carter. >> and i'm dennis -- >> wjz is live tonight where the incident happened. kelly-- >> reporter: it's still being determined if this murder is a case of self-defense. when a college student went to check out some strange noises in the garage and took with him a samurai sword. is killing an intruding justified. what about with a samurai sword. >> i'm glad the guy had a machete. >> to cut off his hand and into his hard, it's a little extreme. >> reporter: john pantolino nearly severed the hand of a would be robber using a samurai sword, the suspect died. the student came here and got to the garage, that's when he told police he saw donald rice

and rice lunged at him. >> police were called to the scene a little earlier for a call of a suspicious male. >> reporter: a few blocks away -- >> i was afraid it would happen. >> i'm he had to go through a situation where he felt his life threatened. you know he probably did what he had to do to survive, at least i hope that's what his mind set was. >> reporter: people at rice's address did not answer the door. police say he's been arrested 29 times for burglary. he had been released from baltimore county jail three days before his death. >> it took me a while to get over it. and you know, whether he needs to talk to some people that he trusts about it -- >> reporter: the state's

living room of this house. a head on collision shuts down a major road during rush hour tonight. the man and woman were taken by helicopter to a near by hospital. we do not have a word on their conditions tonight. inside flu watch, a major dropment in the race to stop the h1n1 virus. the vaccine tested right here in maryland has been approved by the food and drug administration. this means it should be available by mid-october. despite the positive news, doctors still are scrambling to solve a problem. there's not enough vaccines. referee: is time of the essence right now with this test? >> time is very important because we want to make this information available. >> reporter: research doctors at the university of maryland school of medicine are leading

the national fight against h1n1. a deadly strain of the flu already claiming hundreds of american lives. following a massive study, the food and drug administration just approved a vaccine finding minimal side effects. >> when did you get the vaccine. >> august 7th. i didn't have any reaction, i didn't have any pain, i didn't have any headache. >> reporter: federal health officials predict up to 50% of americans could get h1n1 killing between 30 and 90,000 people. and while makers of the vaccine have ramped up production, only 45 million dozes may be available by next month. not merely enough for everyone. >> is it happening fast enough? >> it's happening as fast as it can be done in -- you know, quality with which we usually do these type of studies. >> reporter: maryland doctors are key in determining that a single smaller doze of the

vaccine works. now they're hoping to further increase availability by testing an ajavent, which is essentially watering it done. >> an ajavent is not approved. >> reporter: test subjects say they are willing to risk it. >> we don't know how serious it's going to become. >> reporter: why did you decide to test it? >> to help others and myself too. >> if the safety issues are far outweighed by the potential benefits we have by vaccinating more of the population, i think that might be a victory for public health. >> reporter: possibly stretching the vaccine

protecting millions more. and until more dozes are available, children, young adults and pregnant women will get the priority. plans of how the vaccine will be distributed here in maryland are pending. the u.s. house passed a resolution of disapproval for representative joe wilson. you may remember the south carolina lawmaker yelled you lie during president obama's prime time address. congressman wilson reacted shortly after the vote. >> i truly feel like political games were played today. this really violates what the president asked. he said there should be no more political games, there were political games. but i'm looking forward now to working with the president, working with the democrats. >> historians say this is the first time in the house's 220

year history that such a resolution has ever passed. the resolution is basically a slap on the wrist, not a punishmentment congressman wilson phoned the president last week to apologize. the rescission is most likely over. that's the word from reserve chairman ben bernanke. but bernanke did warn that unemployment will remain high at least until next year. a video shot in baltimore is causing more problems tonight for the well known activist group named a.c.o.r. n. kay jackson has reaction tonight from acorn. >> reporter: this comes at a time when few groups that rely on public funds can afford to lose that money. acorn, the association for

it is 71 degrees and partly cloudy in maryland right now. the complete forecast is coming up. but first breaking news. police in connecticut have a person in interest in the connection with the murder of a yale student. university employee raymond clark is now being questioned by police in the death of annie lay. clark has not been charged and will be released if he cooperates with police. accused kidnapping phillip and nancy garrido are now being investigated in two different cases. dozens of investigators are combing the garrido's property. garrido's are accused of kidnapping jaycee dugard and held her captive for 18 years.

showers just south of st. michaels. basically this has moved through the region, moving south. eventually getting down to southern virginia. temperatures 60s to low 70s. as you can see the wind direction for most places is out of the east northeast now. and that means bringing in moisture off the atlantic ocean. much cooler temps. probably tomorrow and again on thursday. so plan on much cooler temps. good news is, looks like by friday it's out of here and we'll get sunshine and dry conditions with nice temps in the 70s for saturday and again on sunday. >> check in with don scott tomorrow morning on eyewitness news for the updated first
