stopping? >> they are not backing down. trying to stop the construction of a juvenile jail in east baltimore. wjz and mike hellgren are live on east monument street to explain what went down. good afternoon, mike. >> reporter: good afternoon, don. good afternoon, everybody. occupy baltimore protesters tell me they will be back here at the site tonight and police are waiting. you can see here now there are several police cars, a combination of city and state police and state police have their incident command center here ready for anything that might happen. police charged the six people they arrested, four men and two women with trespassing. the arrests came as tensions mounted between officers, some armed in riot gear and more than 70 members of occupy baltimore. the group protesting at the site of a proposed juvenile jail. >> when we look to the future we see a city in which we're building casinos, wall marts and new jails and underfunding services for youth. >> reporter: the gate unsecured, lock cut and police

put up no trespassing signs minutes before the marchers arrived. >> it's owned by the department of pub safety correctional services. it's private property. >> reporter: troopers were initially friendly and didn't push back pieces of a makeshift schoolhouse the demonstrators threw over the fence. after negotiations failed the arrests began. police told demonstrators they couldn't live on the site for five days as they planned. >> we're going to try and keep relationships with the police as much as possible. >> reporter: occupy plans to return here throughout the week despite the confrontations. >> politically hopefully it's a threat. politically hopefully we're keeping this agenda in the public radar. >> reporter: city police also pushed back the media before the event was over last night. reporting live in east baltimore, mike hellgren, wjz eyewitness news. >> thank you very much. last month police evicted a

month from a -- square where people had been living for 10 weeks. there were no arrests. the case begins today with the man who died from a taser. >> reporter: the parents of jerelle gray filed a $100 million lawsuit against the frederick sheriff's department. they said the police had no right to taser their son in 2007. he was tasered twice, including once on the ground. the family says the 20-year-old was trying to break up a fight and didn't hear a police officer's commands. lawyers representing frederick county argue the officers used the taser appropriately. back to you. >> thank you. live in the newsroom. once a jury is selected both sides will offer their opening statements and proceed to call witnesses. we now know the identity of the body washed ashore in anne arundel county. maryland national resources

police say tyler cordray was found yesterday, the 25-year-old was missing since his boat capsized. a person on the boat with him died in the incident. an autopsy determined he drowned. the diver taking a live -- the live look at the ship off the coast of italy, divers hope it will help them find missing passengers. it comes as newly released transcript reveals orders the ship's captain ignored. divers from the italian navy used controlled explosions to open parts of the costa concordia's home. >> we hope if there are still people alive we will find them. >> reporter: crews found more bodies. divers are combing through submerged parts of the vessel and firefighters are navigating through upside down rooms and debris up top as they look for those missing including a couple from minnesota. more than 4,000

people escaped the costa concordia friday night after it hit a rock and started to tip. infrared images show passengers using rope ladders to climb down the side of the ship to safety in the dark. in a newly released phone call a italian coast guard official angrily ordered the captain back to the ship to help stranded passengers. >> reporter: coast guard officials tell the captain, are you refusing? he responds, no, no, i'm not refusing but it's not clear if he ever returned. the captain has come under heavy fire. the company that owns the cruise liner says he didn't follow the approved route and human error likely caused the deadly accident. a judge schedule the captain behind closed doors tuesday. he faces several charges including causing a shipwreck, abandoning ship and

manslaughter. cbs news, italy. >> the captain could face up to 15 years if convicted. with south carolina's primary four days away the republican presidential hopefuls are escalating their attacks on mitt romney. at last night's debate in south carolina they ganged up on the frontrunner slamming everything from his business background to his so far refusing to release his income tax returns. >> mitt, we need for you to release your income tax so the people of this country can see -- [ cheering and applause ] how you made your money. >> romney still has a dominant lead in south carolina and across this country. a new poll out this morning shows most republicans believe he will clinch the gop nomination. the baltimore community gathers to say a final farewell to a local radio legend. this morning a memorial service was held for ron smith, the longtime voice of reason died from pancreatic cancer last month. his family hosted a public memorial at goucher college.

welcome back. a few peeks of sunshine now but we're not completely finished with this storm yet. first warning doppler weather radar, solid bands of rain go through, they are breaking up somewhat as you saw by that shot of the sky. we have a couple more rounds of showers and rain to come through as we head through the afternoon hours. now, the other thing going on, we'll switch over and show you, it takes you back to the morning when it was coming through in more solid bands, that just left us, of course breaking up a little but more to come the other thing, as we were saying the winds are out of the south. this is a warm wind for us, up to 49 degrees now, almost 50 already. 50 in dc. 58 patax under. notice on the map it's warm ahead ahead of the storm, behind the storm it's much colder. that comes here tomorrow. the winds will turn to the

northwest and things will start to dry out and just upstream there's another storm moving our way. that will follow in about a day or so. so it works like this -- rain on and off today. ends tonight. then it's gone. gusty winds and drier wind tomorrow with mix of clouds and sunshine. then thursday the clouds come back in with the next storm. plan for a couple of rain or snow showers as it passes by thursday into friday. it's a clipper and typically with a clipper storm there's not a lot of moisture, it will be fast-moving and will reinforce the cold air behind it. that sets the stage friday for yet another storm heading into the weekend. so for today, we're going up to 53 degrees. rain and drizzle and a few peeks of sunshine. then tonight all the showers end. the winds start to pick up and dry out. going down to 37 tonight but we don't go up much from there tomorrow. only up to 40 for a high. it's going to be a cooler day tomorrow than it is today. the average is 41 so we'll be slightly below or close to average tomorrow. then we've got that next storm

vitamin d may not help severe respiratory problems. studies have shown up to 7 a% of patients with -- 75% of patients with copd have a vitamin d deficiency. when patients were given vitamin d supplements researchers found it didn't improve lung function or reduce attacks. a new study from the american cancer society shows that the dances of dying from medical -- chances of dying from melanoma are directly related to a patient's level of education. the study found that the melanoma death rate in the u.s. declined in the past decade but only those with at least 13 years of education. researchers say the results show there needs to be more awareness of the disease. so-called xer gamers which
