emotional distress. he was apparently under substantial emotional distress. >> reporter: manning's lawyer has argued the case should just be thrown out. >> reporter: he argues the presiding judge is biased, saying if they had their way, they would get my client to be one of the witnesses to go after julian assange. >> manning's defense team would like to call about 48 witnesses, including president obama, hillary clinton, dallas secretary -- former defense secretary gates. if those witnesses are called, it could be a really interesting hearing. >> reporter: so how did he do it? well, the government says even though privacy manning had a low rank, he still had access to all of these confidential files. and in many cases, the government says he would simply take a disk and slip it right into that computer and go out, without anyone noticing. reporting live at fort meade, mike hellgren, wjz eyewitness news. >> all right, thank you very much, mike. and the hearing is expected to last into next week.

there will be large protests outside fort meade tomorrow. >> new information on the wild police chase that ended with the suspect being shot in baltimore county. mary is live in the newsroom with the latest on what happened. >> the suspect remains in shock trauma, in stable condition. he'll be formally charged at a bail hearing. police say it all began in anne arundel county, where police began pursuing the suspect wanted for armed robbery. the chase went for nearly 30 miles, ending in baltimore highlands. the 19-year-old allegedly refused to drop a gun and officers shot him in the leg. tonight, they have linked suspect to an armed robbery wednesday night. an alert was put out for the suspect vehicle, which was spotted wednesday morning. and that started the chase. back to you. >> the 19-year-old suspect faces a number of charges for the robbery. >> graphic testimony at a hearing in the penn state sex abuse scandal. an assistant coach testifies about what he saw between former coach jerry sandusky and a young boy.

manuel gallegus reports from harrisburg. but first, we must warn you, some of what you are about to hear is disturbing. >> reporter: penn state assistant football coach, mike nothing mcqueary -- mike mcqueary left the courthouse giving damaging testimony against sandusky and two college officials. he testified that he saw sandusky, having what he believed to be sexual intercourse with a 10-year-old boy in the shower in 2002. he said he heard quote rhythmic slapping sounds and that he shockingly and surprisingly saw jerry in the shower with the boy. that jerry was behind the boy, in a very, very close position, holding the boy's waist, the boy's hands, up against the shower wall. mcqueary said he didn't try to stop it or call police because sandusky and the boy separated before he left the locker room. he testified he didn't say anything to sandusky, who looked back at him with a blank stare. >> reporter: mcqueary said he

immediately called his father. the next morning, he met with coach joe paterno and told him exactly what he saw, without using graphic language, out of respect. >> reporter: days later, mcqueary testified he made it clear to penn state athletic director tim cleary and vice president schulz, that he saw sandusky, performing, quote, severe sexual acts with a boy. >> lawyers say it's mcqueary's word against their clients. >> had he heard from mike mcqueary that this boy in the shower was being in any way sexually assaulted, he would have remembered that. >> reporter: curly ask schulze are charged with lying to the grand jury about what they knew, charges they deny. >> reporter: manuel gallegus being wjz eyewitness news. >> and just a short time ago, the court ruled there is enough evidence to take the cases of the penn state officials to trial. jerry sandusky faces charges on

high school, had stayed late for tutoring with a teacher before he was struck by a car, then an suv. >> our hearts and our thought goes out to each and every family that has been suffering through this. >> i didn't believe it at first. all my friends kept telling me. and i got on facebook. and i seen "rest in peace, ryan chase" and i knew it was real. >> a lot of kids are here for each other at the school. and this is the time we need to be together. >> reporter: when many arrived, they had not heard the news. counseling serves were -- services were available through the library. >> our students are suffering the loss of a loved one. and we wanted to make sure that everyone was available to voice their emotions, show their concerns and also pull together as a family. as i stated, we are a family- oriented food. >> reporter: -- school. >> no charges have been filed. baltimore's crash team is investigating. >> you don't need to be a parent or grandparent to understand the magnitude of what happened yesterday.

a rare sign. bipartisan cooperation in washington, d.c. republicans and dem democrats reach a deal to avert a government shutdown. still, negotiators are haggling over a plan to extended payroll cuts and unemployment benefits. >> reporter: house lawmaker approved a trillion-dollar plan, funding the federal government through next year. >> the conference report is adopted. >> reporter: leading senators say they'll follow suit, heading off a government shutdown this weekend. but lawmakers are still battling over a bill that would extend a popular tax cut and unemployment benefits. >> putting this money in the pockets of the american people who need it so desperately. and need to spend it on necessities, will inject demand into the economy and create more jobs. >> reporter: the payroll tax cut put an extra thousand dollars in the paychecks of about 150 million americans this year. if it's not renewed, those workers will take home less money in the new year. >> the two parties are divided

