state. but in the end, her testimony may havedded -- have ended up helping the defense. over and over, she said how those robocalls were not intended to suppress voter turnout. >> i would call it countintuitivity. >> reporter: in robocalls from republican campaign bob ehrlich, to 120,000 registered democrats. the call told voters governor o'malley had won re-election before the polls closed. >> we're okay. relax. everything is fine. the only thing left is to watch it on tv tonight. >> reporter: prosecutors argue the robocall was illegal because it was meant to keep democrats from voting. they blame ehrlich's campaign manager julius henson. but on the stand, she said the robocalls were meant to be repsychology.

>> this was to say, my vote is for ehrlich. he's down and out. i'm going to go out and vote for ehrlich. >> she said it was her fault it went to registered democrats, not republicans. saying she used phone lists she already had, rather than generating new lists of republicans. >> i used lists of previous clients because i was being lazy. it wasn't out of anyone asking. it was my decision to use the list. >> reporter: late tonight, the state rested its case. the defense begins its case tomorrow. they have a list of some 30 witnesses. among them, they are expected to call former governor bob ehrlich, and former congressman elijah cummings. and campaign consultant julius henson is scheduled to go on trial february 6th. new allegations in the case of jerry sandusky. now, one of his alleged victims

is fighting back. andre fujii has more. >> reporter: the man says sandusky abused him more than 100 times, starting when he was just 10 years old. now he has filed a lawsuit against sandusky, penn state and the charity, second mile. the unidentified accuser says he met sandusky through the second mile. and after the abuse began, sandusky threatened to harm his family if he told anyone. the man also said penn state is to blame for sandusky's crime. >> it is against penn state. that is the iconic institution in which sandusky not only thrived and prospered. but through which he accessed so many youth. >> the accuser, now 29 years old. vic, back to you.

>> sandusky was charged with sexually abusing eight underaged boys. although he admits showering with them, he denies molesting them. a maryland man accused in the disappearance of a frederick woman is back. but not back in maryland. gary giordano owns a house. mike hellgren explains why it is in new york. >> gary giordano. says his client simply asked for it. >> gary giordano is out of jail in aruba, but not out of trouble. police on the island continue to investigate whether he played a role in the disappearance of robyn gardner and is now believed dead. both from maryland. a judge said he will soon be back home. he took the first morning

flight to the u.s. >> it's crazy. who would think in our neighborhood, there would be an international story unfolding. >> reporter: wendy, his neighbor, finds this a mystery. >> it's scary. and to know that's going on in your neighborhood is unsettling. >> reporter: giordano's lawyer says his client just wants to get home and spend sometime with his kids. >> reporter: aruba's top prosecutor doesn't buy giordano's story that gardner drowned while snorkeling. and cited the past that several women made that he was violent and secretly videotaped him as evidence he should stay in jail. >> we know what he told us about the moment the incident happened. his description of the situation is not in accordance with reality. >> reporter: the fbi raided giordano's home in august in an investigation that is also ongoing. >> i don't think that the

aruban authorities can manage the case. >> reporter: prosecutors appeal giordano's release. but a panel of judges upheld it in aruba. reporting from gaithersburg, mike hellgren, wjz eyewitness news. >> reporter: and gardner's family issued a statement on the release, saying they are disappointed, but they remain confident the truth will come out. the so-called blond bandit is behind bars. 23-year-old stephanie schwab is wanted for several robberies. police say officers followed schwab's car, after she robbed a bank in fair fax county. she eventually crashed and was arrested. time may be running out for the occupy wall street protestors camped out at mceldon square. baltimore may soon join other cities forcing them out. their latest permit request has been shut down. >> reporter: yes, vic. occupy camps all across the country are being cleared out this week. but baltimore still stands. there appears to be a new

