towson gas station owner. eyewitness news at 4:00 starts now. in his own defense, testimony wrapping up in the michael jackson death trial. >> will dr. conrad murray take the witness stand. >> hi, everybody. i'm mary bubala. >> i'm kai jackson. here's what people are talking about. >> final witnesses, the michael jackson manslaughter case is wrapping up and the question everybody is asking, equal "will dr. conrad murray take the stand?" karen brown reports for wjz from los angeles. >> shall the be the truth -- >> reporter: an expert in addiction testifies there is evidence michael jackson was addicted to painkillers in the months before his death.

>> what about addicted? >> possibly. >> reporter: dr. robert waldman examined medical records from a dermatologist, who was treating jackson with injections of demmerol. >> i would suggest that injections over 230 minutes. >> the defense is trying to show jurors that jackson was on many different drugs. but prosecutors say it was an overdose of propofol and anesthetics that caused the superstar's death. and that dr. conrad murray is responsible. >> reporter: he is not listed as a witness. but the judge reminded the cardiologist, he does have the right to take the stand in his own defense. >> the way this trial is going, as poorly as it has gone for him, i would strongly recommend that option. >> reporter: closing arguments are expected to begin next week. and then jurors will decide if the doctor is responsible for jackson's death or if jackson himself is to blame. in los angeles, karen brown, wjz eyewitness news. >> dr. murray faces four years

in prison if convicted. but there's also a chance he would serve house arrest because california's prisons are so overcrowded with violent criminals. guilty of violating a crime. will waltor bishop get the death penalty? >> well, kai, this is the first murder case in maryland to testify the state's new guidelines for the death penalty. this is a police interview videotape of bishop, admitting he murdered gas station owner ray porter. under the new rules, it makes him eligible for the death penalty. bishop's attorneys are arguing the confession was coerced, however. prosecutors say the interview tapes speak for itself. kai? >> wjz is inside the harford county courtroom. and we'll bring you the sentencing decision as soon as it is reached. the dow makes triple digit gains on the heels of a financial agreement in europe. here are the numbers from moments ago. the dow jones is up 340 points

and a and a half. and the s&p is up 43. nasdaq is up 88. show of solidarity. in new york city, dozens of "occupy wall street" protestors. the carefully orchestrated scene is in response to violent counterparts in oakland, california. protestors ignore a deadline to evacuate mceldon square. wjz is live. mike hellgren is there with more on what the mayor is saying about all of this today. mike? >> reporter: mary, the city has said that they don't want overnight camping here, starting last night. but as you can see, the tents are still here. and the "occupy" movement has gotten some big support from unions, including the fraternal order of police, who say they should be allowed to stay put. >> reporter: the debate is

turning more heated in the inner harbor. should the city force demonstrators with "occupy baltimore" to leave mceldon square, where they've camped for weeks? and if the mayor does force an eviction, will it lead to violence as it did in oakland, california? >> we're trying to be healthy, happy and respectful. and if other people would treat us that way, that's what would happen. >> reporter: overnight, organizers marched in solidarity. the city's patience is wearing thin. with talk of rage and threats they should leave. mayor rawlings-blake says the camping is illegal. but is in continued talks with the group. >> we continue to be working with them. but in order to have this cooperation, it has to be a two- way street. >> reporter: other cities are citing health and safety concerns. in denver, protestors are living in the snow. boston did a health inspection on the "occupy" encampment. >> you know, if they have a place to stay when the weather

"occupy baltimore" has meetings every night at 8:00. but they say they have no official leader. days ago, the governor of ohio gets involved in a dispute over who gets the surviving six. this say bold move the governor is making. >> a short time ago, ohio governor john casich ordered the six wild animals left alive to be put in quarantine. the wife of the suicidal man who set free the tigers, lions

and bears, said she wants the animals back. police shot and killed almost 50 of them, roaming the town of zanesville. the zoo is contacting federal and state agencies to find a way to keep the animals, once the quarantine is lifted. kai? >> ohio's governor passed emergency legislation, preventing people from keeping exotic pets. wegman's is recalling 7,000 pounds of pine nuts sold in 79 stores on the east coast, including right here in maryland. the turkish pine nuts were sold in bulk only. the nuts are linked to an outbreak of stomach trouble from salmonella poisoning. so far, 26 people have become sick, including one in maryland. if you have these pine nuts, throw them out. or you can bring them back to the store and they will issue a refund. outside, it's cloudy, with occasional drizzle. but it will get cold in some

