bullied and beaten, the family claiming their son suffered torment and the school never came to the rescue. >> now they are taking legal action. hello everyone. >> here is what people are talking about. >> their special needs child was bullied and now they want to know why they didn't do nothing. >> we talked with the parent the taking their fight to court. >> reporter: denise, the family filed a lawsuit after they say their son was bullied and say the school system did nothing about it. this school supposed to be

bully free, but they say for their 10-year-old son, sean, these hallways were a nightmare. >> he's being pushed to the ground and things taken and his lunch money taken and taking books throwing them around. >> reporter: their son, a special needs student was tormented. >> within a couple weeks he didn't want to go to school at all. all. >> reporter: the couple want to the principal countless times. >> phone calls after phone calls after phone calls including the school police. >> reporter: but the bullying wasn't stopped. the last straw when their son was attacked. >> he was choked until he was passed out, carried into the office and then still nothing came of it. >> reporter: they moved their son which was also not a bully free zone. again, they went to school officials for help but say the problem was ignored.

now the family filed a lawsuit against the school board commissioners and the principals of the schools. >> children are actually being hurt and sooner or later someone will seriously be hurt. >> reporter: they hope by taking legal action, it sends a message that the system needs to be fixed. baltimore city schools would not comment on the case because it is pending litigation but they acknowledged the case goes to court tomorrow. reporting live, megan, wjz eyewitness news. >> thank you, meg. according to the school board policy, bullying, harassment and intimidation are prohibited in the school environment. breaking news, inside a bash bar shop a man was shot and the shop on the 2200 block of hard ford road detectives say it looks like the victim is a victim of robbery. at last check the man is in critical condition and police are still looking for the

shooter. two dead bodies unloaded from a florida freight train. tonight we have learned one of them was a young man from baltimore county. how did he die and how did he get some far from home. wjz is live. more on the man's death. >> . >> reporter: denise, we learned the family is devastated he died. in in the meantime the investigation into his death and the death of a companion continues. officials in play florida say this is the first time in the company's history a tragedy like this happened. lakeland is a small city east of tampa. >> this is the first i heard of this happening. >> reporter: what happened is two bodies found in coal on two days. a man and woman who apparently hitched a ride on a freight train. >> the coal cars come on this track and as they come in, they open up, the bottom of the cars. >> reporter: on monday workers found the body of a man in the

coal. he's 25-year-old christopher francis in maryland. his last known address was this neighborhood. on tuesday, the body of a woman was found in the sail shipment of coal. her identity has not been released. a neighbor says that christopher's family is simply distraught over his death. in fact, that neighbor was so upset, she couldn't bring herself to talk with us on camera. autopsy results show artists apparently suffer kateed in the coal. the woman died from blunt force trama, possibly being crushed by the coal. the train originated in indiana. but it's unclear where on that 1000-mile trip to lakeland, florida the two hitched a ride. >> there was some property apparently that was found with the body yesterday. >> reporter: and that properly according -- apparently is the identity of the woman lakeland police apparently know her identity but not releasing it pending notification of kin. >> each train load has

12,000 tons of coal. the search is on for a rapist. take a good look at the sketch. the man raped a woman he met. the attack happened near the medical center. the man then ran away. a local landmark is reduced to rumble. demolition crews tore it down today. the popular restaurant was destroyed by a fire in october. investigators don't know what sparked the fire but the owners plan to rebuild. the occupy baltimore protesters are busy regrouping tonight. the anty wall street group is trying to figure out the next move after getting evicted yesterday morning. the protesters met tonight at the park under the watchful eye of police but they are banned from camping out there. mike reports on where the group heads from here. >> reporter: sky eye flew over after being cleaned up and

and i like seeing the city nice and clean. >> reporter: occupy baltimore demonstrators are increasingly turning to the internet to get out out their message. from anty wall street raids to anty government anger in the middle east, this is a year of protest and today time magazine named the protester it's person of the year. the news magazine says protesters have been quote redefining people power around the world and reshaping global politics. the death of a drum major from a marching band sparks a hazing investigation it stretches from florida to georgia. police believe hazing is wide spread and florida a & m university and dozens of high schools are under fire tonight. robert champion died november 19th found unresponsive after the band performed. his high school district is now investigating two similar incidents that happened over

