"wjz" is live tonight. derrick b exlcor exhas more on what this could mean to the case. >> >> reporter: the victim's refusal to testify could go a long way in helping the defense. 24-year-old and his 21-year-old brother expected to return to court monday morning after a bizarre twist in the criminal case against them. the two brothers stand accused of the november 10th beating of cory osby during a neighborhood patrol with an orthodox jewish watch group. the incident sharply divided the neighborhood. >> he was singled out because he was a black youth walking in a jewish community. >> reporter: the victim, the prosecution's star witness stood up out of his chair and said "i don't want to testify. i want all of the charges to be dropped." if the victim of a crime does not want this thing to go forward, most typically, prosecutors drop it. >> reporter: but a legal expert

points out it's rare for a victim to change his mind after a trial has already started. this turn of events will give the attorneys for the defense more ammunition as they ask the judge to declare a mistrial. >> it's seeming like the case is getting very weak for the prosecution. >> reporter: community activists are drawing comparisons to the trayvon martin case and said they are closely watching >> i think the case is still very much in motion and the general public should know that righteousness will prevail in this case. >> reporter: the defense maintained that the brothers were acting in self-defense. the trial resumes tomorrow. >> the victim's family has filed a civil lawsuit seeking more than $500 thousand from the defendants' family. stay with "wjz" and "wjz." com for the latest on this. three people stabbed upside of a party home. the three men, including a

clouds will come in during the day, tomorrow and then some rain. we have the chance for still needed rain out here. tomorrow night into tuesday, but when that front leaves us, it is going to usher in really warm air for the second half of the week. you can see on tuesday, just sort of straddling the mid- atlantic. starting to bring warmer air our way. we'll see the numbers in just a moment. here's the warm air coming our way, still in the upper 70s throughout most of the deep south. today, a lot of it into the 90s, there is some hot air out there. by tomorrow, a little closer. wednesday, into thursday, friday is when it is going to peak. forecast looks like this on the water, light winds out there. out of the southeast, warm front coming through. bay temperature pretty cool, 59 degrees. tonight, we are going down to the 30s. just over the border, there are some frost advisories in effect, but for us, slightly
