a major court ruling impacts the way police catch criminals. tonight, the growing public safety concerns in this d.n.a. debate. >> could be some major fallout here. good evening and thanks for joining us. i'm adam may. that major court decision could change the way evidence is collected. it's a ruling that is sparking outrage among police across maryland. w.j.z. is live tonight. ouija jang has more on the impact. >> reporter: it was back in 2008 the governor pushed to pass a law that gave police the right to collect d.n.a. when they arrested people for violent crimes but the state's highest court says that is a violation of rights. police departments across maryland are reeling, claiming a critical tool for solving crimes has been taken away. >> our concern about the court's ruling is that it is going to impede us from being able to put certain bad guys behind bars, that we have been able to put behind bars as a result of this d.n.a. evidence.

>> this week the state's highest court ruled police are no longer allowed to collect d.n.a. samples when they arrest suspects in violent crimes. the ruling stems from a 2009 case. a man was arrested for assault, so detectives took his d.n.a., which matched him to an unsolved rape case. but the high court said the process violated protections against searches without a warrant. for the a.c.l.u., the decision is a victory. attorneys claim it's unconstitutional to take a schwab for d.n.a. unless someone is found guilty. >> the rights of persons who may be arrested for a crime but not yet convicted are different than the rights of persons who are convicted of a crime. and i think that's exactly as it should be. >> reporter: but the maryland attorney general disagrees and says d.n.a. banking has linked several career criminals to various crimes, a reason he says most states allow it. >> it's obviously an opposite of what every other court in the country, federal and state has found, which is that it is

constitutional, because of course it is. >> reporter: doug ganzler says taking d.n.a. is no different than conducting a strip search, taking blood samples and fingerprints which is all allowed. he plans to fight the court's decision. and ganzer says his next step is to take the case to the u.s. supreme court. ouija jang, w.j.z. >> and a lot at stake here. the state has collected nearly 16,000 d.n.a. samples since 2009. down in prince george's county police have made an arrest in the murder of a pregg woman. 22-year-old nathan rogers was arrested. the woman who was pregnant with his baby was found dead last night in a trunk of a car. police say moss told longers she wanted to keep the baby but he didn't want her to. a former anne arundel county high school teacher convicted of having sex with

students learns his fate. jeffrey series is sentenced to 20 years in prison. earlier this month he entered an alfred plea. that means he doesn't admit guilt but he acknowledge there's enough evidence for a conviction. the manhunt for a wanted fugitive is now over in washington state. police say they have found a body that appears to be a survivalist. he was wanted for killing his wife and daughter. >> reporter: police commandos used explosives to blow open this bunker in the foothills east of seattle. inside they found a body. >> they believe the person has been dead for some time. there's a great deal of blood and a pistol nearby, and they do believe that this is peter keller. >> reporter: the manhunt began last sunday when keller's wife and teenage daughter were found dead from gun shot wounds inside the burning remains of their home. the 41-year-old disappeared, but police found pictures on his computer that gave them a general idea where the bunker was located. they believe he first started

building it eight years ago, and that it was loaded with supplies, including food, a gas mask, and a generator. family members describe keller as having a survivalist mentality and say he was probably heavily armed. >> what we're going to do next is take a step back and have our bomb dispose ill unit, ensure that the scene is safe and check for any kind of booby traps or bombs that may be involved. >> reporter: the search for a killer in a popular hiking and biking area had many oath. >> slightly scary. my wife is pretty apprehensive. >> reporter: police say phots of keller's elaborate bunker don't do it justice. it was fortified, has multiple levels and numerous entrances. w.j.z., eyewitness news. >> and kell were drew $6200 from his bank account just last week and told coworkers that he might not return. well, a baltimore city police officer who called escape order and then got famous on the internet and then

lost his job has lost an appeal. according to the baltimore sun, the court of special appeals says that the police commissioner had the authority to fire officer salvador riveeri. he was caught on video yelling at a teenager in 2007, ordering him to stop skateboarding. that video went viral. an administrative board recommended he be suspended but he was fired. another streaker arrested. police catch a man who runs onto the field during an orioles game with the help of an umpire. this was caught on tape and posted on youtube. police say that 20-year-old christopher fatkin of parkville got onto the field. there he was tackled by plate umpire jeff kellogg. he tonight is charged with trespassing and disorderly conduct. this is the fourth time this year that a man has run out on the field. and the season's just started. an f.b.i. raid uncovers thousands of dollars of bogus merchandise at a flea market in southwest baltimore. but tonight as gigi barnett

