beer around 7:30 in the evening. however, they did not smell any alcohol on him and they did not believe he was intoxicated. michael phelps was citing for driving without a license and failing to establish residency in maryland. he had a michigan driver's license. the other driver, amanda burkeis was also cited. they believe she was at fault in all of this. they believe she ran the red light up there. they cited her for that, which carries a $180 fine and 3 points on her driver's license. >> reporter: only wjz cameras captured michael phelps after a serious wreck in mount vernon around 9:00 last night. it happened here at calvert and biddle. you can see a smashed cadillac escalade. the air bags went off. police say the driver of this honda sped through a red light, causing the crash. >> reporter: she was taken to the hospital, suffering neck injuries. phelps was okay. people say the accident shows

what a dangerous intersection this is. >> yeah, i went a couple of blocks up. and i hear people revving their engines. getting ready to hit it on the straightaway. >> police say they were investigating whether alcohol was involved. they later said it was not. but admit they did not give phelps a breathalyzer test. >> it's standard. when you get into a car accident. just like if i get into an accident on my way home. want to make sure i'm not drinking. and obviously alcohol was not a significant factor. >> reporter: so was the accident handled differently because it's michael phelps? >> we knew it was michael phelps. and we knew there would be public scrutiny and national interest, so we had our best people on it. >> reporter: phelps certainly gets a lot of the attention after winning 14 gold medals. but he has also had his share of unwanted press. after a dui in 2004.

and this year, a photo of phelps smoking marijuana led to a suspension for three months. >> this is about a celebrity. it's not about treating everybody the same. >> reporter: the attention for a car crash was certainly not routine. not with michael phelps behind the wheel. >> reporter: you can see the skid marks there. once again, that police report reveals that michael phelps told police he had one beer around 7:30. they do not believe he was drunk. he was cited for fating to carry his driver's license. and to maintain a residence here in maryland. he had a michigan driver's license with him at the time. more details to come at 11:00. for now, we're live in mount vernon, mike hellgren, wjz eyewitness news. >> thank you very much. phelps had two friend negligence the vehicle with him. they -- friends in the vehicle with him. judgment day. a sentence is in for a young man who murdered a baltimore county man for being a witness in another case. weijia jiang has reaction from

both sides. >> reporter: this was an extremely emotional sentencing for both families as the judge called carl lackle a hero. and we did hear from the trigger man, the teenager who was just 15 when he killed carl lackle, the teen who will spend most of his life behind bars. >> reporter: carl lackle's mother, margaret shipley, speaks to wjz just moments after hearing the sentence for jonathan cornish, the teenager accused -- convicted of pulling the trigger. this is considered one of the most brash cases of witness intimidation ever seen. >> i hope in time i can forgive him. and i hope he does do good. and maybe makes something of himself and learns and even gets an education. >> reporter: a federal judge sentenced now 18-year-old cornish to prison in exchange for a plea agreement. in exchange, prosecutors will receive testimony for seven others in the case. all of whom have been

convicted. >> he will never get to walk around the corner. he'll never live a life. he'll just exist. and maybe that's what he deserves. but it's still tragic. >> the most notorious of the eight convicted, patrick byers, who is spending life in prison without parole. bee -- byers was convicted of orchestrating the murder from a jail cell. >> they do extraordinary measures that can be taken to ensure that perpetrators of these kind of witness intimidation crimes are completely cut off with contact with the outside world. >> reporter: even though cornish is closing the lackle murder case, families on both sides say finding closure is nearly impossible. >> he was bold. he was going to tray -- try to testify against someone when he knew he could be killed. i'm sorry that jonathan did this. i'm so sorry. >> that young man looked me straight in the face, looked at me and my picture of my son. and it made me feel better.

>> reporter: feel better but still carl lackle's mother says she cannot forgive cornish at this time. we also heard from michael's sister, who pled with cornish to get an education as he repents in jail. weijia jiang, wjz eyewitness news. >> weijia, thanks for that report. a very disturbing case of animal abuse in baltimore county to tell you about tonight. kai is in the newsroom with details. >> three men are in custody, charged with killing and torturing a cat. according to our media partner, the baltimore sun, the men put the cat into a microwave and freezer. even tied its tail on a ceiling fan and spun the animal around. finally, the cat was put into a bag of rocks and tossed into a river. the three men face a number of charges. >> a hearing for all three men is scheduled for october 29th. a howard county woman sentenced for her role of the deaths of dozens of cats inside her mother's home.

