update for us. captain mike? >> reporter: well all happened around 3:30 this morning, in the 300 block of millington avenue. department of public works employees were working on a broken water main, when they accidentally struck a four-inch gas main, causing the bge and the fire department to scurry to the area. fire officials and bge have begun work on digging up the gas main. as you can see, there is a rather large hole in the middle of millington avenue. this is just west of the west side shopping center in southwest baltimore. we do knowthat at least 900 people are affected by this loss of gas service. apparently some water from the broken water main entered the gas service, which caused a very serious response by the fire department. they have set up a mobile command post, as well as bge has set up a mobile command post, behind the west side shopping center. there are approximately 50 bge vehicles in the area. there are also some road closures near the west side

shopping center, along frederick road. expect delays in the area. as we said, this will affect at least 900 people and possibly last for days before bge can get this problem rectified. back to you on tv hill. >> all right, captain mike. wjz will continue to keep you updated on the report. we'll have a live report coming up all new at 6:00. today, jurors hear the medical explanation for yardley love's death. the baltimore county native was found dead inside her apartment, near the university of virginia. now, a doctor describes severe and significant injuries, discovered on her body. wjz stays on this story, live in charlottesville, virginia. adam may is there, and explains today's testimony was too much for love's mother. adam? >> well, kai. this is what you might call the csi day in this trial. both sides spent the entire day, tryi to set the forensic and medical in their favor. as that was happening inside the courtroom, outside the courtroom, i had a very casual, brief conversation with yeardley love's mother.

a very polite, very gracious mother, forced to relive this awful tragedy. >> reporter: love's mother spoke briefly only with wjz. she expressed gratitude to all the people supporting her back in baltimore. two neurological patholgists spent hours telling the jury about the fatal injuries to love's brain. use a plastic skull, they explained how blunt force trauma killed the student from cockeysville. scott goodman is a prominent attorney. >> by far, the most sensational, notorious case that has ever happened in charlottesville. 1kwr50z love's ex-boyfriend is being tried for first-degree murder. for that, they must introduce premeditation. for that, they've introduced an e-mail. another student testified to seeing huguely choking love. >> hours later issue she's

dead. there's no evidence anybody else was ever in the room. so yes, the e-mail that he was going to do that and the fact that it happened, very powerful evidence. >> reporter: but virginia's laws, regarding premeditation are tough. it's why defense attorneys keep reminding jurors that huguely was drunk. a strategy that has ended up in lesser convictions in the past. >> this is something that is a crime of passion. it often results in a manslaughter conviction. >> reporter: now, one setback for defense attorneys inside the courtroom this afternoon, throughout the course of this trial, they have been trying to argue that love's brain injuries could have been caused by cpr, when paramedics first responded on the scene. well, both the doctors who took the stand today said that was simply not possible. right now, on the stand, there is a fingerprint expert. that person is going over the evidence that was convicted --

collected at yeardley love's apartment. reporting live in charlottesville, virginia tonight, adam may, wjz eyewitness news. >> adam, thank you. stay with wjz for the remainder of the george huguely trial. we will be in the courtroom all week to bring you the latest on air and online at week.com. we are -- wjz.com. we are following breaking news in maryland. political reporter pat warren is at the state house, with details of a house committee vote taking place right now. pat? >> reporter: that's exactly right. we have two committees and one vote. the house judiciary and health and government operations committees heard 10 hours of testimony on friday. now they are gathering in the judiciary committee hear room for -- hearing room for a vote on that bill tonight. >> reporter: same-sex marriage advocates packed lawyers mall last night, calling on delegates to vote in their favor of letting people marry with no consideration for gender. two weeks ago, it was the advocates for traditional marriage, also in huge numbers,

calling on those same lawmakers to stand up for marriage as one man, one woman. governor o'malley kicked off the session, by introducing a bill that changes the definition of marriage but also provides for religious liberties, meaning no religious organization would be required to perform same-sex marriage. even with the law, they fear challenges in court. the governors and others in favor of same-sex marriage, testified in friday's house committee hearing that it is in the best interest of children of gay and lesbian couples that they be allowed to marry. that was challenged with be children being raised by a mom and a dad. >> reporter: all that testimony took place on friday. and now here we are, tuesday, a very short turnaround for such an important vote, which leads everyone to believe that they do have the votes to bring that bill to the floor of the house for a full debate. reporting live from annapolis, i'm pat warren.

