testimony is over. the fate of dr. conrad murray is in the hands of a jury. >> will they be able to determine who gave michael jackson the fatal dose of propofol? >> hi. i'm kai jackson. >> and i'm mary bubala. here's what people are talking about. >> the jury is out. seven men and five women are now deliberating the fate of dr. conrad murray in the michael jackson murder trial. karen brown reports for wjz in the courthouse. jurors have over 300 pieces of evidence at the testimony of 49 witnesses to consider as they deliberate the fate of dr. conrad murray. seven men and five women must decide who is responsible for michael jackson's michael michael jackson's death, his personal physician or the singer himself. prosecutors say the choice is clear. >> this is criminal negligence.

criminal, gross negligence. >> they accuse dr. murray of giving jackson too much of the anesthetic propofol, failing to properly monitor him and then waiting too long before calling 911. >> if you're going to hold dr. murray responsibility responsible -- >> the defense blames jackson for giving himself for giving the lethal dose. they say murray is only on trial because jackson was a super star. >> this is not a reality show. it's reality. >> reporter: during the six- week trial, jurors listened to an interview that dr. murray gave police, but they never heard directly if the defendant because he chose not to take the stand. some legal experts believe that can have an impact. >> the truthful answer is yes. >> wow. >> it shouldn't, but it does. so many people, and jurors, particularly, have in their mind, well, if he was innocent, he would have explained what happened. >> reporter: the judge gave jurors lengthy instructions about how to interpret the law and advised them to use their

common sense, when deciding if dr. murray is guilty or innocence of involuntary manslaughter. in los angeles, karen brown, wjz eyewitness news. >> if convicted, a judge will decide murray's sentence, which could be from probation up to four years behind bars. grisly details in the murder of a montgomery county mother and child. vic is in the newsroom with more on what being uncovered against curtis lopez. >> they say the state only has evidence. lopez is charged in the death of mcquain. he will will also likely be charged in the death of her 11- year-old son. police say lopez beat 11-year- old woman in the head with a baseball bat and left him in a field. the montgomery county state's attorney's office said it was all about mcquain's car. >> he had, in fact, stolen her car and had given it to his newest girlfriend in north carolina.

>> police say lopez took pictures of the car before and after the murder. >> lopez is being held in jail without bond. city police get a break in the most recent shooting at a baltimore carryout. 73-year-old markel jones is charged in the halloween night shooting inside yao's in waverly, getting dinner. this is the fourth murder at yao's in the past three years. is he careless or corrupt? a jury is deliberating the fate of powerful maryland senator ulysses currie right now. weijia jiang has more from inside the federal courthouse. >> reporter: state senator ulysses currie now lies in the hands of the jury, who deliberates whether the 74-year- old sold his power. fbi agents, armed with search

warrants, raided the prince george's county home and the shoppers food warehouse. >> they went through the house, room by room, and grabbed my boxes. >> reporter: the former chair of the powerful budget and taxation committee is accused of taking bribes from shoppers for $245,000, including a deal lowering rent at mondawmin mall other allowing the company to transfer a liquor license, installing traffic lights near the stores and attempting to get millions of dollars in money that would have benefited shoppers. currie said he simply didn't remember to disclose his consultant position in state ethics forms. someone who knows him said he is an honest but disorganized man. the prosecutors said this is not a mistake, this is intentionally concealing. >> he is charged with --

bribery. if convicted on all of the charges, he faces more than 30 years of prison time. at the courthouse in baltimore, weijia jiang, wjz eyewitness news. >> wjz is closely monitoring the deliberations. and we'll have more live updates, coming up new at 5:00 and 6:00. controversial decision. perry hall high school's principal has a change of heart regarding this decision to forfeit the school's soccer championship game. monique griego has more on the decision. >> reporter: just hours ago, principal george roberts announced he has a decision ending the soccer team season. they were the underdogs in the matchup against the delaney lions. in the game's final seconds, perry hall pulled out a win. a few players celebrated by doing the burney dadges. some thought the gestures were lewd and put pressure on roberts to pressure the

