been ruled a homicide. >> why would someone want to do that to her and then set her house on fire? no. i don't understand that. >> reporter: neighbors describe mary as a sweet and quiet woman, who most days would sit on her front step and chat with people in this negotiate baltimore neighborhood. >> -- north baltimore neighborhood. >> she was a really sweet lady. she went to church. and she always said hi to everybody. >> reporter: and neighbors are trying to come up with any reason as to why this would happen. >> i said to my husband, do you really think they were at the right house? >> reporter: police are also looking for answers and a possible motive. because whoever came into this house and committed this horrific crime, is still walking the streets. neighbors can only hope that justice catches up with them. >> whoever did it, they hope they get what they deserve. >> that was monique griego

reporting. neighbors say miss mary lived alone. police are still trying to figure out if the fire was set to cover up the. a man is shot. it happened in the 8,000 block of ians alley. two masked gunmen approached gregory sears in the back of his house and they later shot him. he later died at shock trauma. police believe it was a robbery attempt. anybody with information should call police. a woman's drunk driving charges are thrown out in howard county, after a judge rules her arrest is linked to an illegal practice. wjz is live. weijia jiang explains this controversy. >> hi, kai. and hi, everybody. the practice here is using a quota system. the defendant's lawyer said howard county police were asked to issue a certain number of citations. and that is against the law. >> reporter: when 22-year-old katie clark and bush was pulled over for speeding, she was also

charged with drunk driving. the amount of alcohol in her blood, more than twice the legal limit. but this week, a howard county judge threw out the dui charges. wjz obtained a copy of the police memo at the center of the case. in it, a supervisor advises dui patrols, an average of 2 to 4 citations must be written per hour by each officer or future federal funding may be withheld. >> reporter: it also said you need to stop as many vehicles as possible, looking to make a dui arrest, and warnings don't count. his lawyer says even if his client was drunk, it's irrelevant. >> the only way to teach you not to violate people's people's constitutional rights is to say that you don't get to move forward with it. this is the wrong way to go about it. >> the judge has not issued a statement or commented about

why she made the reversal in this ruling. >> this judge made a ruling i don't agree with. >> howard mcmahon says the district does not use quotas ever. >> this traffic officer is committed to safety. it was a well-intended memo. in retrospect, not worded well. >> the officer did the best they could. and because of an administrative issue, the case got thrown out. >> reporter: and the police chief is consulting with the state's attorney to determine whether they will file an appeal. but right now, that drunk driver will not face any charges. we're live. weijia jiang, wjz eyewitness news. >> it's unclear how many howard county cases, similar to this one, might be affected by the ruling. the leader of the baltimore archdiocese will soon hold one of the most powerful positions inside the catholic church. today, pope benedict named

archbishop edwin o'brien a cardinal. >> baltimore archbishop edwin o'brien, one of two church leaders named cardinal today, with hundreds looking on. we spoke with now cardinal- designate o'brien from rome. >> i knew it was going to happen. but i still didn't -- i'm a fatalist, i still doesn't believe it would. from the very beginning, when i heard rumors. it's especially unique. it's an honor and responsibility. >> reporter: today, local parishioners are reacting to the news. in the history of baltimore, it has only happened three other times. in 1994, 1965, and 1886. >> it's just great. it's a feather in baltimore's cap. and certainly it's an honor for him to be respected this way and to have the pope acknowledge the great service that he's done. >> it is a great honor. and for catholics, it brings a lot of blessings to the city as well.

>> reporter: he came to the city in 2007, succeeding cardinal william keeler. he worked to reverse the decline in enrollment at catholic schools. he will now continue to serve in baltimore until a successor is installed. >> i'm happy the nomination came out while i'm still in a leadership position in baltimore. the church is the light of so many lives. and so often, the only time we make headlines is when things don't go too well. we're not perfect. but we're doing our best. and i think we're accomplishing a lot. >> o'brien will be back in baltimore later this month before leaving for a mission in haiti. the vatican will hold a ceremony to formally elevate him to cardinal on february 18th. anyone interested in saving the baltimore grand prix needs to do it now. denise is in the newsroom with more on a key deadline for the popular racing event. denise? >> reporter: baltimore leaders

