about. >> a life-or-death decision. walter bibop admit -- bishop admits that he kills a gas station owner. but the jury spared his life. >> reporter: kai, not only did the jury decide walter bishop, jr., does not deserve to die. they also say he should have another chance to walk as a free man one day. >> reporter: the same jury that convicted 29-year-old walter bishop, jr., of capital murder, spared his life, rejecting the death penalty prosecutors pushed for. jurors sentenced him to life imprisonment with the possibility of parole. his defense attorney sobbed tears of joy in court. >> i think he was just biting his lip. i think we were all very emotional. >> emotions also ran high for the victim's family who had hoped for a death sentence. bishop shot and killed porter in exchange for a promise of

$9,000. >> it's just obviously been very difficult. like i said, we just, you know, we appreciate all the support we've gotten. and the job that's been done. >> reporter: the key piece of evidence in this case, a rare piece of video evidence made bishop eligible for capital punishment. but the recording may have also saved him from an execution. >> reporter: jurors were convinced of bishop's story that he was manipulated by porter's wife, carla, who is accused of setting up the murder-for-hire plot, who gave are the reasons he should not die. he had no criminal past. he has a lack of family support, mental and drug addiction. >> we had a fair trial. i'm happy that we had that opportunity. >> reporter: bishop also faced charges of conspiracy and having an illegal gun. before the judge punished him for those, he said, i'm not the villain or monster the state is making me out to be.

i don't feel i should have to die in prison for what i did. >> reporter: clearly, a judge disagreed. he gave bishop another life sentence, plus 20 careers for those charges charges to -- 20 years for those charges to run consecutively. reporting live from bel air, weijia jiang, wjz eyewitness news. >> carla porter's trial has been moved to carroll county. it will begin sometime next year. >> a baltimore man is finally come home after he helped the rebels take down libyan dictator moammar gadhafi. new information from matthew van dyke's family. >> well, mary, matthew van dyke will be back in maryland this weekend. the 32-year-old writer is returning home, eight months after he departed on a trip to witness the libyan uprising against moammar gadhafi. after six months in prison, he escaped. but he remained in libya to fight alongside the rebels until gadhafi was killed.

his mother said he is expected to arrive at bwi airport saturday evening. >> she will certainly be glad to see him. van dyke expects to write a book about his experiences. outrage and calls for change after a nightmare school bus mix-up that leaves a 4-year- old boy wandering the streets by himself. wjz first broke the story. tonight, we stay on the story. mike hellgren investigates how it happened. >> reporter: school administrators promised immediate and decisive action in our report last night. well, we have just learned they have disciplined three employees in connection with the incident. >> reporter: there are calls for action, after a school bus snafu wjz first reported that had baltimore county school leaders under fire and apologizing. >> we're sorry that little pierre got on the wrong bus. and we're going to do everything we can to make sure that does not happen to another student again. >> reporter: pierrea the --

pierre is the 4-year-old who attends hernwood elementary and had a nightmare ride home. placed on a bus, when he doesn't even ride one, and dropped often in a strange neighborhood, where a woman found him in tears, called the school and got him back to his mom. >> it was my baby. >> what happened was, we had a breakdown in our process. >> what are the safeguards? if a bus driver does not recognize a student, he's returned to the school. the youngest students are tagged with their name, bus color and number. new students are always introduced to the bus driver, and color codes separate cars from bus riders. >> reporter: the school has apologized. though they can't say what personnel action they took, sighting privacy concerns. >> as far as picking the kids up from school. if you send somebody up there, they're very strict with that. they will not release those children, unless a parent was there. and if there was someone other

than a parent, they have to show id. so this really surprises me. i think it's just one of those flukes. >> reporter: as for pierre's mom, she told me today, she wants her son out of hernwood. >> he's in their care, and nobody knew where he was. >> reporter: and new at 6:00, we'll have the county executives take this on. we'll talk about the incident next hour. kai? >> thank you, mike hellgren, reporting live. pierre's mom says she would still like to sit down and talk with the superintendent about what happened. tonight, wjz has learned the fire at the mount washington tavern caused $2.5 million in damage. the owners promised to rebuild. but that could take a year. the baltimore city fire department still investigating the cause of the fire. closing arguments today in the federal case against a powerful maryland state senator. he's accused of taking bribes from a chain of grocery stores. wjz is live at the federal courthouse. derek valcourt explains the