the homeowner, 81-year-old atin egor iin was sentenced to six months. her daughter was sentenced to 74 days in jail, one day for each cat that died. the judge gave her the sentence for knowing about the abuse and not doing anything about it. michael vick is back in the nfl, the former super star who spent nearly two years in prison for running a dog fighting ring has signed with the philadelphia eagles. >> reporter: michael vick is getting a second chance in the nfl. >> i made some mistakes. i have done some terrible things. made a horrible mistake. and now, i want to be part of the solution and not the problem. >> reporter: the 29-year-old 29- year-old former atlanta falcons quarterback is attempting a comeback with the eagles. he served a year and a half for running a dog fighting ring. vick is promising to turn his life around and help animals. >> hopefully i can continue

with my diligent efforts and in bringing awareness to animal cruelty and dog fighting. >> reporter: the eagles say vick deserves to be back on the field. >> as long as they've taken the right steps, they're given an opportunity. and that's what -- again, that's what makes this country such a great thing. >> reporter: don't expect to see vick on opening day. so far, the league has only cleared him in the final two preseason games. >> he did his time. we just have to move on. >> reporter: but some animal lovers aren't ready to forgive him. >> younger people look up to sports stars. and younger people are going to look up to michael vick and say, it's okay to you know, it's okay to fight dogs. >> reporter: people for the ethical treatment of animals says it is disappointed. but the aspca says that they hope he will make good on his promise to fight animal cruelty. and this sunday on 60

minutes, a one-on one interview with michael vick. we have breaking news to tell you about. a serious accident on reisterstown rd. sky eye chopper 13 is over the scene. captain mike perry with more. mike? >> reporter: hello, vick. it is a fairly serious accident. between rice terstown road and carroll county line. baltimore police have the road completely closed. an earlier accident, where a van struck a utility pole, nearly head on, driving the utility pole out into the roadway. and spilling the oil from the transformer. you're looking at bge workers which were working on the transformers. the tow truck has arrived to take the car away. state police do have route 140 closed on the carroll county side of the bridge. baltimore county police, just south of this accident scene had 140 closed in a northbound direction. you're going to have to use libts road. that's the only -- liberty road. that's the only way around this.

>> it's only the preseason. but tonight, baltimore ranks fans -- ravens fans are basking in the glory. eyewitness news is live at camden yards where the orioles are playing tonight. sports director mark viviano has a look back at yesterday's highlights from the ravens victory. just 24 hours ago, we were getting ready for football at the parking lot at ravens stadium there. and there certainly was an energy, an excitement. people getting pumped up for the start of a new football season. and the ravens delivered with an easy win over the redskins. >> reporter: joe flacco stepped into the second season as a raven and orchestrated an offense that took positive steps on the field. a short pass to ray rice, turns into the longest game of the drive. 34 yards in washington territory that led to the first of two field goals. and a lead the ravens never relink wished. -- relinquished.

powered a deputy and escaped. suzanne collins explains how the 20-year-old explained his break from freedom. the sheriff's deputy choked from the point of unconsciousness. and police say the inmate also tried to grab his gun but was unsuccess. bloodhounds are out searching for the escaped inmate's scefnlt dozens of police officers search neighborhoods, one with a sniper rifle, looks under passing freight trains. police say 20-year-old devin champagne escaped around midnight, and attempted to kill the deputy sheriff, who was transporting him to the court from the jail in jessop. we believe the suspect returned. got the handcuffs. pulled him out from under his legs. placed them under the deputy's neck. and pulled back. and the deputy tried to fight him. >> reporter: after assaulting the deputy, police believe sham -- champagne got out of the front seat, broke the window and escaped. still shackled and handcuffed.

>> reporter: 11:00 p.m. thursday, the deputy transporting him back to the detention center got close to the gate. the inmate attacked. the manhunt lasted for hours. >> if he hasn't been picked up, we believe he is still in the area. >> reporter: champagne's family lives a mile from the detention center in jessop. they called police this morning to say the wanted man dropped in at their house and then left again. neighbors there were concerned by the police presence and that no alarm was sounded, which is normal when there is an escape. >> now, i would much rather have heard the sirens and known definitely that something was going on. rather than guessing. >> i have got some hammers and some screw drivers. and anything that comes through the door that is not authorized. you know, well, he's got to self consecrate. >> the 53-year-old went to