back to you. >> pat, thank you. and we will bring you an update tonight on eyewitness news at 6:00 and 11:00. a customer says she was sexually assaulted at a local home improvement store. police say 60-year-old samuel garris, attacked a woman inside a lowe's in glen burnie. the 39-year-old victim tells attorneys, garris touched her inappropriately. he's facing sex offense and assault charges. baltimore police launch an investigation into a cell phone video, that shows officers threatening to arrest a man who is recording them. wjz is live. derek valcourt has that video and talks to the man who shot it. derek? >> reporter: mary, this video is the latest in the controversy over how city officers handle citizens videotaping them on the job. >> reporter: it's early saturday morning, along croft street in federal hill. six officers all hover around a man, who appears to be detained on the ground, when scott culver see its, he breaks open his cell phone camera. >> didn't know what was going

on. it was happening. it was life. i have a camera. i'm supposed to be able to take video. >> reporter: he's right, at least according to this new police policy, issued friday, in response to court challenges to how city officers handle being video recorded. but watch what happens next. >> take a walk, sir. >> i'm asking you to leave. >> reporter: officers never tell culver to stop recording. instead, they threaten to arrest him for loitering and order him to leave the area. >> turnaround and walk. . >> i'm leaving. >> turn around and walk. give me your id. >> that seems to be your way of trying to -- well, we have this policy. and you know, instead of telling me, you can't do that, we're just going to tell you you ceabtd be -- can't be here. >> reporter: baltimore says for police protection, there should be guidelines on how close you have to be to record officers. >> if you're a police officer that puts you into a life-or- death situation every day when you walk into work, you don't

want the extra burden of having to worry about if videotapers are friend or foe. >> reporter: ironically, culver said, had the officers just ignored him, this video wouldn't have gotten any attention. >> the worst thing that would have happened, i probably would have tweeted something that mentioned like, some poor schmuck just got arrested on croft street and went to bed. >> reporter: for now, culver says he has no intention of filing any sort of legal action. but he does say he thinks the baltimore city police department should admit to its mistake, and he says they owe him an apology. the aclu agrees with cover and has asked him for a copy of his video. derek valcourt, wjz eyewitness news. >> all right, derek. thank you. a police spokesperson would not comment on the story, citing an pend -- a pending internal investigation on the incident. for the first time, we are hearing from the woman convicted of murder inside a yoga store. >> reporter: a judge released

this video of britney norwood, lying to police, after she murdered her coworker in bethesda. norwood beat jayna murray to death inside the lulu lemon store last year. she initially created an alaberate-- elaborate story about two masked men who beat her and murray up. she initially cried. >> you don't know how many times they pit hitme in the head and cut me in the stomach and chest. since i was trying to fight him, he hit me in my head. >> police quickly realized norwood was responsible for the crime. those videos were present said as -- presented as evidence in her trial, where she was convicted of first-degree murder. >> norwood was sentenced to life in prison, without parole. the funeral for whitney houston will be held saturday, in new jersey, at a church, where she first showcased her singing talent as a child. alison harmelin reports.

remembering the music legend. >> reporter: whitney houston's funeral will be held saturday, in the church in newark, new jersey, in the church with where she was first discovered. a family spokesman says the funeral will be private. no wake or public memorial is planned. >> they have shared her for 30 years, with the city, with the state, with the world. this is their time now. >> reporter: fans of the singer have been streaming past the church and the funeral home where her body was brought monday night. >> i always said to myself, i want to be just like her, you know? and i just want her to rest. >> reporter: houston sang here as a child, at new hope baptist church. her mother being siz sissled the music program. and her cousin, dionne warwick, was also in the choir. ♪ >> and i will always love you ♪ >> reporter: houston was one of the best-selling artists, until she started using drugs and alcohol. the 48-year-old singer was found dead saturday, in the water of a bath tub in a hotel.

some prescription drugs were found in the room, but police say no more than people have at home. investigators are waiting for toxicology results before discussing the cause of death. houston's godmother, aretha franklin, honored the singer with a special concert in charlotte. she sang one of houston's biggest hits. >> i will always love you ♪ >> reporter: and asked the crowd to pray for the family. >> reporter: in new jersey, alison harmelin, wjz eyewitness news. >> and houston leaves behind an 18-year-old daughter. right now, a few showers are moving through maryland. outside, it's cloudy, but still warmer than usual for this time of year. meteorologist bernadette woods and bob turk are updating our conditions. >> well, you're finally getting a few showers with sun this afternoon. clouds moving through. take a quick look at radar. just light activity. some areas not really seeing much at all. but over the next two, maybe two or three hours, look for a few sprinkles across the region. right now, in the baltimore

region, a little light activity, reported at the airport and here in tv hill, just enough to make your clean car or dirty car, a little spotty and dirty. tough to get all of that salt off the vehicles. now, tomorrow, a day very much like this afternoon. mild conditions. and a lot of sunshine. so another very mild day headed our way. speaking of mild, bernadette woods has a look at just how warm this winter has been since december. bernadette? >> it's actually incredible. we took it back to december 1st. and take a look at some of these numbers here. we have been so far above average. each of the last couple of months. 24 days in december have been above average. 21 days in january. and we're only 14 days into february. and so far, 11 of those days have been above average. some cases, way above average. remember, we hit 70 degrees earlier on this month. yes, the warm winter continues. we'll have your forecast coming up. >> bernadette, thank you. and still ahead on wjz eyewitness news at 5:00.

