from the city, to the counties, to your neighborhood. now, it's complete coverage. excitement builds underground. >> three trapped miners could be free in a matter of hours. >> hi, everybody. i'm mary bubala. >> and i'm kai jackson. here's what people are talking about. >> trapped. in just a few hours, one of the miners will be freed. right now, engineers are carefully reenforcing the escape shachtd as we -- shaft, as we can see. sandra hughes has more on the very dangerous rescue. >> reporter: above ground, it looks like business as usual at camp hope, where relatives of the 33 trapped miners are waiting. but tension is building, because the rescue is just

hours away. officials say the first miner could be pulled out by midnight in this newly-tested rescue cage. the shaft surrounding it held firm during the tests. though there are fears about the integrity of the mine's roof. the plan, one by one, the miners am make the trip 2,000 feet from underground, winched to safety and under the surface. it will take 25 minutes to get to the bottom. >> between 10 to 15 minutes from the bottom to the top. >> reporter: officials are dividing the men into two groups. the fittest will be pulled up first. the miners will be put on a diet diet. they will have to be careful since they have been in the dark for 60 days. >> they could have a lot of damage. using nice glasses. .

>> then they'll go directly to a hospital where fresh showers will be waiting. maria herrera said there were days she lost all hope waiting for her brother. but she says she doesn't want to take away from the joy she's feeling now. miners are asking for privacy when they come up to make up for lost times with loved ones. but celebrations are inevitable. in los angeles, sandra hughes, wjz eyewitness news. >> and here's another live look at the activity around the mine, where rescue operations are about to begin. the rescue capsule is being called the phoenix, named for the mythic bird that raised from the ashes, of course. a siren will sound each time a miner arrives on the surface. wjz will continue to bring you updates throughout this newscast. and camp hope right there. >> what an incredible story this is. is there a link between

childhood vaccines and autism. some believe there is. the fight has gone all the way to the united states supreme court. >> well, kai, it's an emotional issue. and it could be precedent- setting. hannah brucewitz is now 18 years old. her parents say she suffers seetzures -- seizures after her third vaccine of the diphtheria vaccine. there is a government vaccine program. vic, thank you. public health experts worry that they won't make the vaccines if they fear lawsuits. it was almost over before it began. the man in fort hood, texas appeared in court but just briefly. manuel gallegus reports for wjz. victims' families will have to wait to face him. >> reporter: the defense team

for alleged shooter major nidal hassan immediately asked for a delay for november, one year after the fort hood massacre. >> the investigating officer gave the defense until midnight tonight to file a brief in support of its motion for continuous. >> reporter: the investigating officer will hear arguments wednesday and make a decision. hassan said nothing during his appearance, dressed in army fatigues, pulled down over his ears. sketch artist pat was one of the few artists allowed in. >> he lost color. >> victims are bracing themselves for when the proceedings finally get under way. >> when we hear the witnesses speak about it and relive what my brother lived through, it's going to be very hard. >> reporter: hasan, an army psychiatrist is charged with 13 counts of premeditated murder and 33 attempted -- counts of attempted premed premeditated murder.

security is very tight. the media and base personnel were kept from getting a close look at hassan. >> he is still in a wheelchair, paralyzed from the chest down, after three fort hood police officers shot him. one of the victims was injured and is upon expected to-- is expected to testify. the equivalent of a grand jury will hear the arguments and will decide if there will be a trial. if that happens, he could get the death penalty. >> hassan studied and lived here in maryland for a time. knives come out. and police are trying to sort out the suspects. that started at the thirsty turtle bar. four men, ages 19 to 23 were cut and taken to the hospital. police say it's unclear who started the fight so far. no arrests have been made. without a trace, the baltimore county woman's disappearance four years ago, makes national headlines.

tracy at the time so's -- tetso's body was never found. but now her husband is charged with a crime. >> a police officer testified in court that dennis tetso told him that the couple was planning to get a divorce. he even provided contact information for another man his wife was seeing. >> reporter: dennis tetso is on trial for the murder of his wife tracy. the case is unusual because her body was never found. one of the few such cases in the state of maryland. >> our defense is that the state cannot prove beyond a reasonable doubt that there was even a murder committed, much less that my client was guilty of that murder. >> reporter: tracy disappeared more than five years ago. she was headed to a motley crue concert in washington, d.c. but never made it and never returned home. police found some surveillance video of her car 10 days later. beyond that, she was gone without a trace. her case was profiled

