tonight, there is an investigation out. one of the most popular politicians in maryland, led out of his home in handcuffs. tonight, prince george's county executive and his wife facing charges. alexalex demetrick is in greenbelt with the latest. >> reporter: just a few minutes ago, the judge announced the charges against p.g. county executive jack johnson and his wife leslie. each face two counts of violating federal law. the first count is tampering with a witness. the second count is destruction or falsification of evidence in a federal investigation. if convicted, these charges carry maximum punishments of 20 years in prison, and a $250,000 fine. johnson and his wife were taken into custody earlier today. we are still await thing -- awaiting confirmation. but there are reports that johnson has been the target of an investigation for the last two years. the fbi has searched their homes and johnson's office. more details are still unfolding upstairs in federal court.

and we'll bring them as soon as woo can. again, two counts of violating federal law for jack johnson and his wife, leslie johnson. he is just finishing up eight years and his wife was just elected to county council. >> we will continue to follow the jack johnson investigation. stay with wjz for the latest information. maryland's attorney general is taking action after a wjz report on the dangers of four loko, an alcoholic energy drink. wjz is live. mikemike hellgren is live with more on why friends and family of a young maryland woman blame it for her death. >> reporter: mary, she had had several cans of that drink, four loko. it is already banned in several states that we know of. and tonight, maryland's attorney general wants it out of our state, too. >> reporter: four loko is a cheap and potent mix of alcohol and caffeine that has already been banned after sickening people in several states. now, the heartbroken friends and family of 21-year-old

courtney spury want it off the shelves in maryland. they believe the drink is behind the crash on tuesday saying she had two of them and was out of control before taking the keys to a truck and crashed into a utility pole. >> she changed that night. she was not the same person. she could not remember people's names. she blacked out within 30 minutes of having the alcoholic beverage. >> four loko has the equivalent of four to five cans of beer. alt just three bucks each. if maryland attorney general dug gansler has his way. >> if it's accessible to people, the problem is people are getting hit and killed. >> the caffeine that is consumed with the alcohol will mask the effect of the alcohol to some degree. >> maryland college students say it's popular and easy to buy. >> i'm only doing it a little bit. but i got pretty tipsy. even just a couple of sips of

it. >> i blacked out. i don't remember much of the night. >> reporter: one little place you see there is 12% alcohol in this can. >> reporter: the manufacturer said in a statement, it will cooperate fully in an investigation. we recognize and embrace our responsibility as an alcoholic beverage company, to do all of these things and more, to make sure our products are marketed, sold, and consumed responsibly. >> reporter: and state police tell wjz tonight, they are still investigating courtney spury's death, and waiting toxicology tests to come back. reporting live, mike hellgren, wjz eyewitness news. >> new at 6:00, wjz goes in depth into the four loko controversy, investigating the impact of this drink and its dangers. an accused killer off the streets tonight. baltimore county police say they caught the man responsible for a deadly shooting. denise is in the newsroom with a break in the case. >> reporter: the victim spent his last moments, banging on the door of an apartment for help. when police arrived, he was dead from several gunshot wounds.

now, police say keon cunningham is responsible for killing adullo atimoto. he was found dead last friday outside the old road apartment complex, where cunningham lived. cunningham is charged with first-degree murder. >> he is being held at the baltimore county detention center. he was denied bail. a tour bus, returning from veterans day celebrations caught fire on i-395 last night. a veteran on board spotted smoke near the back of the bus. and alerted the 30 veterans on board. everyone escaped those flames. no one was hurt. crime nos no boundaries. -- knows no boundaries. and a car broken into their home north baltimore, wednesday night. >> reporter: police say a satellite radio system was stolen from kent blake's car. and he and mayor stephanie rawlings-blake were in their home in baltimore. the theft was not noticed,

