controversy. beloved father dies as flames engulf a road house. tonight why loved ones blame his death on the city budget cuts. good evening. i'm gigi barnett . today's deadly fire fueled a heated debate. firefighters union says it could not quickly respond to the fire because a nearby fire company was closed to save money. but the fire department said its response time was well within guidelines. wjz is live at the scene at the fire in southwest baltimore. mike has new information on the investigation tonight. hi, mike. >> reporter: hi, gigi. first the firefighters injuries were minor. just some burns to his ears. four people escaped this home. but james wise did not. wjz has learned tonight that the fire company close to him, number 47 was opened but the one that was second closest

number 23 was closed. that is generating outrage. family friends surround the shell of james wises home angry that the fire company a mile away was unstaffed as his house went up in flames. >> this is unacceptable. this is unacceptable when they are two minutes away. >> i don't think there should have been a time it should have been closed or not. we have lives they need to protect. >> reporter: department says firefighters responded in 3 minutes 54 seconds. within the national fire protection association eight-minute standard. engine 47, closest to the home a third of a mile was opened refuting union's claims. >> response was exceptional in this case. don't particularly relate that or contribute it to there gentlemen demise. >> reporter: rotating closures have been a source of tensions between unions and management as budgets have gotten tighter. >> it is sad city services are

being cut. >> reporter: mr. wise in his 50s was on the second floor. two teenagers rushed to get him out. >> we got him up on the steps. we heard him yelling get me out. once we got on the steps it was a big flame and smoke smacked the wall and started coming down fast. >> i regret running up there. but i tried. >> reporter: a makeshift memorial sits outside where they watched as flames engulfed this house. it is the 11th fire-related death this year. baltimore city councilman who represents this area issued an e-mail saying the mayor and current put a price on a citizen's life. he called for rotating closures to stop. reporting live in southwest baltimore wjz eyewitness ne . >> thank you. the fire department says the home did not have working smoke detectors. they'll go door-to-door to

provide them for neighbors. tonight ann arundel police are continue ducting an internal review and police officers mistakenly pronounced a woman dead when she was alive. she was found motionless inside her severna park home. officers told her family she was dead. the problem? they never checked her pulses. three hours later the woman took a deep breathe and moved her arm. a maryland man is beat into death inside a washington, d.c. night club. tonight the men accused of killing him are getting a break. police reduced charges against the night club owner and four employees from murder to aggravated assault. detectives say the man assaulted the man after he threw a brick through the window of the d.c. 9 nightclub on the east street corridor. charges could be raised again if his death is ruled a homicide. new concerns tonight at the university of maryland over a popular beverage that continues and the heavy dose of alcohol and caffeine. it is so powerful the energy

drink is now under investigation by dozens of attorney's general across the country. many students say they don't remember anything after drinking its. >> reporter: it is called loco it has 12% alcohol and a high dose of caffeine and sugar in a 24-ounce can. the folks who drink it say it is strong. >> it is like you are awake and drunk at the same time. >> reporter: last month in st. petersburg, florida this wreck killed a man and his three sons. dui drove told police he was drinking it that night. because of that several attorney's general nationwide want to pull it from shelves. the drink is popular among college students because it is cheap. about $2.50 a pop. university of maryland college park students are drinking it up without realizing what's inside. >> i only drink a little bit. >> i blacked out. i don't remember much of the

actress best known as june cleaver in the hit tv series leave it to beaver has died. she started as perfect 1950's stay-at-home mom on the show. she suffered from a rheumatoid disease. she was 94 years old. in arizona a paraglider crashes and a local man catches the fall on tape. he ran into the support ropes of the balloon. sending them both to the ground. they crash landed in a parking lot 100-miles north of phoenix. medics rushed the pilot and passengers to a nearby

hospital. police arrested a los angeles mayor after he snatches a woman's purse and tries to make a bizarre get away. he is facing several charges. he was allegedly arguing with the woman over money when he took her purse and hopped in his suv yesterday. it dangled out of the window for a quarter mile before police stopped the vehicle and charged him. 12 tons of trash is how much waste volunteers fished out of the back river today. the consequences of dumping track there goes far beyond baltimore county. >> reporter: it seemed like never ending battle. >> we are here to clean up. it keeps on coming. it is like people don't care. >> reporter: back river restoration committee has been cleaning four years. >> what you see are the bottles and tires. how about the antifreeze? >> reporter: 200 volunteers are

helping out including eastern technical high school football team. >> i'm surprised. >> this is eye-opening. there is footballs, basketballs and bottles and everything. >> reporter: much of the debris is trash. some is natural. a thursday of -- third of what they collect are trees and tree limbs. they collect the trash and keep it in one place. restoration is hoping for state for federal funding. they put in volunteer manpower that cleans the river which flows in the chesapeake bay. >> rock fish are here now. there are crabs in the river. >> reporter: they say the problem is an easy fix. stop polluting. >> why would you live in an dirty environment?

>> reporter: wjz eyewitness news. >> the river cleanups go all year round. learn how to help. log on to wjz.com. it was a very big day for one church in baltimore city. the new baptist church opened the doors of the new sanctuary today called holy city. it will seat up to 4,000 members members. >> it is unbelievable. we are opening up today. we have 4,000 feet,000 seats in the sanctuary. people come from all over the country to be a part of this. we are excited. >> it took more than five years to finish construction on the new church. it is located off of marion drive off of northern parkway in the business park. congratulations to them. five years, wow! >> that is a great congregation. we know the pastor.

bringing us streams of cooler air moving across the great lakes. it is the high pressure building in pressing against the low that's creating pressure and winds. that's going to be with us. high pressure is dominating our forecast. we have pleasant conditions in place. we have a weak cold front moving in the region on tuesday. cooler air behind it. we'll drop down in the 60s and upper 50s one day. that is on tuesday. tuesday into wednesday we'll see a chance of showers. chance of showers moves out of here. again we'll start to see clear conditions heading into next weekend. sunrise tomorrow 7:18. high tide 3:16. west wind on the bay 5 to 10 knots. 41 degrees tonight. 70 degrees tomorrow. ravens will be playing under breezy conditions. kickoff 11:00.
