talking about or asking questions about today, breaking news. there could be an end in sight for the occupy wall street protesters here in this city. wjz has just learned the city has denied the request for a permit to remain in the square through april, although it is not clear if the city plans to take action to move them out soon. it is a far different story in los angeles, where police cracked down on proterses overnight. here is the latest. >> reporter: crews are putting concrete barriers and chain- link fences around city hall park in los angeles, where antiwall street protesters camped to nearly two months. police officers raided the camp overnight and cleared out demonstrators. there were a few isolated scuffles but officials say the operation was mostly peaceful. police arrested about 200 people who refused to leave.

some protesters linked their arms in defiance. police even used a cherry picker to get protesters down from a tree. >> in my life i have never seen a more professional restrained police force. >> reporter: the park will be closed until it is cleaned up but the mayor says they will be able to exercise their first amendment right on the steps of city hall. crews are sorting through the rubble and debris. officials were concerned that demonstrators may have left hazardous materials behind, no drugs or weapons were found. they were expected to hold a rally today. police in philadelphia also moved in on occupy protesters clearing out their camp outside city hall and making 50 arrests. >> he is free to leave but it is still unclear where he is

going. gary giordano, the man jailed in aruba in connection with the presumed death of a woman heads back to the u.s. today. he was released lallsth night after being held for more than 100 days. a judge ruled authorities do not have enough evidence to continue holding him in the disappearance of robyn gardner, prosecutors have appealed and expect a ruling today. his lawyers say he is going to miami, new york, or back home to montgomery county. >> here the prosecution continues to build its case against one of the men involved in former governor bob urlich's campaign. wjz and derek valcourt are live outside the courthouse. good afternoon. >> reporter: hi,don. the prosecutor's office says those calls were an attempt at voter suppression, the defense says they were using reverse psychology and those calls were not illegal. prosecutors told jurors the election night robo calls speaks for itself. an attempt to trick 112,000

democrats into thinking democratic governor martin o'malley had already won re- election and there was no need to go vote. >> relax, everything is fine. the only thing left is to watch on tv. >> reporter: the robo call did not contain the disclosure of who authorized the call and prosecutors say that is because the campaign manager wanted it that way, so that urlich could win the election by suppressing african american turnout. >> there is nothing wrong with it. >> he said they were reverse psychology intended to inspire african americans to rush out and vote for bob urlich before the polls closed. he blamed the campaign consultant for the idea and said it was henson's fault the call never mentioned who it came from. >> so the only thing that you have is a campaign manager accepting the recommendation of a consultant, who is contract to make those decisions and

saying if you believe this will help us go ahead. >> on the stand all morning long has been rhonda russell, she is an employee of julia henson and is the whom whose voice you hear in that robo call. she says it was her fault the calls only went to democrats and not independents and republicans and she says those calls were intended to be her words, counter intuitive. >> the call was literally meant to simulate voters that would not have been in support of o'malley or the democratic administration, that this would stimulate the voters to say, my vote is going for urlich, i am going to vote for him after i heard this call, so this is the motivation of counter

intiewtivity. >> the prosecution expected to wrap up today. >> we will have an update later today. >> detectives are investigating a shooting death in baltimore last night near wilkins avenue. our partner reports an adult male was shot in the head and later died. no arrests have been made. a murder suspect missouri mistakenly released earlier was arrested again. he was held on a no bond status but an error led to his release. he is now held on half a million dollars bond. >> the first lawsuit has been filed in connection with the child sex abuse allegations against jerry sandusky. mary bubala is live with the details. good afternoon. >> reporter: good afternoon. disturbing claims from the man who says the coach abused him more than 100 times. he says he met sandusky when he

was just 10 years old and he was abused in a penn state locker room on trips to philadelphia and a bowl game and at the sandusky home. the alleged victim says he met the coach through the second mile charity that sandusky ran. penn state and the second mile charity are also named as defendants in the lawsuit. the man identified as john doe in the lawsuit is not among the eight victims mentioned in a grand jury report, don. >> thank you mary. sandusky is charged with abusing eight boys during a stretch of 15 years. >> the local truck irresponsible for leaking asphalt along 40 miles of the pennsylvania turnpike is being ticketed. our partner the sun reports george delaney was cited for failing to secure the load and failing to obey a state trooper. the leak disrupted holiday traffic and ruined more than 100 cars. the trucking company's insurer is paying out claims. well it wasn't tar but bad weather this morning that

caused slippery conditions in ohio. this highway just shout of toledo turned into a skating rink after a day of rain then snow overnight. a thin coat of ice caught drivers offguard, causing problems for their morning commute. nothing that bad here today thank goodness but you will notice a change when you step outside. let's take a live look outside. cloudy skies out there. don't forget your coat. the temperature has taken a dive from yesterday. meteorologist tim williams is standing by in the first warning weather center with a look at what is in store for us hello. >> hello, good afternoon everyone. you will notice that temperature change. we are down just around 10 degrees or so, a little more actually in some parts of the area than yesterday. right now 48 there, 50 down at the river, 49 elkton and 30 is the cold spot in oakland. the dew point is 31, not very moist out there. drying out nicely from the rain that moved through yesterday. high pressure is moving in to the region. with that high at least on the front edge is going to bring in

here pushing against the high pressure trying to build in, the wind between those two systems is creating this pressure so the winds are gusty through this afternoon but they will subside. it will be a breezy evening and we will eventually see these winds continuing from the west and southwest but tapping into milder air as that high starts to really grip hold of our forecast. what we are dealing with now, that front came through, dropped the temperatures about 10 degrees on average across most of the area but it is still a very large low pressure system and you can see the rotation here still tapping into a little moisture, some from the great lakes, some from the south, that is the cloud cover cast into our region. so the temperatures have taken a hit. we are not getting a lot of sun, cool air in place. as the high moves off it will allow for milder air to move in, that is going to bring our temperatures up heading into the weekend. sunset is at 4:43, small craft advisory in effect through tomorrow afternoon. today up around 53. we will see a rise in the temperature and some sun.

in today's health watch report 1-5 people with hiv do not know they do according to a new report. they say among patients who are aware they are infected only half receive care so the experts say better testing and access to care are essential to slowing a still growing epidemic. women with elevated blood sugar levels may have an increased risk of cancer. they followed 5000 women for more than 10 years and found patients with the highest glucose levels were twice as likely to develop cancer. they say more studies are needed to figure out how they are connected but they believe high blood sugar may fuel the growth of cancer polyps in the colon. >> be sure to check in with us today at 4:00, 5:00 and 6:00. army based shooting rampage. could the suspect in the fort