until blake got into his car thursday morning and realized the equipment was missing. today, the mayor reacted. >> it was unfortunate. and my husband shared the frustrations that anyone would feel when something is stolen. >> reporter: the mayor's security team was outside her cold spring home at the time of the break-in. >> no threat to the mayor or to her family. the vehicle was parked out of site from the executive protection officers that secure the house. >> reporter: police say car break-ins are down this year by 9% in baltimore city. but they are up 6% in the northern district, where the mayor lives. >> we have been really trying to raise awareness on not leaving items in vehicles and things like that. they're easy targets. >> baltimore city police are now investigating the car break- in at the mayor's home. but so far, no arrests have been made. a late payday for baltimore county teachers. a computer glitch prevented teachers with direct deposits from getting their checks

a special honor for a maryland county. howard county is ranked the third richest county in the nation. weijia jiang spoke with people who live there, with the ranking. >> reporter: we spent the day here in howard county. and the people who live here say they certainly feel rich. but that sense of wealth has little to do with money. >> reporter: he can't think of a better place to raise his five-year-old. >> this place is a plethora of opportunities for such a wide range of background. there's government contractors, government agencies. it's like shooting fish in a barrel. >> reporter: it's not just the number of jobs here that is making national headlines. it's how much they pay. the survey ranked howard count

place to live. howard county is also ranked the healthiest county in maryland. if you're waiting for someone to get home from work, let's check on the roads with sharon gibala at traffic control. getting home this afternoon could take a while. we have so many accidents to talk about and delays. latest one, 50 eastbound. a deer struck there. an accident working on 40 eastbound. another at old joppa in bel air. another at bel air road. and too many accidents to mention in the city. some of them include west north avenue at pennsylvania avenue. north highland at east baltimore. and east biddle at north broadway. and a bunch of accidents in anne arundel county to riddell road at route 3. richie highway. and row boulevard at route 50. 95 southbound, slow. 195 to 32. 11 minutes there. 95 northbound still slow, eastern avenue to the beltway. six minutes there. significant delays on the beltway as well. 29 miles per hour on the top

and west side outer loops. and take a look at this delay, on 70. typical, but it is stop and go, from approaching 29 to marriottsville road. there is another live look outside at the top side of the beltway. and it is not looking pretty either. this traffic report is brought to you by hh greg. hh greg has over 100 flat-panel tvs. watch the most exciting games of the year on tv, from hh greg. hh greg, price and advice. back to you. tunnel concerns. for nine years, the city has been asking csx to make its underground tunnel in downtown baltimore safer. the mayor got a look at what has been promised and what has been done. the rail tunnel runs from the stadiums, under howard street, up to mount vernon. nine years ago, a derailment starts a fire that burns for five days and starts a huge water main break. east coast rail traffic is snarled. and it's then that our city learns about the dragon,

waiting to erupt under its streets. since then, many calls for improvement. and after a minor derailment in august, a plan from csx. five miles of rail have been replaced and will continue to be replaced every 10 years. twice as often as normal. instead of each quarter, the tunnel will get a computerized inspection each month. csx will make a walking inspection each week and will improve drainage. >> by replacing the rail. putting the new pumping system in. and the more frequent inspections, we feel confident we can prevent any safety issues in the howard street tunnel. >> reporter: today, the mayor was taken on a tour, to point out what the rail line is doing. it was her first time inside. >> i think it was important for me to lay myies -- my eyes on this crucial corridor. >> going above and beyond what is required by law is one way to help us make sure that it's safe. >> reporter: in north baltimore, mike schuh, wjz eyewitness news. back to you now on tv hill.

midict midict 60 -- mid-60s after a frosty start. very common condition conditions they have out west. like nevada and utah. 67 degrees now. it's dropped a little bit. dew points still way down. next hour, it will probably drop 8 or 10 degrees quickly. 58 in washington. ocean city at 50. the warm spot right now, easton at 63. once again, the dew point extremely low. about three days ago, the dew point was 41. a lot more moisture in the air. it's very dry now. that means temperatures will tumble again tonight. look at this. 66, after a morning low of 20. it's hard to know even what to wear these kind of days. chilly, frosty in the morning. and nice and pleasant in the afternoon. with very little wind. 58 and 36, the averages. and records, 78. and way back in 1807. that's when we started keeping regions in this area by the way. -- records in this region, by the way.

