returning to the scene. investigators are back inside the theater where dozens of people are gunned down. what they are looking for. >> >> hello, i'm jessica kartalija. anger in aurora. victims are waiting for justice as they begin building their case against james holmes. wjz has complete coverage of the movie theater massacre. mike hellgren has more on a victim that plans to attend school in maryland and we start with theresa garcia. >> reporter: law enforcement officials are entering the theater where dozens were killed and 58 others injured during a midnight showing of the batman movie. investigators and lawyers for the defense may be allowed inside today. james holmes defense attorney asked the judge for access to the theater as well a has his apartment that police say was rigged with explosives.

the public defender is expected to request a mental health examination before he is charged. a makeshift memorial outside the theater continues to grow. people have been leaving flowers and notes for the victim. >> i can't help but cry. >> plans for the first funerals from this tragedy are already underway. stories of those who survived are helping this community heal. katie medley escaped without injuries and gave birth this morning to a baby boy named hugo of the her husband shot in the eye is being treated in the same hospital. >> he is making improvements, small steps. but he is not anywhere out of the woods. >> iraq war veteran christina blosh was shot in the knee. her good friend was killed. several members of the denver broncos visited her in the hospital. >> people take time out of their day to spend with me means something. >> 15 victims are still

hospitalized. five in critical condition. theresa garcia, wjz eyewitness news. >> petra anderson was shot four times. she was going to continue her education in maryland. >> reporter: weeks away from heading to the university of maryland, petra is in the hospital but she is able to walk and talk. she is among the victims of the colorado shooting massacre. the promising musician and composer was heading to the university of maryland's graduate program in the fall. she is lucky to be alive. >> you may have seen my sister on tv on the news or online in the last couple of days. >> her sister chloe asked for donations for victims. $1,000 has been raised. >> thank you for standing with us and letting this joker know he may have intended it as his story but we are taking it

back. >> reporter: petra's story is nothing more than mir rack cue laws. the bullet traveled up a part of fluid in her brain part of a birth defect she had her entire life. it skipped the healthy brain tissue saving her life. >> our family has been shaken by the events of last friday but we have not been broken. >> reporter: it has been especially difficult for anderson's family. her mom is suffering from four different types of cancer. she is fighting for her own life while thankful her beloved daughter still has hers. doctors gave anderson's mother weeks to live but she is hoping new treatment will extend that. mike hellgren, wjz, eyewitness news. >> stay with wjz for complete coverage of the tragedy in aurora. for the latest on the suspect, the victims and the investigation, log on to wjz.com. the penn state community is

reeling after the ncaa hands down severe sanctions against the football program. we have more on what the ncaa is saying today. ron? >> reporter: hi, jessica. the punishment comes in the wake of the alleged cover up regarding child sex abuse, a scandal involving jerry sandusky. the sanctions include a four year ban on bowl games and reduction of scholarships which could take away much of penn state's football talent. the president appeared on cbs this morning to explain why they came down so hard on the university. >> we are reinforcing that message by saying that kind of behavior is intolerable. we can't stand to the side and watch the values be blown up in that fashion. so, we want everyone to pay attention. this is a cautionary tale that the athletic tail can't wag the academic dog. >> reporter: he said he did not

impose the death penalty because it would have harmed too many people that had nothing to do with the scandal. back to you. >> thanks. the sanctions include the removal of all penn state victories from the record book for the past 14 years. the aclu is reaching out to maryland police departments. >> ing them to write new policies that protect citizens rights to record officers actions. this arrest of a woman set off a firestorm when police seized the phone of a man that recorded it. it's perfectly legal for citizens to record the police and many say officers are being retrained on how to handle those situations. a three-car accident lands one man behind bars. it happened sunday night. police say a driver was speeding and rear ended a car at a stoplight pushing it into two other vehicles. the first car then apparently took off stopping down the road. the driver, stephen smith, is charged with driving under the

influence and other traffic offenses. several were treated for minor injuries. sunshine around the baltimore area this noon. out to the west, stormy weather is making its way our way. wjz is live with first warning coverage. marty bass and bern that death woods are tracking the radar. >> hello. all right severe weather making its way into the state. we start with first warning radar. this is a hefty one. in maryland, it's cutting to the southeast. there is now a tornado warning in effect for this cell. starting to see the severe weather today. let's switch it over and show you so far as severe thunderstorm warnings allegheny county until 12:30 and a severe thunderstorm watch will be issued shortly. it's not out yet but reading some of the correspondence it looks like it will be coming shortly. we will keep you in tune as we head through the day. this front will come through and it will bring changes for

there. the sun is somewhere. 88 in central maryland. complete first warning forecast is coming up. a developing story in pennsylvania where a roman catholic mon sean senior faces a judge for covering up sex abuse claims against priest. monsignor william lin was sentenced 3 to 6 years in prison. he handled priest assignment and assault complaints. prosecutors say he sent accused priests to new parishes and never told police. weather conditions are being blamed for a pile newspaper texas. two people were killed during the chain reaction crash. investigators say a dust storm reduced visibility on the road shortly before the accident. two drivers are still in the hospital. elsewhere in texas, three people are recovering after a gun goes off inside a walmart store. police say a shopper was reaching for his wallet when he knocked a loaded gun from his

>> welcome back, everybody. cooling off now. may have to head inside a little later. we have the threat for showers and thunderstorms in baltimore. right now we are seeing some out west. first warning doppler radar, this is a strong storm, basically bypassing most of maryland. it's cutting through most of the state. we want to switch over and show you as it makes its way into the mountains of west virginia there is a tornado warning in

effect. fortunately for us that is passing south of us. unfortunately there is a tornado warning and the threat for a tornado out of that storm. that is the beginning of this storm system moving our way. we will move on and show you that the satellite and radar, we had clear skies overnight. clouds are coming in because of the storms out to the west. temperature-wise a lot of 90s already. 88 in baltimore. dew points are sky high. that is giving us a lot of juice for the thunderstorms to work with in the form of strong to severe thunderstorms in addition to a lot of rain that could come out of the thunderstorms. we know we had a lot around here recently. when the front goes through, there is a break in our heat. take a look out to the west of that. another round that will move our way. it's a short break here. this is the front that we will deal with today. it's elongated back into the midwest. that will slowly push off to the south of us and be south of us for tomorrow. the second part of it will follow thursday into friday. we will see more clouds
