good evening everyone, i'm adam may. we begin with breaking news.

a school police officer has been involved in a shooting. derek valcourt explains that officer was trying to stop an armed robbery. >> reporter: that officer just happened to be at a restaurant when a citizen ran to him telling him of a robbery that happened across the street. he sprang into action, confronted the robbers and shot one of them. just about 8:30, three masked arm robbers entered the family dollar store. witnesses told police that one was armed with a gun, the other with a box cutter. that's when a woman who saw the robbery happened ran to a near by wendy's who alerted a school police officer who was in his official car at the time. >> the officer pulled a service weapon and fired multiple shots striking one of the suspects. two of them were able to get away on foot. >> reporter: no descriptions on

the suspects who got away, but the suspect who is shot is expected to survive their injuries. police say they did find a box cutter on him. police say they are still investigating whether the suspect actually fired any shots at the officer first, that officer on routine leave pending the outcome of the investigation. derek valcourt. >> more details to come, thank you. we'll bring you more information on this story when it becomes available. a local college is grieving the sudden death of a talented athlete who grew up in maryland. devonte bunley collapsed about 20 minutes into basketball practice. bunley went into cardiac arrest and later pronounced dead. this happened during a routine practice. >> students had all passed their physical examinations.

and including this student. and this was simply a routine drill, nothing extremely rigorous about it. first basketball practice of the season. >> reporter: bunley had just graduated from ha rford technical high school. just hours ago we learned that another teenager has been arrested. 18-year-old michael jones jr. is charged with firstdegree murder. jones shot and killed shacar wingate on saturday night. police found wingate's body in edgewood. american officials have released a warning for all american tourists. >> reporter: the u.s. state department issued an alert sunday urging americans to take caution when traveling in europe. the alert warns of a potential

terror plot that could target popular tourist destinations and mass transit hubs. >> make sure that you've registered with the american agency. if you avoid public demonstrations, avoid civil disturbances. >> reporter: the alert is one step below a formal travel warning. which would advise americans not to visit europe. it marks the first time in recent history the state department has issued an alert for an entire continent because of a security threat. over seas, the news put some american tourists on edge. >> coming to madrid has put me kind of an edge a little bit to be aware and kind of watch out for things. >> reporter: intelligence officials believe osama bin laden may be behind the plot to attack several cities in europe. if so it would be his larger roll in planning a terror attack since 9/11. eight germans and two british brothers are believed to be in

the middle of attacks. >> the united states intelligence agencies have picked up information, they picked up chatter. >> reporter: this week intelligence agencies will review two audio tapes recently released by osama bin laden to see if they contain coded messages to militants. in new york, katherine brown, wjz eyewitness news. >> that travel alert will stay in effect through the holidays until january 21st of 2011. according to the baltimore sun, holton is considering a plea deal. she is expected to stand trial on charges. three people are hurt

following a row home fire in east baltimore. city firefighters responded to the fire at 10:00 in the morning. almost everything was destroyed. the victims were treated at john hopkins with nonlife threatening in injuries. the fire is under investigation. earlier this year, 100 homes were in danger of falling down a cliff and all because of a dangerous beetle. tonight that threat was caught on tape. a scary landslide just 6 feet off the back of a home perched on a cliff. >> oh my god, people better not be there. >> i'm going to get that, i'm not comfortable. >> reporter: the homeowner took the video as investigating erosion. >> we both said, we don't think

we should be on this deck. >> we didn't know how much longer it was going to stay. >> reporter: 90 other homes are also in danger of collapse, but nothing is being done because of this. the rare puritan beetle, only 5,000 of the endangered species are left in the planet. >> how much is this worth compared to the eagle, compared to that bush. >> reporter: because of the way these beetles lay their eggs they need the fast eroding cliffs to reproduce or they could become extinct. >> if erosion doesn't occur, eventually vegetation establishes itself. it's detrimental to the beetle. >> these people's homes are in danger, and we need to wake up, the state government, the federal government and the local government. >> reporter: while waiting for

a big picture solution, county inspectors have determined the anchor family deck isn't safe. >> we might not wake up tomorrow, it's scary. >> reporter: waiting for the next landslide to take them or their family too. >> a meeting with the homeowners is scheduled for next month to try to come up with a solution. congressman comings is calling for a 60 day moratorium on foreclosures in the state of maryland. comings said he sent a letter to legislature. some pretty pretty air has moved into maryland tonight. we had round of rain moving into the state. we take a live look right now. how long is this going to last?

