judgment day. a man convicted of murder without the victim's body. >> now, jason gross learns his sentence for killing a 16-year- old girl. >> hi. i'm kai jackson. and i'm mary bubala. >> a baltimore teen missing. her body never found. today, an essex man convicted in her murder is sentenced. jason gross learns how long he'll spend and pay for the crime. >> reporter: with the core of the county homicide squad, which worked this case, occupying the entire back row, the victim's mom was on the edge of her seat, quietly crying, hugging a large, stuffed animal. the jason gross sentencing had become. >> reporter: the cell phone records of 16-year-old rational battle led them to her home and then here. the jury believe it happened here. that jason gross had invited her to his rental home for sex.

then killed her and got rid of her body in an incinerator in the outback. today, her mom, too tearful to take the stand. the girl's father read a statement, saying that their lives are now empty. >> reporter: in the end, the judge believed the prosecution's case and sentenced gross to 30 years for the homicide and 10 years for the sex offense to be conserved consistently. and said that he should not get out of jail until at least half of his sentence is serviced. >> judge cox today gave him the strictest sentence, 40 years. and at least we can be sure that people are safe from him for that amount of time. but it is a tragic case. >> reporter: but a friend of gross's, who testified on his behalf is disappointed. >> i've known him for 20 years. i think he's innocent. i believe him. that's not to say he's without

his demons. >> this is the second time in baltimore county that a jury has convicted the accused of murder, even though a body was never found. >> reporter: her sudden death shocked her neighbors. now, police say a city woman killed in a fire was, in fact, the victim of foul play. alex demetrick is live in the newsroom with more on the death of a long-time city schoolteacher. >> police are now ruling 84- year-old mary heinz' death, a homicide. firefighters put identity a fire yesterday and found her body today. a medical examiner says heinz had been stabbed multiple times. it's unclear if the stab wounds cleared heinz. it's also unclear if the fire was set to cover up the murder. mary heinz is a retired schoolteacher. she was known to the neighborhood as miss mary. >> we will have the latest from police on this developing story. coming up all new at 5:00 and 6:00. the search continues right now for two men wanted for abducting a man outside his

bolton hill home. take a look at these atm surveillance pictures. police say the 45-year-old man was kidnapped from the driveway of his home. the suspect stole the man's belongings and his car, but not before they drove him to several atms to withdraw money. if you recognize any of the suspects, you're asked to call baltimore police. illegal quota? a judge is questioning the motives behind some illegal traffic stops. at least one case is thrown out because the judge says officers are being told to make a certain amount of traffic stops each hour. at least two other county cases may be affected by the ruling. howard county's police chief says the ruling will be appealed. hear what the police chief says about the charges being dismissed all new at 5:00 and 6:00. where has winter gone? answer? we don't know and we don't care. just kidding. it was pretty hard to find people outside today. nobody really needed it. many people ditched those coats

archdiocese will soon hold one of the most powerful positions inside the catholic church. today, pope benedict named archbishop edwin o'brien a cardinal. >> reporter: baltimore archbishop, edwin o'brien, one of just two american church leaders, named cardinal today at the vatican, with hundreds looking on. we spoke with now cardinal- designate o'brien from rome. >> i knew it was going to happen. but i'm a fatalist, i still didn't believe it would, from the very begins of this whole thing when i heard rumors. it's especially unique. it's an honor and a responsibility. >> reporter: today, local patricianers -- parishioners are learning of the news. it has only happened three other times in baltimore, 1995, 1989 and 1886. >> it's just great. it's a feather in baltimore's cap, and an honor for him. to be respected this way and for the pope to honor the service he's done.

hi, everyone. a lot to talk about. plenty of brake lights, from 195 to the beltway. in that little area, it will take you at least 15 minutes to get through. as far as the beltway goes, 20 minutes away. around the west side inner loop, from 95 to security boulevard. and the top side inner loop, really struggling there from york road to perring parkway. top side outer loop, all system congestion in that area. heavy from dulaney valley road to the harrisburg expressway. and plenty of accidents to talk about. west pedonia road at round wood. churchville road at mooresville in bel air. richie highway at 8th avenue. and also york road in baltimore city. let's take a live look. you can see, we do see some slowing there, 95 at the southwest side. and plenty of congestion, 95 north in cecil county. we have an accident at the northeast section that is really backing that traffic up as you can see. this traffic report is brought to you by subway.

