to camp out overnight. now, the raid this morning was one that was well planned. it was also a surprise to the demonstrators. >> reporter: police made a substantial show of force. showing up in riot gear, in the middle of the night. and making good on the city's promise to evict occupy baltimore from mceldon square. >> i was asleep. i got woken up by people shouting. and we had 30 minutes to get out. >> reporter: crews dismantled the tents and cleared the trash. throughout the day, only police would occupy this space. with no arrests and no violence. like other cities have seen, the mayor considers it a success. >> certainly wasn't going to go on forever. and we decided it was time. >> this is not about the message. we understand that the message resonates with me. it resonates with people across the country. >> reporter: the city has not said when they will reopen mceldon square to the public. >> reporter: occupy baltimore made few waves with the exception of some violence at the square and a noble

confrontation with former presidential adviser karl rove. >> extremely intimidating. all dark clothing. ninja masks. you can only see eyes. helmets on top of that. face shield over the helmets. >> reporter: james mcarthur -- covered the movement here. >> it's right in the middle of the street. >> i expected that once the cops came, what happened would happen, they would just simply leave. >> reporter: and where they're headed may be closer than you think. >> we were being contained in mceldon. now that that's gone, there's plenty of buildings to squat. occupy is essentially coming to a neighborhood near you. >> reporter: and the -- mayor did not give a specific answer as to why the city picked today to pick everyone from occupy baltimore. many of the occupiers are now counting on the internet to hold the local group together. vic, back to you. >> it is unclear whether the group will now continue meeting at war memorial plaza. some want to hold their nightly

general assemblies back at mceldon square. >> police are stepping up their efforts to find two robbery suspects. mare sein the newsroom with the latest on the crime. >> reporter: well, denise, the student was robed on campus sunday night. take a look at the surveillance photos. the two suspects at a nearby convenience store. police said the men used a stolen debit card. last month, another student was robbed at knife point near his apartment. it is not clear if the crimes are related. denise? >> the school sent out an alert, to students sent after the robbery. more than a dozen baltimore county high school students rushed to the hospital after pepper spray was used to break up a fight. >> reporter: that's right. one student arrested. 16 taken to local hospitals. and the building evacuated. a chaotic morning at chesapeake high. >> reporter: a student fight in the chesapeake high school lobby. >> i saw everyone running and panicking, in a frenzy. >> kids were going at it.

>> what was the fight about? do you know what it was over? >> no. >> a school resource officer uses pepper spray. >> i just remember starting to cough and cough and cough. >> reporter: the building is evacuated. >> all of these policemen and ambulances and fire trucks, they come in. >> there have been 16 students that were transported to local hospitals. >> reporter: parents rushed to pick up their children. >> this is why we had her in a small, private catholic school for 10 years. >> and i've had enough. my daughter doesn't feel safe. >> baltimore county's public safety spokesperson says wjz isn't authorized to bring it under control. >> they're authorized to bring it. the pepper spray is a tool that is used occasionally in an effort to break up a fight when they determine that it's necessary to do that. >> i cannot believe they would use mace on a child. >> reporter: parents who pick their students up today tell wjz they're concerned about fighting at the school.

>> this should not be happening. it just is an everyday occurrence. and i've had enough of it. >> reporter: wjz was unable to verify the number of fights that there are at chesapeake high school. the information on the child that was arrested is not available to the media at this time. back to you. >> the effects of the pepper spray are not considered serious. a surprising move by former penn state assistant coach jerry san dunk necourt. he waived his right to today's preliminary hearing, meaning the case goes directly to trial. some of his 10 alleged sex abuse victims were expected to testify. sandusky is said to question the credibility of some of the alleged witnesses and victims, saying they could be motivated by money. hear from the attorney and where the case goes from here on wjz. new information about damage to a highway overpass. traffic is backed up for miles as inspectors look for damage. wjz is live along the beltway. derek valcourt has more on the

accident and the repairs that need to be done. >> . >> but the bad news is one of the beams on that overpass is going to need to be replaced. that means crews are going to have to shut down traffic, temporarily in a few lanes in order to do that. the good news, though, is that for drivers, the inconvenience will not happen until the spring. >> reporter: on 695 south, traffic zips along, beneath the 95 south overpass. you have to look closely for signs of the damage done monday, when the massive arm of a back hoe, riding on top of a tractor-trailer, slammed onto a bridge, locking up traffic for hours, on two of the busiest highways in the region. >> obviously, we wouldn't have traffic on 95 or 695. if we had any concerns about safety. >> reporter: from sky eye chopper 13, you can see the shoulder of i-95 has been blocked off. that's because state highway officials found damage to two of the outer most support beams, beams that sit under the shoulder of the road. >> reporter: from underneath the overpass, you can see where the first two beams have been

damaged. and investors say it's that first beam that needs to be replaced. >> if something were to happen to the outer most beam like this or something happened to the outer most beam, the rest of the bridge can take that load and it disperses the weight, and the load amongst the rest of the bridge. that's why it's still not only standing but in good shape today. >> reporter: the state highway administration plans weekly construction. meanwhile, rufus and patricia charles have repairs of their own to deal with. their car had damage to them. >> we're blessed. we're not hurt. i thank god that each the driver that was driving the tractor-trailer, he was not hurt either. because that could have been really a bad, bad accident. >> reporter: so those repairs will start in the spring. and they won't be cheap either. the state says they're going to ship the bills for all of those repairs for the company that owns the tractor that caused

