>> reporter: for years they blasted how the fbi constitutes a rape. >> i would consider a rape, anything that is forced upon anything sexually that they don't want to participate in. >> reporter: since 1927 it is considered forceable penetration into a woman where victims were drugged under the influence of alcohol or male victims, now they are moving to revise the meaning, meeting the demands of advocates. >> not only is it time but it will allow us to protect victims to increase reporting and that's an incredibly under reported offense. >> reporter: since then they overhauled the way they view sex crimes following an investigation by the baltimore sun, he even testified at capitol hill. >> women are often a shamed to

confront their attackers. we need to make sure victims feel safe reporting incidents to police. >> reporter: police did not recognize an incident as rape and over a 19 year period there was a staggering drop in rapes in baltimore and they reclassified them from unfounded to founded and beefed up a is unit for rape. experts say it will raise across the country if rape is redesigned. right here a meeting will be started and any changes they come up with will be given to the fbi for final approval. wjz eyewitness news. >> and there were nearly 8 5,000 cases of sexual assault

last year which a decrease from 2009. a man's body is discovered, police say it had been in the water for some time. officials had no reports of missing boaters or swimmers and they are now working to identify the body. they have learned exclusively, a man who died from a contaminated cantaloupe is going to sue the farm. the listeria outbreak will only get worse. >> reporter: the listeria outbreak has caused 16 deaths in 18 states including central maryland where a man died from eating a tainted cantaloupe, the source of outbreak is generals sent farms -- jenson farms in hawley colorado. 87-year-old william beach died after eating the tainted cantaloupe. >> we received a call from the health department and i

answered the phone and i asked what it is about and they said they had been contacted by the hospital that our father had died of listeria. >> reporter: they say listeria is most harmful to the very old and very young with those with fragile immune systems. listeria can live in the body for a while. >> reporter: the fda is looking for the route of the outbreak, while cantaloupe was being stored before it went to market and like most bacteria, listeria grows in the cold. >> if you have some contaminated food and you put it in your refrigerator, it will be more contaminated by the time you take it out and eat it. >> tonight at 11:00 hear from the family of the maryland man killed by listeria and why they

are filing a major lawsuit against jenson farms. heads-up, texting behind the wheel can now end with lights in your rearview mirror. drivers who are seen typing or sending text messages will be pulled over. before now they had to issue a texting citation and under the new law you can be fined $75 or receive a point on your license. the city's low graduation rate, it is a problem that playings school districts nationwide and in your school watch report, baltimore may have found the key to turning it all around. >> where lab coats, even teachers wear them, it allows them to see themselves as future doctors or scientists

and it's a vision that helps them stay in school which means fewer drop outs and more diplomas. school leaders say it is a part of why they are seeing record shattering drop out rates. new figures released today show over the last four years the city's graduation rate is nearly 72% which a 22% increase and as the numbers go up, the graduate rate goes down, during the same time, less school which means 5 5% more are staying in class. >> it is taking a p government as a sophomore... >> reporter: the doctor says boosting the graduation rate was one of his top priorities when he took over the district in 2007 so he closed failing schools, the number of courses

. well, it is really a lot like fall out there, bob has your weather forecast as we look at the weather harbor, we believe it got to 77 degrees, earlier when the sun came through, now we are in the upper 60s. temperatures on the region, that is where the cool air is, 46 in oakland that is chilly, late tonight tomorrow morning they will see their first snowflakes of the fall season. a little early but they will see something, 71 in washington

73 in ocean city moving through the region as we speak, 64 in hagueers town, upper 60s to around 70 as you see, it is kind of a chilly night, to the west of us, northwest breeze but there is cooler air in and it will be with us until next week. we bring this chilly air in and some things that begin to evolve, we had a few light sprinkles, now it is regent rating over south and east over virginia and the eastern sections of maryland and getting some activity, to the north low pressure, this is the third area of low pressure still spinning around the great lakes and it will migrate maybe towards the jersey coast up towards new york go back to pennsylvania and spin around a couple of times unfortunately because the jetstream is making a big dip, sort of like this,