three trains collide. take a look at this video into our newsroom. it happened north of val parizzo. -- valparaiso. no evacuations are planned so far. and no injuries have been reported. we'll keep you updated. other incredible pictures to show you, out of minnesota now. take a look. the driver of this target truck lost control, went off the highway and ended up in a frozen lake. the truck sunk down to its windshield. as we can see, the driver was able to crawl out after the accident and cross the pond's icy sheet to safety. he was treated and released with just minor injuries. a police chase ends in a dramatic fashion in oklahoma city. take a look at this. officers say four robbery suspects were in a car that ran a red light and was hit by a truck. two more cars then collided with a wreck. no one was seriously hurt. the suspects ran as you saw, but police caught up with them and arrested all of them.

red wine may help lower a woman's chance of developing breast cancer. the new study suggests that previous studies have shown alcohol may increase the risk of breast cancer. edward lawrence reports for wjz in today's healthwatch. >> reporter: many people love an occasional glass of wine. >> i enjoy a glass of red wine. >> reporter: for years, women have been told that lowering alcohol can lower their risk of breast cancer. now, they are being told that drinking moderate amounts of red wine can lower the risk of disease. they looked at 86 women who drank cabernet daily for almost a month. then switched to the other. they saw a difference in the women who drank red. >> in red wine, the hormone levels decreased while the testosterone levels increased. it may be a change in risk

factor for breast cancer risk. >> the change in hormone pattern suggests red wine may prevent the growth of cancer cells. >> reporter: the new findings challenge much of the research on alcohol. one study late last year found a woman had a 15% increased risk of breast cancer if they drank 3 to 5 a week. >> red wine has red grapes, the red seed that goes into the processing of making that. and that's having the fighto chemical. whereas white wine did not change those. >> reporter: the study's author says just how safe red wine is and how effective it is in reducing cancer risk remains to be seen. >> about one in eight women

will get breast cancer in their lifetime. it was a sluggish day on wall street. overall, more people report finding work. but investors didn't appear to be impressed. here's a look at the closing numbers. dow is down 56 points. s&p down 3. and nasdaq is up 4. let's go to new york now. alexis christoforous has tonight's cbs money watch update. >> reporter: the labor market is showing signs of strength. but that forbade the buying here. lowest level in nearly three years. u.s. employers added 200,000 workers. it's the 6th month in a row that the economy has generated at least 100,000 jobs. europe's debt troubles and china's slow economy are still overshadowing. italy's borrowing costs spiked to dangerously high levels.

we're warm, actually. especially where the sun is out. we have 51 degrees in our higher elevations, out toward oakland. 60 in cumberland. 55 in elkton. 63 in patuxent river. annapolis at 64. so these temperatures are just incredible for this time of year. again, we expect to see this trend, with us for the foreseeable future. of course, we know it's going to change but not in this forecast. we have 14-mile-per-hour winds. steady winds are actually blowing at a pretty decent clip. but with 12-mile-per-hour winds, 13-mile-per-hour winds, 13 on the shore. with temperatures this mild, we're not talking about any kind of wind chill at all. just a light breeze blowing through the area. the jet stream is the dividing factor between the very cold air and the warm air. you can kind of watch this line of clouds. that is really the line of the jet stream. so the cold air is forced way up into capada.

