state. but in the end, her testimony may havedded -- have ended up helping the defense. over and over, she said how those robocalls were not intended to suppress voter turnout. >> i would call it countintuitivity. >> reporter: in robocalls from republican campaign bob ehrlich, to 120,000 registered democrats. the call told voters governor o'malley had won re-election before the polls closed. >> we're okay. relax. everything is fine. the only thing left is to watch it on tv tonight. >> reporter: prosecutors argue the robocall was illegal because it was meant to keep democrats from voting. they blame ehrlich's campaign manager julius henson. but on the stand, she said the robocalls were meant to be repsychology.

>> this was to say, my vote is for ehrlich. he's down and out. i'm going to go out and vote for ehrlich. >> she said it was her fault it went to registered democrats, not republicans. saying she used phone lists she already had, rather than generating new lists of republicans. >> i used lists of previous clients because i was being lazy. it wasn't out of anyone asking. it was my decision to use the list. >> reporter: late tonight, the state rested its case. the defense begins its case tomorrow. they have a list of some 30 witnesses. among them, they are expected to call former governor bob ehrlich, and former congressman elijah cummings. and campaign consultant julius henson is scheduled to go on trial february 6th. new allegations in the case of jerry sandusky. now, one of his alleged victims

is fighting back. andre fujii has more. >> reporter: the man says sandusky abused him more than 100 times, starting when he was just 10 years old. now he has filed a lawsuit against sandusky, penn state and the charity, second mile. the unidentified accuser says he met sandusky through the second mile. and after the abuse began, sandusky threatened to harm his family if he told anyone. the man also said penn state is to blame for sandusky's crime. >> it is against penn state. that is the iconic institution in which sandusky not only thrived and prospered. but through which he accessed so many youth. >> the accuser, now 29 years old. vic, back to you.

aruban authorities can manage the case. >> reporter: prosecutors appeal giordano's release. but a panel of judges upheld it in aruba. reporting from gaithersburg, mike hellgren, wjz eyewitness news. >> reporter: and gardner's family issued a statement on the release, saying they are disappointed, but they remain confident the truth will come out. the so-called blond bandit is behind bars. 23-year-old stephanie schwab is wanted for several robberies. police say officers followed schwab's car, after she robbed a bank in fair fax county. she eventually crashed and was arrested. time may be running out for the occupy wall street protestors camped out at mceldon square. baltimore may soon join other cities forcing them out. their latest permit request has been shut down. >> reporter: yes, vic. occupy camps all across the country are being cleared out this week. but baltimore still stands. there appears to be a new

three suspects go on a wild robbing spree. it happened in a matter of hours last night. gigi barnett explains, it started in the county and ended in the city. >> reporter: 6:30 p.m., at forest park in cook lane in baltimore county yesterday. three men approach a man pumping fuel at a gas station. >> forced him at gunpoint into his vehicle. they then drove that vehicle, a '96 lincoln town car, to

baltimore city, where the suspect then robbed the individual. >> reporter: at 7:00 p.m., the suspects are now in the 5300 block of dogwood road. driving the first suspect's green lincoln town car. >> forced the female at this point, indoor vehicle, then stole the vehicle and personal property. >> reporter: 50 minutes later, the suspects are at the 7200 block of windsor mill with the gun. but this victim fought back. >> reporter: the victim then tried to grab the gun at which time the suspects fled. >> reporter: by 8:30, the grime crosses over into baltimore, at the 2500 block of gwens falls. one of the suspects announces a robbery to two people. >> he was able to get from the victims a purse and some other personal property. >> reporter: minutes later, the car reaches the 4500 block of loch loch raven boulevard at a gas station. >> they rob a total of seven people. >> now, it's 10:00.

police say the suspects are reisterstown. where they rob a young man and fire a weapon. >> the victim is shot, at least twice. police officers in essex and towson and woodlawn were all looking for these guys. >> reporter: i'm gigi barnett, wjz eyewitness news. >> the crime spree ended at 10:20 p.m., when the suspects crashed after a high-speed chase. they face charges from kidnapping to armed robbery. some good economic news, as experts release sales numbers for sign monday. on -- cyber monday. they spent a record $1.2 billion. that's a 22% jump from the year before. analysts say shoppers spent almost $11.5 billion the day after thanksgiving. in the 30 years since a.i.d.s. and hiv was diagnosed in baltimore, baltimore has seen its new infection rate climb to the fifth worst in the country.

weeks. hinckley was found insane when he shot reagan. doctors say his illness is in remission. prosecutors say they not convinced hinckley is well enough. they say he recently tried to cover up browsing at books at a store about reagan. it was a nightmare holiday trip for hundreds of drivers. roofing asfault -- asphalt leaked onto the pennsylvania turnpike. and now are a glen burnie man has issued tickets for causing the mess. >> reporter: the company that owns the truck is based out of this complex in stevensville. the driver has been placed on administrative leave as he faces charges in pennsylvania. >> reporter: at the height of the thanksgiving travel rush, in the middle of a heavy rain storm, as many as 300 vehicles got stuck in this, a dark, dangerous goo, that caused widespread damage. >> this is just unacceptable.

they should have shut the freeway down. i mean, it don't come off easy, nothing. i don't even know how i'm going to get where i'm supposed to go. >> reporter: police say a tanker truck oozed roofing asphalt on a 40-mile stretch on the pennsylvania turnpike. it happened tuesday around 7:00. >> it was slippery. i pulled over. and i guess it was like 3 inches of tar. >> reporter: now the driver, 50- year-old george delaney, of glen burnie, has received two citations for failure to secure a load. and failure to obey a state trooper. the trooper said he ordered the truck stay at a service area until he could be inspected. but then delaney and the truck were gone. the harm it caused was not. >> i have never been so damn scared with my wife in my life before. we had no idea if we were going to get hit with other vehicles. >> reporter: the company that owns the truck, mts express, llc, in stevensville, is working to file insurance

claims. no word yet on how much the disaster will cost to clean up. >> reporter: the owner of mts issued a statement to wjz to say they continue to investigate how this happened. and so far, have not put together all of the pieces. reporting in stevensville, on the eastern shore, weijia jiang, wjz eyewitness news. >> and federal documents show mts has a safety record that is above the national average. a wild scene in baltimore county. a car flips over on kingston road in middle river. the driver apparently lost control, crashed into a home and into a house. medics were called to the scene. bank robberies finding a little politeness can go a long way. a man asked a teller to please hand him the money, instead of a threatening voice. keefer was convicted of the lesser charge of theft in a plea deal. he was sentenced to 2 1/2 years in prison, with 4 1/2 years suspended. time now for a quick look at some stories you'll find in

>> reporter: consumer reports tested 88 samples of apple and grape juice and found both arsenic and lead. >> we think that's especially important for young children, whose young, small bodies are growing and who are much more vulnerable to those exposures, based on the frequency of how much they consume juice. >> reporter: 10% had arsenic levels above what is allowed in drinking waters. specifically a type called inorganic arsenic, which raises the risk of cancer. and 25% had more lead than what's allowed in bottled water. consumers find it jarring. >> what do you think about lead and arsenic in these juices? >> well, that's not a very good thing. i would not be happy about that. and i wouldn't purchase it any longer. >> that's crazy. i would never guess that arsenic would be in there. and we definitely don't want to be drinking that obviously. >> reporter: the government has rules about arsenic in lead. but for those those don't apply to fruit juices.