nothing will be able get kicked out to sea. if a jetstream goes flat to the east it will keep on going. unfortunately it will get caught in the jetstream, go back spin around for a couple of days, that means in baltimore north, particularly the mason dixon line, saturday afternoon, sunday afternoon, maybe even monday, definitely cooler temperatures, breezy as well and as i said, that low getting back towards allen p.a. by sunday, one or two may sneak in to our region. you've gotten strong this afternoon but it will be weakening, there is bermuda by sunday a little rain and gusty winds, that is about it hopefully. now we have not talked much about felipe, a tropical storm heading to the west and it will be weakening and heading up to

michael jackson on the day he died. he testified that dr. conrad murray appeared frantic when he entered the singer's bedroom. >> i asked him what his underlying health condition was he did not respond i asked him a third time and he said nothing, he has nothing, simply that did not add up to me. >> reporter: the paramedic said he was cool to the touch and his eyes were open and dry. he died from the powerful anesthetic propofol and he asked if the singer was on any medication. at that point he said no he is not taking anything, and then he followed up with i gave him a sedative to sleep. >> reporter: he claimed he did not have the proper monitoring equipment while administering it to jackson. bob johnson testified the

machine used to monitor michael jackson's pulse had no audible a arm and was not -- alarm and was not considered for continuous use. they asked johnson whether the device could be used for ten or fifteen minutes with a doctor present. >> perhaps. >> he faces four years in prison if convicted of involuntary man slaughter. jackson died in 2009 while he was rehearsing for a concert tour, we will continue to bring you the latest developments from a courtroom. one of the charges against the driver of a fatal bus crash is dropped. he will still go on trial for four felony counts of man slaughter. he admits to falling asleep

. a man crashed off a cliff and becomes trapped for six days reporting from wjz on how he survived. he was trapped for six days after his car plunged off a nearby road. the 6 seven-year-old managed to survive on creek water and whatever he could eat, they managed to pull him to safety a few days ago. another car apparently went off the same road in los angeles, that driver did not survive. >> he had gone off and was down there a lot longer than he was there. >> reporter: he underwent surgery to repair a broken shoulder and multiple broken ribs. >> it is astonishing he survived, when the details of his story became apparent to

me, i was actually shocked at how well he was doing. >> reporter: his the children found him in a roof convenient and when they didn't hear him, they figured out where he last used his cell phone and started their search. >> we stopped at every ravine, my brother got out of the car and kept screaming and the next thing we heard dad screaming saying help, help. >> family members ended up getting caught themselves and rescue crews had to pull them out, despite his injuries, he is in good spirits. wjz, eyewitness news. >> fire officials say roads in the area have sharp curves and sometimes go down to two lanes with some steep cliff's with drop offs on the other side. and a 6-year-old boy trips and falls into oncoming traffic, become trapped underneath a car. while a group worked to pull the boy out safely, luckily he

was not seriously injured and and he is now recovering at a hospital. statements are given in the amanda knox trial, they asked a court to put amanda knox in jail for life as they wrapped up their case. they painted her as a senseless killer during an erotic game. the father of amanda knox talked after the allegations that she will flee the country if she is free. >> i'm not sure he gets this and are ready to escape, the judge and jury have to make the decision on whether or not you know she will have an opportunity to you know come home with us. >> amanda knox denies any role in the murder of her roommate but has been held in jail since 2007. a verdict in the case is due on monday. payments on hold, made 0

town with former derek mason on their team and that brings baltimore's preseason plan to become younger and faster. they brought in more youth and speeded receiver. now flacco has had to adjust and receiver ed lee is hurt so he will not play but flacco found the benefit of youth and speed in rookie smith. he caught three touchdowns against the rams and that breakout game gives flacco the potential to orchestrate the offense he has been craving. >> that was big for us on sunday and i am not too sure that is what they were expecting. they wanted to do some things to try to still get those shots. >> flacco is coming off the best passing game of his career. 389 yards in st. louis but he is expected to face a much tougher offense from the new york jets on sunday.

there is a big college football matchup, maryland plays host to tall son. the terps will be the ones in the cutting edge design in orange and black. the terps were steam rolled this past saturday trailing at 31-0 before they eventually lost 31 when 7. now they -- 3 had 1-7. they are playing with a 3 and 0 record. he respects him but his focus is his guess. >> we understand what they do but what we really have to do this week is focus on ourselves and make sure we do what we are supposed to do and hopefully we will be able to do that. >> maryland is looking to get his offense in gear.
