themselves, apparently. we know transportation authority police were on the scene. but the smoke conditions, apparently inside of this board number 3 were rather heavy. and they decided to get them out. now, shortly thereafter, we began to see heavy, thick, dense, black smoke, coming out of the vents. the air vents, which are the underground vents vents that vent to the open air outside. we saw heavy, dense black smoke coming up outside. fire officials have reached the bus at this point. and knocked down most of the smoke and flames. just a short time ago, we were on the north side of the fort mchenry tunnel. and we saw what was described as the bus driver, walking out of border number 3, under his own power. and receiving assistance from firefighters nearby, apparently for what is believed to be minor smoke inhalation. what is going on right now is they have allowed some people to return inside of the fort mchenry tunnel to retrieve

their cars. and what you're looking at is an evacuation of motor vehicles. and that's what you see occurring here now. there are no reports of injury at this point. we know it is a bus. we don't know what type of bus. whether it's municipal bus or motor coach. caught fire inside of border number 3. heavy smoke conditions were there for sometime. we have at least one or two smoke inhalation patients. and at this point, the cause is not known. transportation authority police have completely closed the northbound fort mchenry tunnel. we'll stay here and keep you updated. >> thank you, captain mike perry, reporting live. let's continue this breaking news. sharon gibala is monitoring this situation from traffic control. i know things aren't perfect. but seems like things could be worse, trafficwise. >> well, they actually are doing a really good job in getting the cars out of there. they're getting the cars out of the tunnel as you can see. and looks like they're turning them around. in the meantime, as we mentioned, 95 northbound.

both the left and the right tubes are blocked. but the traffic backup isn't as bad as it could be. because at this point, they are detouring -- just beginning to detour traffic off at mccollma street. the backup runs to 395. best bets are to take the detour if you're stuck in the backup, that's pretty much your only choice. or take 895 northbound, harbor tunnel. keep in mind, that you'll be getting traffic backups there. >> right now, the fort mchenry harbor tunnel. maybe residual traffic. >> sharon gibala, thank you. wjz will continue to monitor the situation. excitement as families of the trapped chilean miners. the process will begin in just two hours. a live look now at where the 33

men are trapped. sandra hughes has the latest on the rescue. above ground, looks like relatives of 33 trapped miners are waiting. but tension is building because the rescue is just hours away. officials say the first miner could be pulled out by midnight in this newly tested rescue cage. the shafts are holding firm. though there are fears of the integrity of the mine's roof. the plan, one by one, the miners will make the trip, 2,000 feet from underground, winch to safety and the surface. it will take the capsule and the surface 25 minutes to get to the bottom. >> it will take 25 minutes from the bottom to the top. >> reporter: officials are dividing the men into two groups. the fittest will be pulled up first. the miners have been put on a diet to boost their strength and aspirin to avoid blood clotting.

they will have to take immediate action once they hit the surface, if it's light outside, since they have been in the dark for 68 days. >> they could have some damages, being exposed to this light. so we have a situation, using this protects their mission. >> then they'll go directly to a hospital, where showers and fresh clothes are waiting and they'll be examined. maria herrera says there were days when she lost all hope for her brother. but she says she doesn't want to take away from the joy she is feeling now. miners are asking for privacy when they come up. to make up for lost time with their loved ones. >> wjz eyewitness news. >> and another live look right now at the san jose mine. the rescue capsule being called the phoenix. it is named for the mythic bird that rose from the ashes. >> it's been more than five

years since the baltimore county woman disappeared. her body has never been found. but that hasn't stopped prosecutors from putting her husband on trial for murder. wjz is live at the circuit court in towson. mike hellgren is there and has details from inside the tracy tetso murder. >> from what we heard inside the court, it appears tracy tetso was involved in a love triangle at work. one of her coworkers was her husband. and the other was her lover. and it was policy to record all of her phone conversations. and many were played where she said he was jealous and controlling. >> reporter: this newly released surveillance video from a walgreens in rosedale show the last known images of tracy tetso alive. jurors learned about the turbulent relationship between tracy and her husband, dennis tetso. he confronted her after learning she was cheating with

a coworker. she told him she wanted to end their marriage. she was supposed to meet him while on the way to a motley crue concert. march 2005. these are the voice mails her lover left on her cell phone. >> i love you so much. so much. i'd do anything in the world for you. >> sunday, 6:37 p.m. >> you know, you've got me very worried about you. man, if you can, please, please call me and tell me you're okay. >> it's clear from the evidence that at some point, he became aware that his wife was having a relationship outside the marriage. >> tracy tets on -- tetso's boss said he played phone tag. he said he admitted dennis followed tracy and got a tap on the phone, each getting a police officer to give him the address of her lover. jurors also heard my interview