reports, some shoppers say it's still the best place to get a good deal. >> you want to save money this is where you need to be. >> reporter: shoppers at the flea market in southwest baltimore can find almost anything from loathe clothes, shoes, even jewelry. but earlier this week, f.b.i. and homeland security agents found what they were looking for, too. counterfeit merchandise. now, 5 men are in police custody, charged with selling the bogus name brand goods like coach hand bags, nike shoes and mack cosmetics. >> they're criminal organizations, and they're improving their products so much that they're starting to make their way into the primary marketplace, and in those instances, consumers can't even tell. >> reporter: according to court documents, undercover agents set up shop at the markets, taking out the counterfeit ring back in 2009. according to signs inside, the market has a policy against selling phoney items. some customers say shopping at the flea market is the only way they can get deals. >> it's for the people, that

can't afford to get the real deal. sore, i mean what about us? >> reporter: for taishi downer, everything she sells is an original. the self-published author says she'll stay at the flea market, because her book sales are strong. >> the energy inside is good, the people are really good. got a lot of you know, vendors that are trying to do their thing. >> reporter: according to the indictment, much of the bogus merchandise came from suppliers in new york. now, if convicted, the men could face up to 10 years behind bars, and a $2 million fine. i'm gigi barnett, wjz, eyewitness news. an f.b.i. agents found 70% of many name brand items sold at that flea market were actually fakes. well, at the points of thousands of dollars -- 10s of thousands of dollars in prescription drugs that were real were collected in harbor county today. that was all voluntary. the site in bel air was one of more than 5000 across the country today hosting a drug take-back. d.e.a. agents were on hand collecting

expired and unneeded prescriptions. they say that some people think it's just ok to flush drugs down the toilet, but that's the wrong idea. >> that's not good. the e.p.a. has said that flushing, disposing of prescription drugs down the toilet will hurt the -- you know, the water supply. >> the residues can stay in the water supply system. all the drugs that were collected here are burned. the d.e.a. says another turn-in will be organized in the fall. well kind of a gloomy saturday out there. let's look live outside right now, still cloudy and in fact if the towson area where ouija was earlier tonight there were showers. bernadette woods is a live look right now. is there a lot of rain or scattered? >> just scattered. this batch is making way through the state but there is more where this came through. we have this first batch right now, just pass through the city making it's way to the eastern shore. behind it, a little break before you see more over in pennsylvania and that is also

moving our way. so some light rain right now, a few showers out there, all throughout the baltimore metro area. and a little bit burst of heavier rain. not anything heavy, but heavier as you head to chestertown and down to crofton. temperature wise, taking a huge hit with the clouds out there, 51 degrees right now many baltimore. 41 in oakland and throughout the entire metro reink. we are in the low 50s this afternoon. 15 degrees below average. we have a big warm upcoming our way we'll have that shortly. even though it's not exactly swimming weather outside, city pools announced that they're going to open up pretty soon. the pool season begins on memorial day weekend, may 26th just a few weeks away, with all six park pools opening, and operating through labor day. the 12 city neighborhood walk to pools will be open for seven weeks at the annual big splash on june 23. pool admission fees will stay the same this year, 1.50 for park pools and $1 at the walk

to pools and the splash pads. pretty exciting day for the baltimore ravens. they introduced three of their top draft picks. the three newest ravens include outside linebacker courtney upshaw. also offensive lineman kaliche osomille and running back bernard pierce. here they're showing off some of their new gear. stan will have much more on the ravens picks. there's the new shiny helmets coming up later in sports. we have a lot more to come on w.j.z. tonight. some violent protests in malaysia. check this out. police are using water canons to fire at the crowd. why demonstrators there are taking to the streets. >> an inmate escapes, a criminal leads authorities on a wild chase, right through the middle of one of the country's busiest airports. how he was finally caught. >> and a little girl doomed for disaster. she was hit on tape here by a moving truck, but she survives. we'll have her amazing story coming up. ,,,,,,,,,,,,,,,,,,

it's raining and 51 degrees in central maryland. bernadette will have the complete first warning weather forecast in just a mom. first, malation police, check this out. they're firing water canyons, can nones and tear gas on 10s of thousands of protesters. the activists are demanding election reforms. police say they were forced to react after some protesters tried to push their way through barriers and enter a public square.

