collided. wjz looks into the near disaster. mike hellgren investigates with more on what happened. an alarming miscommunication at reagan national airport, among controllers. sources say they allowed two to launch as another plane was coming in to land. and there wasn't enough space in between them all. >> they were clear at the river back there. what happened? >> we're trying to figure this out. stand by. >> that miscommunication should not have happened. >> reporter: but it did happen tuesday afternoon, when a storm caused a shift in the wind and controllers were changing the direction of all takeoffs and landings. the inbound plane and first jet to take off were only 12 seconds apart. traveling at a combined speed at more than 400 miles an hour, when the controller noticed the mistake. >> reporter: where was the breakdown in procedure? we have to understand where it was so that we can make sure that it doesn't happen again. >> reporter: according to the faa, operational errors are

growing. in 2009, there were 1234. in twentdz 10, 18-- 2010, 1887. and congress, general accounting office says serious airborne errors tripled in the last three years nationwide. wjz first investigated the problem in 2007, after two planes missed each other on intersecting runways at bwi, by just 400 feet. even then, a captain told us, the problem was growing worse. >> this traffic has increased. we're seeing more and more of these incursions taking place. in some cases, on a daily basis. >> the faa says while the planes were close, they were not going to crash. >> we are interviewing the people involved. we will get to the bottom of this. >> reporter: the national transportation safety board has also investigated several other recent close calls here. at reagan national airport, mike hellgren, wjz eyewitness news. >> the jets all have collision avoidance systems. they refuse to say what would

have happened if air traffic controllers had not diverted the planes. another record-setting victory in the pool for michael phelps. and this time, it -- this time, it is against his biggest rival. how are you doing, mark? >> reporter: michael phelps already stands atop that olympic mountain with more olympic medals than any other in history. what he's doing is adding more hype to that with more medals, today more gold. >> reporter: michael phelps' latest victory comes in the 200 medley. one without much drama. having already received congratulations from the president, phelps again showed he's king of the pool. the greatest greatest swimmer of all time, adds to his career medal, with 20 medals, 16 of them gold. he finished just ahead of fellow american and rival ryan lochte. this is his first gold medal in

the lonz -- london games. >> reporter: and after today's gold, phelps got right back into the pool for the semifinals of the butterfly. he was the fastest in that, too. and he'll be favorite to win gold in that event coming tomorrow. >> he's amazing. phelps' final olympic race will be the medley relay on saturday. cal ripken jr. will soon make his first public comments about the abduction of his mother. >> he just told wjz the new surveillance video has led to 10 new tips. but so far, no arrests. investigators say the man in this baseball cap abducted ripken. she was returned unharmed. now, cal ripken plans to speak of the incident. he's holding a news conference at camden yards. the fbi is working with several other local agencies in this case. >> the surveillance picture of the suspect is now on several billboards around the area. >> reporter: football star

arrested. a former raven set to be honored by the team finds himself in jail. wjz is live. derek valcourt explains. jamal lewis is in trouble for failing to pay child support. >> derek? >> well, the 32-year-old former running back denies any wrongdoing as he faces a misdemeanor charge of child abandonment. >> reporter: jamal lewis broke ravens records when he rushed more than 2,000 2,000 yards during a single season in 2004. now, it'ses -- it's his criminal record that has him in the spotlight. this is his latest mug shot after he was arrested tuesday for not paying child support. the arrest warrant indicates he hasn't seen his son in over a year. but in a statement released thursday, lewis says my arrest was the result of a miss understanding, rather than the result of me being an unfit father. i am a responsible father and have always provided for my children. that fact cannot be disputed. i have made mistakes in my life, but failing to care for my children is not one of them.

i'm confident this matter will be resolved as the legal process plays out. allegations that lewis hasn't paid child support, comes just months after he filed for bankruptcy. he is reportedly $10.6 million debt. >> and this is not the first time jamal lewis has had trouble with the law. >> i made the mistake when i was 20 years old that i'm heavily paying for. >> reporter: that was judge mall louis, in 2005, just after pleading guilty to attempting a cocaine deal. just before he became a professional football player. he spent four months in a prison work camp. >> they gave me my time. and i did and stood up for what i did. and i took responsibility for my own actions am i'm the only one accountable for that. and i have done it. >> reporter: so far, no official comment from the ravens' camp, which has plans to induct jamal lewis into their ring of honor at a special game on september 27th. derek valcourt, wjz eyewitness news. >> derek, thank you.