with dennis, just days after she disappeared. >> i woke up in the morning, she disappeared. i thought she stayed in a friendia house. -- friend's house. you don't want to think the worst. you just don't disappear. >> the defense can't prove beyond a reasonable doubt that he is guilty. >> this is one of only a handful of cases where a body was never found. >> mike, thank you. >> the jury is made up of 7 women and five men. dozens of homes impacted by a water main leak tonight. it's happening in the 9900 block of harford road. the same place where a break happened yesterday. right now, 50 to 100 homes are affected. it's unclear how long this latest repair will take. students were some of the victims of a stabbing in college park that happened about 1:30 this morning. that's when prince george's county police say four men, including three university of maryland students were stabbed during a fight outside the 50y

turtle bar. the victim's injuries are not believed to be life- threatening. no one has been arrested. a man plows a stolen suv into three cars, sparking a dangerous fire. tonight, we're learning more about the man police say is responsible for this crash. vic is in the newsroom with the latest for us. >> the suspect ran over mailboxes before hitting the parked cars and sparking the fire. sean williams is now in shl strl booking, charged with theft, unauthorized use and reckless endangerment. baltimore police say he was trying to avoid police when he was on north avenue. you can see there is a charge on the accident scene. and williams ran from the crash scene and was arrested while trying to get on a bus. the washington, d.c. resident was also issued 11 traffic citations. mary, back to you. >> all right, vic. thank you. the suv involved in the crash was stolen from washington, d.c., where williams is from. baltimore city teachers are just two days away from voting on their proposed teachers union contract. it's a deal some teachers are trying to stop.

wjz is live at city school headquarters. derek valcourt talked to both sides about the looming vote on thursday. hi, derek. >> union officials say most teachers love the contract once they come to understand it. but there are some teachers who say they think it is being pushed through way too fast. city teachers asked to approve a groundbreaking union contract. >> this is a lot of what teachers ask for. >> teachers union president marietta english says the new form eliminates step races. instead, rewarding teachers based on performance. and student achievement. and the contract includes raises. but not everyone is thrilled. so far, 135 teachers have signed an online petition to postpone the vote. >> i'm not asking to take it off the table. i'm asking for a delay. >> petition organizer robin

thinks this includes excellent provisions for teachers. but argues there are too many unknowns and feels the contract is being rushed through. >> there's really not enough time to decide whether something this radical is good for us, good for the students and good are are the for the -- good for the city of baltimore. >> reporter: union leaders believe most teachers support this. and that the teacher estlesz process -- evaluation prez process still hasn't been -- process hasn't been ironed out. >> we're going to help shape it so that it's fair for teachers. so it doesn't just have test scores as the only means in which a student is measured. >> i think this should give a community-wide direction whether baltimore wants to go in this direction or not. go and vote yes on thursday. >> teachers can vote early tomorrow at the union headquarters. but the official voting happens on thursday, from noon to 3:00

one up across northeast maryland now. gone. around galena. and one batch across extreme western maryland. nothing around the region. and cooler air is headed our way. bernadette woods has a look at first of all, a beautiful day tomorrow. but things could change radically here on thursday. just look at that. bernadette? >> that's right. the front that brought the showers overnight is getting out of here. it's bringing cooler air in for tomorrow. but still dryer air. however, that changes on thursday. the storm making its way up the coast is going to kick up the winds. bring in rounds of heavy rain. that's going to trap in the cool air already in place and tap into even colder air. so we are going to struggle to get to 60 degrees on thursday. by friday, probably just in the 50s. for our highs. now, the good news is, this is going to keep on moving for the weekend. and we'll have that forecast coming up. right now, back inside. >> all right, bernadette, thank you. cbs helps the university of maryland win big.

we continue to follow the breaking news out of southeast baltimore. chief kevin carte bright joins us -- cartwright joins us with an update on the situation. are you there? >> i am. >> you tell us what you know about this bus fire, how it happened. and we understand that captain mike perry that there are no injuries. but i know there is a safety issue with having people stand around the fort mchenry tunnel. >> that's absolutely right, kai. around 4:40, customers were dispatched to the tunnel for the report of a school bus fire. we're not sure if this was baltimore county city school bus. however, they arrived at that location and found the tunnel completely full of smoke.

