mceldon square. >> reporter: that's what they were acting at -- >> reporter: crews dismantled the tents and cleared the trash. throughout the day, only police would occupy this space. with no arrests and no violence. like other cities have seen. the mayor considers it a success. >> the facts bear out that we have the right approach. and tactics to make sure that that happens, in a respectful way. >> reporter: occupiers say simply because mceldon square is now empty, does not mean that the movement is over in baltimore. >> some say they plan to take over foreclosures. >> now it's time to truly occupy baltimore, and not just mceldon square. extremely intimidating. all dark clothing. ninja masks. you could only see eyes. helmets on top. >> when they walked up, these guys -- >> it's roort rite in the middle-- right in the middle of the street. i expected that once the cops came, what happened would hand,

that they would simply leave. >> reporter: but many of them don't know where they're going next. >> the camps definitely have a strong, like, cultural significance to the occupy movement. but they're not really what we're there for. >> reporter: and occupy baltimore was largely peaceful, save for a few violent incidents at mceldon square. and a notable confrontation with former presidential adviser karl rove. they'll be meeting here tonight at 8:00. mary, back to you. >> it is unclear if the group will now continue to meet at the war memorial plaza beyond tonight. dozens of cars are damaged after rocks come crashing onto the baltimore beltway. denise is in the newsroom to explain what happened. >> reporter: state police say shorthands hundreds -- say hundreds of rocks fell. it happened on the inner loop. about 15 drivers were left with cracked windshields, large dents and scratches on their cars. no one was hurt. and police are still trying to figure out what caused the rocks to fall.

state highway crews have since cleared the rocks from the roadway. csx operates the railroad from the overpass. also, engineers say part of an overpass needs to be replaced after an oversized truck crashes into it. crews conducted struct urlt tests -- structural tests. we'll have much more on how the repairs will affect drivers coming up new. 16 people are hospitalized after a security officer uses pepper spray to break up a fight at chesapeake high school. pat warren has more on the chaos and reaction from parents and students tonight. pat? >> all in all, a chaotic morning at chesapeake high school. one student arrested. 16 taken to local hospitals. and the school building evacuated. >> reporter: a student fight in the chesapeake high school lobby. >> i saw everyone running and panicking, in a frenzy. >> kids were going at it. >> what was the fight about? do you know what it was over? >> no. >> reporter: a school resource officer uses pepper spray.

>> i just remember starting to cough and cough and cough. >> reporter: the building is evacuated. >> reporter: all of these policemen and ambulances and fire trucks. they come in. >> there have been 16 students that were transported to local hospitals. >> reporter: parents rush said to pick up their children. -- rushed to pick up their children. >> this is why we had her in a small, private catholic school for 10 years. and i've had enough. >> reporter: they say using pepper spray is authorized to bring a situation like this under control. >> they're authorized to begin with the least possible force and escalate to the most possible force. so the pepper spray is a tool that is used occasionally, in an effort to break up a fight when they determine that it's necessary to do that. >> i captain believe that they would use mace on a child. >> reporter: parents who pick their students up today tell wjz they're concerned about fighting at the school. >> reporter: this should not be happening. it just is an everyday occurrence. and i've had enough of it.

>> wjz was not able to verify the exact number of fights at chesapeake high school this school year. and i also need to tell you that there are no details available on the arrest of the one student who was arrested. that person, we're told, was involved in the fight. back to you. >> okay, pat. thank you. the effects of the pepper spray are not considered to be serious. a surprise decision from jerry sandusky, the former penn state assistant football coach, suddenly waives his preliminary hearing on sex abuse charges. manuel gallegus reports for wjz. his accusers are relieved but frustrated they didn't have the opportunity to testify. >> reporter: jerry sandusky told the crowd outside court, he would prove he is not guilty of child sex abuse. >> stay the course. fight for four quarters. we'll wait for the opportunity to present our side. >> reporter: the former penn state football coach, waived his preliminary hearing just before it was about to start. his lawyer says he waited until the last minute because he wanted prosecutors to agree to share vital information and

