now it is complete coverage. it is wjz, maryland's news station. >> hello again, i am jessica kartalija. >> and i am don scott. >> here is what people are talking about today, breaking news to tell you about, cold stream park elementary school in waverly is being evacuated because of a possible fire. no word on how big that fire is or if there are any injuries. wjz has a crew on the way to the scene. of course, we will bring you a live report shortly. >> the investigation continues this noon into whether or not yesterday's snow fall may have contributed to this fatal accident in baltimore county. sky chopper 13 over the scene. a car and two suvs collided during the rush hour and while it was snowing, the person killed is 30-year-old amy thief of edgewood. another still unidentified driver is in serious condition. the third was not hurt. >> there is new help for homeowners including those here in maryland hurt by the collapse of the housing market.

today the government announced a settlement. alexis christoforous tells us what that means for those struggling to keep their homes. >> reporter: the settlement forces the banks to offer help to struggling homeowners. five banks agreed to a deal worth at least $25 billion. >> this agreement reflects our commitment to ensure justice and recover losses for victims of wreckless and abusive mortgage practices. >> reporter: the agreement stems from investigations into the foreclosures that followed the burst of the housing bubble. to speed up evictions workers sometimes signed documents they had not read or faked signatures, a process known as robo signing. the deal is the broadest plan so far to help borrowers underwater on their loans. there is also money in the deal for people who have already lost their homes.

about $1.5 billion will go to borrowers who went through foreclosure between september 2008 and the end of last year. that will cover 750,000 people, who will receive checks for up to $2000 each. >> we are using this opportunity to fix a broken system. and to lay the ground work for a better future. >> reporter: the deal involves bank of america, wells fargo, jp morgan chase, citigroup and allied financial. while the deal brings relief to some millions of others are still at risk. >> the banks have three years to fulfill the terms of the deal. 49 states have joined the settlement, including maryland. officials say the state will receive $960 million as part. deal. >> how did yardly love die?

that is the focus today. wjz and adam may are live outside the courthouse. good afternoon. >> reporter: good afternoon, don. very detailed information here about the condition of yardly love's body, exactly where it was in her apartment and what kind of injuries she had. also lots of information today about first responders efforts to tray and save her life and meanwhile, the defense attorneys, they are picking apart all of these details trying to lay the ground work for their own theory. former lacrosse player george hugley seen here walking out of court does not deny he was involved in an altercation with his ex-girlfriend in may of 2010 but his defense attorneys argue her death inside her apartment at the university of virginia was accidental. in court for the first full day of testimony they are focusing on medical evidence, the scientific explanation for love's death. prosecutors contend she died of blunt force trauma, beaten to death by hugley, wjz caught this glimpse of the evidence

coming to and from the courtroom. this large package is believed to contain her bedroom door, prosecutors say hugley kicked it in, leaving a giant hole and traces of his dna, love's former roommate, who found the body testified love was afraid for her safety, alluding to another key piece of evidence, an e-mail, huge lee wrote love, you said you would get back together with me f i stopped getting so drunk, i should have killed you. alcohol consumption is a major factor, both sides agree love and hugley were intoxicated the day of her death. the defense calls experts will die she died by passing out and suffocating. but prosecutors say it wasn't responsible for anything except hugley's rage.

reheard from we heard from one of the first responders that her body was still warm, two hours after he left the amount. the implication is she may have survived these injuries if help had come sooner and that drove her mother and sister inside the courtroom today to tears. live in charlottesville, virginia, adam may, wjz eyewitness news. >> stay with wjz and wjz.com for complete coverage of this murder trial. we will bring you the latest from the courtroom in this case. >> the child sex abuse scandal at penn state is prompting one lawmaker to introduce a bill here. ron has this story. >> reporter: nancy jacobs wants to make not reporting suspected child abus a crime. she introduced the bill after the penn state child sex abuse scandal involving jerry sandusky, a grand jury report found that members of the staff failed to report alleged

incidents of child abuse. if the bill is passed here penalties for not reporting child abuse would include a thousand dollar fine and one year in jail. back to you. >> thank you. maryland is one of only three states that doesn't currently have a criminal penalty to failing for report cases of suspected child abuse or negotiate. >> going through security at 28 airport is is about to get easier, that is including bwi thoroughgood marshall. the tsa says passengers who volunteer more personal information will be vetted before they arrive pat the airport and go through a dedicated checkpoint. the program is expected to go into effect by the end of this year. >> our ongoing mild winter could mean more money in our pockets, bge says its customers will see a drop in their energy bills this season. some people could save up to 16% or about 100 dollars. it is both gas and electric customer whose can expect smaller than normal bills. >> we have returned to mild weather here today. the precipitation has cleared

a baltimore school has been evacuated for smoke in the halls. sky chopper 13 is on the scene, captain mike terry has the latest. >> reporter: good afternoon. we are at cold stream park elementary school where fire officials were called here a short time ago for smoke in the hallways. now the school has been evacuated, the children are still outside. firefighters have gone inside and found a problem in the boiler room of the school. that caused the smoke, which caused the evacuation. apparently there is no longer any fire. they are trying to get the smoke out of the building so the children can once again occupy the building. no word on how long it is going to take on own any word on what the initial problem was with the boiler. >> we will bring you more information on this story as soon it becomes available. >> still to come on wjz's eyewitness news at noon breaking free from the no child left behind act, which states

10 states are breaking free of the requirements of the federal no child left behind act. they are among those given a waiver because they have shown they have viable plans and have set their own improvements, new mexico is the only state that applied and did not get one. >> syria resumes their shelling. hundreds have died since the shelling started. officials at the state department is saying the u.s. is looking at what it can do financially and legally to provide help. >> putting more women soldiers closer to the front line. the pentagon is expected to propose a new policy that would allow women to serve in roles at the battalion level.

in today's wjz health watch report most doctors say they are not always honest with their patients, a new survey says more than half admit to making a patient's prognosis sound better than it is. one out of five also say they didn't fully disclose a medical mistake for fear of being sued about it and one in 10 admits to lying to a patient for some reason during the past year. another new study finds ty chi is an effective exercise for people with parkinsons disease. they designed that program and compared them and they ancient art did the best. >> be sure to check in with wjz