say parties who want to take over as organizers of the grand prix need to submit a proposal by tomorrow. this comes after the mayor terminated the contract with baltimore racing development because the group failed to pay its debt to the city. now, at least two different teens are expressing interest in taking control of the race. but they must demonstrate they have the money and the experience to run the event. for now, indy car still has the race through downtown baltimore, scheduled for labor day weekend. kai? >> denise, thank you. last year's race drew about 160,000 spectators. the winners of maryland's $128 million power ball ticket finally came forward. a couple came to claim it. they are the sole winners of the jackpot, and they are choosing to remain anonymous. the winning ticket was purchased christmas eve in cecil county. >> well, now we know, kind of. ravens are getting ready for the play-offs. and one of the keys to their

successful season, certainly has been terrell suggs. mark viviano takes a look at what may be the nfl's best defensive player. >> reporter: well, terrell suggs has already produced a movie. and he tells us this week that his next endeavor may be a singing career. but for now, his focus is football. >> reporter: he's one of the most feared pass rushers in the league. leaving the raiders with a career high 14 sacks this season. but as far as terrell suggs is feared, he is also funny. his nonstop entertainment offers the ravens comic relief. >> i just try to be me. i just try to be myself. i guess some people think i'm funny. >> the locker room is probably his best side, the way he interacts with guys, his personality. you can't say enough about the guy. >> he's a great guy. he is a great teammate. you know, obviously, you hear him coming. we're in here. you hear him all the way in the

live here on wjz. we're enjoying some warm weather right now. it's an absolutely gorgeous friday night. and feels more like spring time than january. wjz is live with first warning weather coverage. meteorologist tim williams and bob turk are tracking the mild temperatures. >> last hour, take a look at these numbers. this is about 30 to 40 minutes okay. -- ago. we were sticking at 62 degrees this afternoon. it actually got a little warmer. tim will talk about that in a minute. 50 in oakland. we dropped a little. currently, we just dropped to 59 degrees. it's been a crazy week. tim has a look at these temperatures. >> bob talked about the temperatures right in the 60s. well, we have had a roller coaster, basically a january swing, if you want to call it that. we started off this week with temperatures around 50 degrees. down to freezing on tuesday. that was the high. wednesday, 41. and then right back up yesterday to 46. and today, we have officially topped out at 63 degrees. the record was 72. so nowhere near that.

south carolina. focusing his attacks on president obama. >> what would happen if we elected someone without experience to the white house? now we know. >> reporter: and his campaign strategy appears to be paying off. a new poll of south carolina voters shows romney gaining 17 points since last mont, knocking a stumbling newt gingrich to third place. rick santorum jumped from 4% to a second-place 19%. and after a strong finish in iowa, santorum is drawing large crowds in new hampshire. but voters here are also asking pointed questions. >> i was wondering how you say that you want less government control, except you say that they can adopt kids and seven in the military. >> -- serve in the military. >> but it's not a right. it's a privilege. same thing with marriage. >> hoping to put a death to mitt romney's big lead. and to say that his motto, live

it's still crazy. the average high now, 41. average low, 25. the record, 72. not that far off this afternoon. the record low, 5, in 1904. southwest winds brought the warm air in. it was in the 70s in carolina, georgia, florida, low 80s. so that warm air just came right up the east coast. i mean, it's even warm up into pennsylvania and new york state. portions of new england were in the 40s and 50s, which is still way above normal. southwest winds, until tomorrow night. we go back to the west/northwest. still running above normal. here in the east, not much going on. there's a weak front to the north of us, with clouds. and it will pass through the area tomorrow night. may give us a few clouds from time to time. and the winds go back to the northwest. and they'll drag a little cooler air coming in from the griks. -- great lakes. but it's certainly not frigid air. temperatures dropping probably about 10 degrees or so on sunday. and monday, still above average, but back in the 40s.

tonight. an essex man learns his fate after he's convicted of murdering a 16-year-old girl, even though her body was never found. mike schuh was in court, as jason gross was sentenced for killing rochelle battle. >> with the core of the county homicide squad which worked this case, occupying the entire back row of the courtroom, the victim's mom was on the edge of her seat, quietly crying, hugging a large stuff animal. the jason gross sentencing had begun. >> reporter: the cell phone records of 16-year-old rochelle battle, first led investigators, then her family here to chase. they believed what they were told happened here. that jason gross, first invited her for sex, then killed her and got rid of her in an incinerator. today, her mom, too tearful to take the stand. the girl's father read a statement saying their lives were now completely empty.