jury is getting two different pictures of senator ulysses currie. >> closing arguments. one side is trying to paint senator currie as an honest politician whose only mistake was some sloppy paperwork. the prosecution, meanwhile, wants the jury to know of him as a corrupt politician who sold his power. >> reporter: 74-year-old prince george's county senator ulysses currie in the fight of his life, as prosecutors blast him in closing arguments, telling jurors, senator currie used his office to get shoppers what they wanted. that's c they paid him a -- why they paid him a quarter million dollars. prosecutors say they used evidence that proved currie used his power to pass legislation, allowing shoppers to transfer a liquor license, to get shoppers traffic lights near stores and he tried, though failed, to get millions in state grant money for a benefit that would have benefited shoppers, all,

prosecutors say, without ever disclosing that he was working as a paid consultant for the grocery store as required on forms. >> but his attorneys say it was all perfectly legal. and they call his omissions on his state ethics forms a mistake. >> reporter: former lieutenant governor anthony brown and steny hoyer all took the stand to say he is a good man. they'll all confess they had no idea he was being paid by shoppers. his wife said that she was supposed to fill out the forms and errors were her fault. the defense says he didn't forget $245,000. it didn't get lost on the stack of papers on his desk. >> reporter: two former shoppers food warehouse executives are also on trial, along with senatorux lises -- senator ulysses currie. their attorney was making closing arguments today in their defense tomorrow morning.

senator currie's attorneys will make their closing arguments. then the federal prosecutors get a chance for rebuttal. by day's end, it is expected that jury will begin deliberations in this case. live at the federal courthouse, ulysses ulis -- derek valcourt, wjz eyewitness news. >> senator currie faces up to 20 years in prison if convicted. we have breaking news for the occupy baltimore protestors. wjz has learned that the city is shutting off power to the outlets at mceldon square. the protestors have been able to plug in until now. the city said it is shutting off power due to safety concerns. wjz has more new at 6:00. new budget troubles. the city is facing a $52 million budget shortfall next year. mayor stephanie rawlings-blake is considering cuts to city employees pension and benefits. >> a heated rivalry.

a plea from police tonight, after the murder of a troubled carryout restaurant. this is the second deadly robbery to happen while a customer waited for his food. >> reporter: this is freddie jones, waiting for his food order. in just a few seconds, he's going to be shot to death. police want you to look at this video, as they want to know who these four machine are, as they

are all now wanted for murder. >> the victim was approached by the suspects. he resisted. >> he reaches for a wallet. a gun comes out. police stop the video at this point. it's 6:45 on halloween night. the 52-year-old bus driver getting something to eat before going to work. >> i just word how can people just kill anyone? like my dad was a wonderful man. >> reporter: killed, his wife said, over $13. >> for $13, you took a good man, a good husband, a friend, a dad. and i hope you pay for what you've done. >> reporter: first, police need to catch the killers. so 20 detectives fanned out, flyers in hand, their message, saw something? say something. >> this has been the site of two other murders in two years.

someone, stating that someone had been choked. and police responded to the scene as well as paramedics. someone has been found dead inside this home in the 2700 block of sarah lane. now, police supervisors are here. the original medical unit that responded more than an hour ago, also remains here. they called for crime lab technicians and homicide detectives to respond to the scene. it is not clear what the circumstances were surrounding this death. and what the sex and age of the person that has died. but we'll continue to monitor the situation and keep you updated as we continue to gather information here. back to you on tv hill. >> all right, captain mike. thank you. it is a wish come true for one teen fighting cancer at johns hopkins hospital. a chance to meet one of her favorite singing stars turns into a surprise serenade, with a song written just for her. gigi barnett has that story. >> there she is. >> how are you? >> reporter: for months, 14- year-old cancer patient, brook

