case of a police officer. >> how that decision could backfire. hello everyone i'm vic carter. >> and i'm denise koch. here is what people are talking about tonight. >> making his case. a baltimore city police officer calls the victim's sister to the stand. >> it was wrong. >> reporter: shante broke down in an exclusive wjz interview after officer tshamba gunned down her brother. a year later, she was calm in court as she recalled her brother's last moments alive. the prosecution called attention to the inconsistency in her case. >> i think she reenforces all

of the evidence that are being proven here by the prosecution. that tshahba was aggressive. >> reporter: she said he fired shot after shot, and as brown lay on the ground bleeding, he walked off as if nothing. next witness, crystal ramsey. she's the woman who brown grabbed. she testified that brown chased tshamba, so he shot him in self-

defense. >> reporter: and we will be hearing from a security guard that said that brown lunged at tshamba. the rising temperatures have led to the deaths of two people in maryland. the state department of health and mental hygiene tells wjz two people died last week because of the heat. one of the victims is a cecil county man the other a woman from anne arundel county. both were more than 65 years old and they each had previous health problems. if you think the heat is back, imagine what it's like fighting a fire in these temperatures. firefighters spent the afternoon battling several fires in this northwest baltimore apartment complex. luckily the apartments were empty at the time of the fire. and we are expecting more dangerous heat over the next few days. baltimore county schools are closing two hours early wednesday and the city has already issued a code red heat alert for tomorrow and thursday.

wjz has your first warning weather. bob turk and bernadette woods has a look at how hot it's going to get. >> last week that's what we're looking at for the next couple of days. take a look at the temperatures around the region. they are not that hot right now. 87 to the west they had shower activity. here we go right up to 88 just one minute ago. so we're still in the upper 80s. we did get to 90 degrees earlier today. because the heat and humidity coming back tomorrow full blast, we have to our northeast around the philadelphia area, a warning for all of central maryland a heat advisory beginning tomorrow. and an air quality alert tomorrow as well because the air quality is not going to be in a good range the next few days because of the staggering air of the heat and humidity not going to make it safe for folks with compromised immune systems, lung problems and other health problems.

a huge ridge of high pressure just like last week. right now it's sitting in the middle of country but it's moving our way for the next few days. it is going to stick around maybe a little longer than that. but the peak days are tomorrow and thursday. as far as numbers go, we're already forecasting a record high for tomorrow. the record for tomorrow is this. it's 97 degrees set back in 1999. the thing is we're forecasting a high of 98. regardless they're going to be very close. 98 for thursday, we may not come toward that one but still close enough that it's worth mentioning. when you factor in the humidity, as bob was saying it's going to feel more like the low 100s. we'll have a lot more coming up shortly. bernadette and bob, thank you. be sure to stay with wjz for updates on the rising temperatures. we'll get the updated warning forecast 24 hours a day on our

forecast. a rising politician brought down by a sexting scandal. there's growing calls calls for weiner to resign. >> i haven't told the truth, and i've doing things i deeply regret. >> reporter: the married congressman admits he twitted a picture to a seattle woman then lied about it. weiner is now facing a federal investigation. the congressman admitted to inappropriate online exchanges with six women but says he will not resign. >> i don't see anything that i did that violated any rules of the house. >> reporter: up until now, weiner had been a rising star everyone touted as a top contender for new york city mayor. now he's hoping to hang on to

his congressional seat. >> who's taking over what health care plan? >> reporter: he's been an outspoken liberal voice but this scandal may compromise his ability to influence legislation. >> he no longer will be able to do that for a long period of time until this blows over. >> reporter: weiner came public after he said that someone hacked into his twitter account. and only after pictures were released on a website. breitbart is warning weiner he will postan exrated photo if weiner tries to retaliate. >> reporter: and there could be more trouble for weiner. even more women are coming forward with stories about his internet escapades. a driving lesson goes horribly wrong. mary is in the newsroom to show how the van ended up in the water. >> police say you can blame the

accident on an unexperienced drive and a bad decision. a 14-year-old girl was learning how to drive with her aunt after she accidentally stepped on the accelerate. you can imagine they are very shaken up but luckily no one was injured. >> the girl's aunt is facing $400 in fine for the accident. it is against the law to let anyone under the age of 15 drive. an anne arundel county family's dog shot. >> reporter: there are two dogs, there are two dog owners and two different versions of what happened that day. >> i really miss my dog. >> reporter: 18-year-old bianca moire says she was walking her

