wjz crews are on the scene. meghan mccorkell has the latest on the man's condition. >> reporter: denise, we have just learned that the lexington subway market station has just reopened. things have significantly calmed down here. but take a look at this video from sky eye 13. this is just from half an hour ago. a man pulled out from under a train. we know that man has been rushed to shock trauma. witnesses tell us the man was in a wheelchair, and he just tipped forward and seemed to fall right on the tracks. now, firefighters tell us they did find a wheelchair on the tracks with that man. we talked to one witness who was on the platform and saw the whole thing go down. >> when the dude fell on the train, like when he tipped over, and when the train was coming, like a lot of us, we were trying to tell the train to stop. and that's when the train ended up on top of them. >> reporter: now, amazingly, when firefighters reached that man, they tell us that he was conscious. he was able to talk to him. -- to them. they had to put him on a back

board and free him, then drag him on that back board, underneath the train for about 100 feet. that's how they wound up detting him out. now, we know that he suffered both bruises and abrasions. tonight, he was rushed to shock trauma. but you can see, lexington market subway station, back open and in business tonight. for now, i'm meghan mccorkell, wjz eyewitness news. >> all right. thank you, meghan. and of course, we'll bring you the latest on the victim's condition as the information becomes available. another developing story tonight. a judge denies bail for the young man accused of killing his father. >> reporter: well, kai. that teenager is charged as an adult. in court today, he appeared very timid, polite and yufnlgt but prosecutors -- young. but prosecutors call him a serious danger to the community. >> reporter: 16-year-old robert richardson iii was ordered to

custod's custody after the judge denied his bail. he is accused of killing his father and dumping the lifeless body into a pond. in court wednesday, the judge said the issue is too serious for bond to be considered. he also called richardson a flight risk, based on the chase he led police on through harford county. >> when the vehicle approached. the vehicle fled away from him, southbound on 24, through the town in bel air. >> reporter: richardson crashed into a cinder block wall, outside a bel air church. that's when he admitted to the murder and told officers he hid bethe -- the body behind the pond. also, they had breaking and entering and possessing drugs. my motherly instinct told me something was wrong. >> reporter: neighbors say the teen acted out of desperation. and say his father often had

fits of rage. >> towards his family want. -- family. and he'd be working in the yard. and terrible cursing. and horribly, verbally abusive. >> reporter: charging documents name richardson's sister as the one. she was in court as well, and tells we'll, some of -- tells wjz, some of that report is false. is >> reporter: richardson faces several charges, including first-degree murder. and because his confession was videotaped, he could be eligible to receive the death penalty. the judge jeaz advised -- judge advised him of that in court. we are live tonight in bel air, weijia yang jaij -- weijia jiang, wjz eyewitness news. >> a preliminary trial for richardson is scheduled for next week. >> a trial that could test maryland's revised death penalty law is under way in annapolis. >> reporter: opening statements started today in the trial of lee edwards stevens. he is one of two corrections officers charged with stabbing to death in 2006.

the murder was a primary factor in the decision to close for capital correction. it requires a videotaped confession or scientific evidence, linking the defendant to the crime. denise, back to you. >> thank you, vic. the trial will resume tomorrow, with testimony from first responders to the scene of the crime. a fallen maryland soldier gets a heroa welcome -- hero's welcome. police escorted the flag-draped coffin to the funeral home. he was killed by an explosive device in afghanistan. he will be laid to rest at arlington national cemetery with full military honors. a damp rain continues. bob is tracking radar and first warning weather. >> it's been very light around the baltimore area. but heavier south of us. take a look at this display. you can see a lot of rain across virginia. and it's all moving generally toward our area. heavy rain to the west of us.