warning shot fired from the mayor's office. >> reporter: city officials deny the occupy baltimore group a permit to stay in mceldon square. >> i am a little skeptical about the rejection. >> reporter: protestors now left wondering if baltimore will fall next. occupy camps in philadelphia and los angeles were cleared out this week. workers wore hazmat suits, concerned about health dangers. for weeks, baltimore's mayor has kept eviction an option. >> we continue to inform them, routinely, that camping is prohibited. and with hopes that we'll have some resolution to that particular issue. >> reporter: there is no question, baltimore's tent city is dirty. >> you can see there's -- i would say, a certain sanitation problems. but sometimes, you know, freedom is messy. >> reporter: rosalyn ellis heed lives in a luxury high-rise, just a few blocks from the camp. >> and you support it? >> i certainly do. absolutely. >> why? what do you support. >> i support people being able to go out and express their

outrage at what is going on in this country. >> reporter: the protestors say they represent the 99%, americans who are not millionaires and who are victims of corporate greed and income inquality. >> we have doctors, nurses, two attorneys that stay overnight here. >> you know, the general perception among a lot of people is that they are a bunch of homeless people. >> that is so freaking hilarious. it's hilarious when people ride by and they say, "get a job." and i sit and think about it and i go, i have a job. i have a good job. >> reporter: but protestors are getting behind whether they call a populous movement. >> reporter: this is the second time the group has been denied by city hall. city officials will only say they could evict this group at a time of their choosing. they will not tell people when or if they'll do it. live at the inner harbor, adam may, eyewitness news. >> and between 40 and 150 people are at occupy baltimore at any given day.

[ applause ] >> reporter: the debate last year ended without a vote in the house. but same-sex marriage supporters think governor o'malley's political power could make it inevitable next year. >> we could be on the record as being a family next year and get all of the rights we deserve. >> well, we have something to say about inevitability. all humility, bring it on. >> reporter: so it appears for the could is -- the second year in a row, same-sex marriage will dominate the general session. in maryland, i'm pat warren. >> and the maryland marriage alliance say its represents more than a quarter million people. a huge day on wall street. here's a look at the closing numbers. dow is up. s&p 500 is up 52 points. it's the biggest one-day gain for the dow since march of

2009. while stocks are up, temperatures are down. dry and seasonal last day of november. bob is in the first warning weather center, with the updated first warning weather forecast. bob. >> looks like we're sort of back to normal for a couple of days. take a look at radar. there's nothing around here at all. we do have some clouds. but temperature-wise, we're back in the mid-40s, which is pretty much where we should be on this last day of the month. now, tomorrow, as we start december. can you believe that? things are pleasant. it will be cool to start probably around the freezing mark. but with plenty of sunshine, temperatures where they should be around the 50-degree mark tomorrow afternoon. >> after two straight wins at home, the ravens head to cleveland to face the browns. as sports director mark viviano reports from today's practice, the ravens have the chance to report they can go on the road and beat the teams they are

favored against. >> reporter: the ravens return to practice on extra rest. 10 days between games as they prepare for a trip to cleveland. rested players, but some fans and critics are restless. because the ravens lost three road games, they were expected to win earlier this year. making them seem inconsistent. >> people want to say that we've had an up-and-down season. well, we're 8-3. there's nobody better than us in the afc right now. so to say that we've had an up- and-down season, i don't think it's correct. it's just you haven't played well against some teams that people would expect us to beat. >> reporter: we know it's in the back of our minds, obviously. you know, the games that we've had. we're definitely working our tails off to try to, you know, just go out there and execute a game plan. >> reporter: earlier losses may be in the back of their minds. but these ravens look at what is in front of them, a play-off

three suspects go on a wild robbing spree. it happened in a matter of hours last night. gigi barnett explains, it started in the county and ended in the city. >> reporter: 6:30 p.m., at forest park in cook lane in baltimore county yesterday. three men approach a man pumping fuel at a gas station. >> forced him at gunpoint into his vehicle. they then drove that vehicle, a '96 lincoln town car, to