shockley waited for this introduction, a chance to meet singer, actor, and high school musical star, drew sealy. but this special meeting is just the beginning. ♪ [ music ] >> reporter: seem sealy serenaded brook and other cancer patients at johns hopkins hospital. it's all through a foundation called "music is medicine," a baltimore-based group that asks artists to write songs for patients. >> i get autograph requests all the time. but i don't get requests to meet a really special person and write a song for them. >> reporter: the name of brook's song is "fly" because bone cancer has stripped her ability to walk. the song may be released soon to help other children with cancer as well. >> in the song, talking how i walk and everything, just makes me want to work harder. >> reporter: he founded freedom

over in washington and hagerstown. upper 50s, low 60s. pleasant conditions. very light winds. we just went dead calm. but we haven't seen much in the way of winds today at all. today, that's where the real weather is going on. very cold temperatures from montana down to northern new mexico and out through utah and nevada. east of that region, shower activity, thundershowers. this is snow this morning in the afternoon, to nebraska. they had almost blizzard conditions with strong winds out there. anywhere from 8 to 14 inches of snow. now, east of that, the winds are generally southwest. very mild temperatures. detroit, nearly 70 degrees this afternoon. now, we're not going to get that warm. but there is a weak front across southern canada by later tomorrow. it will bring us a few clouds. then looks like it will just drop temperatures a little bit friday into the weekend. but dry weather. this low is going to head down to our south. keeps us in the mild air. then the cooler air comes in on friday for the weekend.

with details. mike? >> hello, kai. we are in west baltimore at franklin town and edmondson. this is edmond son and franklintown, where a shooting occurred a short time ago. police were called. we know that an adult male was shot here. you can see that some of the paramedics supplies that were left in the center of the roadway. that person has been transported to a local area hospital. we know only that it is an adult male at this point. and it's not clear whether this happened as a result of a robbery or anything like that. but police have completely closed edmondson avenue in franklin town in both directions. homicide are en route to the scene, conducting their investigation. but at this point, it's not clear what has happened, as far as the victim being transported. back to you. >> captain mike perry, reporting live. a major gang bust. dozens ever people are named in a federal indictment. they're accused of murders, violent robberies and drug deals around maryland.

adam may is there and has details. good evening, adam. >> federal officials believe that this new indictment puts a major dent in one of the most notorious criminal organizations. >> reporter: they operate in just about every jail and prison across america. the gang. >> this is a gang that allegedly began here in jails and prisons in maryland and now is operating on the streets and is extended beyond the state. >> reporter: now, the area's top law enforcement officials announced 22 federal indictments. charges include four murders, planning for additional murders, armed robberies and extortion. >> for many years has terrorized comurnts in maryland. -- communities in maryland. >> it has been one of the most active gangs in baltimore county. this is a significant series of arrests. >> reporter: dmi supreme

leader, allegedly ran the criminal enterprise from behind bars, using cell phones smuggled into the prison. rourke's alleged accomplices went by the names of mom, skinny boy, the fat boy. >> we believe we are to target the leaders of the gangs. >> reporter: 11 of those defendants are already locked up in prison on other charges. seven were apprehended earlier this morning. four of them remain at large. we're live downtown, adam may, wjz eyewitness news. kai? >> adam, thank you. if convicted, all of the suspects face life in prison. a man accused of killing his wife and stepson returns to maryland to face charges today. police say 45-year-old curtis lopez murdered jane and william mcquain last month in montgomery county. lopez fled where he was arrested.

and police brought him back to maryland this afternoon to face charges. fbi says four senior citizens plotted, using a deadly poison. vic is in the newsroom to explain. the men are also plotting. >> they were arrested at their homes in georgia. they dispersed the deadly ricin. also wanted to attack federal, including the irs. the fbi says the suspects are part of a right-wing militia group. at least two of them are federal employees. one of them served in the u.s. navy for years. >> the fbi has been monitoring the men since march. hemman cain becomes angry.

