in a car, in the dangerous cold. tonight, derek valcourt has more on how a fast-acting employee in frederick may have saved lives. >> reporter: temperatures were well below freezing on tuesday, when a wal-mart employee spotted a toddler and a baby alone in a car in this parking lot. >> reporter: the wal-mart employee called 911 and waited in the car. they found a 5-month-old baby and a 4-year-old boy alone. their father, 41-year-old sim anosur rockman was placed under arrest. >> you cannot leave a child, under the age of 8, whether it be a home or vehicle alone. his children were much younger than that. >> reporter: deputies were able to determine that the father had been inside the store shopping for more than 20 minutes. >> reporter: on that tuesday, it was 24 degrees here in frederick, with a wind chill of just 11. >> reporter: the children were found to be okay and were released to their mother while rockman was charged with two misdemeanor child abuse charges

of confining an unattended child. he's out of jail now. he was in but he refused to answer the door. at his point of rocks home. >> i think he should be prosecuted. >> reporter: the story upsetting to many parents like ashley reynolds. >> i would hate to think of my kids in the freezing cold. >> you can't let a woman alone in a car like -- children alone in the car like that. >> if convicted, he faces up to 60 days behind bars and a $1,000 fine. in frederick, derek valcourt, wjz eyewitness news. >> and the next court hearing for the accused father is set for march 6th. robbed at gunpoint and then abducted from his home. tonight, police are searching for the suspects. mary is in the newsroom, with more on this crime causing concern in a baltimore county community. >> reporter: well, kai, the victim had just parked his car outside his home, when the suspects came at him with a gun. take a look at these surveillance pictures just sent to wjz by suspects. the city police forced the man

into the car. and then ordered him to drive around to different banks and try to withdraw money from different atms. after more than three hours, he was taken to another bank. people were not told about the crime right away. kai? >> mary, thank you. if you have any information about the suspects, call baltimore city police. >> reporter: a developing story from anne arundel county now. three people rescued from a burning apartment building in glen burnie. it happened in an apartment on tall pines court. a 64-year-old woman was rushed to the hospital with life- threatening injuries. two others were also hurt. and the cause of the fire is under investigation. sadness in one east baltimore community tonight. an 84-year-old woman killed in a house fire. the flames erupted from the row home. after putting out the fire, firefighters found the body of mary heinz on the first floor. she worked for the city school system for decades, retiring as the principal of william tinder hughes elementary in 1991.

the cause of this fire is under investigation. the second district showdown. a new political battle, pitting two veteran maryland politicians, against one another in a district that covers large parts of baltimore and harford counties. wjz is live. mike hellgren has analysis and spoke one on one with nancy jacobs about the challenge. >> kai, she's hoping to tap into what is happening in washington. but she's hoping to get democrats to cross to her side. congressman dutch rupersberg won the seat in the last election by 64,000 votes. >> i'm not a washington insider. i'll never be a washington insider. >> reporter: republican nancy jacobs is counting on the dissatisfaction with d.c. to give her an edge in congress. she served and before that was a teacher, a broadcaster and a realtor. she hopes to be holding democrat congressman dutch ruppersberger's seat next year.

>> what about the benefits that people aren't happy? >> absolutely, it benefits me. i have a record of not being one of those incumbents that becomes part of the system. >> look at my record. look at who i am and look at where we are. >> reporter: but ruppersberger who won in 2003, beat his challengers by more than 2-1 in the last election. and the county still favors democrats. umbc professor, don norris. >> it's very hard to beat an uncumbent. >> i think it's less than anti- incumbensy mood. >> reporter: but senator jacobs has already released this, her first ad, as one of maryland's most recognizable republicans. she promises to make the race competitive. >> that's our number 1 goal right now is to raise money, so i can run the kind of campaign

that we need to run. >> in a statement, mr. rupeersberg says he is look -- looking forward to a fair campaign with all of the candidates. reporting live, mike hellgren, wjz eyewitness news. kai? >> jacobs recently stepped down as minority leader in the state senate to focus on this race. >> another carbon monoxide incident in baltimore. it happened in the home in the 1900 block of north washington street. firefighters found dangerously high levels of the odorless gas. four people had to be treated for the co poisoning. no word on the location of the gas. excitement is growing. less than two weeks until the ravens' home play-off game. wjz is the place for complete ravens coverage. local businesses are getting a boost. first, sports director mark viviano speaks with quarterback joe flacco from owings mills. >> yeah. joe flacco. >> he's been called joe cool for his calm demeanor. but joe flacco knows the heat gets turned up in january.

dna ferredz is the -- evidence is the focus. wjz is at circuit court in towson. weijia jiang has details from the courtroom. >> reporter: the state rested its case this afternoon, as expected, all of the testimony we heard was extremely graphic. just a warning for some of our viewers, the language used may be difficult to hear. >> in court, 26-year-old davon perry turned and smiled at his father, after the jury will decide his fate heard critical

testimony that could help his case. perry is one of three men accused of gang-raping a 13- year-old girl inside skate works, a woodlawn skating rink. >> this is the doorway. where the victim alleges that three young men took her. >> reporter: the child testified that in august 2010, the men dragged her to a storage room, then took turns, forcing her to have oral sex and intercourse. on the witness stand, two police officers working security that night, told jurors, the girl was completely covered semen. on thursday, a forensic scientist said, there was not a single trace of perry's dna on or inside the victim. after processing several pieces of her clothing, a standard rape kit and swabs of her body. but the expert also said a lack of dna in sexual assault cases does not clear a suspect and says he may have not ejaculated or he used a condom. he might not have viable sperm or had a vasectomy.

