hi. i'm kai jackson. >> and i'm mary bubala. here's what people are talking about. >> we're following breaking news in baltimore county. sky eye chopper 13 is over an accident. >> we're up in the sparks area of baltimore county. the southbound i-83. about a half mile south of belfast road, where it appears a four-wheel drive vehicle, perhaps a jeep, has skidded off the left side of the roadway. and tumbled to a stop. it came to rest upside down. the driver has been extricated from the jeep. you can see it's a mess. he is in an awaiting ambulance right now, getting ready to be loaded in a medivac helicopter to be taken to shock trauma. his condition is not known at this time. other than believed to be critical. we do have maryland state police on the scene. baltimore county police are assisting with traffic. they have completely closed

southbound i-83. just at belfast road, as this medivac operation is in process. they will reopen one lane and allow traffic to get by. but expect delays to get in the area. it's affecting both north and southbound. northbound, folks want to see what's going on. it's slowing down. just use caution and have patience as this med track operation continues. medivac operation continues. >> thank you, captain mike perry, reporting live. a third student is dead after the school rampage in a suburb of cleveland. the 17-year-old suspect just made his first court appearance where he admitted to the shooting. manuel gallegus reports from chardon, ohio. >> reporter: devastating news keeps battering the community of chardon, ohio. three students are now dead, victims of monday's shooting at the local high school. officials confirm the death of russell king and shortly after, demetrius hewett. they were juniors as was daniel

palmentor, who died on wednesday. a family friend identifies the suspect as tj lane. he was at chardon, waiting for the bus, when witnesses say he opened fire, hitting five students. investigators searched his family's home for clues to a motive. cbs news has learned lane complained of being bullied. nate mueller was in the cafeteria when the gunfire started. he knew the suspect but says he never sensed trouble. >> he was a quiet kid. i mean, he never caused problems. he was never -- he never egged anybody on. >> reporter: a lot of the talk here in chardon is about how tight this community is. the sheriff himself has deep roots here and was shaken up by the violence. >> i happen to be a graduate of chardon high school. i met my wife here. the most eerie feeling in the world was walking down the halls yesterday, running down them. >> reporter: across town, there are ribbons for the victims. >> i just can't imagine what

the parents are going through. it's horrible. it's -- you never think it's going to happen in your town. >> reporter: the community will gather tonight for a candlelight vigil. thursday, parents and students return together to chardon high. in chardon, ohio, manuel gallegus, wjz eyewitness news. >> at lane's court appearance, prosecutors said lane admitted to firing 10 rounds in the school cafeteria. he said he did not know the students but chose them randomly. the murder of a high- ranking maryland soldier in afghanistan, fuels anger in capitol hill. denise has the latest. >> reporter: well, kai, the gunman who killed army major robert marchanti, inside a heavily-guarded building in afghanistan, is on the loose. his body is now being returned to u.s. soil. and in washington, maryland senator barbara mikulski asked secretary of state condoleezza rice secretary of state --

secretary of state hillary clinton. >> my question is, what do i tell his family? was it worth it? because they're angry. >> reporter: clinton responded, saying she cannot justify the death of one person, but she defended the u.s. mission in afghanistan, despite a week of deadly anti-american protests. more than 30 people have died in those protests, fueled by the accidental burning of a muslim holy book at a u.s. air base in kabul. >> major march ante is the father of a firefighter. flags are being lowered to half staff in his honor. some of the 133 horses are taken now on their way back to the owner. wjz is live on the eastern shore. derek valcourt has more on the plea deal. >> reporter: prosecutors agree to drop 123 of the animal neglect charges and give the

owner back 63 of the horses seized last year. >> reporter: sky eye chopper 13 over centreville's canterbury farm in april, where even from a distance, some horses showed obvious signs of weight loss. animal rescuers say others had problems in life. >> every animal there on that property are suffering from lack of care. >> reporter: the owner agreed to euthanize them. with the help of the humane society, queen anne confiscated the remaining 133 on the property. the owner charged with animal neglect. but they agreed to give probation on 10 charges and give her back nearly half of her horses. >> reporter: under the plea deal, once they inspect her farm, parkinson will immediately get back 25 of her horses. if all goes well, 90 days later, she'll get back more of her horses. 16 days after that, 18 more.