for a possible kitchen fire. we did see some smoke coming from the ruth's chris side of the building. it's not clear where the fire was contained in the kitchen. but it appears this did take care of it. we did see several puffs of smoke. there's a significant amount of fire personnel that remain on the scene. they have a whole first-alarm assignment. just at this time, sort of cooling their heels. we did see firefighters returning briefly. there's no reports of injuries at that time. -- at this time. and it's not clear how it's affecting either one. >> thank you, captain mike perry, live in sky eye chopper 13. lawmakers have a lot on their plates as they gather today for the start of the 2012 legislative session. wjz is live at the state house. derek valcourt is there and explains some of the general topics, the general assembly expects to tackle. hi, derek. >> reporter: some big battles

this year. >> number member -- members, please take your seats. >> reporter: with the hammer of the gavel, they roll up their sleeves for what promises to be hot topics. chief, to raise the gas tax, by 15 cents over three years, in order to pay for major transportation projects the state doesn't have money for. >> the need isn't there. the public doesn't like tax increases. but that doesn't mean we don't try to raise the transportation trust fund. it hasn't been raised since 1992. >> reporter: republicans blast the idea of a gas tax increase that is out of touch with reality. >> i'm sure that they got sugar plums and taxes dancing in their head every night. there's a tax and spend crowd here. but that's the worst thing for this economy. >> this is one of the most punishing of all taxes. it hurts the working families of maryland. and the governor should take it off the table. >> reporter: another battle

looming, same-sex marriage. supporters see this as their year to win approval in the general assembly, now that they have the full support of governor o'malley. >> the governor has weighed into it. and we'll see exactly where he believes he can help get some votes and educate some people and why we should have same-sex marriage in the state of maryland. >> reporter: but same-sex opponents say they are not going down easily, promising a voter referendum, if it does pass in the legislature. >> we're going to tight it until the end. -- fight it until the end. and i don't think it's going to be successful. >> reporter: governor o'malley, creating a minor stir here in annapolis this morning when he said on a radio show, he would raise the sales tax by 1%, rather than having a gas tax increase. but his aides insist he was just speaking off the cuff, that there are no proposals to do that. and senate president mike miller insists, raising a sales tax is not going to happen. we're live in annapolis, derek valcourt, wjz eyewitness news.

we're following breaking news out of baltimore county. sky eye chopper 13 is over an accident in east point. let's go to captain mike perry. >> we're at east point mall, eastern avenue. this is right at 54th street, where we have several-vehicle accident. at least three people injured as a result of this accident. police and fire personnel are on the scene.

it's 5:30. 45 degrees, with rain in spots. good evening. thank you for staying with wjz, eyewitness news. here are some of the stories people are talking about tonight. neighbors near reisterstown call police, after someone witnesses something being thrown from the balcony. it turns out to be a york shire terrier. mike schuh reports, that dog barely survived. >> a neighbor there reported that she saw a man launch an object from a balcony. >> reporter: it's the higher of the two. >> she heard this object land with a thud. and when she went over to investigate what it was, she found that it was a small dog.

>> reporter: the dog's name is louie. he's a 3-year-old york shire terrier. police say louie was intentionally thrown. >> about how tall was that deck? i'm taking these pictures with a small, handheld camera. when thrown, it takes more than a second for it to reach to the ground. >> he's definitely a lucky guy. >> reporter: louie lived. his eye is bruised and red. teeth are missing. he was in a lot of pain. but louie lived. >> i think if it was just a few feet more, he may have expired due to the head trauma. but he was very, very lucky. >> reporter: lucky, too, he was found and taken to a pet emergency room. he's now on two painkillerless. gary wall -- painkillers. gary wallace was arrested. the doctor can't talk about this specific case, but in general about animal abusers.

>> are often about power and control, someone who feels they don't have enough control, don't have enough power. >> reporter: as for louie. >> he's not in pain right now. he's not uncomfortable either. >> reporter: but had a sharp- eyed neighbor not seen and heard what she did, louie probably would have died. >> reporter: in harford county, mike schuh, wjz eyewitness news. back to you on tv hill. >> the man charged in the case, gary wallace, jr., remains in jail, held on $250,000 bond. two men are robbed at gunpoint. it happened in odenton, around 2:30 in the afternoon. in the 2600 block of cedar elm drive. two armed suspects stole money and other items before fleeing on foot. the crime forced the lockdown of nearby piney orchard school. anyone with information is asked to call police. >> reporter: an update tonight in one of hollywood's biggest mysteries. vic has the latest into the investigation of natalie woods' death. >> reporter: the sheriff's office has found no new