the violence could carry some politic ill risk for the current prime minister who is seeking reelection. a child is very lucky to be alive after she's nearly run over by a truck in china. this is a close call here. several school students were running across the street by that crosswalk. look at that big truck that came barreling right there. it was full of sand and stone, and it really swept down that slow-moving girl. apparently, she just missed the tires. the truck crashed into a telephone pole and a traffic light. the driver was hurt but the girl ducked when she saw that truck coming and she only suffered some minor injuries. amazing. an inmate scapes from police -- escapes from police inside a crowded arizona airport. police say 22-year-old john robisill was being extradited from detroit when he managed to get away from two deputies in phoenix. check this out. he's basically all over the airport. once a deputy finally caught up with him he took off again. airport employees were finally able to detain the suspect until police arrived and right

now, that suspect is locked up. he was originally accused on drug violations. some heavy winds and thick hail pound south carolina. powerful thunderstorms left a trail of damage all across the mountains here. check out this home video. shows the beating down there, the damage from the wicked winds and hail is around dime sized. i do like the sound of hail, though, it's very pronounced, isn't it? >> you sent me that video before. >> i did send you that last week. >> about baseball sized hail. a lot of the severe weather in the middle of the country, landing on water and then landing on people -- it looked like snow. >> right. but it was so much hail. i can't remember where that was. so much hail. it looked like a blizzard. >> that's crazy >> not good for your car. fortunately we don't have that going on here right now. a little bit of rain is it. 51 degrees is where we sit. it's a cool saturday afternoon, and we will have your forecast when we return. ,,,,,,,,,,,,,,

welcome back. getting a little bit of rain out there, and the timing may not be right for some people but we do need that rain. doppler radar, nothing heavy at this point, but still a chance for more rain overnight. you can see all of this is coming in from the northwest. throughout the area just light rain at this point. we'll switch it over and we're going to show you, here's how it looked overnight. the clouds come in, it started to thicken up. now some rain is out there and that will continue on and off throughout the night. winds also pretty light, so you may see some fog overnight. temperature wise we have really taken a hit here. 51 degrees is where we sit in baltimore. everyone in the 50s or upper 40s. that is it. the average high right now is 69 degrees. we are 15 degrees below that for our high today. we did start out at 35 degrees, not going quite that low tonight. we'll get stuck in the 40s, but tomorrow, we start to warm it up as this goes to the north of us. probably clouds during the morning hours but then sunshine

returns and that dry air comes in from the south. after that, we get into a pattern where there's some really warm air coming our way. we get rid of one storm, here's the second one moving our direction. now it's going to bring some clouds by monday, maybe some showers on tuesday, but behind it, some of the warmest air so far this season is sitting down to our south. there were records over the desert southwest, slowly but surely it's moving in our direction, and it won't be quite as warm as it was down there. look at all of these idea down there and that is what's moving our way. so the forecast looks like this on the water. very light winds tonight and tomorrow with this first part of the storm going through. the chance for some rain and drizzle throughout the night, mostly cloudy. only going down to 42, and then tomorrow, that gets out of there, back up to 69 degrees which is our average. then again, we'll see clouds sort of swing by monday, with that next front. as it starts to move through we get back into the 80s, it could even be higher than this. wednesday and thursday.

receiver tommy streeter. he's big. 6' five. we grew up in the same neighborhood, even though i am a lot older than tommy. those are the draft picks for now. meantime men's lax show down. at loyola. number 10 johns hopkins visiting, and there you saw the goal from chris blaine. but in the end this went down to the wire. hopkins, number ten. pen's topped loyola, their first defeat of the season. loyola 12-1. hopkins beat them 10-9 in overtime. downtown at the baseball park tonight, there will be reminiscing of how things were back from 1966 to 1971, when the o's were never better. that's some of their best years. so a statue honoring arguably the best player to ever wear that uniform will be unveiled tonight. a statue showing frank robinson. last night, meantime, first place birds hosted oakland. jake arrieta, did all he could to add to the win streak but he got in trouble early. watch what happens right there when it's eric sogard driving that pitch to the right field