>> reporter: all along, parkinson denied neglecting them saying they were not suffering or in danger. she said, they had no basis to take my horses and i should never have been charged. the humane society saw an opportunity to grab headlines and raise significant money in order to further their own agenda at my expense. >> i don't know how somebody can --ue know, can argue the point that there was not a need for intervention. >> the head of queen anne's county control said without the plea deal, the case could have been tied up in court for a while and has no regrets about seizing the animals. >> reporter: as part of the plea deal, parkinson's farm will be inspected regularly over the next year, some of them will be surprise inspections. after the sale, she now has more money for her horses. >> reporter: parkinson's attorney says after her probation is over, she will apply to have her record wiped clean.

well, a home is destroyed by a fire in cecil county this afternoon. you can see in sky eye 13, only the house's frame is left. the three-alarm fire broke out just before 2:00. it's unclear if anybody was inside at the time. after nearly a week of deliberations, the jury in anne arundel county still hasn't agreed on a sentence for lee stevens. he's eligible for the death penalty. wjz is live in annapolis. weijia jiang explains why the jury is struggling. >> reporter: many people are watching this case very closely as it will set a critical precedent. so far, the jury has given no signs of what kind of work they're doing. >> reporter: should twice- convicted killer, 32-year-old lee stevens, live or die? jurors have been deliberating a sentence since last wednesday, with no answer yet. legal expert, andrew levy. >> well, it's not supposed to be easy for the state to kill someone, even if you are in

favor of the death penalty, i think most people recognize that we have to be sure. >> reporter: the same jury found stevens guilty of murdering 42-year-old corporal david mcgirn inside the now closed house of corrections in jessop. stevens was serving a life sentence for another murder. >> reporter: stevens is a landmark case. for the first time ever, prosecutors used a dna link to pursue the death penalty. under maryland's new and more stringent capital punishment law. >> the first case is always important. and is always going to be something that goes to court. and lawyers are going to look to set a baseline. >> reporter: since 2009, the state can only seek a death sentence in first-degree murder cases that have biological or dna evidence. a video recording of the crime or a videotaped confession. mcgwynn's blood was found splattered on stevens' clothing, shoes and cell bars. still, the sentencing process is a meticulous one.

this is the very thing jurors are working on now. they have to balance the crime against a long list of mitigating circumstances. like whether they acted under duress. there is also space to right in -- write in their own. >> and in maryland, the only time a jury can hand down a sentence is when the death penalty is on the table. they have to reach a unanimous decision. tonight, they've gone home. reporting live in annapolis, weijia jiang, wjz eyewitness news. >> weijia, thank you. jurors have gone home, as weijia mentioned, overnight, but they will be back tomorrow morning. teachers testified in support of funding baltimore city schools. advocates want money to fix what they describe as inadequate city school buildings. they give an example of leaky roofs and undrinkable water. wjz will have more coming up at 6:00. a milestone on wall street. dow closes above the 13,000 mark for the first time in

2008. the final push came from a report showing improved consumer confidence. the s&p is up. nasdaq gained 20 to close at the 3,000 mark. our weather is a bit cooler today. but it's still mild for this time of year. lots of sunshine out there. this evening. but there are some changes coming. meteorologist bernadette woods and bob turk are updating our conditions. bob? >> if the weather didn't put you in the mood, maybe the stock market would today. warm front forming to the south of us. already a little shower activity. pittsburgh up to cleveland and detroit. and eventually, the clouds will be moving in our direction. look for a wet day tomorrow. but temperatures are mild right now. we're at 53 degrees. around the baltimore region. generally, temperatures today got into the low to mid-50s. still above normal. but about 8 or 9 degrees. cooler than what we saw yesterday. but we'll take it. however, tomorrow looks like a cool and damp day. as far as temperatures go this