>> okay. thank you. in just hours, the house is set to vote on a bill that would extend a payroll tax cut. as tara mergener reports for wjz from washington, a controversial provision could mean the bill will die in the senate. republican leaders say they're confident legislation extending the payroll tax cut and unemployment benefits will clear the house with bipartisan support. we've got a reasonable, responsible bill that really will help the american people. really upon will help create jobs. >> reporter: the payroll tax cut expires at the end of the year, unless congress acts, 160 million workers could see their paychecks shrink. both parties have said they support an extension, but they disagree on how to get it done. they call the house bills dead on arrival. because of fast track approval of an oil pipeline project. >> they're really wasting time to people catering to the people.

before polluters can be called into court, they have to be owned. that is to conduct an ongoing audit. alex demetrick reports, the inner harbor is the state's dirtiest. tourists usually cruise the irnl harbor. today, it was maryland's attorney general. >> you don't want to stay in a castle. you need to tour the water. >> trash is the most obvious pollutant. but that's only the surface problem.

a live look outside right now. downtown baltimore. doesn't it look a lot like christmastime right now. >> not from this vantage point. >> i've had a lot of inquiries about the weather next week. >> okay. >> and it does not look particularly conducive to cold and snow here in the eastern half of the united states. that is not the pattern we're currently under. so unfortunately, this year, does not look like we'll be seeing a white christmas around here. not too many places in the east. maybe some higher mountains. maybe. that's about it. at least that's the way it looks right now. let's take a look at temperatures around the region. by the way, there's a meteor shower late tonight. after 10:00, look up. might see some of those shooting stars. west winds, barely moving at 3. humidity.

50%. barometer rising. 30.04 inches. right now, down to 32 in oakland. 41, ocean city. and 43 up in elkton. the dew point is up to 25. i don't think it will be quite that chilly tonight. a little warmer than it was last night. we had 23 this morning. 22 yesterday morning. tonight, probably the mid- to upper 20s. and some low 30s. 42 now in bel air. and 46 in annapolis. kent island, by the bay. and that's pretty much the bay temperature now. they've had very little frost. of course, areas close to the water have kept warmer. downtown this morning was 35. just eight miles down the road. it was 23. that's a huge difference. 51, 23 today. the average, 46 now. for the average high. 29, the average low. and the record, 69. back in -- way back in 1899. and 7 degrees above zero in 1962. right now, our light west winds. tonight, the winds are probably going to quit later tonight.

we'll see a few clouds. but i think for the most part, it's going to stay clear for the meteor shower late tonight. and there could be many, many shooting stars. if you're out on a dark, dark place, away from the lights of the city, you'll probably see that. rain this afternoon, across missouri. up toward illinois and indiana. but it's pretty much weakening, as you can see. but that will bring us some clouds tomorrow afternoon, tomorrow night. thursday, probably a chance of some shower activity as that front gets a little closer. but it's going to be very mild. temperatures near 60 or better. maybe even 70, down in southern virginia for one day. then this front comes through. through the shower activity on thursday. then it cools down for friday and the weekend. but back to normal. southeast winds. tonight, generally clear. so look for those meteors late tonight. 28 by morning. tomorrow, a mild afternoon, again with sunshine. and then some clouds. tomorrow's high, up to 54 degrees. normal high tomorrow, like 45.

jerry sandusky. he waived his right to a preliminary hearing, meaning the case goes directly to trial. manuel gallegus reports for wjz. the decision spares a number of accusers from having to relive their stories on the stand. >> reporter: jerry sandusky told the outside court he would prove he is not guilty of child sex abuse. >> stay the course. fight for four quarters. we'll wait the opportunity to present our side. >> reporter: the former penn state assistant coach waived his preliminary hearing just before it was about to start. his lawyer says he waited until the last minute because he wanted prosecutors to agree to share vital information and also to spare his client from further accusations. >> what you would have heard would have been the commonwealth's case. not our case. because today is not the time. >> reporter: sandusky's attorney says this is a fight to the death. and there will be no plea bargain. the prosecution says it is ready to move onto a full trial. >> it will allow us to promptly

