get out. new york city where the movement began. protestors vow to come back and take their right to protest to court. >> hi, everybody. i'm mary bubala. >> i'm kai jackson. here's what people are talking about. >> face-off in new york city, the nypd raids the occupy wall street movement. randall pinkston reports on what happens next. >> reporter: occupy wall street protestors lined the street outside the park, waiting for police to let them back in. >> reporter: these guys -- >> these guys are getting paid to be here. and they're going to run out of money before we run out of faith. >> if you refuse to leave the park, you'll be subject to arrest. >> reporter: new york city police evict demonstrators overnight to clear the park. promising to let them re-enter,

but without tents and sleeping bags. police arrested about 300 protestors who refused to leave. >> unfortunately, the park was coming to be a place where people came, not to protest, but to break laws and in some cases, to harm others. >> reporter: police moved in after midnight, with almost no warning. mayor bloomberg said the raid was timed to minimize disruption to the neighborhood. >> i think it's unnecessarily provocative. >> but residents claimed it hurt business. and the crowds and noise frustrated residents! i don't think they have the right to take over someone else's property. >> reporter: demonstrators say their fight against corporate greed and economic inquality will go on. they are planning a demonstration thursday to mark the two-month anniversary of the "occupy wall street" movement.

both the city and demonstrators are waiting for the outcome of the court hearing that will determine if the eviction from the park was legal. >> courage and recovery. arizona congresswoman gabrielle giffords sits down for her first extended interview. giffords is in the newsroom with what giffords is saying about the shooting. >> giffords struggled for word. this is gabrielle giffords's first appearance. giffords and her husband spoke to diane sawyer. many times, giffords would gesture to her husband, to help her forge the words. >> angry at what happened to you? >> no. no. no. no. life. life. >> giffords said she will not return to congress until she is better. her husband, mark kelly, says he has no interest in taking over her congressional seat. kai, back to you. >> vic, thank you.

about a dozen survivors and family members are in washington, lobbying for tougher gun laws. former pen state -- penn state coach jerry sandusky is speaking out about charges he abused boys. he is maintaining his innocence. >> reporter: jerry sandusky denies he abused any young boy. in a telephone interview with bob costas for rock center, sandusky refutes the allegations. >> i say that i am innocent of those charges. >> are you a pedophile? >> no. >> reporter: sandusky was charged last week with 40 counts of sexiumly a-- sexually abusing eight boys he met through his charity program, the second mile, a program for at-risk youth. allegations. >> i have horsed around with kids. i have showered after workouts. i have hugged them.

and i have touched their leg, without intent of sexual contact. >> reporter: the president of second mile, jack ra covits, resigned monday, in an effort to restore what he calls faith in the organization. >> we do know that pedophiles don't become pedophiles at age 50. i think so a lot -- i think a lot more will come out about mr. sandusky. but that doesn't mean the board knew anything about it. >> reporter: there is criticism on many levels as to why charges against sandusky weren't brought sooner. >> it takes a while to develop a case. the people should be sure that we tried to move that case as quickly as we possibly could. >> reporter: late monday issue the new york times reported close to 10 additional victims have come forward. sandra hughes, wjz eyewitness news. >> and the big 10 has taken joe paterno's name off the trophy it will award on december 3rd. it will now be called the stag

championship trophy. a suspect identified. anne arundel county police need your help to find a man wanted for murder. this is 24-year-old corneilious johnson. police say he shot and killed andrew johnson outside of mo's seafood in glen burnie. the two are not related. anyone with information is asked to call metro driem stoppers -- crimestoppers at 1- 876 -- 866-7-lockup. during a major raid in south baltimore, someone was hurt. mike hellgren has a look at the chaos. >> reporter: we don't yet have specifics on the operation. but we can tell you this on the ground unit targets the most dangerous, most offensive violators. >> reporter: this shows a frightening frightening moment during an atf raid. people ran, after hearing gunshots. then a ford explorer careened

into another suv. seconds later, it ran into a sign. >> it was chaotic. everybody was running. and we all was getting down. sky eye chopper 13 shows you the aftermath. the feds made several arrests. the injured agent is expected to fully recover. sky eye chopper 13 shows the size of the separation. dozens of officers swarmed the storage unit. >> i have heard the gunshots. and it was in nigh parking lot. going back to that complows exclusive home video, you can see snipers stationed on top of buildings. the atf's violent crime impacted the raids. it was established in 2004 and targets the worst of the worst offenders, aiming to reduce gun violence. wjz has learned it is not just in operation here but closer to