baltimore city, where the suspect then robbed the individual. >> reporter: at 7:00 p.m., the suspects are now in the 5300 block of dogwood road. driving the first suspect's green lincoln town car. >> forced the female at this point, indoor vehicle, then stole the vehicle and personal property. >> reporter: 50 minutes later, the suspects are at the 7200 block of windsor mill with the gun. but this victim fought back. >> reporter: the victim then tried to grab the gun at which time the suspects fled. >> reporter: by 8:30, the grime crosses over into baltimore, at the 2500 block of gwens falls. one of the suspects announces a robbery to two people. >> he was able to get from the victims a purse and some other personal property. >> reporter: minutes later, the car reaches the 4500 block of loch loch raven boulevard at a gas station. >> they rob a total of seven people. >> now, it's 10:00.

police say the suspects are reisterstown. where they rob a young man and fire a weapon. >> the victim is shot, at least twice. police officers in essex and towson and woodlawn were all looking for these guys. >> reporter: i'm gigi barnett, wjz eyewitness news. >> the crime spree ended at 10:20 p.m., when the suspects crashed after a high-speed chase. they face charges from kidnapping to armed robbery. some good economic news, as experts release sales numbers for sign monday. on -- cyber monday. they spent a record $1.2 billion. that's a 22% jump from the year before. analysts say shoppers spent almost $11.5 billion the day after thanksgiving. in the 30 years since a.i.d.s. and hiv was diagnosed in baltimore, baltimore has seen its new infection rate climb to the fifth worst in the country.

make a new showers by late in the afternoon. not a lot. around here the rain is gone. it will be chilly and sunny the next few days. take a look at temperatures right now. back in the 40s where we should be. 45 here, the cold spot, oakland, 28. and 48 down in patuxent river. the dew point is 30 degrees. and that's probably going to be a low tonight, very close to to mid-40s. a little warmer on the bay. 47 in annapolis and kent island. d.c., 46. 50, 40 today. now, by midnight, probably down around 36, 37. 51, 32 are the averages on the last day of this month. tomorrow, the averages dropped to 50 and 32. 74, the record high. 12 degrees. you can get pretty cold, even in november. at 1929. right now, the winds are dropping down to 20 miles an hour. still 15, 8, 10. now, oakland, with a breeze at

with women are costing him at the polls. >> reporter: a friendly crowd welcomed herman cain to dayton, ohio. the presidential hopeful focused on his 9-9-9 tax plan, steering clear of the personal problems, plaguing his campaign. >> reporter: the establishment does not want herman cain to get this nomination. the liberals do not want herman cain to get this nomination. but i happen to believe that the american people have a different idea about who out to get -- ought to get this nomination. >> reporter: cain is rethinking his strategy, following accusations from ginger white. the atlanta businesswoman claims she had an affair with herman cain that lasted more than a decade. >> reporter: campaign aides call it a reassessment. cain's campaign says cain is not dropping out of the run for the white house. >> reporter: this comes amid

sexual harassment allegations that pushed him out of the first place position at the polls. newt gingrich is gaining momentum. the former house speaker is wrapping up a swing through south carolina. polls have him leading in that state by 11 points. he is determined to win the first primary in the south, come january. >> from 1980 to the present, the winner of the south carolina primary has been the republican nominee. >> reporter: gingrich is working hard to hold on to his front runner status. less than five weeks remain until the first votes are cast at the iowa caucuses. at the white house, tara mergener, wjz eyewitness news. >> at an appearance in south carolina, gingrich says, if he is the gop nominee, he will follow president obama around on the campaign trail, appearing four hours after him to respond to his speeches. the man who tried to assassinate president ronald reagan wants to be allowed to visit his mother's home, unsupervised for up to three

weeks. hinckley was found insane when he shot reagan. doctors say his illness is in remission. prosecutors say they not convinced hinckley is well enough. they say he recently tried to cover up browsing at books at a store about reagan. it was a nightmare holiday trip for hundreds of drivers. roofing asfault -- asphalt leaked onto the pennsylvania turnpike. and now are a glen burnie man has issued tickets for causing the mess. >> reporter: the company that owns the truck is based out of this complex in stevensville. the driver has been placed on administrative leave as he faces charges in pennsylvania. >> reporter: at the height of the thanksgiving travel rush, in the middle of a heavy rain storm, as many as 300 vehicles got stuck in this, a dark, dangerous goo, that caused widespread damage. >> this is just unacceptable.

