courthouse. >> reporter: she told jurors those phone calls were never intended to. >> i would call it a political tactic. >> this is rhonda russell, the woman whose voice was heard from robo calls to 112,000 registered democrats. the call told voters governor o'malley had won reelection before the polls even closed. >> we're okay, relax, everything is fine. the only thing left. >> reporter: prosecutors argue the robo call was illegal. they blame ehrlich's campaign manager and rhonda russell's boss. but on the stand russell told jurors the robo calls were supposed to be reverse psychology. >> hey, my vote is going for

ehrlich. >> reporter: said it was her call the calls went to registered democrats and not republicans saying she used lists she already had available. >> i used lists from previous clients because i was being lazy. it wasn't out of anyone asking. it was my decision to use the list. >> reporter: the state prosecutor has now rested. the defense begins their case on thursday. they had a long list of witnesses. among those they are expecting to call to testify, former governor ehrlich. campaign consultant julia is scheduled to go on trial february 6th. a car goes out of control and flips into a yard. apparently the driver left the road and crashed through a fence before narrowly missing hitting that house.

that driver walked away. gary giordano is back in the u.s., but after 4 months in a jail, he was released for lack of evidence. >> reporter: gary giordano is out of jail in arub a but he's not out of trouble. vetors continue -- investigators continue to -- both are from maryland. a judge said prosecutors lacked evidence to hold giordano and he will soon be back home. >> it's crazy. who would think in our little neighborhood there would be an international story unfolding. >> reporter: windy wilcox, his neighbor finds the case as bizarre as it is troubling, an international mystery in her backyard. >> to know that's going on in your neighborhood is unsettling. >> reporter: giordano's lawyer

says his client just want to get home and spend some time with his kids. aruba's top prosecutor doesn't buy giordano's story and has cited giordano's past, including several accusations made that he was violent with women. >> we know what he told us about the moment the incident happened, his description of the situation is not in accordance with reality. >> reporter: the fbi raided giordano's home in august, an investigation that's also ongoing. >> i don't think that the arubian authorities can manage a case. >> reporter: appealed giordano's release but a panel of judges upheld it in aruba. gardner's family issued a release saying they are

disappointed. they won't go without a fight. in philadelphia and in los angeles police cleared some 350,000 people. police have been breaking up en campments and in -- the last few weeks. there's speculation baltimore members could be cleaned out next. camping is banned there. city leaders still aren't saying when they will enforce the ban. between 40 and 150 people camp out at occupy baltimore on any given day. in jeopardy with no money to pay costs. the city wants to turn control over to private companies. meghan mccorkle has these serious concerns. >> reporter: many community members are upset with the city's plan to privatize 20

recreation centers but say it may be the only way to save them. >> you are about to give away a gem in our community to strangers. >> reporter: fiery feed back from a standing room only crowd. >> every time there's a financial crisis you can't keep cutting the children short. >> community members concerned about the city's plan to turn over rec centers. >> why would it be important to private privatize it to give your center away. >> reporter: but many say it's necessary. with funding slashed the chief of recreation says finding partners may be the only solution. >> we aren't going to be able to do it without partners. >> reporter: some say the business needs to be simplified. >> it was 64 pages of requirements. it was heavy duty expensive.

including morgan state university students. one victim was shot. there's no sign of a motive. she's known as the blond bandit. believed to be responsible for a number of bank robbers and tonight she is behind bars. how police say they caught her in the act. >> stephanie swab is facing numerous charges, yet as this investigation unwinds it could reveal even more crimes. fair fax county police say stephanie swab was arrested after she tried to rob a bank around 1:00. police say something went wrong and she drove away without any money. >> this particular case we were very serious about making arrest. >> reporter: a fair fax county police officer followed swab into -- and was arrested. police say swab, who is 26 and 5'6" robbed banks and carjacked

administration said it's -- the fda says it is expanding surveillance activities to help determine if a guidance level can be established. >> we think the fda should move swiftly to put guidance in place for standards. >> reporter: for now consumer reports is recommending parents avoid giving juice to babies under 6 months. and children under 6 years old can drink some use but consumer reports say they should drink no more than 6-ounces her day. dr. oz warned about high levels in juice a few months ago but the fda said his research was flawed. he tried to make a grand entrance in a mall by repelling into a food court. it was going fine until his whiskers got stuck. he eventually did get to the