>> hi, mary. hi, everyone. the delays are still beginning to build. and they're getting pretty heavy already. if they're travel being west side inner loop, heavy there. at least 20 minutes to get through. as far as the west side outer loop goes, heavy there from stevenson road to baltimore national pike. another 15 to get by. over on the top side outer loop, sluggish there from providence road to charles street. average speed, about 35 miles an hour. and 70 eastbound, we have an accident that is lingering there on the right shoulder. as far as 70 westbound goes, still jammed up pretty bad there 29 to marriottsville road. and we have congestion to the beltway. as far as accidents go, one new one to update you on. and looking at our travel times, 83 to 95. 37 miles an hour, and 17 minutes to get through. let's now take a live look. that is a look at the beltway

criminals tried to take a plane to get away.

but they take drastic action. the car is getting closer to closer to that plane. in a tip, police say they were racing to stop it from taking off. because suspects were smuggling electronics on it. >> this looks like typewriters. >> yeah. an accident investigation in kentucky after a school bus overturns. the tractor-trailer driver said he lost control. 16 students and four teachers were on board the bus. back here, an opening for baltimore's youngest learners. a new classroom that will help an entire school. it's not just another day at hampstead hill academy.

the 40-plus pre-k students now have a brand-new place to learn. 4-year-old elijah loves this new space. his mom said it is a cramped environment. >> it's a great working environment. it's bright. they have a lot of room. and i just think it will be a great addition to the school. >> reporter: these two new classrooms have freed up space in the main building where now fifth, sixth and 7th graders are utilizing the two extra rooms. the mayor and city ceo, dr. andres alonzo took a tour of the $1.2 million facility, paid for by about six years of saving by the charter school. >> more and more research shows that the importance of early childhood education, especially prekindergarten. >> hoping to point these young learners down the path. >> pre-k is the start of years to come. >> reporter: andrea fujii, wjz

the pride of baltimore. how beautiful that is tonight. >> wonderful. and coming back from a good will mission to canada, the great lakes, and the east coast. now it's back. i guess you saw one of the tugs spowtsing the water. that's a wonderful welcome home for the pride and the crew. welcome back. >> really a gorgeous day to have that happen. >> almost picture postcard perfect. >> it really is. >> the blue waters. and of course, the blue water, reflecting the blue skies am it's a gorgeous day to be out there. if you're watching the pride come in, i would imagine you'll be able to go down and view it up close and personal in the harbor, good place to be this weekend. weather is going to be very, very nice. and we wantedded to remind you, had an extra hour to do all of that. standard time resumes on sunday at 2:00 a.m. before you go to bed on saturday night, set your clock back one hour. if not, you'll just be an hour early for everything you want to do on sunday morning. and again, just reminding you to, of course, change the batteries in your smoke detectors and all of your

cooler than average. it is a light breeze to make for a nice autumn evening. the low pressure along with the front associated with it, was poised to move across from yesterday. the low actually took a dive down to our south, carrying all of that moisture with it. it went down to the carolinas and, you are still seeing a bit of that rotation. what we have been dealing with is the cloud cover associated with it. but now that the high is moving in and bringing in dryer air. we're starting to see more and more of that cloud cover break. the sun coming through. we're still seeing the temperatures coming through. this is going to be the case for tomorrow. as we move into the rest of this weekend, very mild air starts to really overrun the mid-atlantic, so that mild air brings us back up to temperatures, right at or above normal for the next several days. so the cooler air starts to move on out of here. pleasant mild conditions stay with us. sunshine, blue skies, right on through the next five days. it's just going to be a really nice stretch of november weather. sun sets today at 6:02.

hijacked. but the good news is, we can take it back. >> reporter: cain has spent most of the week, answering allegations about sexual harassment during his days at the restaurant association. so far, cain's fight to fend off the allegations doesn't seem to be hurting his campaign. the latest washington post abc poll shows cain and mitt romney nearly tied at the top of the republican field. >> reporter: cain insists he never sexually harassed anyone. he is blaming rivals for attacking his character because of his unexpected success. >> reporter: for now, republican voters in iowa seem willing to give cain the benefit of the doubt. >> in politics, i do wonder if it's true or something someone is trying to do to knock down the leading candidate. >> from everyone i talked to,

it's kind of a small issue. it wasn't something that was that pertinent or that important. >> reporter: cain's campaign said it is moving on and credits the media frenzy for giving them a financial boost. a spokesman says they raised more than $1.2 million since the story broke. in washington, danielle nottingham, wjz eyewitness news. >> and minutes ago, one of the women accusing cain alleges he committed, quote, a series of inappropriate behaviors. we'll have more on the alleged victim breaking her silence coming up at 6:00. gabrielle giffords. kai has more on that new book and the shedding light on her recovery. >> the memoir called gabby, a story of courage and hope, was written by giffords' husband. but she delivers the final chapter. in that, she says she will get stronger and return to