also to spare his client from further accusations. >> what you would have heard would have been the case. not our case. because today is not the time for us to present our defense. >> reporter: sandusky says this is a fight to the death. and there will be no plea deal. it is time to move on to trial. >> it will allow us to promptly advance this case to adjust conclusion. >> several men who accuse sandusky of sexual abuse were set to testify. victim number 4 was supposed to tell his story first. >> reporter: his lawyer read a statement from his frustrated client. >> reporter: i can't believe they put us through this, until the last second. only to waive the hearing. >> reporter: the attorney for victim number 1 says his client is hoping sandusky eventually takes a plea. so he never has to take the stand. >> testifying means recounting and reliving those horrific experiences that he had to endure. >> reporter: sandusky remains

under house arrest until has trial sometime next year. >> reporter: manuel gallegus, wjz eyewitness news. >> reporter: sandusky's next court date is january 11th. but he's not required to attend that proceeding. syracuse university, slapped with a lawsuit by two men who say they were abused by an assistant basketball coach. bobby davis and mike lang say bernie fine molested them when they were children. they are now suing syracuse university for defamation. they say school officials initially suggested the accusations were not true. head basketball coach, jim bayheim is also named in the lawsuit. fine was fired, but right now faces no criminal charms. we are-- charge little. we are following some breaking news on interstate 95. captain mike perry, what can you tell us? >> reporter: hello, mary. it's not a horrible crash. but a three-vehicle accident. northbound i-95. between washington boulevard and 395. or 295. in the northbound right lane.

three vehicles involved. as you can see, it is clearly causing delays along northbound 95. the backup extends almost all the way to the beltway at this point. up 95, expect delays as maryland transportation authority police are on the scene, conducting the investigation. all the accident is over to the right shoulder. back to you on tv hill. >> captain mike, thank you. dna evidence helps anne arundel county police make an arrest in an unsolved crime. police say keith dooly is now linked to a summer home robbery invasion. police say on august 14th, dooly forced his way into an elderly couple's home on redwood avenue. dooley is already behind bars for unrelated charges. new information about a robbery on the towson university campus. police identify the suspect as 47-year-old larry mcknight. he's charged with robbing the pnc bank inside the university union. police also believe he robbed a bank of america last night.

a secret hazing ritual exposed. three are accused of severely beating a female band mate. this is just the latest violent incident within the prestigious marching band. >> investigators say it was a brutal hazing ritual. three members allegedly beat a fee male band member with their fists ask a ruler to initiate her into an organization called the red dog order. the beatings were so severe,

they broke the victim's thigh bone. >> if the students had been terminated from the university or terminated -- suspended from the university, it may have sent a strong message. >> reporter: a little over a week later, dr. julian white suspended 26 band members for their suspected involvement in that beating and one other. and he talked about this before they left for the biggest of the year. white says they failed to discipline students any further. >> did i make those recommendations? yes, i did. were they followed? for the most part, no. >> reporter: on november 19th, hours after that performance, drum major robert champion was found unresponsive on a band bus. he later died. and investigators believe hazing was involved. >> reporter: his death, and now the arrests have exposed a hazing culture that has haunted

florida a&m for over a decade. the school has suspended performances by the march marching 100 for over a decade. anna werner, cbs news. >> the university's system has called for a special investigation into actions taken by the university. >> if you're waiting for someone to get home from work, let's check e-mails. hi, christy. >> hi, mary. hi, everyone. >> we have an accident out there that just occurred. southbound on the jfx at pleasant street. as you can see, it is taking away one. at this point, the best-case scenario is to take away pleasant street. this is going to attract a lot of attention and expect a lot of rubber necking. as far as 95 goes, in the northbound direction, we still have that accident there at russell street, blocking the right lane. three vehicles involved in that. it's backed up to the beltway. as far as the beltway itself, 30 minutes from the top side