>> reporter: in the end, the judge sentenced gross to 40 years for the homicide, and 10 years for the sex offense to be served consecutively, and said he should not get out of jail until at least half of his sentence is served. >> judge cox today gave him the maximum sentence. 40 years. and at least we can assure safety from that man, that sexual predator, for that amount of time. and so for those reasons, i am happy. but it is a tragic case. >> reporter: but a friend of gross's, who testified on his behalf, is disappointed. >> i believe in him. i think he's innocent. i've known him for 20 years. that's not to say he's without his demons. >> reporter: gross's public defenders say they will appeal his conviction. this is the second time a baltimore county jury has convicted an accused of murder, even though a body was never found. police are still searching for the men responsible for an abduction in bolton hill.

the suspects are caught on an atm surveillance video, as they withdraw money from the victim's bank account. investigators tell us these men held the victim at gunpoint, forced him in the car, and drove around with him to various banks for three hours. anybody with information should call city police. an abortion doctor is brought back to maryland to be arraigned on murder charges. denise is in the newsroom with more developments on this high- profile case. >> reporter: at his first court appearance, a cecil county judge ordered the man held on half a million bail. dr. steven brigham is charged with five counts of murder. the counts are related to an elkton abortion clinic. when they searched the clinic, they say they found nearly three dozen late-term fetuses in a freezer. court records show dr. brigham posted bond, but it is not clear whether he has been released from custody yet. another doctor remains in

custody in utah. awaiting extradition to maryland. frederick county school leaders are investigating how a 5-year-old girl ends up asleep and alone on a school bus, instead of at her elementary school. pamela brown has more on what happened. >> reporter: on tuesday, 5-year- old camia myers fell asleep on her school bus drive from this day care center to glade walker elementary school. but she woke up in the wrong place. >> i bet she was terrified. i bet she doesn't even know what -- didn't each know what to do. >> the bus driver failed protocol to sweep the bus before driving to school from her home. >> the report says that she drove the bus home. and upon arriving there, was cleaning the bus and discovered the child. >> reporter: but myer's mom kiki, who didn't want to go on camera tells a different story. she said her daughter woke up on the bus and felt scared. she followed direction to pull

on the bus door and knocked on the bus driver's front door. in a statement, kiki myers says someone wasn't dog their job. we're just glad -- wasn't doing their job. we're just glad it wasn't something involving a pedophile. the principal wasn't notified about the incident until the next morning. officials blame miscommunication. >> i think there's a responsibility that the school has to notify parents. >> reporter: myers says her daughter will no longer ride the school bus. other parents say they understand why. >> it's crazy. i don't really like him riding the bus anymore. because anything can happen. >> another bus driver says the driver in question is experienced and has a clean driving record. the school says disciplinary actions will be taken. a minnesota man is literally dragged off a plane, after allegedly attacking a flight attendant. the incident captured on video

by are the passengers. ellen was removed from a night after getting into a drunken altercation. chavez is being held on a misdemeanor count of assault. well, the air force academy is charging three of its cadets with sexual misconduct. all three attended the air force academy in colorado springs. they were reportedly involved in separate incidents in the last three months, including one accused of rape. these charges come just a week after a department of defense report found a sharp increase at the nation's military academies. the pentagon is investigating whether hollywood producers were given classified information about the mission to kill osama bin laden. the decision follows the new york times article, which claims the defense department leaked secrets about the takedown to filmmakers. the movie about bin laden's asasination is expected to be released in september.