they should have shut the freeway down. i mean, it don't come off easy, nothing. i don't even know how i'm going to get where i'm supposed to go. >> reporter: police say a tanker truck oozed roofing asphalt on a 40-mile stretch on the pennsylvania turnpike. it happened tuesday around 7:00. >> it was slippery. i pulled over. and i guess it was like 3 inches of tar. >> reporter: now the driver, 50- year-old george delaney, of glen burnie, has received two citations for failure to secure a load. and failure to obey a state trooper. the trooper said he ordered the truck stay at a service area until he could be inspected. but then delaney and the truck were gone. the harm it caused was not. >> i have never been so damn scared with my wife in my life before. we had no idea if we were going to get hit with other vehicles. >> reporter: the company that owns the truck, mts express, llc, in stevensville, is working to file insurance

claims. no word yet on how much the disaster will cost to clean up. >> reporter: the owner of mts issued a statement to wjz to say they continue to investigate how this happened. and so far, have not put together all of the pieces. reporting in stevensville, on the eastern shore, weijia jiang, wjz eyewitness news. >> and federal documents show mts has a safety record that is above the national average. a wild scene in baltimore county. a car flips over on kingston road in middle river. the driver apparently lost control, crashed into a home and into a house. medics were called to the scene. bank robberies finding a little politeness can go a long way. a man asked a teller to please hand him the money, instead of a threatening voice. keefer was convicted of the lesser charge of theft in a plea deal. he was sentenced to 2 1/2 years in prison, with 4 1/2 years suspended. time now for a quick look at some stories you'll find in

>> reporter: consumer reports tested 88 samples of apple and grape juice and found both arsenic and lead. >> we think that's especially important for young children, whose young, small bodies are growing and who are much more vulnerable to those exposures, based on the frequency of how much they consume juice. >> reporter: 10% had arsenic levels above what is allowed in drinking waters. specifically a type called inorganic arsenic, which raises the risk of cancer. and 25% had more lead than what's allowed in bottled water. consumers find it jarring. >> what do you think about lead and arsenic in these juices? >> well, that's not a very good thing. i would not be happy about that. and i wouldn't purchase it any longer. >> that's crazy. i would never guess that arsenic would be in there. and we definitely don't want to be drinking that obviously. >> reporter: the government has rules about arsenic in lead. but for those those don't apply to fruit juices.

>> the food and drug administration says it is confident. but since some do contain higher amounts of arsenic, the fda say its is expanding surveillance. >> we think the fda should move swiftly to put guidance in place, followed by standards for arsenic in lead and juices. >> reporter: for now, consumer reports is recommending that parents avoid giving juice to babies under 6 months and says children under 6 years old, should drink no more than a few occupancies per day. -- ounces per day. and a few months ago, talk show host dr. oz warned about high arsenic levels in juice, but the fda said his testing was flawed. still to come on eyewitness news. thousands of workers take to the streets in britain. they're trying to bring the nation to a standstill. the message they're trying to get across. watch your step. there you see it. well, you saw it a moment ago. a massive sinkhole opens up in oklahoma.

a wild scene in a texas neighborhood. two men driving expensive corvettes pull up to a red light and start to race. they speed off. and one car spins and smashes into the other. before they are both sent crashing into roadside trees. neither driver was injured. a massive sinkhole. 40 feet wide by 40 feet deep. the armer who owns the land says it appeared overnight. and he is just glad it didn't appear on his tractor he is waiting to see how big the hole will get before he decide what to do. heather cobal reports from london. workers are reporting changes in their retirement plans. >> reporter: public workers, filled the streets across britain, to protest against pension reform. >> have to pay more, work