spread some holiday cheer. dozens of students from baltimore city spent the day at dave and busters in the arundel mills mall. they got one on one time with jake arrieta. >> i had a great time. because i get to meet the orioles. >> reporter: students here in east baltimore were chosen to go to the party today, based on attendance, good behavior, and excellent school work. >> our students have worked so hard over the past four or five weeks. you know, teachers have used this as an incentive for students who work extra hard to earn this trip. and we're real proud of those who have. we are having a good time. mingling with the orioles players, the staff. and it's a great way to ring in the holidays. >> reporter: the games are free. food served up by the players. and... the gift delivered straight from santa. aka -- aa dave johnson. each count also went home with a copy of the book, the polar express and a new baseball glove. >> just having fun, putting smiles on faces and letting

54 degrees tomorrow, with clouds and sunshine. very nice, mild afternoon. even warmer on thursday. but we'll have a risk of some showers thursday afternoon. which is pretty typical this time of year. when you get that warm, probably going to see some showers. >> thank you, bob. >> thanks, bob. before polluters can be hauled into court, they have to be caught. that has led the state attorney general to conduct environmental audits along maryland's waterways. the inner harbor is the state's dirtiest. >> reporter: tourists usually cruise the inner harbor. today, it was maryland's maryland's tarn general. >> you don't want to stay in an ice tower. >> reporter: not much to see today, but when it rains, there is plenty of trash is the only obvious pollutant. but that's just the surface problem. a lot more spills out of storm drains like this one. affecting -- >> water quality.

mostly due to storm water. bacteria, contamination. and trash. >> reporter: all of which makes the inner harbor, maryland's dirtiest water. and an ongoing priority. >> our biggest role is enforcement. we actually prosecute polluters. and we have a dozen ongoing cases that pollute the inner harbor. >> reporter: during his boat ride, he heard of wider, more anonymous sources. >> it's our lawn fertilizer, our trash, our cars that are generating all the junk that makes its way into the harbor and becomes a toxic soup. >> reporter: tracking that, backup stream enforcement to few a few counties. a few jurisdictions have already submitted checkup plans. >> reporter: because there is no dirtier water in maryland than the inner harbor, improving it could make the bay seem a lot more doable. >> by doing that, we can lift everybody up and increase their commitment to the bay. >> reporter: alex demetrick, wjz eyewitness news. >> as a starting point for

it is 5:29. 45 degrees. and mostly clear. beautiful shot of a christmas scene at somebody's house with a santa to go along with it. beautiful. and good evening, everybody. thank you for staying with wjz, eyewitness news. here are some of the stories people are talking about tonight. we now know more about the damage to an overpass spanning the baltimore beltway, after a truck slammed into it. inspectors spent more than seven hours, examining the very spot where it happened. wjz is live along the beltway. derek valcourt has more on the accident and how the repairs will affect the drivers. derek? >> one of the support beams on that overpass is going to have to be replaced. that means crews are going to have to shut down several lanes of traffic to do it. but luckily, for the drivers who hit the beltway, that inconvenience will not happen until the spring. >> reporter: on 695 south, traffic dips along, beneath the

95 south overpass. you have to look closely for signs of damage done monday, when the massive arms of a back hoe riding on the arms of a tractor-trailer, slammed onto a bridge. on two of the busiest highways of the region. >> reporter: obviously we wouldn't have traffic on 95 or 695. if we had any concerns about safety. >> reporter: from sky eye chopper 13, you can see the shoulder of 95 on the overpass has been blocked off. that's because state highway officials found damage to two of the outer-most support beams, beams that sit under the shoulder of the road. >> reporter: from underneath the overpass, you can see where the first two beams are damaged. and they say it's the first beam that needs to be replaced. >> reporter: these bridges are built with redundancy. if something is to happen to the second most beam like this that happened. the rest can take that load. and it disperses the load amongst the rest of the bridge. that's why it's still not only standing but in good shape