family pit bull cain. a neighbor was walking his dog, scared he dropped the leash. >> this is the third situation we've had with this dog. >> reporter: noriega admits that when his children came running inside the house to tell him about the dog fight he first grabbed his gun. but his story is different. >> i asked her to please grab your dog. please grab your dog or i'm going to have to shoot him. he again backed me up to where a wall was. i had my kids blocked, so they couldn't get any where. at that time i decided i had to shoot. >> reporter: police have been trying to sort the details out, but so far they have not taken sides. >> i feel i did the right thing. i feel that the only option

the dog started barking at him so he shot the dog. -- family members tell us the woman suffered a set back today at the hospital. the dog's owner has been fined $550 for the attack. a violent attack at a restaurant. >> reporter: the surveillance video taken at the second chance saloon. you will see a woman smack another woman. she punches her in the face repeatedly before stealing her purse and walking away. >> this is unusual. we have not had situations like these, robberies like these that have happened inside of an establishment. >> reporter: howard county police say they are still trying to track down the attacker. >> we have talked to the victim and several people in the restaurant as well. right now it does not appear that they knew each other on

that this was provoked in any way. >> reporter: what is evident is that about a dozen people walked right by the victim while she was on the floor in pain. but a few minutes later, some patrons do come to the aid of the victim. >> i am shocked by the actual incident then i'm even more shocked by the -- what took place with all the people that were here not responding with the girl. >> reporter: woods opened the second chance saloon two years ago. he hope it is incident doesn't ruin his dream of owning a family friendly eatery. >> first time anything like that has happened. hope it never happens again. >> reporter: the woman was treated at the scene. meanwhile police have offering a $500 reward for information that leads to an arrest. in howard county, adam may, wjz eyewitness news. and police say that the suspect is 5'5" over 200 pounds and she has a pony tail.

if you've seen her give howard county police a call. police are looking for this man wanted for attacking two people. marlow mclane is accused of attacking two people then holding them against their will at a trailer. the alleged victims were released about an hour later. holding out hope, the families of a fire recruit is praying for his safe return. it's been about a week since anyone has seen him. the family will hold a vigil tonight at 7:30. it took five days but rescue crews have finally found the body of a man who drowned in the tridelphia reservoir. the u.s. airways plane that landed in the hudson river is

the u.s. supreme court decision yesterday not to hear a challenge to california's in- state tuition law. granting the lower tuition rate is good public policy say supporters. >> we have a lot of people who support it and it's going to benefit the state a lot. >> reporter: mark barber associate dean of law tells wjz the decision to pass on the california case could have different meanings. >> there may be an inference the court is making. if it doesn't concern congress it shouldn't concern us. >> reporter: the supreme court may also act if federal court rulings are split. >> if we have one federal court saying you can do it, one federal court saying you can't do it, there'll be a lot of pressure for the supreme court to step in. >> reporter: organizers of the petition drive to put the issue to maryland voters intend to apply pressure. >> for those who think this is wonderful, i'm going to tell you two things.

we're going to get a law and they're going to rule 5-4 against illegals. the petition is going to win, it's going to referendum, we're going to kill the bill in maryland and we're going to kill it in the united states. >> reporter: the supreme court decision may have settled immigrant tuition for california, but apparently as far as maryland is concerned everything is still on the table. reporting from the university of maryland school of law in baltimore, i'm pat warren, now back to you on television hill. and the state board of elections has validated nearly 20,000 signatures to put immigrant tuition on the 2010 ballot. thousands more are still needed. baltimore heros, orioles and under armour are all getting in to help injured troops. the players decided to help out because they know people serving overseas. >> you don't have a family member or a friend in the military you don't know what it's like for them to go over

>> reporter: harold was just a teenager as he arrived as part of the 26th infantry. almost 27 years later he is awarded. >> the minister in giving the award he gave a little talk about each one of our exploits. i mean some of it. and he mentioned about me participating in pulling some of the soldiers out of a burning building. i didn't even think about it at the time. if something has to be done, it has to be done. i didn't even think am i going to get injured, it's just second nature. >> a true hero. shaprio received the medal yesterday on the anniversary of d day. >> the legion of honor is the highest award in france. the equivalent to our medal of

all right, baseball tonight down there at camden yards. should be a warm night but not too terribly humid. a little breeze, not too bad out there tonight. looks like tomorrow however it's going to be a tough day and thursday, the next few days really obnoxious heat and humidity just like we saw thursday. compared to the next few days not too terrible. 88, 88 in easton. 88 in washington. 72, 79, 82 in ocean city. the dewpoint 61. i think tomorrow is dewpoint probably getting to 66, 67. our temperatures in the upper 90s. it's going to feel like 102

