>> facing the victims. the colorado theater shooting suspect makes his first court appearance as prosecutors consider the death penalty. erasing paterno. more than a decade of wins are wiped from the record books as part of the crushing sankses imposed on penn state's football team. and reaching for the stars. remembering the first american woman in space, sally ride. this is the "cbs morning news" for tuesday, july 24th, 2012. good morning, everybody. good to be with you. i'm terrell brown. during his first court appearance, not a single word from the man accused of opening fire on a colorado movie theater but his demeanor caught everyone's attention. james holmes sat glassy eyed looking we we willedered and

even drowsy at times. manuel gallegus is in colorado this morning. good morning to you. >> reporter: good morning. suspect james holmes is back in solitaire confinement this morning after keeping quiet during his initial court appearance yesterday. his family is standing by him and they're concerned about the death penalty. investigators for james holmes defense team are scheduled to be inside the century 16 theater today. they'll be looking for any evidence they can find which could help defend their client. on monday, holmes appeared in court for the first time for a preliminary hearing. his hair was dyed orange red and he had a dazed look as a judge advised him about his rights and his alleged crime. >> you committed the offense of first-degree murder which is a class 1 felony under colorado law. >> reporter: some of the victims' families were inside the courtroom including ian sullivan, father of veronica missourier sullivan, the

youngest to die in the shootings. david sanchez waited outside of the courtroom. his son-in-law was shot in the head and is in critical condition. >> to feel the pain in there makes you more angry about this man that decided to take everybody's life. >> reporter: prosecutors have 60 days to decide whether to seek the death penalty in that time the district attorney says she'll talk with the victims' families to get their advice. >> if the death penalty is sought, that's a very long process that impacts their lives for years. so they will want to have and we will want to get their input before we make any kind of a decision on that. >> reporter: holmes' father was here in colorado to support his son. the family attorney spoke with the media. >> their hearts go out to the victims and their families. yes, they do. he's their son. >> reporter: holmes will be formally charged monday. we're getting a little bit of good news about some of the survivors. hospital officials say two more survivors have been released and

one is doing better. seven people are still in critical condition. >> good to hear. manuel gallegus in aurora, colorado, this morning. thank you so much. president obama is warning the syrian government against using its chemical weapons arsenal. syria says it will use chemical weapons if it faces a foreign attack but not to put down the rebellion against the assad government. it is the first time syria acknowledged it had chemical weapons. it is believed that syria stockpiled nerve and mustard gas and missiles to deliver them. >> we will continue to make it clear to assad and those around him that the world is watching and that they will be held accountable by the international community and the united states should they make the tragic mistake of using those weapons. >> rebel troops continue to battle government forces. the arab league offered assad safe exit if he steps down. both president obama and mitt romney are on the campaign trail today. the president in oregon and

seattle. romney in nevada where the economy is the main topic in particular the issue was helping small business, something that romney said was a priority of his speaking in california yesterday. >> if you're employing people and hiring people, i want to see you do better because i want more people having good wages and better benefits. >> romney begins an overseas trip tomorrow with stops in britain, israel and poland. penn state's pretigious football program has been sacked. the university agreed to a crushing list of penalties imposed by the ncaa for failing to act in the jerry sandusky sex abuse scandal. the "sports illustrated" cover sums it up. we were penn state. once a football powerhouse, the school will be crippled on the gridiron for years to come. >> reporter: the late joe paterno is no longer the winningest coach in football history. one day after his campus statue came down, the ncaa took away all of his victories from 1998 to 2011.

it's part of the sanctions imposed in the jerry sandusky sex abuse scandal. >> the 1998 date was selected because that's when the first reported incidents of abuse occurred and that's when the failure to respond appropriately began. >> reporter: the ncaa also fined penn state $60 million, banned the football team from postseason play for four years. and reduced scholarships. current and incoming players are free to transfer and compete at other schools. university officials accepted the penalty saying they will require penn state to move forward. many students believe the ncaa went too far. >> i just don't think its fair that they took away joe pa's record. >> definitely too much. the people who should be punished are sandusky and those who covered it up. not the players and new coaches. >> reporter: ncaa stopped short of imposing the so-called death penalty which would have canceled games for a year or more. >> suspension of the football program would bring with it

significant unintended harm to many who had nothing to do with this case. >> reporter: joe paterno's family released a statement saying the sanctions defamed the legacy and contributions of a great coach and educator without any input from our family or those who knew him best. a little later on "cbs this morning" ncaa president will discuss the crushing sanctions imposed on penn state and its program. sally ride changed the face of the american space program at a time when the u.s. astronaut core was dominated by military test pilots, she became the first american woman in space. ride died yesterday after a 17-month battle with pancreatic cancer. seth doane has the report. >> reporter: sally ride was a physicist when she answered an ad seeking applicants for the space program. in 1983, she became the first american woman in space. >> the thing i'll remember most about that flight is that it was

fun and in fact i'm sure it's the most fun i'll ever have in my life. >> let me just remind you that when we had lunch here at the white house before your flight, that somebody said that sometimes the best man for a job was a woman. you were there because you were the best person for the job. >> reporter: she flew again in 1984, served on a panel investigating the "challenger" disaster and inspired countless young women to pursue careers in science. she founded sally ride science which developed science themed camps, festivals and classes for children who dreamed about reaching for the stars. >> it's a real experience and the experience of a lifetime to be able to fly in space and fly aboard the space shuttle and i have to admit i'm more excited about that opportunity than i am about being the -- as you say a footnote in history. >> reporter: today president obama called sally ride a national hero and a role model. ride was 61 years old. seth doane, cbs news, new york.