amidst allegations of sexual harassment in the past. >> reporter: reporters are chasing republican hopeful herman cain all over washington. >> excuse me! >> reporter: the gop front runner is trying to steer clear about more allegations of sexual harassment allegations. >> don't even bother asking me all of these questions. >> a third restaurant employee said cain behaved inappropriately towards her, when he headed the group in the 1992ints. -- 1990s. cain says he never sexually harassed anyone. >> there are factions that are trying to destroy me personally, as well as this campaign. >> reporter: cain has admitted, he knew about an agreement between the restaurant association and one of the women. so far, none of the accusers has spoken publicly. but one of their attorneys says

that should change. >> lawyer joel bennett says he does not remember the specific allegations. but his clients signed a confidentiality agreement with the trade group more than a decade ago. >> i think the national restaurant association ought to waive the confidentiality and nondisparragent positions ask let the two women, if they choose to do so, come forward ask tell their stories. >> reporter: cain is trying to stay focused on his busy schedule on capitol hill. he met with lawmakers, in search of endorsements and cash for his campaign. in washington, danielle nottingham, wjz eyewitness news. >> and so far, cain has zero endorsements from members of congress. the other republican front runner, mitt romney, has lined up 30 congressional endorsements. a new york city is fighting -- woman is fighting for her life, two days after a shopping cart is dropped onto her head. 47-year-old marian hedges is on

breathing tubes and will be in rehabilitation for months. she was struck by a shopping cart thrown by kids four stories above her in a shopping mall. the suspects are charged with juvenile assault. troubled actress lindsay lohan is going back to jail after she 5d mitts -- admits she violates probation. >> reporter: lindsay lohan is going back to jail. >> you're to serve 30 days in the county jail now. >> reporter: the 25-year-old actress admitted she violated her probation, when she got herself fired from a women's shelter. she was supposed to do her community service there for a shoplifting incident and a drunk driving case. >> the sentence i'm going to impose is known in our circles as putting the keys to the jail in the defendant's hand. >> reporter: when she's done with her jail time, the judge said lohan will have to do all of her community service at the los angeles county morgue, where she started working two weeks ago. >> reporter: because of a work commitment, lindsay lohan has a

week to turn herself in. the judge said this time, she is not eligible for house arrest but because of jail overcrowding, it is still possible she could be let out early. >> reporter: if lohan messes up again, the judge said she will have to serve the remaining 270 days of her jail sentence. >> do you accept all of these new terms and conditions and modifications? >> yes, your honor. i do. >> reporter: lindsay, we love you. >> reporter: outside the courthouse, lohan's fans showed their support. >> we want to remind her that she does still have people who are rooting for her and don't want to see her torn down. >> reporter: lohan will also have a tough new probation officer. her last one refused to work with her any more. in los angeles, karen brown, wjz eyewitness news. >> this is the fifth time lohan has been sent to jail for her drunk driving arrest. a pilot in poland is denying he's a hero, after he makes an emergency landing without wheels. he says it is a huge relief that everybody is safe after he

is forced to bring the plane down on its belly. the safe landing brings back memories of the miracle on the hudson. and the pilot of that flight, sully sullenberger, is now offering his thoughts on yesterday's crash-landing. >> it's important to have not only flying skills, but the skills necessary to analyze a situation, develop a plan, and to lead the crew in the execution of that plan. and that's what led to this good outcome. >> reporter: and the pilot in this incident said he credits the landing to his years as a glider pilot. the medical expertise of shock trauma medical center is at work in afghanistan. physician in chief thomas scallia, returned from a trip to assess the healthcare professionals get right here in baltimore. >> reporter: where shock and trauma are the norm. >> reporter: medical personnel trained at shock trauma center are on the job. >> everywhere i went, someone

would come up to me and say, you trained me. and i'm better because you guys trained me. >> reporter: and our men and women in uniform are better for it. >> you think about vietnam, the last sort of big war, that would take two or three weeks. now, it takes two or three days. and so it's a very, very different look at things. >> reporter: dr. scalia's field trips may put him in harm's way, but war is a shared battlefield. >> it was fabulous to see the il -- impact that we have had on the care of the injured soldiers. >> reporter: an impact he hopes to see continue. >> reporter: dr. scalia believes that real challenge now would be to maintain that medical expertise as america draws down its military presence. >> reporter: shock trauma, in conjunction with the air force, has trained more than 3,000 air force medical personnel. tonight, we know what killed former baltimore colts player, bubba smith.
