a liar. does that get to you? >> didn't see that one. i'm glad i didn't. look, i don't think we should personalize this. we lose a lot. it's not about president obama. it's not about the democratic party or republican party. it's about solving the health care issues of this country. >> reporter: under the proposal can i choose my own doctor? >> absolutely you'll be able to go into a plan where you can  choose your own doctor. >> reporter: will my rates go up or down or stay the same. >> our objective is to reduce the growth rate of health care costs. that means your rates will be less than would otherwise have been if we did not -- [ indiscernible ] >> reporter: any concerns private employers will force people into government health care? >> i think that's less of a risk than the current system

where the costs are driving employers to drop their coverage. >> reporter: there are many supporters of the democratic plan, but polls show growing concern among many americans. are directs losing this fight right now -- democrats losing this fight right now? >> i think it's just engaged. >> reporter: senator cardin says he's open to discussing tort reform but as of right now it's not included in the proposal. adam may, wjz eyewitness news. >> senator cardin's town hall meeting will take place this afternoon in hagerstown. complete coverage later on eyewitness news. this noon the state fire marshal's office is trying to determine the cause of a house fire in queen anne county. people were inside the house when the fire started but everybody was able to escape without injury. damage is estimated at nearly $1 million. it has been another humid day here in maryland. let's take a live look outside

this noon. if you've been outside, you notice the humidity is sticking around. we've had lots of clouds, too. we're watching some showers move through on the radar earlier. eyewitness news is live now with complete first morning weather coverage. meteorologist tim williams is in the weather center with the radar. >> good afternoon, everyone. we've been dealing with this humid activity. a front moving through. because of the front, we're looking at little ripples that are causing some showers. take a look at doppler radar. we've been watching shower activity on the eastern shore primarily. the front is moving through the area and kind of stalling just down around the shore. so as it does, well, it's going to be presenting the potential for some problems a little bit later in the week but look -- you see salisbury, berlin moving over toward ocean city. pretty hefty showers moving through right now. they'll take another hour or so to move through. deer island, crisfield seeing shower activity and up toward elkton in northeast maryland. that's what we're dealing with as this humid air stays in place and the front continues

to try to work through it. it's not going to do it any time today so we'll keep you posted. as for keeping you posted on the tropics, we'll send it over to marty with more on some activities starting to heat up. >> thank you very much. we started discussing this with you yesterday. this is tropical depression number two. it will get the name ana. it's expected to strengthen as we move through the afternoon. it's still a good six to ten days away from the continental until. it's moving right along the inner tropical convergence zone. the fact of the matter is this. this needs to be watched very closely. it's starting to really organize itself a little bit. we're getting now updates every six hours as it gets closer to the united states. as it strengthens we'll get updates every three hours or so. it's beginning to track very near the vacation island. it was on august 16, a few years ago now, the storm named andrew pretty much kind of

followed the same track and became one of the deadliest and costliest hurricanes to hit not just south florida but the continental united states. so we're coming up on the anniversary of one ever the worst storms -- one of the worst storms. we're watching what may be the first real storm of the season. as far as our weather goes, well, those clouds are getting out of here. meteorologist tim williams with the details of the weekend coming up shortly. now back to you. >> thank you very much. more furloughs are reported on the way for state workers as maryland tries to deal with a multimillion dollar deficit. officials say they're planning to give out more furloughs to workers making more than $40,000 a year soon. the final plan is due out on august 26. the state is trying to close a $700 million budget shortfall. and still to come on wjz's eyewitness news today at noon, a small plane goes down in new jersey. several people on board. another michael jackson tribute. a date has been set but the location for this event may

two people are hospitalized after a plane crash up in new jersey. it happened shortly after 8:00 this morning in sussex county, new jersey. investigators say the small private aircraft went down after taking off from a nearby airport. all those -- everybody on board was conscious as they were being transported to hospitals. one may have sustained a broken leg. the cause of the crash still under investigation. general motors unveiled its new mostly electric vehicle and it's all the rage when it comes to gas mileage. the new chevy volt can get 230 miles a gallon in certain city driving. those triple-digit fuel economy numbers will come at a price, though. the car is priced at $40,000 and won't hit showrooms until sometime late next year. michael jackson tribute is expected to be held next month in austria. organizers say it will be a global tribute that will last three hours or more. the organizers also say it will feature about ten major entertainers who will perform 15 to 20 of jackson's hits on a crown shaped stage outside of

we're looking at just a few scattered showers around the region. the hot, humid air locked in place. a front moving through the region. it's stalling just to our east. as a result we're going to see just a little bit ever clutter, the radar is picking up. we've seen some scattered showers. ocean city will continue to see some of them through the afternoon. we'll see some clearing just a little bit. maybe some sun peeking through. we're not going to be rid of the clouds and a chance of showers. take a look at current conditions. 08 degrees at bwi marshal. the dew point moisture level is high. humidity 68%. winds were coming in from the northeast and have now calmed down. the barometer at 29.94. it is falling. across the state temperatures are ranging from just around 79 in cumberland, 69 on the low side. on the far end ever the mountains -- of the mountains, 87 in ocean city. around the immediate metro area we're all just around the 80- degree range. feels just a little bit warmer because ever the humidity factored in -- of the humidity

factored in. not talking a major heat index because the clouds are kind of locking us into a bit of a cooler zone blocking out some of the sun. a northeast wind when it's been blowing has been bringing in just a bit of a cool component. there's less humid air off to our northwest. that's trying to move on in here. as a result, the moisture of air is going to present the chance of thundershowers. it's really not going to be able to move on through here. the problem is high pressure well off the east coast. high pressure trying to build in. it's not allowing this front to move on by. the result is that this front will stall. it's going to stall just off to our east and it's going to be close enough that it will allow a few ripples to move up and create just a few chances of showers in the afternoon. the less humid air though eventually does move in here by the weekend. temperatures will drop. we stay very close to our average of about 86 degrees for this time of year. the front stays to our south. then we'll start to see maybe potentially some sun by the weekend but our chance for showers right around 30% for the next few days. our sunset today is at 8:05.

in today's eyewitness news health watch, new research about ways to avoid developing alzheimer's disease. we talk about this all the time. >> this time it has to do with what you put into your mouth. combining a mediterranean diet with some regular exercise may actually help you reduce your risk of developing alzheimer's. a new report found people who exercised and ate a diet rich in fruits, vegetables and healthy fat were 60% less