it's 5:28. 68 degrees and clear. good evening. thank you for staying with eyewitness news. here are some of the stories people are talking about tonight. the breaking news wjz has been following all evening. a powerful maryland politician and his wife, are indicted in a federal case. alex demetrick has an update on county executive jack johnson from greenbelt. >> reporter: yeah. developments are developing. just a few minutes ago, prince george's county executive, jack johnson and his wife leslie, each pled not guilty to violating federal law. count 2, destroying evidence in a federal investigation.

these charges carry up to 20 years in prison if convicted and a $250,000 fine. even so, the judge did not set bail. instead, both will be released on their own recognizance, with jack johnson receiving somewhat stricter rules than his wife. under the terms of release, he must be under home arrest, and wear an electronic bracelet and monitoring. he will be free to go to work and medical appointments and whatnot. coming on the heels of a discovery in court a few minutes ago, that when the court were arrested, the fbi found $80,000 in cash. that money was in the house. and it was also on mrs. johnson's person. and again, we're getting more details. we'll get a lot more when the affidavit is unsealed in a few minutes. back to you. >> alex demetrick, wanting -- report lookive from greenbelt, prince george's county. we'll have a live update next

at 6:00. the on again, off again talks of building a new arena in baltimore are back on. but this time, the venue could be in a completely new location. so what does that mean? for first mariner arena? wjz is there. gigi barnett is there to break down the plans. >> reporter: the city does want that new arena. one with 18,000 18,000 seats. a brand new stage and better equipment. it was on hold for a while, until now. >> reporter: bruce springsteen has played here. the rolling stones have, too. and next summer, r&b song ster sade comes to town. but they'll have to deal with a small bathroom and a building that is 50 years old. >> imagine what we could do with a new building. >> reporter: that's yet city has renewed efforts to renew the building. the question now is where to build. frank runs the arena. and he says a new building will continue to attract bigger

names and help charm city compete with larger cities. but only if it's near the downtown area. >> the nice nuances that makes it more conducive for events. easier to get in and out of. more parking. >> it's time to put out a bigger net. and look again at what are possible sites, the pluses and the minuses. >> reporter: jay brodie runs the development corporation, which oversees the development project. he says one idea to tear it down and build a new one in the existing spot won't work. because that could put the entertainment on hold for several years. >> reporter: and the arena is doing well, even though it has to compete with cities like d.c., as well as philadelphia. now, coming up at 6:00, the baltimore development corporation says tearing this down and building anew will harm, actually harm its entertainment business.

back to you. >> the arena was built back in 1962. jfk has visited. the beatles, beyonce and michael jackson as well. anne arundel county police are looking for two. it happened in west meadow road. the victim told police, two men attacked him. took his car and fled in his light blue jetta. anyone with information about the robberies is asked to contact police. a man included in a three- state spree will stand trial. elias abazulam. a michigan judge has ordered him to stand trial for one of those stabbings. the victim told authorities he was stabbed back in july, while helping the suspect with car trouble. taking down gangs. law enforcement takes another swipe at gang violence, using federal money and state oversight. political reporter pat warren explains, the grants might be given to communities you might not ordinarily think.

>> reporter: marking their territory. gang members thumb their noses at the law-abiding. like darrell get. getz. >> that means crip killer, slash is the insult thing, we're going to get you. >> reporter: and including harford county, where he was murdered. in an effort to warn them, the state has awarded five jurisdictions. >> our goal is to prevent these people from turning to criminals. i can't tell you how many times i watch someone in their 20s and 30s who are being sent away to federal prison for life in some cases. and you ask yourself, what if you go back in time 10 or 15 years? as well something -- is there something we could do to send this in the right direction. >> it's what michelle getz would pray. >> we pray god would use him and use him mightily for his glory. >> there are gangs.