the coast. rarely does it see it go down like many on patapsco avenue did last night. mike hellgren, wjz eyewitness news. >> new at 5:00, why this involved atf agents from across the country and new eyewitness news gives his account on the frightening scene. >> guilty of arson. a man who worked at a west baltimore tire store admits to burning it down. 35-year-old jason hicks says he sent this september 26th fire at belvedere tires. the fire could be seen for miles around the city and burned for days. hicks was flicking a lighter near a paint brush, saturated with gasoline when a spark ignited the flames. hicks was sentenced to 10 years in prison with all but time suspended. he must serve 100 hours of community service. and toward the hopkins baby burn unit. >> the election robotrial today when a judge recuses himself in

the case. julius hensen. the call suggested that voting was over. hensen was paid by the ehrlich campaign. but prosecutors say the former governor was not aware and did not approve of the robocalls. a new trial was set for february. we're enjoying october temperatures here in november. outside, it's mild and cloudy. there is rain on the way. bob turk is here with the updated numbers. >> not quite as warm as yesterday. but still well above normal. take a look at radar. shower activity, primarily to the north and west. we've had a couple of sprinkles north and west. but later tonight, this batch over west virginia, looks like it will head across our region. and we are looking for a wet overnight. and looks like a pretty moist but still rather mild wednesday. before it dries out, it will get dryer and cooler. it's going to get quite chilly

at least until the end of the week. >> checking in on our roads now. here's wjz traffic control. >> hi, mary, hi, everyone. traveling on the top side inner loop. we're looking at about 15 minutes there from the harrisburg expressway toular ford road. average speed at this point. frederick road to security boulevard. and several accidents to report as well. 70 westbound at 29. also, an accident on the south side of the inner loop. that one on richie highway. and southbound on the jones falls expressway at the beltway, we have a struck deer on the shoulder there, attracting plenty of attention and really starting to build a backup in that direction. as far as harford county goes, two accidents in that region. westbound 24 at pulaski highway, all lanes blocked. and we have a second accident in the havre de grace area,

a bumpy morning, yet all of the markets did post gains. the dow was down 17. s&p up 6. nasdaq 29. let's go to new york, where alexis christoforous has tonight's money watch. >> reporter: americans are giving a modest lift to the economy. they spent more to boost retail sales for the fifth straight month. the games are encouraging as we head into the crucial holiday shopping season. shares of wal-mart fell after a surprise drop after quarterly earnings. and sales at staples fell short of expectations. they also cut the earnings forecast. home depot profits. consumer reports spent a little more on this. home depot also raised its profit outlook for the year and its shareholders dividends. kindle full-colored touch-

warm. 67 this afternoon. not as warm as yesterday's 74. but hey. it is the middle of november, friends. and this time of the your, we can have all kinds of weather, you know. let's take a quick look at radar. there's some shower activity. but it's primarily north of the region. and right now, it's not really moving toward maryland. it's moving across southern p.a. it may touch a little bit of washington county, looks like. but for the most part, we'll probably stay mainly dry, just a few comments. a few sprinkles tonight.

that's when the rain should be moving back into the region. 64 degrees right now. still way above our normal high. it's 57. not all that moisture. humidity is 67%. south winds at 7. kept that warm air in for today. barometer just beginning to fall. 29.91 inches. out to the west, a lot schooler. they have had some rain and a bit of a wind shift out there to the northwest. 46 oakland. 59 cumberland. 59. 64, 64, and 64 and 68. temps today, were in the 70s. around their local area. low 60 to the mid-60s. annapolis and kent island coming in at 66 degrees. southerly winds primarily once again. late tonight into tomorrow. they're going to turn around more to the north and northwest. and that will eventually cool things down. and by -- really by thursday afternoon, it will be pretty chilly in the area. a lot of rain. you can see it from north texas, where they need the

rain. all the way up toward the east coast. maine toward the stalled frontal boundary. eventually, this is going to slide by. will take the rain with it. we'll see rain later tomorrow. and tomorrow night, the rain begins to head out and behind it, drier -- dryer and chilly air for thursday. and the end of the week. the good news is, it's not going to last. i guess, good news. if you like mild temperatures. cool air moves in for thursday and friday. but by the weekend, the same cool high pressure is going to move off the coast. winds go back to the southwest and a warmup again for the weekend. this is the third weekend in a row. that should be dryer and milder. north winds only around 5 knots. and a small craft advisory will be going into effect late wednesday night. sunrise, 6:51. sets 4:52. tonight, then, cloudy skies. it will be mild, 51 tomorrow. yeah, we'll see some rain activity. and it could be heavy in some spots. but turning cooler late, late

