in her crib. >> reporter: a father strangled the girl. he has been charged with first- degree-murder. we spoke with darius fields, his roommate and god father. >> i was there with him when she was born, before she was born. it's definitely. i was so close with them. he was a brother to me. to hear this, it definitely hurts my heart. >> reporter: late wednesday night someone noticed the baby wasn't breathing. >> we thought it was sids, that she fell asleep wrong in her bed. >> reporter: lewis brought the baby girl here to sinai. doctors notified police. lewis eventually confessed it wasn't sids. he had murdered his daughter. >> he ultimately confessed to murdering the baby after becoming frustrated with the child. >> reporter: the investigation continued.

>> the autopsy revealed the baby did have several old wounds, several broken ribs, but they also stated they had nothing to do with the baby's death. even so, that is one of the looseneds we have to tie up. >> reporter: lewis was processed this afternoon. he has been charged with first- degree-murder, first degree assault and child assault. >> as the investigation is ongoing, police said there could be other charges filed. a construction worker was killed when the roof of an anne arundel school collapsed. he was trapped underneath. he was rushed to the hospital. state regulators are looking into his death. a dispute outa washington, d.c. nightclub leave as maryland man dead and five people are facing charges.

vic has more. >> police say a washington, d.c. nightclub owner and four of the employees are start charged with -- are charged with murder. ali mohammed was denied entry into the club and returned with a brick rand threw it threw the window. he was then attacked by the other five. the man died in a hospital. the police chief in washington, d.c. said show's shutting down the nightclub today. maryland's highest court will consider emergency measures to combat fraud lent foreclosures. a judiciary committee gave judge the power to des miss it. the committee chair is cited hundreds of bogus affidavits. the court of appeals will consider the proposal tuesday.

a resounding no from baltimore teachers on a ground breaking contract that would change the way they receive pay raises. teachers are headed back to the negotiating table. gigi barnett has more. gigi? >> reporter: the contract would base pay raises on student achievement but it took them two days to reject the contract. >> i think they need to work out all of the problems that they have and to be able top answer our questions. >> reporter: other teachers wanted it to go way. >> the evaluation system is broken. right now this is the change we have. i say let's go for it. >> reporter: it would have done

away with the current way by seniority and masters degree and instead basedded on student achievement. the city school ceo said he thought teachers would back it. at a press conference this morning, he compared this woke's vote to a marriage proposal on hold. >> when i propose, i usually expect and hope for an immediate yes. sometimes it's okay for me to hear let me think about it a little bit more. >> reporter: he said new contract would have made the pay skell more competitive and have them more to say about how the schools are operated. >> we felt so strongly because our schools have such unique identities and challenges that we needed to make sure that it's a large number of teachers felt they needed to do things in a new way that they could,

we witnessed the scene of harmony but there are new reports from deep underground that there were uglier moments we did not see. according to journalistist jonathan franklin, the first 17 days before they were discovered were extremely intense. there was infighting among them that came to blows. even feels of despair. there was even a fear of cannibalism. the feelings are in the past for now. as the miners continue to celebrate their new found freedom. carlos mamani, the only bolivian, had worked in the mine five days before the collapse. he said i'm very thankful and long live chile. he was welcomed home still wearing sunglasses to protect his eyes, but already getting a glimpse of the spotlight. after worrying about their

rescue for up to 70 days, day 71 brought the chance for recovery. relatives of jimmy sanchez, the youngest trapped, videotaped their reunion for cbs news. the 19-year-old told the camera he's doing well but doctors worry he seemed withdrawn. sanchez' uncle had been dreaming of this day. >> doctors are thinking of the longer term psychological effect. do you worry about jimmy? >> of course, but with all of the support from his family, he will be fine. >> reporter: it's clear the lives of the 33 miners is starting to change. reporting from chile. >> they hired an accountant and agreed to divide all earnings.

homeland security secretary janet napolitano came to see how close the area is to a disaster plan. >> reporter: the idea arose in 2001. first a leaking chemical car caught fire in the howard street tunnel, then a terrorist attack on the twin towers killed so many first responder. now maryland has a highly trained team of first responder who can even survive without resources for a week. >> thinking ahead, thinking how you might need to be independent, self-sustained for a full week, working under very stressful conditions. that's really great. >> reporter: homeland security secretary janet napolitano comes to baltimore to check out maryland's task force and supplies. >> it's one of 64 urban areas

it's breezy. normal high is 66, 67. today it's only around 60. take a look at temps. it's 60. oakland at 41 degrees. as i mentioned earlier, up in snow shoe, west virginia, they had service for a hue hours this afternoon. 50 in cumberland. 62 in washington. 62 in ocean city. 56 in packs river. they picked up an inch and a half of rain. baltimore region a half. two points low at 38 degrees. the winds west, northwest. the wind gusts have been higher. 25 here. 22 at ocean city. so far this afternoon i did see a wind gust up to 30 at the airport. that's about the strongest i've seen.