johns hopkins with lacerations to his neck. his boss believes the deputy followed all of the protocols. >> reporter: the sheriff's office plans to review its policy, like the one that allows inmates to be transported locally with just one officer. tonight, president obama is out west, trying to ease concerns about his $1 trillion plan to overhaul the healthcare system. manuel gallegus reports. he is holding another town hall meeting and facing some opposition. >> reporter: the salesman in chief is out west, stepping up his pitch for healthcare reform. >> health insurance reform will mean a set of common sense consumer protections for folks with health insurance. >> reporter: president obama is using his own town hall meetings to beat back the fiery opposition, boiling over in other town halls across the country. >> fight against the fear. this is not about politics. this is about helping the american people. >> reporter: while montana voted for president obama rival in the last election, and

usually casts a wary eye toward washington, we were hard- pressed to find any ticket holders who didn't support a healthcare overhaul. >> i trust the government far more than i trust private insurance companies. >> tickets for this town hall were distributed on a first come, first served basis. most of the shouting was relegated far away from this hangar outside of the airport. >> what do we want? >> healthcare. >> when do we want it? >> now. >> they staked out ground nearby. >> no one knows what is on the bill, actually. but they're already opposed. >> reporter: many hope the president can better explain what it is in the legislation and redirect the debate. >> this whole conferring has devolved into a bitter argument. and i think we need to step back and say, we're very sure about what we disagree on. what do we agree on? >> reporter: president obama will face a new town hall crowd in colorado tomorrow.

and fly. sky eye chopper 13. they're probably going to have a little gas right now. >> pretty darned nice weekend to be on the water. looks like a nice, summery weekend. a lot of sun. going to be warm. a little warmer than average. but awfully nice. take a look at temps around the region. 80 in oakland. 82 in ocean city. they finally cool down. because the winds are now off of the easterly direction. off the ocean. and there's two things. number 1. it keeps their temperatures down a bit. instead of the west wind, which really rises in temperatures. and also brings in warmer water from the gulf stream. so when you have a west wind, the temperatures in the water start to drop into the 60s. when winds out of the east go back up to 70. they go to 75, 76 degrees. that's really nice. dew point down to 66. a little more comfortable.

a nice summer day. east winds around the region. east winds, ocean city. at 8, d.c. winds southwest over the weekend. and that's going to allow some of this fair but warmer conditions to move in. down to the south, along the gulf. the gulf coast there in florida, and along the atlantic coast. perhaps this thing by the bahamas may join up. could be quite a bit of rain. extreme southern wind. could develop into some kind of tropical system. we'll keep watching it. but from our region, looks like high pressure building in. and it will eventually get warmer. temperatures getting close to 90. normal high after the weekend is 85. anything over that would be considered above normal. east winds on the bay. 5 knots.

about tonight. off the job. two air traffic controllers are suspended. as drew levinson reports, the faa says one was making a personal phone call. and the other was absent when the crash happened. as investigators examined the wreckage from the deadly collision of the hudson river, two air traffic controllers are suspended. one for being on the phone. the other, the supervisor, for being out of the building. the faa says the controller at teterboro airport, who cleared for takeoff, warned another pilot in the area. and then made a personal phone call. soon after, he told the contact the north tower. radar showed several aircraft in the area. the faa says the controller who was still on the phone, did not advise the pilot of that. but the newark tower controller saw the hazards and asked teterboro to instruct the

pilots to turn in another direction. when teterboro responded, there was no response. >> it had just takenuf off from a heliport, here along the hudson river in manhattan. all nine people were killed. >> in a statement, the national air traffic controllers said. we support that any such allegation is fully investigated before there is a rush to judgment about the behavior of any controller. the controllers will be paid as the faa investigates. in new york, drew levinson, wjz eyewitness news. >> now, air traffic controllers are expected to be alert at all times while on duty. and typically are given about a 15-minute break roughly every two hours for that reason. a member of charles manson's cult-like group is out of prison tonight. lynette "squeaky" from was resleased today. -- released today. from who was one of charles

using a cell phone on the job. this picture is what sparked the controversy. it shows the driver using a cell phone behind the wheel. however, the union says the driver was caught in the control center. because the work-issued radio wasn't working. people who used reme tro reacted -- who used metro reacted to these developments. >> give the person a chance if he was calling the metro. if he would have just said that. i was calling my boss. but to hear about it three weeks later, kind of makes me feel like the whole situation is skeptical. >> everyone is jumping over everything now. >> metro continues to investigate. as summer winds down. misery ramps up for thousands of marylanders. and it's not the return to school we're talking about. alex demetrick reports, it's the return of ragweed. >> reporter: st. joseph's allergy expert, dr. john bacon, doesn't need to look at a calendar to know that fall is coming. not yet.