or it simply didn't show up. attorneys fired back. tracy henkins admitted to having sex with the girl. his dna showed up, too. prosecutors also relied heavily on surveillance video to show perry was at the scene. a jury will decide if it's enough to convict him. >> reporter: and based on the evidence, the judge and the state threw out several charges in the 29-count indictment against perry, but he still faces second-degree rape and second-degree sex offense amongst others. reporting in towson, weijia jang, wjz eyewitness news. a 5-year-old girl is left on a school bus after falling asleep. the child woke up outside the driver's walkersville home. she then went to the house and then asked the driver to take her to the school. an investigation is under way. the driver will likely be punished for failing to check his bus, after the last stop. supporters of same-sex marriage in maryland have a new

ally tonight. and it's a potentially powerful one. members of organized labor say it will do whatever it can to get same-sex marriage passed into law. >> with this ring. >> with this ring. >> i thee wed. >> i thee wed. >> when same-sex marriage was legalize last year in new york, supporters in maryland thought it could happen here. and today in baltimore, the afl/cio announced it would fight for it. >> and we expect the full support of all of our affiliates to make sure that it becomes law in the state of maryland. >> reporter: that support will put pressure on state legislators in the upcoming session. but it is also driving a wedge into some who normally back union issues. >> i'm very, very disappointed. i will continue to support afl/cio, except on this issue. >> reporter: labor is generating optimism. same-sex marriage could become

law. >> i think it really demonstrates the support that is out there for marriage equality. >> organized labor now enters in 2012 in what is sure to be a political fight in annapolis. and the outcome couldn't be more personal. because i am in a relationship, we have children, we both go to work. and she wants to have the same rights to take care of my daughter, like i would want to take care of hers. we will defeat this bill in the house. but if not, we certainly will defeat it in referendum. >> reporter: meaning even with big labor support, same-sex wedding invitations in maryland remain on hold. alex demetrick, wjz eyewitness news. >> when the legislative session opens later this month, governor o'malley will introduce a same-sex marriage bill for debate and vote. if you're looking for something to do this weekend, how about a trip to the maryland zoo in baltimore? the zoo will be opened friday, through monday, from 10:00 to 4:00.

being acquitted of killing her daughter, we are seeing and hearing from casey anthony. mary is in the newsroom with more. mary? >> the video is from a video blog. from casey anthony. >> just surreal how much has changed since july and how many things haven't changed. >> this entry in her video diary was made back in october. anthony only briefly mentioned her former legal problems, talking about her probation. she mostly talks about her new computer and dog. back in july, anthony was acquitted by a jury of the first-degree murder of her daughter caylee. in the video, she gives no clue about wheresly is now -- where she is now living. >> reporter: anthony is now on probation for lying to police about caylee's disappearance. hockey fans, taunting and

then attacking two new york rangers fans. it happened after a game earlier this week. one of the victims is a former marine who earned the purple heart in afghanistan. both victims are recovering. police are looking for their attackers. a man visiting a family gets into a fight and nearly kills an infant. 34-year-old steven morningstar is being held on $100,000 bail right now. police say he was at his father's house in union town when he got into a fight. at some point, he left the house and then came back, storming in. grabbed his 22-month-old niece and threw her onto the asphalt in the driveway, when his father intervened, he hit him in the head. the infant suffered a skull fracture but is expected to recover. a frightening case of animal cruelty tonight. their search for their puppy in middletown ends in heartbreak. >> reporter: it happens in a rural area in middletown.

in 7-month-old golden retriever, hider, -- heidi, was taken in. she couldn't find heidi. then three yards from her home, she found the puppy's body. heidi had been shot three times. >> if she had been hit by a car, i could understand it. but this is beyond my comprehension. it is just totally beyond my comprehension that somebody could do this. >> kaufman says due to the size of the woundoss heidi, she believe -- wounds on heidi, she believes she was shot and killed by someone at close range. >> reporter: fbi says they're trying to recover forensics from the animal's body. and that they have two credible leads. i'm mike schuh, wjz eyewitness news. >> anyone with information about the shooting or who heard gunshots, you're urged to call animal control in frederick. time now for a quick look at stories you'll find in the baltimore sun. second year tight-end has

custody, after suffering nonlife-threatening injuries. they say he has limited criminal history. an investigation at a ski resort in massachusetts. police say a teenager fell 30 feet from a ski lift. he was rushed to the hospital where he was pronounced dead. they say the member was a -- the victim was a member of the high school ski team. the owner says there were no mechanical issues with the lift. a wildfire is being blamed for a major highway accident in southeast texas. police say at least 50 vehicles were involved in this series of collisions. dozens of people were injured. four of them critically. poor visibility was the result of fog, mixed with the smoke from the wildfire. wildfires have been sweeping through the dry marsh lands for over a week. in tonight's tonight's consumer watch, chevy volt is asking customers to return. the move comes after three volt batteries caught fire at