weekend, temperatures have been remarkable to say the least. bernadette has a look at comparisons. >> reporter: it is absolutely incredible. we're almost done with what we call meteorological winter. take a look at numbers. our average high for each month has been so far above normal. in december, we averaged over 50 degrees. this month so far, we're averaging 57 degrees. and each and every month, we've averaged between 6 to 7 degrees above the norm. that's why we're looking at a pretty warm winter overall. and the final numbers aren't in yet. but this looks like it is going to be a top 10 all-time warm winter. we'll vathis coming up -- have that coming up. orioles are in their second week of workouts at spring training in florida. as always, there is a lot of work to do. sports director mark viviano joins us with a look at the team and your input with our exclusive fan cam. oh, the fan cam is back, mark. it's a dangerous and illegal baltimore tradition. dirt bikes on city streets. their numbers have been rising along with recent warmer temperatures. wjz is live in druid hill park. a prime spot for riders. mike hellgren has an inside look at this problem. mike? >> reporter: kai, many of you who drive on city streets have seen this dirt bike before.

but it is difficult for police to enforce the law and get them off the streets. >> reporter: sky eye chopper 13 spotted dirt bikes weaving through traffic. 20 people riding through baltimore city streets here, putting themselves and others in danger. >> oh, [ bleep ] >> reporter: in this you tube clip, they couple get injured. and it's illegal in the city to own a dirt bike that has not been disabled. >> we have packs of dirt bike operators who are literally terrorizing neighborhoods. >> another claims to show city cops chasing dirt bikes. but police say their policy is not to chase but to stay back and watch from six cameras. >> at the end of the day, it's just rescue for disaster. >> reporter: in the mondawmin area, people see them all the time. wjz asked them what they think should be done. >> this all depends on where they're riding them at. i think they need a place for them to really ride them.

>> the place is strictly for them. >> as opposed to having them out on the streets. >> reporter: by law, gas stations aren't supposed to sell fuel for dirt bikes. and they can seize bikes that are locked up. you about none of that is for riders. knowing it's hard for cops to track them down. >> reporter: and police have called on the public to help them and report where these dirt bikes are being stored. reporting live in north baltimore. mike hellgren, wjz eyewitness news. kai? >> mike, thank you. baltimore outlawed riding dirt bikes on city streets 12 years ago. if you're waiting for someone to get home from work, let's check on the roads with kristy breslin. >> reporter: quite a situation on the harrisburg expressway. sky eye chopper 13 is over the scene of it. as you can see southbound, there was an accident. overturned vehicle. everything looks pretty banged up. traffic is being detoured in

the south direction. the delay is solid back to mount carmel. you can also expect a lot of heavy traffic in that route. delays there from the beltway all the way up to belfast to the scene of the accident. as far as the rest of the region goes, if you're traveling on the north side inner loop, heavy traffic there. that's from the jones falls expressway over to providence road. the outer loop also still dealing with congestion there from harford road to charles street. and west side inner loop, bumper to bumper there, from southwestern boulevard to security boulevard. that has not eased up one bit. 70 westbound, heavy congestion from 29 to marriottsville road. and still a couple of accidents to deal with. emerton road and hanford road. west cold spring at wabash avenue. let's now take another live look. you can see, no traffic. because everything has been closed off at northbound. very heavy traffic once again from the beltway up to belfast road. the scene of the accident. this traffic report is brought to you by your baltimore

you can hear the clouds, beginning to form, as warmer air is coming over top. and it's more moist, over top, with this slightly cooler dryer surface. that's what is creating these clouds. overnight, they'll continue to get cloudy. and the clouds get lower. and tomorrow morning, maybe 8:00, 9:00, 10:00. it should be with us most of the day. look for a wet, cool damp day. let's take a look. that's the last day of this month. yes, it's leap day. 53 now. 50 in hagerstown.