with visibility less than zero, where they were met by two civilians met out of the tunnel. shortly thereafter, they were able to gain access to the front, get some water on it to completely extinguish the fire. again, as you indicated, there were no injuries. so they're working with the transportation authority to ventilate the tunnel of smoke. and you still may see remnants of that from your chopper. >> were there any students from that bus that you're aware of, kevin. >> at this point, there are no reports that our students are on that bus. but members are working now to continue wetting down any areas of the bus that might still be hot, as well as performing our secondary and tertiary of the bus. >> still need to ask first. what happens? how do you get the vehicle out of there? and then, what happens when you're standing there? they need to get become in their cars? but how are they going to get in the cars and get out of

there? will it be a turnaround issue? or are you going to have them drive in the tunnel? do you know? >> the actual traffic issue. the authority will have oversight of that. most importantly right now, we want to clear the tunnel of any smoke before allowing any citizens back to their vehicle. we want to make certain there are no safety issues of these people getting back to their cars and getting on the road. >> kevin, from the standpoint of fires, we know that the state is certainly prepared for that kind of issue. that's why the ventilation is in place. but from a safety standpoint, in terms of breathing that air, how much of a concern is that to you at the fire department over a period of one on or two hours. >> certainly anyone who is ambulate or exposed to the smoke for a while, we have to

be cautious of. we urge them not to stand around in that immediate area to become victims themselves. >> all right. kevin, thank you very much. we'll try to get an update with you a little later. we appreciate it. we know this is an ongoing situation at the fort mchenry tunnel. and captain mike perry remains over the scene of the fire right now. captain mike, give us an update from your vantage point. >> hello, mary. what you're seeing is just what kevin was reporting. there's about 50 or so people, standing outside of bore number 3. you can see about 4 or 5 transportation authority police officers, standing guard at the entrance to border 3. we know there are at least two pieces of fire apparatus that remain inside. i guess as well as all of the cars. apparently, the bus driver walked out of the north side of the fort mchenry tunnel. we saw him being attended to by firefighters. he appeared to be breathing normally on his own. the good news.

this, we haven't seen really anyone carted off in an ambulance, which is really good, considering the amount of heavy, dense, black smoke we have been seeing since. they have been venting the entire fort mchenry tublg. -- tunnel. they've turned everything on. so they're hoping to get the smoke condition cleared as quickly as possible and restore the northbound flow. both northbound lanes, both northbound fort mchenry tunnel bores are closed at this time. back to you. >> thank you, captain mike perry, reporting live. our complete coverage of this breaking story continues. let's go to sharon gibala, who is following the impact on the commute from wjz traffic control. how or where do things stand now, sharon? >> reporter: well, actually, the backup is not that bad. they are doing a good job of diffusing traffic. they got them turned around. and they're detouring 95 on colma street.

captain mike. >> hello, mary. we are, indeed. this is board number 3. we told you, since about 4:40 this afternoon, firefighters have arrived to fight a school bus fire inside. there are no reports of request injuries at this time. that's really good news. these cars are actually stuck inside the tube, behind the school bus that is on fire. that is why they are still here waiting. at this point, fire officials remain in bore number 3 and 4. they have both closed. the alternate would be the harbor tunnel through way. and that is where all traffic is being detoured to. will fire has been under control since about 5:10. it's coming up on half an hour

or so. >> continuing to monitor the situation. what can we offer our viewers for this moment. >> traffic unfortunately is trying to back up. we had a little more of a break than i thought we were going to get. because they detoured traffic. 95 northbound. if you are heading 95 northbound. basically, you are looking at a backup. that's going to go all the way to mccollma street. they are detouring at 95. remember, all lanes are blocked at the fort mchenry tunnel. neither tube is getting by. and in the southbound lanes, we're also getting a look at a tube closure as well. you're looking at a right two closures there. traffic is going to be backing up there as well. meantime, there is bailout traffic as you can imagine. that is all headed over to 895. 895 northbound starting to back up north as well.

very tough situation. gridlock situation. definitely an area to be avoided. and doesn't look like it's going anywhere any time soon. >> even when it opens back up, it's going to take a while for that amount of traffic to clear. sharon gibala, reporting live. and we are following other developing news tonight. freedom is at hand for the 33 trapped chilean miners. denise is in the newsroom with, as chile's president just announced rescue operations will begin in about 33 minutes. >> the escape shop and rescue caps all are ready. you're looking live at the surface as the first miner is expected to be lifted later tonight. the 2,000-foot trip will take 20 minutes. the first miners out will be the fittest ones because they are best suited to handle any problems that may arise. it is expected to take about 48 hours before all of the miners are freed. they have been trapped 2,000 feet underground since august