they are committing crimes. and again, they are being investigated by the various police agencies. >> reporter: gang activity is a continuing concern here in frederick county. they became the first to prosecute under the state's new anti-gang laws. reporting from frederick, i'm pat warren. now, back to you on television hill. the governor's office on crimes control also distributed grants to police officers in prince george's county. a heartbreaking end in the search for a missing north carolina girl. just a short time ago. police say they believed they have found her body. vic is in the newsroom with the unfolding developments for us. >> police in hickory, north carolina, are fairly confident they have found 10-year-old zara baker's remains. she was reported missing more than a month ago. dna matched zara. the child had bone cancer and had a prossetic leg and hearing aids. the girl's mother has been

charged with obstruction of justice after police say she wrote a bogus ransom note at the home. >> police say they have had a hard time hearing anyone outside of zara's family saying they had seen zara alive in the weeks before disappearance. 34-year-old tina herman was reported wednesday. that's when police realized, several were unaccounted for. herman's truck was found at a nearby college campus yesterday. police are talking to her ex- husband, but are not calling him a suspect. the supreme court is still refusing to get into the controversy over the military's don't ask, don't tell policy. the court denied a request from the gay rights group to review the matter. last month, a federal judge ruled the policy violates the civil rights of gay americans. but an appeals court said the policy will remain in effect while it reviews the case. facing the consequence. the man convicted of hacking

sarah palin's e-mail account could spend in -- some time in prison. a judge sentenced david cornell to one year and a day to hacking the former governor's account. he figured out answers to security questions to gain access to palin's private e- mail. they recommended that he serve time, one year and a day in a halfway house. but is that decision -- that decision will be made by the bureau of prisons. president obama is wrapping up his trip. but it hasn't gone as smoothly as the white house had hoped. as the president faces pressures overseas and here at home. >> reporter: while g20 leaders toasted what they called a successful summit, president obama left south korea with little to celebrate. he failed to strike a deal with the south koreans on a free trade agreement that has been delayed for years. do we have a deal that works for us? that's my first obligation. >> and the president had no

luck convincing world leaders to put more pressure on china, over its undervalued currency. after the setbacks in south korea, reporters traveling with the president asked him if he had been hurt by the punishment his party took in the midterm elections. >> the answer to the second question is no. >> reporter: things won't get any easier when the president gets back here to the white house. next week, he'll sit down with congress's newly-empowered republicans to talk tax cuts. >> reporter: while the president wants to let the bush era cuts expire for taxpayers making more than $200,000, gop leaders are pushing to extend the cuts for everyone. >> i think extending all of the current tax rates and making them permanent, will reduce the uncertainty in america and help small businesses begin to create jobs again. >> my hope that somewhere in between there, we can find some sort of solution. but i'm not going to negotiate here in seoul. my job is to negotiate back in

tonight's wjz healthwatch. an outbreak of whooping cough has health officials calling for children and adults to be vaccinated. but as sandra hughes reports, a new study says adult vaccinations might not make much of a difference.

>> reporter: it's called whooping cough. because of this. the long cough and then the whoop that follows. [ children coughing ] >> reporter: health officials are warning everyone to get vaccinated against the disease, especially older adults. but a new study is questioning that. >> blanket vax seen -- vaccines may not be effective. >> reporter: they analyzed data to figure out how whooping cough spread. they figured the children are more likely to catch the whooping cough from another child, not an adult. >> reporter: although we realized kid his contact with other kids, we didn't realize how intense that contact is. >> reporter: so far this year, health officials in california have dealt with almost 6500 cases of whooping cough and 10 infant deaths. >> reporter: children under 1 year old cannot be vaccinated.

and they're the most susceptible to whooping cough. and of those who can get vaccinated, 10 percent of parents don't do it. >> if you can get parents to vaccinate it, we can control this disease. >> reporter: researchers say we should make all children get the shot. >> reporter: there were 200 new cases of whooping cough in california this week alone. also in health watch, new research into what you're thinking when you're awake. at least half of the time, you're thinking about something other than what you're doing. the study found that people are happiest when they are exercising or engaging in conversation. an expert stays he lost 10 pounds on a junk food diet. he didn't want to have others follow him. he just wanted to prove that the key was lower colorric -- calor icintake. snps okay -- >> i don't know about that.