it is 5:30. 53 degrees and partly cloudy. good evening, everybody. thank you for staying with wjz, eyewitness news. here are some of the stories people are talking about tonight. easing congestion on one of maryland's most heavily- traveled roadways. the state had hoped by now to have special express lanes open on i-45 from the-- i-95 in the city to past whitemarsh. as mike schuh reports, the construction has finally begun. >> reporter: the scream of 95 drowns out what the state wants to crow about. construction here. but on the other side, and all around whitemarsh boulevard. here, the state is beginning a project that should have been done by now. but a few years ago, worked slow to a trickle. >> reporter: the reason the

weak economy means that the tollauthority hasn't been collecting as many tolls. >> reporter: but with fewer road projects nationwide, contractors began offering better deals on all state roadwork. >> a lot of the bids are coming in lower than expected. which has freed up a portion of the commony. -- money. >> reporter: soon, this whitemarsh bridge will have ramps that connect it down to the new toll lanes, being built where the median used to be. yes, toll lanes. you'll pay a toll for the privilege to drive past the most congested for the of 95, to whitemarsh. >> some people just want to go, go, go. and others are mindful of what they put in their pocket. >> here's your penalty for running late. >> reporter: along 95, in whitemarsh, mike schuh, wjz eyewitness news. and the idea of express lanes is to have them stretch to the

delaware line. as of yet, none have been built. federal indictments are unveiled in baltimore. the operators of bodog.com, face charges of operating an illegal gambling operation and money laundering. prosecutors say the company took in more than $100 million in winnings from gamblers in maryland and across the country. stunning revelations about where the remains of some victims of 9/11 attacks were sent. denise is in the newsroom with more on the pentagon report. denise? >> reporter: well, mary, an empty independent committee was looking at the practices at the military. they discovered the unidentified remains of 9/11 victims from the pentagon in shanksville, were is sent-- were sent to this landfill. they were investigating a similar attack. the number of 9/11 victims involved were unclear, according to the report. it is also unknown as the victims of the families were

told. >> the report says there is no indication any of the victims from the world trade center were involved. a cruise ship with more than 1,000 people on board is stranded in the indian ocean. rita nissan reports for wjz. the ship's owner also operated the one that capsized off the coast of italy last month. >> reporter: rescue crews are towing a crippled cruise liner in the indian ocean. hundreds of passengers are crowding the deck of the costa alegra because there's no power. a fire in the generator room on monday left the ship why with -- ship with no air conditioning or food. >> we have reports of no one being sick or hurt. as far as we're concerned, the situation is very calm, that the captain is in control of the boat. >> reporter: emergency generators are only powering the ship's control room, and its communication equipment. helicopters are dropping food, satellite phones and radios. it's taking longer- than-- longer than expected to to the ship off the coast of

tanzania, because the ship is so heavy. but most of the 1,000 on board, including eight americans, should be back on land in the next 24 hours. families of those on the ship are worried. >> i haven't heard from her yet. >> reporter: this woman's daughter is a dancer on the costa alegra. she also had a son working on the costa concordia, which capsize said off the coast -- capsized off the coast of italy. >> it was a nightmare. >> carnville -- carnival owns both ships. carnival says it has armed guards on better board to keep everyone safe. rita nissan, wjz eyewitness news. >> carnival is also flying in engineers and technicians to try to repair the generators. in tonight's wjz healthwatch, researchers discover potentially harmful effects of sleeping pills. a new study in the british medical journal links sleep

a fatal bus crash in new york is acquitted on homicide charges. 60-year-old john thomasus k i. that bus slammed into a railroad bridge near syracuse, killing four people on board. according to a state report, more than 50 people have hit that bridge since 1987. the spanish guard intercepts a fishing boat, carrying more than 6,000 pounds of cocaine. officers seized the trawler on friday. authorities say the boat belongs to a firm that is based in northwest spain. four spaniards and an african american man have been arrested in connection with this. steve sipack, arrested for keeping animals at his home. florida wildlife seized two tigers. are the now, sipack also made

we have new details in the murder of i 10-year-old california girl, who died following a fight with another girl. joanna ramos' mother said she started vomiting after school. she told her mother she had been hit once in the head. ramos died of a blood clot that night. ramos' doctor said one punch in the head is not enough to cause a trauma for death. fire broke out on the second floor where the administrative office is located. officials say most of the damage was caused by water. firefighters used to battle the flames. no one was hurt. but some boston red sox photographers were apparently damaged in the fire. the team has not put a value on
