hello everybody i'm denise koch. >> and i'm denise carter. a tragic accident in hartford county tonight, when a young boy died while playing with a friend. the 8-year-old was playing near a stream by his home when he fell into the water. his friend ran for help, but by the time officials found him it was too late. controversy over a law designed to protect your privacy. but is it really supposed to protect police? >> get off the motorcycle, get off the motorcycle state police. >> reporter: the man being arrested on this video faces federal charges for recording on his camera. >> we enforce the law and we don't make any apologizes to that. >> reporter: this video from

the preakness quickly made it online. despite police officers making a warning to the person issuing a warning. can police stop you from recording their actions. the aclu says, no way. >> for the government to be saying that it has the power to prevent the citizens from doing that is profoundly shocking, troubling and in the case of maryland simply flat out wrong. >> reporter: under maryland law, conversations in private cannot be recorded without the consent of both people involved. but are cases including this controversial one three years ago caught on tape where an officer arrested a teenager private? law professor lauren renkin. >> when you tell me to turn it off because it's against the law, you've proven to me that i'm not secretly taping you. you don't have to right to say, if you don't stop recording me, i'm going to arrest you.

>> reporter: the latest interpretation from the law came from the attorney general, to say that it was legal for officers to record video on their dash cam. >> if he finds that there are circumstances when it's illegal under existing law to tape public acts by the police or other public officials, then it's appropriate for me to introduce a bill to change that. >> reporter: we did ask the governor, he refused to comment at first. reporting for baltimore police headquarters, mike hellgren. so far the attorney general's office is declining comment. an suv crashed landing

partly on the roof of a house. investigators are trying to find out if a little boy was behind the wheel. >> reporter: alicia popolucos and her son are at the hospital recovering. but now officials are trying to investigate if the 10-year-old was behind the wheel. this is a new one for investigators. trying to determine how a woman and her son crashed their vehicle on top of a roof. you can see their driveway is very steep, right where it drops off is where the jeep went through tree, hit a stone wall and was launched into the air landing on the family's house. >> we sat up there and watched the helicopter come in and we

saw a grown up and a kid being taken away. a witness has told investigators that the boy was sitting on the mother's lap when the crash happened. >> we are looking into all aspects of where everybody was sitting on the vehicle. >> reporter: neighbors say all four kids from the family are well mannered. >> i think, i'm not willing to leap to any kind of conclusion about that. >> reporter: other family members were inside the house when this crash happened last night and they were not injured. investigators still need to do full interviews with the two victims. reporting live, kelly mcpherson, wjz eyewitness news. kelly, thank you. so far no charges have been filed in this case. a major baltimore artery is shut down as another water main

break plagues the city. cold spring lane near morgan state university was closed for several hours today as crews worked to if i cans the 12-inch break. the traffic problem was magnified because cold spring was being used as an alternate route. and bp says it will attempt to stop all of the oil from gushing into the coast. anger is growing along the coast and across the country. >> reporter: the oil is gushing nonstop. 5,000feet under water. but this view from space gives a much bigger picture of the spread of the floor into the gulf of mexico. >> it was unbeliefable. you have oil everywhere. >> reporter: the dark gooey mess is gushing up in beaches. it's forced the beach in grand isle, louisiana to close. >> there's nothing much you can do but watch it come.

>> reporter: the oily mess is not just angering residents but really the entire country. lawmakers are starting to ask tough questions like why bp is still in charge of trying to solve the problem that seems to be so out of control. >> this is an all hands on deck crisis. we need to use every asset the united states has including the defense department and all of its most sophisticated technology. >> reporter: marquee and other members of congress are blaming the u.s. government for not putting enough measure on bp. >> they have the technology to plug the hole. >> reporter: bp is trying to ease is public concerns. >> has been working very cooperatively and openly from the start. >> reporter: crews will inject fluids and cement into the well hoping to clog it. bp says that could get under

way by tuesday. in venice, louisiana, joel brown eyewitness news. we're also learning that the white house plans to name former florida senator to cochair the commission to investigate the spill. he's served on panels to investigate the challenger disaster. one of the women at the center of the sex scandal surrounding tiger woods is in baltimore tonight. jocelyn james says she met woods in vegas. >> i changed everything about my life for him to make him happy. to make what we had going on work. granted it wasn't the most ideal of situations. but you know at the time it was good enough and we were happy. >> reporter: james did make an adult film based on her

removed from the cockpit after he sent an e-mail threatening to hurt himself. the jet blue pilot e-mailed an exgirlfriend saying he was going to hurt himself in spectacular fashion. jet blue said the flight was never in jeopardy and the pilot was removed for health reasons. an emotional call for justice at the sight of a recrept hit and run. friends and coworkers of julio gonzalez gathered at the intersection. today's rally was in effort to raise attention to the incident and in hope that someone will come forth with information. >> we just want him to come forward, because they're a coward. and my friend was murdered, i will never get him back and we

free. the first one we expected, because it was three days later we expected him to fail. the second one when he failed it, we were very shocked. >> reporter: howard county becomes the first state system to require mandatory concussion testing on every athlete in a contact sport. >> this program is designed to make sure all kids who do suffer concussions don't come back too early and run the risk of serious injury even death. >> reporter: starting this fall, the students will be given the concussion test even before they start playing so they can establish a baseline brain function. the students athletes will all take the computerized test. it measures concussion test and memory. >> there hasn't been any discussion on when the kids could come back. they've always shut out until they reached the baseline again. it's been a great process for us. >> reporter: students take the baseline test every two years. and coaches go through

mandatory training about concussions every year. >> students and parents are also educated about the signs of concussion. justin behever is a little out of it with the reinvolving door. >> my fore head hurts. i thought what happened, i pushed and i thought it opened, but obviously it didn't. and i walked right into if window. >> reporter: video of the incident started a blogging frenzy. the 16-year-old posted an update, that his head still

watching the last couple of days is beginning to split apart. as you probably noted earlier, lines of showers and thundershowers tonight from ohio down to kentucky. these are moving primarily to the northeast. so any of this activity that even survives is going to have a tough time getting into the mountains, we might see a scattered shower late in the afternoon tomorrow, a better chance on sunday as that front kind of hangs on a little bit. at least it'll start to dry out a little bit and gets warmer for early next week. south eastern five to 10 knots. the bay temp around 64. tonight, let's call it partly cloudy right now not too bad. 64 for a low. normal low of 53. tomorrow maybe a popped up shower, more likely in the evening. high of 74. the next five days, better chance on sunday. the áf still lots of clouds. sunshine returns.