today. >> reporter: the state highway administration plans weekly. meanwhile, rufus and patricia charles have their own to deal with. >> we're blessed we are not hurt. we really are. i thank god that even the driver that was driving the tractor-trailer, he was not hurt either. because that could have been really a bad, bad accident. >> reporter: the bills to repair that overpass will not be cheap. and they say they'll send that bill to the company who owns the responsible trailer. derek valcourt, wjz eyewitness news. >> state police say the tractor- trailer faces federal and transport charges that carry fines of up to $280. >> reporter: the howard county police officers involved in the shooting death will not face criminal charges. last month, jeffrey nichols was confronted by an officer on

high-tech drive. police say he was ordered to drop his weapon but refused. investigators determined the weapon was a pellet gun made to look like a semi automatic handgun. >> reporter: two military officers crash at a base in washington state. denise is in the newsroom with details of this tragic accident. denise? >> reporter: military officials say four army aviators was killed in this. it occurred last night. the single-engine helicopter is involved in the accident are used for armed reconnaissance. investigators say they don't know if the helicopters collided with each other or crashed separately. no one else on the base was involved in the accident. the military has not yet identified the victims. mary? >> denise, thank you. the louis mccord base is one of the largest in the country, with over 100,000 military and civilian personnel. three hunters in texas are being questioned by police after two middle school students are wounded. the students were hit by stray bullets. one of them remains in critical condition. police say they want to

determine if the shootings were intentional, reckless or accidental. a hunting pasture is located about 600 yards from the school. a christmas fair is interrupted by flying hand grenades in belgium. police say a man launched an attack on a busy town square. heather cobar reports for wjz. at least five people are now dead. >> reporter: panicked holiday shoppers ran screaming through the streets about 55 miles east of brussels. they were trying to escape a man throwing grenades and firing in the town square. this witness said he saw people lying on the ground, bleeding and crying. police helped evacuate a christmas market full of children. >> it's really smooth. >> reporter: the bus stop exploded, says this man. police said the 33-year-old attacker threw grenades toward a bus stop and fired a rifle on a crowd, before killing himself. paramedics used stretchers to carry away victims. a 2-year-old baby, two

teenagers and a grandmother, are among those who were killed. according to officials, dozens were injured, including young children. police don't know what motivated the killings, but they say they're not terrorist- related. authorities say the gunman was on his way to the police station for questioning when he launched the attack. he had a history of drug and weapons convictions. heather cobar, wjz eyewitness news. in another attack in new york today, a gunman shot and killed two street vendors at a market in florence, italy, before killing himself. >> reporter: penn state students are facing prison time in connection with a massive riot on campus last month. six students were arraigned and charged today, for tipping over a news van in protest. the students were angry about the firing of coach joe paterno. each defendant has been charged with a felony. sharing their story. a year ago, a rutgers freshman committed suicide, after his roommate posted his sexual encounter with another man online.

now as michelle miller reports for wjz, for the first time, his patients are speaking out. -- parents are speaking out. >> tyler was a great kid. ♪ [ music ] >> he was an accomplished musician. he was a lot of fun to have around the house. >> he had a very good sense of humor. >> reporter: joe and jane clemente thought they knew everything they should about their son tyler. >> it was just two days before he was leaving for school. and he pretty much just told me, mom, i'm gay. and i was really really surprised. very, very surprised. >> reporter: while the clementes processed that surprise, tyler began college, where he roomed with 19-year- old duran ra vi. ravi is accused of videotaping a sexual encounter of clemente with another man. >> we don't know why he committed suicide. all we know is his alleged invasion of his privacy, how he

reached out to the r.a.s and how he texted a friend that he was upset. >> are you angry at mr. ravi. >> for me, it's not anger. it's really more heartbreak. >> mr. ravi. >> reporter: ravi faces up to 10 years in prison. >> what we're looking for is justice and accountability. it doesn't have to be a harsh punishment. but acknowledgment of wrongdoing. >> do you want him to apologize? >> that's a very tough question. it certainly would be welcomed. i'm not expecting it, and i don't really foresee it in the future. >> makes no difference to me. i'm not expecting one. >> reporter: what the clementes do hope for is a change in a culture that brings bring -- breeds intolerance. >> they are hoping to decrease the suicide rate among gay and lesbian teens. the national transportation

