well, first amendment fight, the controversy over protest that a marine's funeral in maryland goes to the superior court. >> is it free speech or harassment. >> he low, i'm don scott. >> and i'm jessica kartalija. this is the amendment that's befitting the fallen marine's father versus the church group's right to free speech. wjz is live outside of the courthouse in washington, d.c.. mary bubala has been following the case and sat in on oral arguments before the justices a short time ago. >> reporter: good afternoon, don and everyone at home. it was a huge cloud outside the u.s. supreme court today. we had protestors from the

church where the signs are . we had protestors outside of the supreme court who were on the side of snider and his family, he's the father of the maryland marine who's funeral was protested. i sat inside the courtroom and listened to the justice's side. they had specific questions about the first amendment rights and by public speech and whether or not a private individual has protection from hateful speech. >> this morning, the first amendment rights go before the superior court. it's a case that started with the marine from westminster killed in iraq. ♪ god hates america ♪ >> it's hard enough to bury a child, but to have this go on -- it's like someone kicking you in the face. >> reporter: in the hauls of the u.s. superior court, the

justices are asked to decide whether the protests are freedom of speech or harassment. they argue this it's an invasion of privacy in a time of suffering. >> in my opinion, the folks in the conduct was so extreme, it went beyond all bounds of basic human -- indesenseis. >> his son was not guy, but they believed that god was punishing america for tolerance of homosexuality. they told the justice's unpopular speech is still protected. >> there's no line drawn here without shutting down speech and you know, you don't want

attack is likely. well, hi, jessica, the warning came today from france's foreign minister. the terror threat level is high in the united kingdom. terrorists could plan on attacking with assault weapons. travelers are told to exercise extreme caution in busy tourist areas and the u.s. state department is advising all americans living and traveling in europe to take precautions for their personal security. and so far, there are no details on specific targets and the security's stepped up at the popular tourist areas. jury deliberations are on hold today for the men accused of killing ken harris. derek valcourt has more on the

delay. >> reporter: hi, don, they've had a lot of questions. yesterday, they asked if they could examine the bullet that killed councilman, ken harris and today, no questions and no verdict. the defendants face a long list of criminal charges in connections with the murder of ken harris. the police say that harris visited the haven lounge to use the bathroom. he walked in on a robbery trying to get away and was shot in the back. the prosecutors told the jurors that dna on gloves and a halloween mask links the three to the crime and they showed the video that they argued puts the defendant at a crime scene and the defense attorneys say that the evidence is circumstantial. >> reporter: the jurors have been deliberated for several

the sun's been moving in and out all morning long. it's pretty overcast now. look at the clouds above us. we're live with the coverage and marty bass is out back and it's meteorologist tim williams in the first warning weather center. good afternoon, don and everyone. we're looking at improvements and we're dealing with the cloudy skies and a slight chance, about a 30% chance of showers in the afternoon. you can look at the satellite radar and give you an idea of what's going on. we're sitting under a flow. that's the low off of the coast of new england and it's creating a rotation and we'll get a shower coming through and every time we get a bit of a break in the cloud cover, the sun comes out and warms up the ground and creates the clouds. it's really self-destructive, that's what we'll deal with when the low gets out of here. 41 in oakland and that's the

range across the state. and what's it going to be for the next few days? we have the improvement and marty's here with the good news. >> reporter: well, thank you, good afternoon, everyone. improvement is an understatement. first off, by tomorrow, the low retreats up the coast and it takes the cool, damp conditions with it and the nice air moves into the mid-atlantic as the high pressure builds in. then, by friday, by the end of the week, this is in full tilt boogy, it's running half of the united states and we'll see the beautiful, beautiful conditions. it's the high that will bring us the dictionary definition of indian summer. there are a few days that are that close to 80 degrees. and the first warning detail coming up shortly. and new data from the state department shows that more maryland teens are graduating high school.

it's the second year they have to pass the state exam to graduate. and overall, the graduation rate jumped 1% for the class of 2010. and the drop off road was lowier. and there are more details about the plans to raise your energy bills. the increase effects distribution rates and they make up 1/4 of the bills. and the move should make the $77 million a year something that's not sitting well with many customers. >> they need to manage their money better. i have to manage mine to make it end -- towards the end of the month and that's what they need to do. they need to learn to do with less. >> reporter: the public service commission has to improve the increase.