[ applause ] >> reporter: dan duquette is back in baseball, after 10 years away from the major league. he's been the orioles gm. occupying the office that has seen six are the gms in the last decade and a half. all unsuccessful in their efforts to change a losing streak that has now reached 14 seasons. i sat down with duquette to his season so far. >> i do know that oriole fans are dedicated fans. and by going around the community, they've all said the same thing. you know, give us some hope. >> you inherit a beleaguered fan base. you know that. does that make it tougher? >> oreiole fans are very engaged with the team.

and i know they'll come out if we give them a reason to come out. >> reporter: the reason has to include baseball. and winning baseball has to include good pitching that's the top agenda for duquette. he has not spent any big money or added any star players. but he believes the orioles can compete with rising young talent, like alin jones, and matt sweeters. >> my job is to help us decide, who are the oriole. >> okay? what is our identity. all the good teams, all the winning teams, i know, have a specific identity. and something they stand for. so my job in spring training is really to help us form our identity. if we're going to be a good time and win more than we lose, we have to know who are these orioles, how are we going to play? what values are we going to bring out. so when people come to the ballpark, we can give them a team that we're proud of. >> and i hope to start finding

light rain falling. very, very light. but it shall pass. take a look at radar. light shower activity. some of it is not each reaching the -- even reaching the ground. the air is so dry. some folks will see a little shower activity in the next hour or two. maybe even another shower later this evening. but none of it, the heavy variety. and temperatures are still very, very mild.

right now, still looking at 50 degrees. 50 in easton, washington. 46 in hagerstown. showers here this afternoon. 39, a few showers still in oakland. now, later tonight, it may get cold enough in garrett county and the higher elevations for a little bit of light, wet snow. not a big deal. but it's possible out there. nothing like that here. just going to stay on the mild side. 46, ocean city. and 49 at pax river. locally, 48 in westminster. and close to 50 once again by the bay. 55 degrees once again today. the average temperatures just went up 1 degree yesterday, to 45. 26, the normal low now. and the record, 70 in 1990. and 1979. two below zero. this morning, it was they. stayed above freezing once again. and bernadette just showed you how many warm days we've had this winter. southeast winds now, keep us in this mild air. and rather moist air. but tonight, this weak system, crossing the area, moves off to the east. high pressure building in tomorrow. a lot of sunshine. there will be a few clouds. next system coming in on thursday.

good evening, everybody thanks for staying with wjz eyewitness news. here are some of the stories people are talking about tonight. updating that news in baltimore. mike hellgren explains the impact on really hundreds of homeowners and businesses tonight. mike? >> reporter: mary, it's just a mess. started this morning, when crews working on a water main break. there was a piece of asphalt that ruptured a gas line. so that gas main break caused problems. you can see right here, the crews are here on the scene. we're just on frederick, off of wilkens here. and they had to turn off the gas to dozens of homes. some of those homes they had to go in forcibly and turn off the gas. you're looking at scenes from sky eye chopper 13, which has been above throughout the day. they have to do this before they turn the gas line back on. and they have to fix the water main break. the process could take days. they had to forcibly go into some of the homes. and some people may have water in their gas appliances. and they have to get those fixed before the gas could be

turned back on. so we're talking about a process that could take sometime to fix. reporting live in southwest baltimore, mike hellgren, wjz eyewitness news. >> mike, thank you. it is a mess out there. we will bring you the latest on the repairs coming up all new on eyewitness news at 6:00. embarrassing. that's what the mayor calls the conditions at many baltimore schools. now she wants to raise the city's bottle tax to start repairs. monique griego has more. >> reporter: parents are obviously happy the mayor is taking some action. but they also want to know what took so long. >> old ac units. dunlap -- dilapidated doors. this is what kids deal with every day. >> i think it's long overdue. the schools needed repairs, years and years and years ago. >> reporter: principal anthony rubio agrees. he gave a tour inside the school. ruby says teachers do their best to dress things up.

but it's hard for the outside. >> we make things as beautiful as possible. >> reporter: because so many baltimore city schools look like this. mayor stephanie rawlings-blake is making it her mission to improve things for kids by finding more funding for school construction. >> we are at a place where too many of our schools don't have air conditioning. too many of our schools have clouded windows. >> reporter: the mayor's plan would up the bottle tax from 2 to 5 cents. she believes it would increase the city's contribution to city schools by 140%. >> reporter: the mayor says she is focused on one thing when it comes to any plan to improve the schools. >> that the proposal we put in place will give us immediate results. >> reporter: parents and community groups have also been rallying for change. >> it's awful. the bathrooms. the classrooms. the lockers. the smell and everything. it's just horrendous. >> reporter: while parents and ruby know upping taxes isn't easy, many feel baltimore kids are being left behind.