nationally. and in several wjz investigations. >> i was trying to find her. and praying the whole time, god, please don't let me the be the one who to do it. >> the murder trial is expected to last two weeks. >> the prosecution also played some of that surveillance video for jurors. tracy tetso's mom waited outside the courtroom for much of the day. >> the jury is made up of seven women and five men. is your teen ready to get behind the wheel? a new triple a study has candid results from parents that no 16- year-old wants to hear. one in three parents says their teen is not ready to drive unsupervised, even after completing driver's education classes. parents' biggest concerns, driving in the rain, rush hour traffic, and on the highway. the research is released in advance of national team driver safety week, which starts on

and three in the city, bel air at bidison. harford at grindon. and north patterson park at east fayette. one in gambrels. meantime, if you're traveling in the city, we have a water main break. we have a live picture, i'm told, of that water main break. and it is blocking argon drive, between alameda and loch raven drive. your best bet there is to take cold spring lane. looks like we have traffic getting by in both directions now. blocking the right lane. obviously it's going to be causing some distraction as well. looks like everything will be running smoothly. meanwhile, we have a look at speeds on the beltway. drive times and speeds. slowest spots now, 28 miles an hour. that's going to be on the top side inner loop or outer loop. with a 19-minute drive time. taking a live look outside at the west side at green spring avenue. heavy volume there, but everything is running at least a little bit there. there's a look at 895 at the tum. and look at the beltway at 83.

of gas is up for grabs in louisiana. people in baton rouge can get up to $200 in starts for turning in a gun. $40 is from funding from area businesses. >> for the first time ever in the u.s., a patient with a spinal cord injury has been injected with human embryonic stem cells. as dr. john lafuch reports, doctors hope that one day, this treatment may help people who are paralyzed, walk again. >> beautiful. >> reporter: the scientists who design the treatment has waited for the moment for years. >> this clinical trial is a very historic moment in that it reflects a change in spinal cord injury research. as we move from the bench to the bedside. >> reporter: the procedure took place here at the shepherd center. a spinal cord and brain injury hospital in atlanta. no details were released. but according to the study

guidelines, the therapy is only for recent injuries, given within seven to 14 days. and it's designed for patients paralyzed from the chest down. >> i think they're going to get better. and i'm just dying to see if i'm right. >> reporter: he explained how the treatment works. in spiej cord injury, the -- spinal cord injury, the insulation surrounding the cord is destroyed. electrical messages can't get through properly. and function is lost. they found a way to turn stem cells into this cell. >> this is the insulating cell. >> millions of cells were injected into the damaged area. the hope is that by restoring the insulation, the spinal cord will work again. >> any benefit to that patient population is really going to be a home run. >> reporter: the main goal of the study is to see if this treatment is safe. but doctors should know within one to two months if it works.

dr. jon lapook, cbs news, new york. >> the stem cells used in the procedure were taken from embryos left over from fertility treatment. looks like a decent day on wall street. major markets posted gains. let's go to new york, where alexis christoforous has tonight's cbs money watch update. president obama has lifted a ban on deep water drilling in the gulf of mexico. the moratorium was put in place after the bp oil spill. the administration had been under heavy pressure to lift the ban. it brought damage to the economy. set to break a record for the second year in a row. according to the wall street journal, about three dozen top firms, including banks, will pay out $144 billion in salaries and bonuses this year. that is up 4% from last. and it comes just two years

after taxpayers bailed out many of those firms. drug giant pfizer said it will have pain pharmaceuticals cash. some include the pain drug evinsa. and embedda. a pain treatment described to be resistant to drug abuse. consumers spoke out on facebook and twitter and said they didn't like the new design, which set the gap name against a black backdrop, with blue scare in the corner. gap says it will revert back to the emblem featured in its marketing for more than 20 years. new york, i'm alexis christoforous. still ahead at 4:00, you're looking live at a developing story from chile, where final preparations are under way to rescue 33 trapped miners. from paychecks to foodstamps. more people are needing help.

a storm now. get down and show you that overnight into the morning hours, that's what we saw going on out there. but all of that is part of the same front that is now leaving us behind it. the winds are turning to the north. and that is eventually going to bring in cooler air. but not today. it is 81 degrees right now in baltimore. 76 in hagerstown. but look, 82 also in d.c. the air is going to dry out and cool out tonight into tomorrow. but it's dry air at least for now that is coming in behind this front. coming from this direction here where you see the dryness. you also notice a storm out to the west. this is the next one that is going to move the storm our way. first of all, we have the dry air coming in. and eventually, we have that storm coming our way. and something else going on. down in the tropics, paula is a hurricane at this point. category 1 with winds at 75 miles per hour. this saturday path that it is forecast to take. initially, moving off to the

