this complaint filed in federal court by doug gansler alleging 100,000 calls violated the telephone protection act by failing to disclose the required information about who made these calls. >> >> this was with the intent to suppress voter turns out. we do not tolerate this type of behavior in maryland. >> asked for fines of $168 million against the company and a coworker who were paid political consultants. >> we have no reason to believe that bob you ehrlich had any

knowledge that these calls were being put out. >> simpson has denied the robe o cop was to suppress vote. >> sometimes they do. in retrospect we should have put a tag on that call. >> reporter: while this is a federal civil lawsuit, it is still possible that the maryland's state prosecutors office and prince george's county could all still decide to pursue criminal charges in connection with these calls. derrick value corps. now, wjz has not been able to reach julius. a car flips on to its side in the middle of a busy junction. this is 395 near 95 and it

caused a major back up. one person was rushed to the hospital but no other injuries. two armed robbers storm a video store and we get a look at the surveillance video. watch these suspects carefully as they threaten employees. they made off with about 100 copies of the new vox game. fire rages through a body shop and after the flames are out police find two people inside dead. outside the state medical examiner's office. >> reporter: the fire department has not released the identities of the two people found inside the be able but we spoke with two men that say they have no doubt that their loved ones died today. >> reporter: fire took over an industrial building wednesday

morning. 45 minutes later the roof caved in. >> it collapsed very quickly. >> reporter: the 60 firefighters didn't notice that two people were inside the building until the fire was extinguished. >> reporter: there was such a heavy volume of fire, no one was going inside is structure j the men who died have not been identified. they say it's their loved ones. >> they couldn't find them and they always stay there. they work a lot, like all night long. they are good guys, worked hard. >> last night when he left me, he said i'm going to go back to the shop and work. so when i hear it this morning at 10:00, i drove over here. >> reporter: friends of johnny and macho say the two would work here so often that they would sleep inside the garage. investigators told them the two men were found in sleeping

positions. >> [ indiscernible ] >> reporter: at least one sister gave a dna sample to help confirm the identity of her brother. the medical examiner will perform autopsyies on both men. kelly, thank you. the 45-year-old man is from puerto rico and the 17-year-old is from honduras. settles with the government for 22 million-dollar, but are criminal charges next. mike halgren has the latest on the investigation into unnecessary medical procedures. >> reporter: st. joseph medical center will pay 22 million to the feds because of kick backs in exchange for patient referrals but that settlement

is notable for what it does not include and that's a deal to stop any criminal prosecution. law professor. >> i'm going to make sure if i give you that amount of money i want you to guarantee me that you're not going to prosecute me criminally. no, we're not going to promise you that. >> reporter: this is what the u.s. attorney told wjz about the possibility of criminal charges. >> the only issue here is -- there's no promise behind that. >> reporter: the settlement also claims st. joseph billed the government or stents. >> reporter: dr. midday strongly denies any wrongdoing. he filed his own lawsuit against st. joseph. three physicians were whistle blowers. >> they are certainly ready to

develop rate with the government on whatever next steps the government wants to take but that's up to the government. >> reporter: no one has been charged as a result of this investigation. >> will this go on for a while? yes. should everybody play it safe and get lawyered up? yes. >> reporter: the hospital did not admit any liability and says it will cooperate fully with any investigation. today also faced more than a hundred lawsuits from stent patients. the settlement does not stop those suits from moving forward. a terrorist bomb intercepted last month likely would have exploded just over maryland. but its usual path takes it straight across the atlantic. the bombs originated in yemen.

cigarette boxes. >> we want to know every person that picks up a cigarette carton know what their risks are. >> reporter: the government says every day 4000 new children try their first cigarette. those we talked with were shocked by the proposed ad. >> that's scary. >> reporter: that's the kind of reaction the government is seeking. warning labels have been on cigarette boxes for years but there hasn't been anything like this. still there's no guarantee the target audience will listen. >> it will speak to children. i mean, this is real. >> reporter: some may see this as more government meddling. >> anyone has a right to buy what they want to buy but they also have to be able to tell you that these are the consequences of what you're buying. >> reporter: according to

maryland's health initiative, the smoking rate has dropped 32% since 2000. the fda is proposing 32 images for public comment. you can see them all at wjz.com. the police officer who got an autograph from ray rice about warning him about his window tints. rice and baltimore county police say rice offered the photograph after the officer issued him a warning. a new look and new eats are coming to camden -- aerial park. also hired a new company to take over concessions and is adding new viewing platforms to snack and watch the game. this will all be ready for the 2011 season.

it is 53 degrees and clear in central maryland right now. the forecast is coming up. goes off course in ohio. some smokestack came down in the wrong direction, landed on some power lines. the incident caused 4000 people to lose electricity for several hours. no one was injured and investigators are still trying to determine what went wrong. 50,000 students took to the street in london because of tuition right. they are behind the proposal to slash funding. the students occupied a building for a time.

they also smashed windows, 8 people were taken to the hospital with minor injuries. has been convicted in a sex assault case. the 42-year-old was sentenced for -- with a currently -- college student. his lawyers say they will appeal. now an incredible story of survival. a columbia woman spends years in shock trauma fighting a rare flesh eating bacteria. tonight she tells us about her life and death battle. >> reporter: just a few years ago sandy was literally being eaten alive. >> i was being torn apart from the inside out. >> reporter: flesh eating bacteria were attacking her body, ravaging her organs.

started in 2005 when they gave birth to her son by c-section. >> they were trying to give me hope but i could read it behind their eyes that they didn't think there was any hope. >> on a recent vision to shock trauma, no one could believe sandy was alive. sandy and her doctors can't pinpoint where she picked up the bacteria. but it lives all around us. you can pick it up from contaminated items. all it needs is an open wound to get into your body. >> it probably was 50. >> reporter: sand eye spent the first years of her baby's life in the hospital but doctors

upper 60s. that won't get that warm here but some of that warm air will be moving our direction. this is going to head way off to the northwest. it will keep the flow out of the west, southwest which means more mild air coming to our region. just a really nice weather picture, really no complaints. high pressure, that's going to rule the roost. eventually i think by saturday night or sunday, far west, maybe a brief sprinkle of exposure. we don't expect any rain here until maybe a shower on tuesday in the baltimore region. northeast winds 5 to 10 knots. generally clear. our normal low is 36. average high 48. next five days, a lot of sunshine to start the weekend.