safety board is calling for a ban on any use of cell phones while driving. the new regulation, if adoomented -- adopted by states would eliminate all texting and ban all hands-free devices. this comes after a deadly pileup in missouri. some say texting is to blame for the crash in august 2010. the 19-year-old driver sent or received 19 texts immediately before the accident. a war of words is brewing between the front runners and the gop presidential race. newt gingrich and mitt romney are exchanging public blows to get ahead in the polls. nancy cortes has more. >> reporter: romney started it. early in the day, saying gingrich should give back the money he earned, consulting for freddie mac. >> working for freddie mac. getting paid $1.6 million.

by the way, a different story from the number he first said. it would make him the highest paid historian in history. >> reporter: gingrich's reaction was swift, going directly at romney's leadership at investment firm, bane capital. >> i would just say that if governor romney would like to give back all of the money he's earned from bankrupt companies, he can. >> doesn't he understand how the economy works? in the real economy, some businesses succeed and some fail. the 400 enterprises i led, all were successful. >> reporter: on monday, romney acknowledged to politico what the polls already show, that gingrich is the front runner in many places and that this could be a long battle. >> this nomination process takes place what? five or six months from here?

this this -- this is not going to be decided in a couple. >> reporter: congressman ron paul has been going after the speaker with some of the harshest attack ads of the campaign. >> the iowa caucuses are now three weeks away. congress and the white house continue to battle it out over the extension of the payroll tax cut. the biggest sticking point is that a house plan is linked to the approval of a controversial oil pipeline. they want to study the impact on the environment. without an agreement, the tax cuts will expire on january 1st, cutting into the paychecks of 160 million workers. time now for a look at the baltimore sun. part of umbc's success has been redesigning basic courses to make students more effective. find out how they do it. a local group who spends their weekends delivering christmas trees and pulled pork sandwiches by bicycle.

little girl's rescue in china, after she gets stuck under the wheel of a car. take a look at this video. witnesses say the 5-year-old squated down in a parking lot because she was mad at her mom. seconds later, a car turned the corner and ran over her. the girl was treated for a few minor injuries. but she is expected to make a full recovery. the occupy movement takes a violent turn in washington state. police use pepper spray and flash-bang grenades to clear people from the port of seattle. dozens set up a wooden crate outside a terminal there. protest was part of a national effort to disrupt ports up and down the west coast. an investigation is under way after police make a shocking find at one california flea market. detectives say a vendor was selling antibiotics for cows to people in sacramento. no one has fallen ill. so far, no arrests have been made.

following a deadly shooting of a new york city police officer. the officer was killed as he responded to a break-in in brooklyn. >> police badges. black bunting outside of the 75th precinct station house. mourning the death of peter figowski. >> he has 12 commendations, including eight for exemptional police duty. we are all praying for him. >> reporter: the final call of his 22-year career brought him to 225 pine street, where he and his partner were backing up cops. police say gunman lamont pride hid in a side room as the first responders entered, then ran outside, where he saw officer figowski and shot him in the face. figowski's partner, glen estrada, chased pride several blocks and captured him.

shannon gilbert went missing in may 2010. police were searching for 10 bodies. investigators do not believe gilbert's death is connected to the serial killer. michigan police say a man charged with a dui refused to take a breathalyzer test and walked out of the courthouse. that led to this chaotic chase. investigators believe the suspect was drunk again. and no one was seriously hurt. a new hampshire driver's car gets swallowed up. as you can see, hopefully. there you go. a large sinkhole nearly sinks the entire car. the driver was pulled to safety by firefighters. officials say they had a hard time removing the car because it was on top of a gas line. the collapse is caused by a broken water main. a nebraska woman is alive, thanks to some quick thinking by her mail care crer. the postal service -- carrier. the postal service was there. knowing that the woman was inside and that the woman was