advance the prosecution in this case to a just conclusion. >> reporter: several of the 10 men who accuse sandusky of sexual abuse were set to testify. victim number 4 was supposed to tell his story first. >> reporter: his lawyer read a statement from his frustrated clients. >> reporter: i can't believe they put us through this until the last second. only to waive the hearing. >> reporter: the attorney for victim number 1 says his client is hoping sandusky eventually takes a plea so he never has to take the stand. >> testifying means recounting and reliving those horrific experiences that he had to endure. >> reporter: sandusky remains underrous arrest until -- under house arrest until his trial sometime next year. >> reporter: manuel gallegus, wjz eyewitness news. >> reporter: penn state university officials have been charged with perjury and failure to report suspected abuse. their preliminary hearing is scheduled for friday in harrisburg. new developments in another sex abuse scandal. this one involving a former

assistant coach at syracuse university. two men say they were molested by bernie fine. bobby davis and the other have hired gloria allred to handle the case. fine denies the allegations, which are under investigation. new york's long island believes they have found a prostitute, whose killing sparked an investigation. >> reporter: it has taken nearly a year. but police believe they have found the body of 24-year-old shannon gilbert. police say she vanished in the remote oak beach area, after meeting a client, while searching for her remains last year, police discover the the first of what would become 10 murder victims, all dumped in a similar fashion. police suspect a lone serial killer is behind the killings. police have only identified five of the 10 victims. and police are not commenting on possible suspects. denise? >> thank you, mary.

relatives of some of the other victims whose bodies were found, plan to hold a vigil tonight. a gunman in belgium kills five people in an attack on busy town square. >> reporter: panicked holiday shoppers ran screaming through the streets about 55 miles east of brussels. they were trying to escape a man throwing grenades and firing a gun in the town square. this witness says he saw people lying on the ground, bleeding and crying. police helped evacuate a christmas market full of children. >> reporter: the bus stops exploded, says this man. police say the 33-year-old attacker threw grenades toward a bus stop and fired a rifle on a crowd, before killing himself. paramedics used stretchers to carry away victims. a 2-year-old baby. two teenagers and a grandmother are among those who were killed. according to officials, dozens

were injured, including young children. police don't know what motivated the killings, but they say they're not terrorist related. authorities say the gunman was on his way to the police station for questioning when he launched the attack. he had a history of drug and weapons violations. in another attack in europe today, two street vendors at a market in italy. new information of a robbery at the bank branch of towson university. 47-year-old larry mcknight allegedly walked into the pnc branch and forced the teller to give him cash. a baltimore officer spotted him a short time later and arrested him. he is now a suspect in another bank robbery in pikesville in november. and 42-year-old keith dooly is in custody tonight, for a brazen home invasion. last august, police say he forced his way into the severna park home of an elderly couple. stole money, their credit cards and their

performances following champion's death. the parents of the rutgers student who committed suicide are speaking out for the first time. one year ago, tyler clemente took his own life, after having his romantic life secretly videotaped. ♪ [ music ] >> he was an accomplished musician. he was a lot of fun to have around the house. >> he had a very good sense of humor. >> reporter: joe and jane clemente thought they knew everything they should about their son tyler. >> it was just two days before he was leaving for school. and he pretty much just told me, mom, i'm gay. and i was really, really surprised. very, very surprised. >> reporter: while the clementes processed that surprise, tyler began college at rutgers, where he roomed with 19-year-old duran ravi. ravi is accused of using a web cam to secretly stream video of

a sexual encounter between clemente and another man. >> we don't know why tyler committed suicide. all we know is the alleged invasion of his privacy and how he reached out to the r.a.s and how he text a friend that he was upset by that. that's all we know. >> are you angry at mr. ravi? >> we're just overly sad by the whole situation. >> yeah, i think for me, it's not anger. it's really more heartbreak. >> mr. ravi. >> reporter: ravi faces up to 10 years in prison. >> what we're looking for is justice and accountability. and it doesn't have to be a harsh punishment. but an acknowledgment of wrongdoing. >> you want him to apologize? >> that's a very tough question. it certainly would be welcomed. i'm not expecting it. and i don't really foresee it in the future. >> makes no difference to me. i'm not expecting one. >> reporter: what the clementes do hope for is a change in a culture that breeds intolerance.

>> that was michelle miller reporting. the clementes recently set up a foundation in honor of their son, hoping to decrease the suicide rate among gay and lesbian teens. facebook is launching a new service to help peervet teen suicide. -- prevent teen suicide. if a friend spots it, they can notify facebook. this will encourage them to send an e-mail or start an online chat. the national transportation safety board is calling for a nationwide ban on any use of cell phones while driving. the new recommendation, if adopted by states would outlaw all nonemergency phone calls and texting by operators of every vehicle on the road. it would also ban hands-free devices. a crowd of strangers, ban together to save a girl in china, after she gets trapped under the wheel of a car. witnesses say the 5-year-old squated down in a parking lot because she was mad alt her