27%, followed by ron paul, mitt romney, and newt gingrich. cain hit the campaign trail in iowa, fighting to hold onto a small lead there. he's also trying to move past his shaky response to a reporter's question about libya monday. >> okay, libya. [ silence ] >> reporter: his popularity has already taken a hit from sexual harassment allegations that surfaced a couple of weeks ago. >> reporter: cain's campaign troubles are goodinize for his republican rivals. and the latest national survey, newt gingrich has pulled into second place behind mitt romney, who has reclaimed his front runner status. >> reporter: the former massachusetts governor was in columbia, south carolina tuesday, focusing his attacks on president obama. >> he said that americans are lazy. i don't think that describes america. >> reporter: but the gop race is still wide open in the first

state to vote. bloomberg's iowa survey found six out of 10 voters polled could be talked into changing their minds. >> reporter: in washington, danielle nottingham, wjz eyewitness news. >> another poll released tuesday could spell trouble for herman cain. it shows nearly three-quarters of women nationwide now call the harassment charges against the candidate serious. now to julian assange as he tries to avoid extradition to sweden. >> reporter: assange's attorney has filed a request to have his case heard by london's high court. assange has been on house arrest in britain. he is wanted for questioning in a rape case. assange has denied any wrongdoing. if the court rejects his request, he could be extradited in two weeks. they are demanding that he return to scandinavia to face questioning. wikileaks has been forced

johnson faces up to 20 years for each of two counts. the u.s. navy is denouncing a book claiming to describe the covert raid taking down osama bin laden. navy official say -- officials say the man who wrote the book never spoke to any of the seals who took down osama bin laden in afghanistan. the author, chuck farrar, insists his story is actual. maryland's top lawmaker is preparing for another international trade mission in asia. governor martin o'malley is in india. it is the largest trade mission by a governor in maryland history. back in june, governor o'malley visited china, south korea and vietnam. transportation officials are delivering a warning to anybody, thinking about bringing wrapped presents onto flights. for the first time, the tsa officials say the agents will start opening and searching wrapped christmas presents. agents say any bags or box are

subject to search. that includes presents. they have good reason to be cautious. last week, tsa agents in los angeles arrested a man who allegedly tried to smuggle 35 pounds of marijuana on board a plane, described as a christmas gift. although the searches are on a case-by-case basis, tsa is advising flyers to wrap the presents after you've landed. it's unclear if the rule change will stay in effect in the years to come. in tonight's pump watch. cinding -- sending oil prices back up today. oil prices climbed back up. amid news that spending increased. so far, the spike has not translated to bigger prices at the pump. so how much are you paying in our area? the average price for a gallon of regular, $3.36. that's actually down 2 cents from a month ago. but last year at this time, you only had to pay $2.36. it is an overcast day. cloudy conditions on a mild

classes continue in a north carolina college, while a gunman runs free. police are still searching the campus of university of north carolina wilmington. they're looking for an armed man who robbed four people nearby. they believe the suspect is now

out of the area; well, the texas judge caught beating his daughter on camera, is now facing other problems. his ex-wife is filing a restraining order on him, and that is preventing him from visiting his 10-year-old daughter. it also says the judge cannot drink alcohol within 24 hours from seeing his daughter, if granted permission. the video showed the judge violent lashing the teen. a search for a missing 2- year-old toddler. monique griego. >> reporter: turns out the mother plairve listed on an online site. this discovery comes in the middle of the search for her son. she claims she left the 2-year- old alone in her car to get gas. but when she returned, he was gone. now, police have since found that the car was still able to drive the distance, making that statement suspicious.

vic? >> thank you, monique. the child's mother is refusing to take a polygraph test because she says she is too distraught. a record-breaking skier and stunt man dies in a utah avalanche. take a look at this video, that captures jamie pierre, performing some of his riskiest moves. he is famously known for jumping off a 225-foot cliff. pierre died when an avalanche dumped him off. in august, this small plane crashed right in the middle of a california home. and for the first time, we have a look at recordings and video in the crash. serene branson reports. >> my air speed indicator doesn't seem to be working here. i need to go around and land. >> reporter: you're hearing this pilot. moments before his cessna went nose-first into a santa monica home. >> you're okay, man. you're almost there. >> this shows good samaritans, pulling him from the burning plane.