evidence of foul play in the actress's death. detectives reopened the case two months ago after sources came forward with new information. but so far, there is nothing to suggest her death was anything but an accident. >> investigators say they have carried out several interviews and traveled to hawaii to inspect the boat where wood was last seen alive. >> reporter: he is the prime suspect in the unsolved disappearance of natalee holloway in aruba. now, joran van der sloot pleads guilty and confesses to killing another woman in peru. >> joran van der sloot told the court in lima, peru, he is, quote, really sorry for what happened. in spanish, he confessed to the panel of three women judges that he robbed and then killed 21-year-old stephany flores in 2010. the confession ends the trial that started just last week and gives van der sloot the

possibility of a lighter sentence. >> reporter: van der sloot is well known in the u.s. as the prime suspect in the disappearance of 18-year-old natalee holloway in aruba. >> reporter: the 24-year-old dutch citizen was arrested twice but never charged. his lawyers in peru argued that investigation left him traumatized. van der sloot met flores in a peruvian casino and later admitted he snapped her neck in a fit of rage, when she got onto the computer and discovered his connection to the holloway case. >> reporter: lawyers for flores argue that there should be some kind of payback for her life. they don't think the court will go easy on van der sloot because he could be a danger to society. >> reporter: van der sloot's lawyer called his client deeply regretful of the murder. after court, van der sloot laughed with his attorney. when he's sentenced friday, he is expected to get 20 to 25

years behind bars, with the possibility of parole in five years. >> holloway was from alabama and disappeared during a high school graduation trip to aruba, where van der sloot grew up. divers are searching an icy river in maine, as they have been looking for a toddler. no one has ruled out a suspect in the disappearance of ila reynolds. and her disappearance has been declared a crime. police say other bodies of water might be searched in the coming days. >> occupy wall street protestors are back in business in new york city. demonstrators have gathered once again in zucoty park. protestors say they want to have a symbolic presence in the area at all times. they are allowed to stay, as long as they don't set up tents or sleeping bags. the teen driver takes his story to washington. he hopes his near-death experience on the roads will convince lawmakers to pass

tougher highway safety laws. tara mergener reports for wjz with the possible exchanges -- changes in store. >> reporter: 17-year-old joe pelocowitz. >> although i remember the crash the first few months of being in the hospital, i just know how lucky i am to be here today. >> reporter: joe slammed into a tree in 2010, suffering a brain injury, a broken back, pelvis and ribs. >> it's been horrible going through what i have been through. >> reporter: he's now working with the advocates for highway and auto safety, fighting to get tougher safety laws for the road. the group is calling on states to pass 15 laws, covering everything from seat belts, booster seat and motorcycle helmet rules to restrictions on teen drivers and texting behind the wheel. >> reporter: every year, about 33,000 people die in crashes across the u.s. and over 2 million more are injured. >> reporter: advocates say

putting tougher safety laws in place will make a difference. >> reporter: we know that this will save lives and save the states money. and we'd like to see them being more aggressive and serious about getting the job done. >> reporter: joe says tougher laws, including increasing the driving age to 18, might have saved him a lot of heartwake. -- heartache. >> if i had one wish, it would be to go back to the day before my wreck. >> reporter: and that's why he's lobbying lawmakers to force drivers to play it safer. >> the group also grades states on their safety laws. a frederick county bus driver is being punished for driving home with a sleeping girl still on board the bus. camaya myers woke up in a parked bus outside the driver's home last week. the 5-year-old said she went to the house and asked the driver to take her to school. the driver has since been taken off her route. school officials say it is not clear when she'll return. county police are hoping