congress. she goes on to recall the day she was shot, saying she was shocked and scared. the book also goes on to describe the six others killed during the shooting spree. >> the book hits store shelves november 15th. shot by police. a man wounded by a baltimore sheriff's deputy is in critical condition. the deputy said he shot 36-year- old john doherty in the arm when he tried to attack him with a knife inside his police cruiser. the incident happened last friday. doudry's mother says her son is on life support and that his brain is swollen. the deputy is on administrative leave while the shooting is investigated. an investigation continues tonight after a fatal fire rips through a garage in northwest baltimore. the fire started behind a vacant home. relatives say alvin whitehead was the only victim. investigators are still trying to determine how the fire started. >> police in ohio claim they had good reason to shoot and

kill dozens of exotic animals last month. mary is live in the newsroom with more. >> reporter: according to a new report, lions and bears came charging at the deputies, crashing through fences and leaving them with little choice. the officers were forced to kill 48 wild animals other including some that are on the endangered species list, after their owner opened their cages and took his own life. deputies say they saw the man's body, but wouldn't get too close by because the tiger was protecting that body. they say their main concern was protecting the public. >> the man was having marital problems and also owed money to the irs. washing ashore north of the bay bridge. watermen are finding mostly dead oysters. and recent tropical weather may be to blame. >> boats tied up and watermen on shore for lunch are not good

signs. but these men in rock hall are here. because they aren't finding live oysters in the northern part of the bay. >> i'd be doing it now. >> got eight or nine oysters in it and all of them are dead. if not all of them, there will just be one of them in there. >> and the reason? they go back to runoff from tropical storm irene and hurricane lee. it replaced the brackish water oysters need to survive with fresh water. >> then comes along these two hurricanes that dumps all of this fresh water in. ask they can't live in fresh water. so they killed all our oysters in the bay. >> i was here when we had agnes. we were able to oyster through agnes. but we can't oyster through this. and if catching up to recover expenses is unlikely. >> maybe getting all the way down the bay or the stand -- last stand of oysters maybe. >> they're not making money,

be checked. damages from "occupy oakland" riots are costing the state of california. crews had to repair broken windows and walls. demonstrators set fire and fired bottles. about 80 people were arrested. officials were cleaning up and working to prevent more violence. justice for phone hacking victims. head of news of the world paper robert murdoch is starting a compensation plan. monique griego is in the newsroom with more. >> british police have identified almost 6,000 potential victims of hacking by potential judicialist -- journalists. the plan will help victims pay for court fees and other damages. murdoch was forced to close the paper in july when news broke that journalist his routinely hacked cell phone voice mails. and the list of people

hacked includes celebrities, politicians and stars. a texas judge captured on video beating his daughter will not be going to jail. a district judge said the statute of limitations has passed. adam's daughter hillary videotaped the beating in 2004 when she was 16. she revealed the violence in an eight-minute you tube clip last week. adam's wife has divorced him and said he brainwashed her. >> he would force me to do things. so when i'm out of the room, he's talking to me, saying things, telling me to go do things. and i was just very pressured. i act very zombie like. >> the judge has dealt with over 300 family law cases in the past year alone. adams will no longer hear cases related to child abuse for at least the next three weeks. jacqueline policastro

reports for wjz in indianapolis. >> reporter: wearing handcuffs and orange jail clothes, his long dark ponytail, sniped off. >> all i got to say is i'm sorry. judge i didn't mean to hurt anyone. >> reporter: a much different look from the look caught on camera. a 42-year-old robert brennerman was captured wearing a child's pink bikini. police say he changed into several little girl's swimsuits before changing into his own clothes and leaving. >> it wasn't children's swim suit. >> what was it? >> he said he brought the swim suit with him. he's now charged with criminal trespassing and for resisting law enforcement, after police had to chase him down. >> i have a fetish for women's clothing. >> reporter: while he admitted he likes to wear women's clothes, he's not unfamiliar with this jail garb either. he's a registered sex offender, committed burglary and just got