aalexis christoforous has december numbers. >> reporter: the unemployment rate is at its lowest level in nearly three years, dropping to 8.5% in december. employers added 200,000 new jobs. [ applause ] >> reporter: the news was a boost for president obama, who said the economy is continuing to heal. >> we have made real progress. now is not the time to stop. >> reporter: chris boris hopes the hiring trend will help him find a grob -- job. >> you just have to get out there and put the word out there and just let nature take its course. >> reporter: boris worked at a financial services company for 10 years before his position was cut in december. while jobs remain tight in that industry, most other sectors were hiring. and for the year, the economy gained 1.6 million jobs. >> reporter: economists say the unemployment report makes real, meaningful improvement. >> reporter: the stock market

reaction was luke warm, as investors worried that europe's financial troubles could overshadow the progress here at home. >> if europe does go into a deep recession that is going to affect our expoarltds here, -- exports here, that's our corporation. >> reporter: for now, though, companies are showing the best hiring trend in over five years. >> reporter: people tell me, when one door closes, another opens along the way. and you have to trust that. >> reporter: even with december's gains, there are 6 million fewer jobs than they there were before the recession. and economists say it could be years before they catch up. >> reporter: alexis christoforous, wjz eyewitness news. >> the labor department also revised the november unemployment rate from 8.7%. up from the original report of 8.6%. >> this weekend, congresswoman gabrielle giffords will return to the arizona shopping center, where she was shot in the head. giffords and her husband will attend sunday to mark the

anniversary of that massacre. jared loughner is accused of that shooting during a meet-and- greet. in today's healthwatch, red wine may help lower a woman's chance of breast cancer. edward lawrence reports for weenl. the new study challenges previous findings. >> reporter: many people love an occasional glass of wine. >> i enjoy a glass of red wine. >> reporter: for years, women have been told limiting alcohol can lower their risk of breast cancer. now, new research shows drinking red wine in moderation could help lower the chance of disease. they looked at 36 younger women, who drank 8 ounces of cabernet savernon. then switched to the other type of wine for a month. they saw a difference in the women who drank red.

>> in this, the hormones decreased while the test testosterone increased. >> reporter: dr. cassandra shufelt said that is encouraging because the change in pattern suggests red wine may prevent the growth in cancer cells. one study late last year found that women had a 15% increased chance of breast cancer if they drank 3 to 6 drinks a week. >> for taste, i actually prefer white wine. >> dr. shufelt said they didn't see the same protective effects with white wine. but that doesn't mean it ups the risk. >> the red wine goes into the processing of making that. and that's been found to help fito chemicals. >> reporter: more research is needed to confirm this small study. the study's authors say just how safe red wine is in reducing cancer risk remains to

though. a fourth man is still on the loose tonight. a group of firefighters gather together to save a man pinned beneath a car in oregon. another car couldn't stop in time. that vehicle rolled over. the man pinned him facedown in a busy intersection. cedown in firefighters used brute strength to lift that 3200 pound -pound car. >> i was just impressed how fast and how quickly those guys were able to lift that up in the air. just kind of a test to the quality of guys we have working here. and some of my coworkers, these guys are pretty amazing. >> reporter: paramedics rushed the victim to the hospital, where listed in serious condition. police say the man made an illegal lane change. one man's attempt to shorten his commute lands him in trouble with the law. the man said he started hauling around, my goodness, a fake skeleton, so he'd be allowed to drive in the carpool lane.

custody. >> reporter: the u.s. navy rescued a fishing boat from iran that had been taken over by suspected somali pirates in the northern arabian sea. this video from the military shows the operation in progress. commanders say 15 pirates seized the boat more than 40 days ago. the iranian fishing boats capped an issued distress call. the pirates surrendered without a fight. >> we fundamentally recaptured the chip. and took the pirates into custody and returned the ships to iranian control. >> reporter: the rescue effort came just days after iranian commanders took a bold stance against the u.s., threatening to close down the strait of hormuz. and telling a u.s. warship not to come back. >> reporter: in an interview for sunday's face the nation, defense secretary leon pineta told bob schieffer, the mission should send a message to iran.