commanders say 15 pirates seized the boat more than 40 days ago. the iranian captain on board issued a distress call. the pirates surrendered without a fight. >> we fundamentally recaptured the ship and returned them to custody. >> reporter: this came just days after iran took a bold stance against the u.s., threatening to close down the straits of hormuz. >> reporter: defense secretary leon pineta told bob schieffer, the mission should send a message to iran. >> it make its very clear to them that despite how much they often try to provoke us, that the united states, in this kind of situation is going to respond as we should, in a very humanitarian, responsible way. >> reporter: the rescue operation caps a week of

growing tensions between tehran and the u.s. after president obama signed tough new sanctions into law. the measures are designed to punish iran for moving forward with its nuclear program, by making it harder for iran to sell its oil. >> reporter: at the white house, tara mergener, wjz eyewitness news. >> now, the iranian government has not acknowledged the mission. but navy officials say the fishing boat's capt expressed his gratitude after the pirates were taken into custody. >> the man suspected in the disappearance of natalee holloway, the american teenager, and charged with murdering a college student in peru, appears in new york. >> reporter: a court in peru just granted jor an van der sloot more time to decide how he wants to plea in the murder case in peru. he is accused of killing 21- year-old stephany flores in a hotel room in 2010. just as it seemed he was about to enter a guilty plea, van der sloot asked for more time to decide what he wants to do.

the flores family wants justice. >> we need justice. he's psycho. murderer. and he has to pay. >> van der sloot, who is 24, was once the prime suspect in the unsolved 2005 murder of natalee holloway, a teen from alabama who vanished in aruba. she was last seen with van der sloot. >> thank you, kai. the current murder case against van der sloot was postponed until wednesday so again he can decide on a plea. baltimore police are looking for the man who sexually assaulted a transgendered woman. back in november, police say this man assaulted the 16-year- old victim in the 2100 block of hunter street. anyone with information is urged to call city police. >> the fbi is changing its longstanding definition of "rape" to now include men. the original devination --

definition was quote a female. it now includes any gender, a victim or suspect and instances in which the victim is unable to give consent because they are under the influence of drugs or alcohol or because they are too young. the maker of a popular medicine for children, is being sued by a couple who lost their child. daniel and katie moore of washington state say their 2- year-old son died after being given some tylenol from a batch that was recalled. the child was given children's tylenol for a slight fever in 2010 and began spitting up blood a few seconds later. he died from liver poison. johnson & johnson says its recall was not related to the allegations in the lawsuit. frederick county public school officials are investigating how a 5-year-old girl ended up asleep and alone on a school bus instead of at

her elementary school. pamela brown has more on what happened. >> reporter: on tuesday, 5-year- old camia myers fell asleep on her school bus ride from this day care center from glade elementary in walkersville. but she woke up in the wrong place. >> i bet she was terrified. i bet she didn't even know what to do. >> reporter: according to frederick county spokesperson, the bus driver failed protocol, failing to sweep the bus before driving home. >> the bus driver reports she left the school, drove her bus home, and upon arriving there, was cleaning off the bus and discovered the child. >> reporter: but myers' mom, kiki, who didn't want to go on camera tells a different story. her daughter told her she woke up on the bus alone and felt scared. she found directions to pull on the bus door and knocked on the door. she said someone wasn't doing their job. we're just glad it wasn't a situation where there was a

who admits he tried to blow up an airliner. omar farouq mutalab will now get his sentence february 16th. it gives more time to review a mandatory pre-sentence report. he pleaded guilty. a 15-year-old u.s. citizen who was mistakenly deported to columbia, is on her way home to the united states. jack adrian turner wound up being deported after u.s. authorities mistook the girl who lacked identification for a columbian national. jack adrian's family said she left home in november 2010. houston police arrested her in april 2011, and she claimed to be a columbian woman born in 1990. the family is planning a lawsuit. the mother of a german man, suspected are setting at least 50 arsons in los angeles is expected today on fraud charges. kai is here with more on the

hearing. >> reporter: that's right, denise. dorothy burkhart was charged with 19 counts of fraud in frankfurt. she's accused of failing to pay for a 2004 breast augmentation surgery and from pilfering rent money from renters. this is part of a rash of fires in hollywood. authorities say they believe he was angry over his mother's legal troubles. >> burkhart is also under investigation for arson in germany. his mother says her son is mentally ill. some oklahomans found a big problem in the yard this week. dana hurtne reports the kkk is explaining their actions. >> reporter: at first glance, the flyers, tucked into plastic bags, with a couple of rocks, hardly warranted a second look. lorna davis walked right past it and didn't read the flyer