the summer. >> they directed us this morning to sustained spent all band activities, marching band at our high schools so we can conduct a full scale investigation of activities at the band at the high school level. >> reporter: florida a & m band remember from southwest dekalb tells police she was beat in a a hazing ritual, just weeks before champion's death. three band members have been arrested and charged with hazing. >> this is nothing more than a gang, a gang of young people that have a form of initiation which essentially is a beat down. >> reporter: florida a & m president defends the school's zero tolerance policy. >> every allegation of hazing has been fully investigated and appropriate disciplinary action has been taken. >> reporter: but bria hunter disagrees. she fears for her life and gave up a 82,000-dollar scholarship to leave. university officials suspend the the marching 100 band for

performances until the investigation is complete. the presidential historian accused of stealing valuable artifacts calls his arrest illegal. he said police did not have enough evidence when they arrested him in july. he's accused of stealing historic documents and other archives up and down the east coast. his assistant already pleaded guilty to similar charges. let's make a deal, governor mark agrees to support the take over of consullation energy with major concessions. according to the media partners, they promise to develop more natural grandson, wind and solar power in maryland and provide help to low income customers. they oh posted the $7.9 billion buyout. some unique change could end up in your pocket. the u.s. mint unveiled designs for two new coins today. there is a 5-dollar gold coin and one dollar silver coin to

it's 48 and cloudty. the full forecast coming up. a truck exploded. transportation officials believe the intensity caused damage to the road and overpass. the highway is closed until tomorrow. no injuries reported. they think the brakes may have over heated. surveillance cameras capture two collisions at a store in tennessee. the first one shows a pickup truck crashing through the front window, police say the driver was trying to run down his ex-girlfriend. they say he then stole the suv in the parking lot. the cameras show him driving head-on into a truck.

he's in critical condition but amazingly, no one inside the store was seriously hurt. pepper sprays at school. more than a dozen students are rushed to the hospital after police used the chemical to break up a fight and tonight new developments in a case that has some parents enraged. >> reporter: when a school police officer used pepper spray at a high school tuesday, several other students in the school got sick including a pregnant daniel nickelson. >> my throat was closing up and my eyes were watering. >> reporter: she and as many as 15 other students had to be taken to the hospital for treatment. police released details saying it started when two students wouldn't stop fighting after the officer and a teacher physically tried to break up the fight. >> our officer continued to struggle on the ground with a student as he resisted arrest. the officer warned him that pepper spray was going to be used if there was additional violence and the student then attempted to go after the first

student again. >> reporter: police say their officer is justified to use the pepper spray, state of the unions were temporary evacuated while the school was aired out. >> as a parent, i'm scared for my child and the other children. >> reporter: many parents complained, fights are a frequent problem at the school. >> it's real upsetting to me. it's to the point i'm going to put her out on maternity leave and i don't know she's going back. >> reporter: the two that started are now facing charges as juveniles. derrick, wjz eyewitness news. students report there were extra officers and staff on hand at the school today and there were no fights. the president and first lady make a visit with soldiers to mark the ending of iraq war. they went to fort bragg to welcome the troops home. the last of the 6000 forces will be out of iraq by the end of the month. the president told the returning veterans the jobs bill will

help them to find works because they offer tax credits. while they are leaving iraq the president promised they will help the u.s. with security and military training. a horrible elevator accident claims the life of a 41-year-old woman. the woman's leg got caught in the closing elevator doors. the elevator than shot upwards dragging the woman in the shaft and crashed her. two people were in the elevator at the time. it's not known what caused the malfunction. a leaving doctor's group wants the state to have tougher laws on tanning beds. it will push the general assembly to prohibit the use of tanning devices by anyone under the age of 18. howard county has a similar ban in place. young people that use indoor tanners have an increased risk of skin cancer. a cowboy in colorado decides to ride to the grocery store. now here is the punch line. they road their horses right