targeted in a deadly attack. police say two assailants on a motorcycle stuck magnetic bombs to the car of a nuclear scientist. >> reporter: i saw the bike by, this witness said. they were wearing black hats and had hats -- something in their hands. >> reporter: he is the fourth nuclear expert to die in the attack in a nuclear bomb in two years. iranian officials accuse israel of dispatching hit squads of trying to destroy its nuclear program. they have hibitted about co -- hinted about covert campaigns. tuesday, israel's military chief of staff said iran should expect more unnatural events in 2012. the u.s. and its allies are pressuring iran to stop enriching uranium. they believe it's being used to develop a nuclear bomb. but tehran contends its program

is peaceful, designed only to produce electricity. >> reporter: tina kraus, wjz eyewitness news. >> iranian officials claimed earlier this week, they are expanding nuclear operations, south of the capital with more high-tech equipment. a man cheats death on a california highway. the man was driving along highway 99 when a metal pipe flew off of a car in front of it and came crashing through his windshield. amazingly, his quarter-inch steering wheel stopped the pipe before it struck him. the man said someone was looking out for him that day. >> much greater chances of getting hit by lightning or winning the lottery than to find a 4-foot steel pole in your -- >> windshield. >> yeah. in your windshield. just a micron away from death. >> the man walked away from the incident, with a few minor injuries. police are searching for the driver of that car. in tonight's healthwatch, the fda says it will step up testing for a fungicide that has been found in several brands of orange juice.

the agency says an unnamed company detected the levels in the orange juice. health officials believe the chemical came from brazil. so far, the fda does not believe it is a public health risk. but it has asked suppliers to stop using the fungicide. the first lady fires back in an interview with cbs this morning. michelle obama talked with gayle king about rumors that she's forced her will on white house aides. mrs. obama also said she has very real goals in mind for her programs with children and military families. and they go a lot farther than photo ops. >> i don't want this just to be p.r. i'm always asking people on the ground, do you feel what we're trying to do? and until they feel it in their own lives and in their own homes, we've got to keep working, we've got to keep figuring out how do we tap deeper, so that we haven't just moved policy, but we've really moved lives.

an animal rights group is taking full responsibility for one of california's largest beef processors. officials say they received a detailed statement from the

activist, who were protesting factory farming. the fbi has joined the arson investigation and is looking into the claims. >> a robbery leads to a dramatic high-speed car chase in houston, texas. [ sirens ] >> three men tried to escape police with a stolen safe in the back of their car. officers followed this white car with the 300-pound safe in its trunk. but the chase came to an end when the suspect stopped in the middle of the high and -- highway and tried to run on foot. a man accused of throwing his son overboard a tour boat in southern california will not be spending time behind bars. sloan briles was convicted of child endangerment and sentenced to three years of probation. in august, briles purposely threw his 7-year-old child overboard. another witness saved the child. part of brile's probation includes one year in a child abuser's program. a major drug bust at dulles

international airport in virginia. custom and border protection officers have arrested a 61- year-old nigerian man on alleged heroin smuggling. an expert revealed pellets in the abdomen. he later passed the pellets that police say are filled with nearly 16 ounces of heroin. the drugs have a street value of about $31,000. a few hundred feet. that's how close two jets came to pit hitting -- to hitting each other at chicago's midway airport. dana kozlov reports with what what happened and who is to blame. >> reporter: you can hear the southwest pilot's frustration. >> technology. planes were taking off. >> the ground please. >> reporter: it's a question the traffic controllers did not answer. the clip exchange featured a 737 and a private learjet.

the national transportation safety board says the pilot was told to return right. but another controller told a learjet pilot to take off on the same runway. one saw the southwest jet and yelled for the learjet to stop. >> learjet or something was taking off. we had to hit the brakes and the jet went right over our head. >> the two just narrowly missed each other. >> we look at the size of these planes. anything below 300 to 400 feet, it's really a very close call. >> reporter: and dupaul university transportation experts say the mistake came from the control tower. a mistake that could have cost lives. >> at the very least, what should have happened here? >> no doubt, this regards more vigilance at midway to make sure we have the right controllers arrested. -- rested. >> reporter: 85 members and crew were on board that southwest plane. nobody was hurt.