over how to cover the costs of the tax break and republicans. to add language that will speed up construction of a controversial oil pipeline. >> reporter: it's a proposed 1700-mile project running from canada to texas that is unpopular with democrats. >> if that bill comes over to us, we will make changes to it. and i will guarantee you that the keystone pipeline will be in there when it goes back to the united states senate. >> reporter: lawmakers have until december 31st to find common ground. but they're not taking any chances. the senate is working on a plan b that would extend the tax break until february, allowing lawmakers to head home and tackle the issue in the new year. on capitol hill, tara mergener, wjz eyewitness news. >> the payroll tax cut bill also includes a provision that extends benefits for people who have been unemployed for a long period of time. maryland is getting a cut of $500 million in grant money for education. the funding will go towards pre-

k schooling. all part of the nation's race to the top competition, where states compete for federal dollars, by making progress in educational standards. nine states are polit splitting the $500 million this time. last year, more than $4 billion in similar grants were handed out. the pounding rains from tropical storm lee caused plenty of problems last summer. but alex demetrick reports, one critical resource, feared damage, appears to have come through better than expected. >> reporter: trillions of gallons of runoff, from tropical storm lee, swept down through the head of the chesapeake. debris spread for miles, turning the bay into an obstacle for watermen at the height of the crab season. >> propane tanks to hot water heaters. >> reporter: then this fall, it kept other watermen ashore, after fresh water from lee. >> when we went out there in november, they were all dead. >> reporter: but what worried researchers was what all of

that bay did. >> that's all wild celery, which is head of the bay stuff. pretty good odds that most of it has come from the flats. >> reporter: the susquehanna flats, where the river merges with the bay. it was feared one of the largest collection of grasses was destroyed. >> the good news is, they're still there. that's the thing we're most excited about, is they survived having the tropical storm comes through. >> reporter: a recently completed aerial survey shows most of the flat's 16,000 acres made it. and because they did, a lot of other life gets a shot as well. >> they're a major habitat for fish and shellfish. and they also provide food for water fowl. >> reporter: but they were no match for this force. >> reporter: agnes -- decimated everything on the flats. but agnes came in june. >> reporter: turns out, timing may have played a big part in the grass's survival. >> it would have made a huge difference. again, hurricane agnes in 1987, when the flats were starting to come up. if that had happened with tropical storm lee, the effects would have been much more su

bigad shaban reports. he had faced up to 21 years in prison. >> reporter: home run king barry bonds left court. a judge sentenced bonds to 30 days house arrest and two years' probation. far less than the year in prison he could have gotten. the judge also stayed his sentence, pending appeal. >> we absolutely believe that barry was wrongly convicted of a felony offense. >> reporter: bonds was convicted in april of giving misleading testimony to a grand jury eight years ago. it was part of an investigation into steroid use among baseball players. when asked if his trainer ever injected him with performance- enhancing drugs, bonds gave eveilsive answers. throughout -- evasive answers. he insisted he thought he was getting injections of flaxseed oil. >> bonds was the last of 11 people implicated in the investigation of balco labs. all the others either were convicted or pleaded guilty.

>> bonds, pitches high. hits it deep. it is outta here. >> reporter: the steroid controversy damaged bonds' legacy in baseball. >> barry bonds is the babe ruth and the willie mays of his era. when a player of that stature comes under question, it begins to bring into question the entire era of the sport. >> reporter: bonds will remain free until his appeal to wipe his record clean. in san francisco, bigad shaban, wjz eyewitness news. >> bonds has 14 days to file an intention to appeal his conviction. the appeals process could likely take a year or more. a critical ruling from a federal judge in a hearing for a man accused of firing shots at the white house. mary has more on this case. >> reporter: and vic, the judge denies the request for a mental health evaluation for oscar ortega hernandez. he said there is no evidence to suggest that ortega hernandez

is incompetent to stand trial. he was accused of shooting a rifle at the white house last month, although the president and first family were not there at the time. he is accused of attempted assassination. friends say he has been acting strangely in recent months and believed he was jesus, and began saying the president was the devil. republican candidates are hard at work, heading into the final weekend of campaigning before the holidays. it comes after they famoused -- faced off in their debate. susan mcginnis has more on that debate. >> reporter: newt gingrich is trying to prove he's presidential material. >> i believe i can debate barack obama. and i think in seven, three- hour debates, barack obama will not have a leg to stand on. >> reporter: the gop front runner spent much of last night's debate, plugging his conservative record and fending off attacks from his rivals. >> we can't have as our nominee for the republican party, someone who continues to stand for freddie mac and fannie mae.

caucuses next month. >> according to politico, mitt romney will pick up an endorsement from nikki haley. she's a rising star in the gop. a woman has been robbing area banks. these are surveillance pictures of the woman investigators are looking for. she's wanted in at least three bank robberies this month alone. investigators say it's rare to see a female serial bank robber, here in baltimore and across the country. three elderly women continue to recover tonight, after being involved in an accident involving a stolen car. it happened around this time last night, here in york road in towson. police were pursuing the stolen car when it spun out of control and struck a taxicab. at least one was taken to st. joseph's medical center. for nonlife-threatening injuries. several people in the car were arrested. four new troopers joined the force today. they graduated from the academy where they were tested. but as mike schuh reports, all of their answers were nonver