>> their county cousins that go to a nice, new building. we don't have that. and our kids deserve that. >> reporter: and the mayor plans to introduce the bottle tax hike sometime next week. kai, back to you. >> monique, thank you. the mayor says the city is waiting to determine exactly how many schools need repairs and what it will cost. could amanda knox go back to prison in italy? prosecutors are asking the country's highest criminal court to reinstate her murder conviction. denise is in the newsroom with details about that appeal. >> reporter: prosecutors file the 112-page appeal, four months after the conviction against knox was thrown out. the seattle native was back in the united states after being released from an italian prison. she was convicted in 2007 for killing her roommate in what was called a sex-fueled attack. this will be the third and final stage in the case against knox. the high court cannot hear new evidence. they can only make their decision on what has been submitted in earlier trials. and a decision is expected toward the end of the year. mary?

>> all right, denise. thank you. knox'sknox's original conviction carried a conviction of 26 years. rick santorum's mission is putting him in the front of the polls. danielle notingham reports, this comessuring it -- comes during the republican lull. next primaries are two weeks from now. >> reporter: rick santorum greeted supporters in washington in the leaders of the presidential race. >> it's great to be in the real washington. >> reporter: santorum tops the new york times poll of republican primary voters nationwide. he's opened a small lead over mitt romney. the former pennsylvania senator, with the help of conservatives. he has a 14-point lead over romney. and is 26 points ahead of newt gingrich. with gingrich losing four straight contests, and some suggesting he drop out, santorum is starting to see this as a two-man race with romney. the former house speaker says,

not so fast. >> that's exactly what i said when i suggested that mitt ought to drop out weeks ago. and he decided that wasn't a good idea. and he was right. >> reporter: there is a note of caution in the latest poll numbers. 60% of those surveyed said it is too early to decide who they will support. >> reporter: arizona and michigan hold the next contest. michigan is where romney grew up and his father served as governor. >> i grew up in michigan. >> reporter: he unveiled a new adtuesday, remind -- ad tuesday, reminding voters of the race. >> he may actually win michigan. and what does that do to the romney campaign? it's hard to say. but it's not good. >> reporter: santorum is also running ads in michigan. both are headed there later this week. at the white house, danielle nottingham, wjz eyewitness news. >> the election cycle picks up in march. voters in 10 states will go to the polls super tuesday, march

6th. in tonight's wjz healthwatch, it appears flu season has finally arrived. the cdc saw an increase in the number of samples testing positive for the virus in the first week of february. researcher says flu season may peak. this is the slowest start to the flu season in nearly three decades. well, time now for a quick look at some of the stories you'll find in tomorrow morning's edition of the baltimore sun. see the heights the high schoolteacher goes for his arrow nautics class. preview of the 2012 college lacrosse season. and a lifting of the best high- end burgers in baltimore. remember to look for the updated forecast in wjz's first warning weather team. baltimore is in need of new police officers. a growing city and greater scrutiny of law enforcement has made entry into the department selective and demanding. tonight, wjz gets insight into the process. >> reporter: the baltimore city police department is looking

for a few good men and women. >> the goal is to prepare these men and women to be the best police officers that we can possibly make them. >> reporter: and they allowed wjz to get a glimpse into their world by sampling the process of becoming a cop. >> i'm officially a rookie now, right? [ laughter ] >> reporter: there are roughly 3,000 officers on the force. the number they recruit each year, varied, depending on things like retirement and need. but it could be anywhere from 30 to 300 candidates. the starting salary is just over $41,000. to get your badge, you first have to pass a background check. >> reporter: in 2010, nearly 3,000 men and women applied to be city cops. but for some reason, many simply didn't make the cut. so the brass tells you, -- us, the problem isn't finding applicants, their problem is finding qualified applicants. >> i think essentially, you

want someone of good character. >> reporter: next, there is a battery of tests. first, a civil service exam. >> i think that's the only mentality we should have is get the best applicants on the street. >> reporter: applicants must have a grueling training. the training is physically and mentally demanding. >> teamwork is the only way to succeed.