bernadette woods has a look at live forewarn weather. we're going to go to our map. here is a little disturbance across the state. not what we saw the other day. but you see a couple of these little yellow or darker green that's heavy rain going on. it's pretty much blanketed through the region. a little to the south that is breaking up. on the eastern shore these are just patchy areas at this point. out to the west we're seeing it spread in your direction. so the rain is coming in and along with it the winds and the chilly air. we are only in the 50s right now. we are not going up all that much tomorrow. we'll have that forecast coming up. a number of new laws went into effect october 1st affecting every driver in maryland. as jessica cartalia reports, new conditions make it safer

for those traveling on two wheels. >> reporter: an accident in august kills an owensville husband and father of two. a collision on bell air road sends another bicyclist to shock trauma. >> i bicycle to work because sometimes that's faster than driving. >> people leave all kinds of degree on the road, you really do feel like you take your life in your hands when yourriding around the city. >> reporter: now a new law aims to make getting around the city on a bicycle easier. under the new law drivers are expected to maintain a 3-foot distance from bikers on the right side of the road. >> that gives bicyclists just a little extra room to share the road safely. >> reporter: there are other provisions that also take effect, what gives bicyclists a

few options when they are traveling down the road. >> three foot laws is a fantastic thing for everybody i think. >> reporter: under the law, bicyclists no longer have to use shoulders on roads which are often in bad condition. >> there's potholes, there's sewer grades, there's glass and we have to be able to maneuver around that. motorists don't give us enough space, we're going to have problems. >> reporter: the new law brings safety to future bicyclists. still to come tonight on wjz's eyewitness news. a miracle recovery. a 5-year-old lost for nearly 24 hours, where he turned up safe and sound. dangerous cargo, what fell out of an airport and landed

and my mom's a teacher. my dad's an auto technician. my mom's a receptionist. i'm not sure i would have been able to afford college without the tuition freeze. while tuition in other states is rising out of reach... governor o'malley made the tough choice to freeze tuition. he made my dream of going to college into a reality. i'm the first in my family to go to college. my brother and i never would have been able to afford college. even though times were tough... governor o'malley kept his promise. there's never a doubt... there's never a doubt whose side he's on.

a missing 5-year-old boy is back home safe tonight. 21 hours later, searchers found the 5-year-old alive, he was huddled in a bean field. the boy was just fine, he was just a little bit cold from being outside all night long and a little scared. a renewed effort to try to find hormon the 8-year-old oregon boy host been missing since june. 160 volunteers combed the woods and waters. tips led them to search the area. despite exhaustive efforts today there are still no named suspects or solids leads in the boy's disappearance. kiran's mother is also pleading for donations so they can increase the reward fund. residents in california are

left shocked after a large object fell from an airport and landed on a house. officials say it damaged several roof tiles on a home and spilled jet fuel. fire and hazmat teams arrived at the scene. officials are still trying to fig figure out how a hose got lose. ultra violent nail dryers carry the same dangerous light that is in tanning beds. people who use them on a daily basis could have a higher risk for skin cancer. a study first raised the issue when two women got cancer in the back of their hands. both of them regularly hat manicures done. tim williams has more on what you need to know to be

prepared for flu season. >> reporter: it's a question health care workers -- hope to ask frequently this year. with the onset of the 2010 flu season supplies are in and health care workers hope people soon follow. >> today being october 3rd is the day that the state of maryland officially starts it's flu season monitoring. we have individuals already coming in with some high fevers, flu like symptoms, when they do come in with that we do test for for influenza then treat them. >> reporter: last year it was h1n1. in maryland there were 45 h1n1 related deaths. meanwhile the heavily stocked seasonal vaccine was all but

this point. the point is, even though it's picking up on intensity it's not like the rain we had last week. the city has picked up moderate rain. south of that is broken up some what but there is more where that came from. so it'll continue to come in in waves. that trend will continue. earlier today we had sunshine out there. then the clouds started to thicken up as the clouds came up. then the rain overswept the state. that's the process we are seeing for tonight. with this going on. the winds have also started to pick up. they are going to continue to increase overnight. that gusty northeasterly wind is tapping into cool air. so tomorrow, it brings all of this cool air, with the rain and winds around that's going to knock down temperatures even

more. when we drop tonight, we're not going up very much for tomorrow. at the same time you see that low just offshore, it is going to sit for a couple of days. so, here's that storm coming up in the south. here's the other front that's out there. it's the one that was just off to our west all day long. now it's going to merge with that coastal system and that's why it's going to sort of cut off from the entire jet stream and sit on top of us for a couple of days. because the jet stream tends to push the storms around, but when we've lost that connection, there's nothing to push us along so it's going to sit for a couple of days. we won't see as heavy rain as we're going to see with this initial round. the chance for showers and it is going to keep it cool around here. so this is what we've got going on. those storms merging, we keep that northeasterly wind in. it's going to be a cold day tomorrow. then it remains cool tuesday and wednesday with our low around. then we start to warm it up.

gail warnings in effect, tomorrow we have advisories. the wind heavy at times, we drop down to about 50 degrees and tomorrow we only get up to 54 for our high. with gusty winds and rounds of heavier rain. then on tuesday and wednesday, the storm still over us. it'll be breezy and we have chances for showers. when we get out of here, 70 on thursdays, 72 on ,,,,,,