north/northwest. looks like it's going to take somewhat of a turn and move off to the east. thing is, there is nothing really driving this storm at this point. the front that we'll talk about will try to draw it up to the north. but it doesn't look like it will make that connection. it will hang around down to the south for a little bit. here are the forecast models. some sort of drifting around the yucatan. some take it off to the east. and this is what we'll be watching. and we'll keep you updated on it. as far as our weather tonight, patchy fog. that's about it. otherwise, we're looking at those winds picking up for tomorrow. we'll see that there is a small craft advisory in effect. the bay temp now, 67 degrees. forecast for tonight. we begin our cooldown. going down to 48 tonight. any showers out there will be coming to an end tomorrow. a lot of sunshine. but much cooler. 68 for our high. and believe it or not, that is actually our average for this time of year, 68. much more seasonal air coming in. and then the storm comes our way. and with it, not only -- we could see heavy rain out of

>> an amber alert with a missing north carolina girl with bone cancer is called off. mary is in the newsroom with the disturbing reason. >> police in north carolina indicated today that they believe someone killed the 10- year-old. right now, both her parents are being questioned by police. >> reporter: police and the fbi are still trying to peace -- peace together what happened to 10-year-old zara claire baker. around 2:00 p.m. saturday, her dad, adam baker, called police to report his daughter missing. he also said his wife last saw zara asleep in her bed 12 hours earlier. zara suffers from bone cancer, a disease that has left her with hearing aids in both ears and a prosthetic leg. both hearing aids were found in the home. neighbors say they hadn't seen the girl outside the home in weeks. a ransom note addressed to her father was found in the house. police now say the stepmother confessed she wrote it. we have your daughter and your son is next unless you do what

is asked. 1 million unmarked will be in touch soon. >> we are questioning the note. no further demands have been made from the note. >> reporter: on sunday night, a search warrant shows that police dogs found indications of human remains in two of the bakers' cars. >> i hope and i pray that we'll find her and that she'll be okay. because that youngun was the best youngun you could ever ask for. >> reporter: investigators have determined that no one outside the family has seen the girl for an entire month. vic, back to you. >> what a sad story, mary. thank you very much. the stepmother has asked for an attorney. a solemn anniversary for the united states military. it was 10 years ago today, the uss cole was attacked during a fuel stop in yemen. 17 were killed in the suicide bombing. past and present crewmembers for the cole attended a

ceremony at the naval station in norfog. -- norfaulk. officials hope to pull at least one miner to the surface before midnight. they say it will take more than 36 hours to pull all 33 miners to safety. each man faces a claustrophobic 20-minute ride alone in the rescue capsule crews have dubbed the phoenix. officials say the miners won't be going home right away. they'll be taken to the hospital first, for hot showers and fresh clothes which are waiting for them. >> thank you, kai. wjz, of course, will continue to update you on this developing story throughout the evening. an update now on the baltimore county trial. the man accused of killing his wife five years ago. tracy tetso went missing. her husband, dennis, is charged in the case, even though her body has never been found.

several have testified for the prosecution, including the police officer. mike hellgren will have more coming up at 5:00. danger in the skies. wjz has shown you several times just how widespread problems of pilots falling asleep in the cockpits cockpits have become. the faa is finally moving to change the rule. >> they push you to fly when you are tired. >> i would say that this is good. >> i was in la la land for sometime. >> they are voices of veteran pilots from all over the united states. all of them asking for anonymity for fear of losing their jobs. all of them calling for changes in faa rules which govern the amount of rest required between stints behind the stick in the cockpit. >> lives are quite literally at stake.

>> reporter: right now,faa allows companies to schedule pilots to 16 hours limited duty a day. as long as they are limited to eight hours of flying time or block time in the cockpit. more than 16 hours in a week. >> the 16-hour duty period nmy opinion, should be shortened. that definitely is an issue. >> reporter: finally, that is about to change. in washington, secretary of transportation, ray lahood, has suggest said new changes in the rules, which would require nine hours of rest in a day, an increase of an hour. it would also bar airlines from scheduling pilots longer than 13 hours in one 24-hour period, down from the 16-hour duty day. >> sometimes you don't realize how tired you are. >> reporter: dave swegert is the manager. >> it can be serious. it can be serious because it degrades the performance and alertness of a pilot. >> reporter: the issue of pilot fatigue is a critical one.

using data from three different agencies, the cbs 4 i-team pieced together a troubling history of pilots falling asleep or fatigue behind the stick. earlier news report showed more than 300 fatigue-related incidents or accidents nationwide. the i-team uncovered more than three times that number. and in more than 600 of those cases in the last five years alone, the pilots were so concerned they anonymously reported thmszs -- themselves to authorities. the faa rules are still months away from becoming official. the body of an american missing on the u.s.-mexico border may never be found. that's the word today where david hartley was reportedly shot on a border last month. hartley's wife says he was shot by pirates. police are now warning the family that they need to be prepared for the possibility that hartley's body will not be recovered.