when you go outside. that's why you need to take it easy right now. 84 up in bellaire and only 83 in westminster. 90, 60 today. the average is 81 and 59. and the records 1999 is the high 96. and 47 way back in 1954. we do have that heat advisory and an air quality alert. up to our north, philadelphia region has an excessive heat warning, expect temperatures and humidity over 100 degrees during the day tomorrow. high west winds will keep us in warm humid air. it'll knock temperatures down and give us a chance for showers. there's quite a few showers in pennsylvania, western maryland this morning that's all across

southwest virginia. you see the left over clouds. if the clouds come in, that will be just fine with me. widely scattered showers, thundershower to our south and north. the front getting in sometime friday. that's when temperatures begin to head down. and the chances for showers will increase and yes we can use those showers. tonight clear to partly cloudy. let's call it mid-60s to low 70s. hot, more humidity. not a good afternoon, you're going to have to work outside tomorrow, take lots of breaks, drink lots of water and stay in the shade as much as possible. if you have health issue, you should stay inside. >> i'll take that advice.

maybe he will get more votes because of this. searching for clues in the case of the new york serial killer. mary is in the newsroom with what police found today. >> reporter: police returned to a long island beach today that's become a graveyard. they were looking for signs of more bodied buried in the sand. surveillance pictures made police think there were more bodies or bones buried there. but they didn't find any new remains today. so far they've uncovered 10 sets of remains in the area. detectives think it may have been a serial killer who buried the bodies of 10 prostitutes there. and the fire has been burning for a week and now covers 365 square miles. that's about four times the

size of baltimore. five buildings have been destroyed but no serious injuries have been reported. health officials in europe still do not know the cause of one of the most deadly e.coli outbreaks. rita nissan reports for wjz many farmers are furious about the situation. >> reporter: spanish officials are demanding pay back for their cucumber farmers. and now they may get it. the european union says it will compensate farmers at least $220 million for lost crops mistakingly targeted in the e.coli outbreak. but farmers say that's not enough. they lost millions of the dollars when they destroyed cucumbers. the german chief lashed out. german officials defended their claims saying some tests did

show there was e.coli in spanish cucumbers. the number of new cases appears to be falling. here in britain some experts have urged grocers to take all german produce off the market because no one knows why people are getting sick. consumers throughout europe are afraid to buy salad vegetables even though they've been given the all clear. if the source is not found in a week the cause may never be known. rita nissan, wjz news. >> now russia has banned imports of all european countries. police will be cracking down on drivers this summer. it's all part of a new smooth operator program. police are looking for those following too close and speeding. time now for a quick look

a 12-year-old florida boy is facing murder charges for killing his younger brother. christian fernandez allegedly killed his 2-year-old half brother inmar by repeatedly hitting him in the head. he may have broken the toddler's leg just a few months

earlier. the 12-year-old's mother is also facing charges for aggravated manslaughter of a child. a bus driver is facing charges. just as you heard, the driver threatened the student then got out of her seat and you can't see it in the video but police say he actually hit the 10-year- old in the leg. that violates the school's ban on corporal punishment. >> as a parent, as a superintendent. as a human being, it's just wrong you can't do that. you know those days are long long gone. you can't treat these children like that ever. >> reporter: the driver was suspended for two days and later resigned. she's facing two misdemeanor assault charges. people in chile and argentina are cleaning up after a dormant volcano erupts for the first time in half a century. the volcano spewed ash more than 6 miles high saturday blanketing some areas with more

if you thought it was hot last week we're in for more than of the same. bob turk meteorologist, and bernadette woods will show us how hot it will get. first here's bernadette. >> it starts out tomorrow. we start the day not too unbearable. we'll be in the 50s. but as we head through the afternoon that humidity starts cranking so do the temperatures. then as we head through the evening it's going to be very warm and very muggy. so for the rest of the five day, here's bob.

play. he'll be at congressional near dc. woods announced today that he will not be in the field, he is out of the u.s. open. woods says doctors have advised him to continue his rest and rehab on the injuries to his left knee and his achilles. the injury caused him to pull out of the open a couple of weeks ago. woods says he hopes to be back in time for the at&t national in three weeks. news of serious injury and subsequent suspension, national hockey league. nathan horton suffered a severe concussion. hit by vancouvers aaron roman game three of the series last night. horton will miss the rest of the series and that did draw a major penalty. rome is going to be suspended for the rest of the series. the hit was deemed illegal because rome had already passed the puck when he hit horton.