. an amazing rescue caught on tape. a man survives 100 hours buried underneath rubble after an earthquake. rescuers pulled a man out of a collapsed building for more than three days. he's been taken to the hospital. his condition is not known. he was rescued from the town of ursus, that's an area hit hardest by the sunday 7.2 magnitude quake. death toll now stands at 734. new changes to come by the bp gulf oil spill. compensating individuals and businesses hurt by the spill says he wants to wants to -- wants better payouts for shrimpers. shrimpers have complained that their industry has not recovered from the impact of the spill. a family pet has been found

at the airport, 61 days later. reporter kit doee has the latest. >> reporter: the latest image of jack the cat is heartbreaking. he's in new york, dirty, matted hair. after little to no food and water for two months, he's now in critical condition. vets say his chances of recovery are 50-50. >> do you like those odds? >> i don't like those odds at all. >> reporter: karen checked him in to a flight. workers tell her jack's kennel fell from up high, broke open and he escaped. karen didn't get the word that jack was missing until three days later. american says they were busy prepping for hurricane irene. but karen says the storm didn't hit for two days. >> they had two more days to do a more active search and recovery and get to the animal, where he was lost, close to where he was lost. >> reporter: then yesterday, an

3. all three markets are up 3% today. let's go to new york where alexis christoforous has tonight's cbs money watch update. >> stocks soared, turning the dow, s&p and nasdaq positive for the year. the dow jumped back about 12,000 and is on track for its best october ever. the buying spree was sparked by news that european leaders have finally agreed on a plan to contain europe's debt crisis. and the u.s. economy was not as bad off as expected last quarter. the commerce department says the economy grew a modest 2 1/2% after nearly grinding to a halt earlier this year. stepped-up spending by consumers and businesses helped to give the economy some momentum. applications for unemployment benefits dipped by 2,000 last week. but experts say it's still not enough to suggest that hiring is picking up. the number of americans who signed up to buy contracts for homes fell for the third straight month since september. a realtor group says a number

tim. >> sugar as well. >> ice cream, snowballs, all the same. and when you look at the forecast, you'll see exactly why they have something to do with our forecast. take a look. rain right now. this is the reason for all of the clouds and the drizzle we've had all day long. but i promised you an interesting forecast. this is not one we like to talk about this early in the season. talk about temperatures. we're talking about temperatures at 63 degrees. average is 63. we're right on target for that for this time of october. 83% relative humidity. west/southwesterly wind, bringing in mild air at 6 miles per hour. temperatures now across post of the state, in the 60s. you start getting a little cooler out to the west. look at this number here in oakland, 39 degrees. that's kind of an indication of what is coming our way. upper 80s, 66 degrees in both locations. they will get another dose of these but tomorrow, all of this

front moving across the region. the temperatures will drop. the temperatures between where the front is moving across. look at these 60s and 70s, to where it's already past 40s. well, that is definitely the change we're going to be seeing, heading into the weekend. here's the line right now. all of the moisture associated with it. what we're watching right now is this batch right here. this indicates kind of a low- pressure system that is going to be dragging right across the lower edge of the front here. going to eventually make its way off the carolina coastline. as it starts to move into our area, here's the interesting part. it starts to turn into a bona fide nor'easter. as we head into saturday, with the moisture and cold air in place, look at this line of snow. it rose right across the 95 corridor, heading back into carroll county, and out into our western suburbs. we're not ready to talk about accum always. but this could be the first taste of snow and could happen this weekend. colder air moves on in. the rain comes in behind it. and by the weekend, we're

the death penalty. bishop was found guilty of killing towson gas station owner ray porter. under the new rules, bishop's voluntary confession to police makes him eligible to be put to death. a tragic night of babysitting. police have discovered the body of a 16-year-old utah girl, who went missing after taking a babysitting job. >> i didn't think anything like this could happen. >> reporter: a north ogden family. >> we've lost so much. >> reporter: trying to cope with the tragic loss of their 16-year-old daughter, sister and niece, lexy rasmussen. >> lexy was as smart as she was beautiful. highly intelligent. quick-witted. >> you keep expecting she's going to walk through the door any minute. >> reporter: lexy was last seen saturday, september 10th, when she went to babysit for eric and dee millerberg. when lexy didn't return home,