six new jersey fishermen were found unharmed last night. the u.s. coast guard received a mayday call early monday morning. the helicopter spotted their 32- foot black fin boat shortly thereafter. it is still unclear how the boat became disabled. but the men should be clear in the next few hours. halloween is just a few weeks away. if you are planning to use decorative contact lenses, this story is for you. the american ophthalmology is issuing a warning tonight. decorative lenses can be dangerous. they are popular time of -- this time of year. but they can cause pain, inflammation, serious infection, and permanent vision loss. any type of contact lens is considered a medical device and requires a prescription and proper eye fitting by an eye professional. captain mike perry with more. mike, what's going on? >> hello. we are on the northbound fort mchenry tunnel. this saturday south side of the

fort mchenry side, where a bus apparently has caught fire inside the northbound number 3. now, all of the people you see standing outside were folks that were stuck behind the bus, inside of the tube when apparently this bus caught fire. as you can see, they have moved a lot of the vehicles aside initially to allow fire department access to the northbound harbor tunnel throughway. but since then, they have asked most of these folks that are stuck to get out of their vehicles and step outside into the fresh air. we have no reports of injuries. we can't see any smoke coming out of number 3. we know very little about the bus. but at this point, we'll continue it monitor the situation and keep you updated as we gather information. back to you. mike, one quick question. any idea how far inside the tube it is? >> no. we have no other information other than what we just told you. you can see, here comes some

firefighters or police personnel in vests, moving people out. apparently it must be a good distance inside. because we can see snow smoke whatsoever. back to you. the face of poverty is changing. and charities are seeing some of the greatest need in baltimore county. andrea fujii explains how a new program at local parishes is now helping to put the less fortunate back on their feet. >> as a single mother on disability, luz figueroa lives on $1140 a month. >> traveling is very difficult. >> reporter: behind on her mortgage and bills, the earned benefit outreach is helping her to find out which federal and state aid she's eligible for. >> i know i will be saving a lot of money. >> reporter: saving money through food stamps, low cost health insurance, energy bill assistance, legal help and more. >> if you put the resource that allows them to be paying their bills on time for months to come. >> reporter: the program is a partnership between catholic

charities and a private nonprofit. seedco. in the first three months, they've had helped 200 people. not including the hundreds of others who have utilized the food pantry at st. clements. and they say the number of poor is growing. >> people really struggling. a lot of people out of work. families struggling with the issues of hunger. >> one in seven families is now below the poverty line. >> reporter: program organizers say 90% of clients have never needed assistance before. >> it's very, very hard, asking for help. and looking for help. sometimes you ask for help. and the doors have closed. >> reporter: but after finding it, and now on the road to self- self-suficiousy. -- self sufficientiancy. >> there are some that have the earned outreach program. to learn more, go to wjz.com

mchenry tunnel. and it is blocking all lanes. the tunnel has been evacuated at this point. traffic backed up to key highway. but again, this is just happened that they closed the tunnel entirely. so that backup is only going to continue to grow. you'll want to take 895 as your alternate. although, the left tube, i should mention is opened. we have an accident on interstate 7. we also have another accident on mcdonogh. that one is going to be mcdonogh at crossroads, involving a bus. another at mcdonogh at winans. and three in the city. bel air at biddleton. harford at grindon. and north patterson park. annapolis road. and a water main break in the city. still blocking argon drive. take cold spring lane instead. there's a look at your drive times and speeds on the beltway. all in the 30s on the inner and outer loop there on the top and west side. there is a live look outside at greenspring avenue. there is a look at the traffic

we want to update that breaking news. a major fire is evacuating the fort mchenry tunnel. mike? >> reporter: this is pretty scary. what you're looking at is the heavy smoke coming out of the harbor tunnel. the fort mchenry tunnel. we know that fire officials were called here for a bus fire. we are south of fort mechanic henry.

everyone started coming out of evacuated their vehicles on the south side of the tunnel. we have heard fire apparently are trying to gain access. at this point, we note that there are two people that just passed firefighters that were inbound. reporting that possibly two people suffering from smoke inhalation, working their way towards the direction they're shooting from. fire personnel have still not reached the bus, as you can see, the heavy, thick, deps black smoke still continues to come out. fire officials are gaining access or trying to gain access to this bus from the side. they have not closed. and we still continue to gather information. but what we know, just to recap, that a bus, allegedly is
