"the early show." great to have you with us. >> we'll get right to our top story and it's one that a lot of people are talking about this morning. robert joe halderman, a producer for the cbs news program "48 hours mystery" is out on bail after his a rapement on one count of first degree grand larceny. >> the revelation of the alleged plot forcing the late night host to admit to having sex with woman staffer, kelly wallace is here with the latest. >> reporter: more and more bizarre. good morning. friends and colleagues of joe halderman are in absolute shock over the allegations. allegations the veteran news producer who covered crime for "48 hours" stands accused of a crime that could land him up to 15 years behind barses. joe halderman looked sober and serious on in court on friday.
8:02 am
his only comment was when he entered a not guilty plea. his attorney says the 51-year-old father will vigorously fight accusation againsts him. >> thisser to is far more complicated than what you heard this afternoon. >> reporter: according to prosecutors, at 6:00 a.m. on september 9th halderman waited outside letter mann's manhattan home and left a package on the back seat of his car. in an enclosed letter halderman said he needed to make a large chunk of money. he allegedly threatened to write a screen play saying letterman's world is with b. to collapse around him if information about his private life is good opposed. halderman had had a relationship with a woman who worked for the late show host and there are reports he had to pay $6800 a month in child and spousal support. >> our concern here is extortion and that's what we're focusing on. >> reporter: prosecutors conducted a sting operation in which letterman's attorney wore

a wire and met with halderman at new york's essex house hotel on september 23rd and again september 30th. that's when the attorney gave halderman a phone mifoe any check for $2 million. the next day he allegedlies forred it and was later arrested outside his office. >> and the creepy stuff was that i have had sex with women who work for me on this show. >> reporter: the late night funny man made a remarkable personal admission thursday and said he'd have no more to say on the subject. in a statement, worldwide pants, the company which owns and produces letterman's show says letterer mann is not in violation of the company harass want policy since no one has raised a complaint against him. >> so now we'll take a look at what's next in the case. joining us los angeles, lisa

bloom. a couple of interesting things that we have definitely been talking about. the fact that he met with the attorney and also went to deposit a $2 million check from someone who would investigate these kinds of crimes. it seems that this would be kind of out of character for someone who would look at those things in a story. >> exactly. it's almost halfable. those of us who cover crime stories for a living often joke that we know how to commit the perfect crime. well if these allegations are true this defendant was way off base. and especially by asking for a check with his name on it that he then went and deposited? certainly cash might have been a better idea. an investigation great difference journalist goes for meetings lawyers apdoesn't think about the possibility that he might get taped? it's really astounding if these allegations are true how weak this extortion attempt really was. >> his attorney we should points out came out yesterday and said look there is so much more to this story, so much that you
8:05 am
don't know, a lot more evidence going to come out here. as an attorney if you're looking at had case what else do we need to see in terms of evidence for his attorney to prove that in fact this is not what really happened? >> i have been thinking about that question ever since yesterday when his attorney said that. given that there's this $2 million check that was given to him by letterman, that he deposited in the bank, the defense will have on come up with some plausible legal explanation. perhaps it's in exchange for selling a screen play, exchange for settling a claim. i'm only speculating, but it's hard to see out defense will explain that. the other possibility is some kind of diminished or insanity defense. but given that this is an emmy award winning producer a highly intelligent person he seems to have calculated the whole thing, it doesn't seem like that would fly either about. >> what about david letterman as we move forward? as kelly mentioned, he's not technically an employee of cbs. he's an employee of his company,
8:06 am
worldwide bands, which has said that he hasn't violated any policies. cbs is doing its own investigation. from what we know thus far in this case, could david letterman face any he legal charges? >> well, his company is correct that there is no sexual harassment case unless shall be brings a claim. and if nobody's brought a claim, then they're in the cheer. the problem for worldwide pants and letterman is that the facts have changed significantly in the last few days. it's quite possible that there are employees who were not a water that david letterman oig was engaged in sexual behavior with not just one but multiple staff members and under sexual harassment law, there is a claim for sexual harassment somebody can come forward and say the boss was sleeping with other employees, they got favors and advantageses that i didn't get. they got to appear on the show perhaps, for example. got additional payments for that. so this is why every company in the united states has a policy that an employer should not be having sexual relations with a

and you don't make the goal it means that you are a loser. >> reporter: rio made its strongest argument pay, that it was time for the olympic games to come to south america. >> you can play a great game and still not win. >> reporter: it's now brazil's challenge to host those games. they come with a hefty price tag of about $15 billion. the brazilians say they are ready and willing to pay. >> sheila thank you so much. joining us now is veteran republican political strategy guest ed rollins. good to see you. thanks for joining us early this morning. was this trip a mistake for the president? >> at the end of the day, it's a question of his priorities and he's got a lot on the plate right now. to a certain extent to take a day, fly away and have no result, i think the more significant thing is the chicago guys can't count votes very well. >> but he wasn't on the ground for that long and he can deal with other issues while he's on the plane.