5th, mary? >> officials say the miners will be shielded from the media as they emerge. they will be reunited with their families after receiving a medical checkup. the search for a missing north carolina girl has turned into a homicide investigation. 10-year-old zara has bone cancer. and police say no one outside of her immediate family has seen her in a month. her parents reported her missing on saturday. now, her stepmother has confessed to writing that note. police are calling this a homicide case. >> the problem is, we at any time confirm with any confidence how long zara has been missing. >> i hope and i pray that we'll find her. and she'll be okay. because that youngun was the best youngun you could ever ask for. >> police are not saying why they are now labeling this a homicide investigation. the girl's stepmother has requested a lawyer. more lapstops spying on student. tonight, a settlement in the

lawsuit by two families whose children were photographed. the lower marion school district just outside of philadelphia will pay $610,000 to a current and a former student of the district. the students were photographed several times by web cams on apple mac book issued by the school district. the district never informed students nor their parents that computers could be remotely tracked and turned on and that technicians could switch on embedded web cams. investigators launched by the investigations -- investigations, rather, launched by the u.s. attorney's office, and the fbi cleared the district and itsch --ies -- and its employees of any wrong doing. two killed in a crash. the duck company is putting its boat back on the street. the tourists died july 7th, when a disabled vehicle stranded in the river was rammed in a barge. tonight, the duck boats are back on the streets in philadelphia for the first time in three months. right now, there are no

passengers on the boat that travel on land and water. the company says it was just testing routes. a snag in the trial of the man charged in last year's fort hood shooting rampage. now the victim's families will have to wait to face him. manuel gallegus reports on why there is a delay on the trial. >> the defense team for alleged shooter major nidal hasan allegedly asked to wait for the hearing for one year. >> gave until midnight tonight to file a brief in support of its motion for continuance. >> the investigating officer will hear arguments wednesday and make a decision. hassan said nothing during his appearance. dressed in army fatigues and a knit cap pulled down over his ears. sketch artist was one of the few people allowed in the proceedings. >> he is very, very pail. so pale that his 5:00 shadow

was a light, light blue. >> we had the witnesses speak about it and relive what my brother lived through. it's going to be really hard. >> hass san, an army psychiatrist is clarked with -- charged with 13 counts of premeditated murder. and 33 counts of attempted premeditated murder. the media and base personnel were kept from getting a good look at hassan. >> he is still in a wheelchair, paralyzed from the chest down. sergeant kimberly munly was injured and is expected to testify. the hearing, the equivlent of a civilian grand jury, is expected to last three weeks and will determine if hassan has a full trial. if that happens, he could face the death penalty. >> hassan once studied and lived in maryland. time now for a quick look at some of the stories you'll

a fire causes an evacuation at the fort mchenry tunnel. kelly mcpherson is there with an yawp date from the scene. two minutes ago, the northbound lanes reopened. you can see behind me, there are a couple of cars trickling through. these cars have been stuck for more than two hours since this fire broke out in the tunnel. we have some video from earlier, from sky eye chopper 13 to show you what happened here. a schoolbus caught on fire, inside the tunnel. and two people were on that bus, we're told by mta that those two people were able to escape. and they are possibly suffering from smoke inhalation and are being treated right now. they were actually able to walk out of the tunnel on their own. the whole tunnel to be evacuated. and if you come back live here to us, we'll show you traffic that is also happening here on the southbound side. it's improved slightly over the last few minutes. but you can see, it's a lot of

traffic here. that is because one of the bores on the southbound side had to be shut down to deal with this emergency. but once again, you can see that the northbound lanes have reopened here. after being closed for more than 2 hours because of this school bus fire that happened just around quarter to 5:00. reporting live in southeast baltimore, kelly mcferson, wjz eyewitness news. meteorologist bernadette woods, updating conditions for us. we'll start with bernadette. we'll start taking a look at what happens tomorrow for this extended forecast. and tomorrow, we start out the day, much cooler than it has been lately in the 40s. now, as we head through the afternoon, expect a lot of sunshine. we're not going to warm up to the same point as the last few days. more seasonal weather. high of about 86 degrees and we start to drop tomorrow evening. for the rest of the five-day, here's bob. beautiful, normal day tomorrow.