dawn called police and reported her missing. >> i knew she didn't run away. i let a lot of people convince me. that's how i got through the next week and a half. >> reporter: lexy's body was found dumped here off highway 84, about 40 miles southeast of where she lives. the miller burgs are now persons of interest and are now expected to be charged as suspects in what is being called a homicide case. >> when i met him, i had the most horrible feeling in the world. i had no idea that they were capable of doing something like this. >> reporter: lexy's mom says dia seemed like a nice lady. >> she seemed to be a mom like me. i would run into her at the store. makes me sick to my stomach. i ran into dia, two weeks after lexy disappeared. and she didn't ask me one question about lexy. so i thought that was really strange. >> even if you live in a nice neighborhood and everything appears to be safe, that it's

not necessarily true. >> police are now trying to determine the cause of death and find those responsible. >> we all know it takes hard work to lose weight. but keeping those extra pounds off can be just as tough. mary is in the newsroom with more on the findings of a weight loss study. >> when it comes to losing weight, biology is not on people's side. scientists from the university of melbourne, recruited 50 people who are all considered overweight or obese. they consumed about 500 calories a day for 10 weeks and lost an average of 30 pounds during the study. despite those results, most people gained that weight back. but scientists say this is a normal response. weight loss actually triggers a chemical in our bodies that gives us the urge to keep eating. frustrating, vic. >> yeah, i'm sure it is, mary. more than 60% of adults here in the u.s. are overweight or obese. baltimore is planning to ban employees from smoking in government-owned vehicles. the change comes as dozens of

months of yemen's uprising that such an event has happened. a trial is in the future for former presidential candidate john edwards. today, a federal judge denied edwards an attempt to get criminal charges against him dismissed. edwards is charged with using campaign money to cover up an affair he had with rielle hunter when he was running for president and then falsifying documents to cover up his tracks. edwards has pled not guilty and a trial is expected to start next year. ntsb explains what happened when the plane carrying michelle obama got too close to a military cargo jet. >> reporter: investigators say this wasn't the first time the air traffic controller involved made a mistake. the report shows the air traffic controller violated two faa procedures when the boeing 737, carrying mrs. obama and joe biden couldn't land at andrews air force base. the landing was aborted because

the largest -- larger military jet hadn't cleared the runway. the name of the controller has not been released. >> that controller was sent for retraining and is now reapproved to handle air traffic again. a little girl fast asleep. >> reporter: surveillance video captures the moment a car thief abandons the truck he just stole in everett. in the back seat, a sleeping 7- year-old girl. >> if i was that girl, i would feel like scared and cry. because i wouldn't want to be that person. >> reporter: neighbors who saw the suspect they say watched as he waited in the truck before running away. >> i watch like her, 3 to 5 minutes. and i never saw when the guy come out. >> i saw the little girl come out. and he ran away and left her alone. >> reporter: it all started a few blocks away, just before 2:00 this afternoon, when her dad was running an errand, dropping off a dentist bill.

he left his car running with the daughter sleeping in the back. >> radio broadcast was put out, several minutes later, the vehicle was retrieved. no suspect in sight. the daughter was still sleeping in the vehicle. >> reporter: the girl is just fine. but it is a warning, police say, to parents, never to leave your child alone in the car. >> never, never, never leave unattended kids. just get out of the car and take them. because there is no safe place to leave unattended kids. >> reporter: these happened just north of boston in massachusetts. but the little girl is now safe and back with her family. an 11-year-old north dakota boy is waiting for a school bus and shot in the leg. a hunter who was across the street was aiming his rifle at a deer. but shot and injured a boy. the child was taken to the hospital where he is in fair condition. north dakota state police are investigating the incident. a baby born with two mouths goes under the knife for a life-

changing surgery. the baby girl was born in egypt, where doctors told her parents she would not survive. but thanks to the help of charities and children's hospital in los angeles, the little girl was able to get the care she needs. doctors successfully performed the procedure and say the baby is in stable condition. honking soarns -- horns are a sound new yorkers and others are familiar with. but some tax drivers may -- taxi drivers may pay dearly for tooting. >> they're part of the sights and sounds of new york.