an expedition hoping to find wreckage of amelia earhart's plane is headed back to hawaii this morning empty handed. earhart would have been 115 years old today. she disappeared during a flight over the pacific ocean 75 years ago this month. the international group for historic aircraft recovery believes she crashed into a reef off a remote island and survived there for some time but their $2.2 million search found no con includesive evidence. more extreme weather. the strongest typhoon in over a decade hammers china. every ar we pi a necity to plore.

the boat, crew and australian tourists that took this wild video barely escaped from this iceberg tsunami with their lives. it's unbelievable. a powerful typhoon that battered hong kong overnight is weakening causing widespread flooding as it moves inland in southern china this morning. the storm said to be the worst to hit hong kong in more than a dozen years all but shut down the city forcing the airport and stock exchange to close. more than 100 people were injured. what was seen as a promising new drug for treating alzheimer's disease failed its first big test. the drug developed by pfizer and johnson and johnson was given to late-stage alzheimer's patients but didn't slow the decline in mental or physical functions. researchers will continue to study the drug in a different group of patients. once again. spain's borrowing costs increased raising the risk it will require a bailout. moody's downgraded its outlook on credit ratings for germany, netherlands and luxembourg the rating service cited growing instability in europe and the possibility those stronger countries may have to fund future bailouts. asian markets fell slightly this morning. both japan's nikkei dropped a faction and hang seng sunk only 1%. today we'll get apple's earnings report after the closing bell. analysts are not expecting a big quarter from the tech giant. they believe consumers may be waiting for the next version of the iphone to be released. the unease over europe pushed stocks on wall street lower. the dow lost 101 points while the nasdaq was down 35. the nasdaq is raising the amount it will offer brokers that lost money because of technical glitches during facebook's ipo. the exchange will pay out $62 million up from 40 million it proposed in june. however, some experts say the

trading losses may have added up to more than $200 million. the government is investigating chrysler's two top selling vehicles. the national highway traffic safety administration is looking into 2009 and 2010 dodge ram pickup trucks. the agency says the rear wheels can lock up and potentially cause crashes. the investigation also includes 2012 jeep grand cherokees. power steering fluid can leak possibly causing engine fires. american airlines is trying to make things more comfortable for passengers flying from coast to coast. the airline will be the first to offer flat seats on transcontinental flights. several airlines make them available on international flights. american will use the new seats in first and business class on flights between new york and california. i think our trip to l.a. is looking up. >> we'll probably have to pay an arm and a leg for it but we don't have to drool on the person's shoulder next to me. >> hopefully it's not me.

highs in the central and southern plains will again top 100. scattered thunderstorms are likely from the dakotas to kentucky. along the eastern seaboard and gulf coast and from the southern rockies to montana. and in sports this morning. after 12 seasons with seattle, ichiro suzuki is now a new york yankee. hoping to get a shot at the world series. mariners traded him to the yanks on monday. a ten-time all-star and gold glove leader, at age 38 his average has slipped a bit. with the yankees and seattle last night, ichiro switched dugouts, uniforms and numbers from 51 to 31. he bowed to a standing ovation from mariners fans and then delivered a hit up the middle in his first at bat. 16th stolen base this season in the eighth inning.

a-rod hit a single home run and in the ninth ichiro caught the final out in a 4-1 victory for new york. in st. louis, cardinals up one. cruz with a three-run homer to left. a little bit of a surprise. the ball bounced on top of the left field wall, came back and popped holliday right in the head. seventh inning, mark ellis added to the lead. l.a. won 5-3. and in pittsburgh, cubs left fielder smacked the first of what would be two rbi doubles on the night. the chicago right hander struck out five and gave up just one hit in eight innings. cubs win 2-0. only pirates fifth loss in 26 home games. he didn't make warp speed but sir patrick stewart managed a brisk trot carrying the olympic torch in london.

restrictions on small business and even spectators. >> reporter: competition hasn't even started but sponsors are already battling for gold. some are paying as much as $100 million to advertise at this year's olympic games. >> when they put in that amount of money quite rightly, they want something in return. >> reporter: like the right to shut down their competition. only visa cards are accepted at cash machines in the olympic park. craving french fries? mcdonald's has exclusive on those. >> it's a little bit far. this is olympic. this is sport. >> spectators wearing logos of rival brands will be turned away. >> if it's your own clothes and you're not allowed into the olympic park because you're wearing a nike top, i think that's a bit out of order. >> reporter: british lawmakers passed legislation prohibiting businesses from using the olympic rings and avoid words like olympics and london 2012. some merchants are finding ways to get around the restrictions.
