colorado where the gunman accused in the movie theater massacre appears in court. >> james holmes appeared in court for the first time with bright origin -- orange red hair. >> james holmes made his first court appearance since the deadly rampage. he was read his lights and asked if he understood why he was in court. >> it is said that you shall not harass or tamper with any witness to or victim of the acts you are charged with committing. >> prosecutors were given until next monday to file formal charges. police say holmes has lawyered up and refusing to cooperate. it could take months to learn what motivated the attack. the district attorney is considering pursuing the

death penalty. prosecutors will consult with families of the victims before making that decision. in the cha i don't -- chaos holmes almost got away, he was wearing tactical gear and his gas mask was different. investigators cleared out all explosives from his apartment, including 30 homemade grenades rigged to a trip wire. police found a bat man mask. president obama met privately with the families of the victims. he told them he was not there as the president but as a father and husband. >> we can understand what it could be to have to have somebody we love taken from us in this fashion. >> 11 victims are still in critical condition. some have had multiple operations, including brain surgery. aurora's mayor is concerned some survivors may not make it. >> holmes will not have bail.

million fine. the school will be banned from post season games for 4 years, scholarships will be reduced and all wins from 1998 to 2011 will be taken away, which means justice -- joe paterno's is no longer college football's winningest coach. >> our goal was to make sure the university establishes an athletic culture and daily mind set in which football will never again be placed ahead of educating, nurturing and protecting young people. >> the sanctions follow on independent report that found top university officials, including paterno covered up the criminal acts. the ncaa spared penn state the death penalties, which could have canceled all games for a year or more. >> the scope of the punishment is unprecedented. >> definitely too much. the people who should be punished are sandusky and those who covered it up, not the players

being down more than 200 points just a few minutes ago, the a and p 500 and the nasdaq are down substantially this noon. spain has asked for a bail out package of up to $121 í billion to save the banks there. >> thank you. the dow has had only four declines of 200 points this year, including its worst a 274 drop on june 1st. this noon baltimore city police are waiting for an tops autopsy. derek valcourt has the latest on the investigation. >> reporter: police do not know exactly what happened here. in fact, they are not certain how long this woman had been dead. >> saturday night just before 7:00 police were called to this apartment building, on 29th street in charles village. inside one of the apartments they found a badly decomposing

body of a woman. police say it appears she had been dead for one week and her corpse was not alone. >> there was an individual who was inside of the apartment with her. she was taken into custody and questioned. at this point no charges have been brought. >> the woman's body has been sent for an autopsy and police are waiting to determine her cause of death and if charges will be filed. >> reporter: police say they do know who they woman is but are not releasing her identity yet. she's 41 and that apartment was not hers. jessica. >> thank you . commuters in downtown baltimore will have to deal with traffic detours for a few more weeks. light street will continue to be shut down as crews work to repair the 133-year-old water main that ruptured last week. senate ben cardin is calling on congress for help. he said the ageing water system is a problem facing many states. it's a humid start to our work week.

not out of the question. jessica, back to you. >> thank you. a maryland state trooper is lucky he's okay this noon after his cruiser gets hit from behind. it happened last night in centerville. trooper robert isabel was responding to a call when his cruiser was hit from behind. no one was hurt. that crash is under investigation. just when we thought we were getting some reloof at the pumps -- relief at the pumps gas prices spike. prices have gone up for a third straight week. the national average is $3.47. if you're filling up here in maryland gas prices are gone up 6 cents in the past week to that national average. a month ago we were paying just $3.36. it may have been a wet weekend out there but that didn't stop thousands from attending art scape. it was the 31st year for art scape, which is america's largest free arts event. hundreds of artists displayed paintings, photographs

i got to be honest, i'm sitting here looking at you given how humid it is, there it is party boat. it's human out there. i guarantee -- it's humid out there. i guarantee it's sticky. the breeze is nothing but a warm and humid one. for it being such a humid morning we had some shots from our harbor cam -- >> bad hair day. >> you have a great hair day going. there's not one frizz there. >> finally i just went whatever. >> that's what i do every morning. take a look at the current conditions. there was a couple shots we had this morning where it was darn near foggy