now from the tower tapes obtained by cbs news, you could hear what led up to the crash. >> you need further assistance? is everything okay? >> just my air speed indicator doesn't seem to be working here. >> reporter: the student pilot took off august 29th, when he encountered trouble. tower controllers tried to help him land. >> we're calling the equipment immediately. >> should we go to the app? >> hold that there. we have progress. >> witnesses pulled him from the plane, even before he was identified. he only suffered a broken leg, even after the cockpit collapsed. >> unit 3, you can see him from the tower. just south of departure from the runway. >> assistance. going out of bounds or something. >> that's it. we have emergency personnel. >> the pilot was a student with

40 hours of flying experience that was attempting to fly to santa barbara when the plane crashed. >> reporter: a california man thought he was getting a good deal for a used minivan. turns out. turns out it was loaded. cocaine, stacked in the body panel. one of the packages owned. >> he said he was numb. i went numb. we both stared at each other for a long time. >> the van was impounded by police, where they found seven kilos, at each door. police believed the van was used by smugglers before it was sold. a texas school is using a technology that has been likened to cloning teachers. helping students in the same classroom, learn at different rates. jason wheeler explains how it works. >> reporter: over the years, computers have increasingly written good old pen and paper

out of the equation. but now they're back and better than ever. >> the pen is actually picking up what i'm writing. and it's also recording my voice. >> reporter: teachers at aisd's pleasant hill elementary have been using this smart pen, which when used with special paper, can record a teacher's instructions, step-by-step, word for word. if a student is absent or just absent-minded during class and needs a refresher later, the teacher is right there, at their fingertips. >> an example is end. -- >> reporter: not only can pupils hear the professor, verbatim, they can even hear their own voice notes. so they can jog their memory later or remember to ask the teacher for help. >> the technology is engaging students in a way you would not believe. >> reporter: pleasant hill was one of the first local schools schools to engage this new gadget, which the principal

says is particularly important for this student population. >> i think it's awesome. it's going to level the playing field. we only have about 19% of our families with computers at home. i feel like we have to do this. i take it really, really seriously. >> reporter: so far, the high- toke helpers are being employed by 14 pleasant hill employees. they are helping kids with everything from math to english. >> reporter: the school is still studying the full benefits. but administrators say that they are sure that these devices are helping them connect with students in a way they hadn't before. >> they're learning things in a different way. >> and the school is now using the pen for adults as well. conducting faculty training with the technology. representatives of the live scribe pen said they expect to see it in more schools in the near future. prized jewels of hollywood icon elizabeth taylor are being displayed. auctioneers are trying to build

excitement before a huge sale next month. taylor died of heart failure in march and is known for her love of jewelry. black friday deals seem to be coming out earlier every year. now, there's a campaign to change that. target is taking the lead from other retailers, and it's opening on thanksgiving night. one employee in nebraska says bringing workers in earlier on a holiday isn't fair. he started a petition. and now has 80,000 signatures. target says opening at midnight the night of thanksgiving, will make black friday shopping easier for customers. imagine studying in your college dorm room and calling room service or housekeeping. hundreds of college students in california will soon be able to do that. the university of pacific is turning three-star hotel rooms into high-class dorms. the rooms come complete with new furniture and even flat- screen tvs. >> see? >> no, no, no. >> they're supposed to suffer. >> viewtle. -- absolutely. suffering is a virtue.

later tonight, to the west of us, 46. 70s today in virginia. and south of the region with more sunshine. 63, rock hall. the mildest area, kent island and annapolis. our normal high is 57. our normal low is now 37. just to keep things in perspective. the record high, 79. 1993. 19degrees in 1986. what a range here in mid- november. southerly winds right now. that will keep us in the mild air tonight. this frontal system that is kind of lined up from oklahoma up toward northern new england, has shower activity along as you can see, further west, where it's cold. a little light snow in the dakotas. and portions of northern wyoming. here in the east. frontal system, kind of laying across the mid-atlantic. slowly but surely, it's going to sink a little further to the south. and that rain activity will kind of ride along that front. and that's why we expect that