lewis retired in 2009. he spent six seasons with the ravens and three with the cleveland browns. tonight, baltimore city police are asking for your help to track down a murder suspect. take a good look at the sketch of the suspect wanted in the death of lance johnson. a transgender person killed in the 2300 block of north utah place. police are investigating as a possible hate crime. they say the suspect is between 18 to 22 years old, with a thin build. anyone with information is urged to call 911. scary moments it's a -- inside a busy annapolis theater. a suspicious man inside the theater. wjz is live. monique griego has more on what happened. monique? >> reporter: police say the man was pointing at the audience, like he had a gun. turns out he did not have a weapon. but moviegoers did not find that out until much later. >> reporter: wednesday afternoon. parents and kids pack into the bow tie cinemas in annapolis, for a showing of madagascar 3. but just before the movie ends,

panic erupts, after police say 25-year-old kyle nolan tanner, began yelling and pointing at the audience, like he was holding a gun. >> he came down this aisle and he was like that. >> reporter: wendy lantis got a frantic call from her 12-year- old son, who was watching the movie with a friend. >> he's hysterical and crying. >> reporter: police say tanner did not have a weapon. but at the time, witnesses coo couldn't tell because it was so dark in the theater. >> they thought he had a gun. because they went underneath their seats. and as soon as his friend looked up, he said, let's get out of here. >> reporter: there were people there who were unsure he had a weapon or not. and that's why he fled. >> reporter: several moviegoers ran out and called police. within minutes, officers arrested tanner, a short distance away from the plaza. >> we take these types of matters extremely seriously. we understand how that can cause angst or fear -- angst or fear in the movie theater. >> reporter: the horrific events were also on the mind of

gladys sun. >> thinking about like in batman, someone with a gun is going to kill somebody. >> reporter: police say he is now facing a list of charges. >> he should. it's not right in this day and age for that kind of thing to go on. >> reporter: and tanner is facing several charges, including disorderly conduct and reckless endangerment. vic, back to you. >> the state's attorney's office is facing additional charges am but no additional charges are expected. the trial for john leopold is delayed. he is accused of misusing his policeecutor detail to collect information on his political oppone wants as well as using security aid to do personal errands. leopold denies any wrongdoing. the president declares a major disaster area for parts of maryland hit hard by the derecho storm by the end of june and into july. that money -- that federal aid means money is available for local governments in certain

private, nonprofit organizations for emergency work and repairs. calvert, charles, centsz, mont -- kent, montgomery, and st. mary's are eligible for funding. the storm knocked out power to hundreds of thousands. some for more than a week. after a few showers, things are clearing up tonight. take a look at this video from sky eye chopper 13. short time ago, you can see heavy rain falling from the clouds. a live look outside right now. it's actually fairly pleasant right now. a little sticky, but overall, not bad. bob is in the updated weather center. bob? >> pretty good showers. north sections was city. and over towards essex, middle river. now it's pretty much cleared up. one cell that has developed over portions of caroline county. it's moving pretty much off to the east, just north of denton. another weak shower there. well, just about near del mar. they're heading towards smyrna, delaware. so most of the activity tonight is pretty much over. probably going to stay quiet. but over the next few days, will probably see more

activity. now, speaking of activity, let's go back to the tropics. we have a new tropical storm just announced this afternoon. there was a depression earlier. now, it's a tropical storm with winds around 50, 52 miles an hour. heading out to the west. very quickly at 22 miles an hour. looks like the path would take it south of most of the major islands in the caribbean. but it may just go south of jamaica by -- let's say by monday and by tuesday. maybe approaching cancun, cozumel, as perhaps a category 1 storm. and all the models, once again, do take it south of all the major islands, right into that area. now, if it getting into the gulf, it could conceivably grow to be a stronger storm. it will be sometime in the middle or understand of end -- end of next week. something we'll be tracking, of course. we're planning to hit the road this weekend. your trip could be delayed by a major construction project. sky eye chopper 13 is over the harbor tunnel, where crews will rebuild the bridge, south of

the toll plaza. wjz is there live now. rochelle ritchie explains drivers are being urged to use alternate routes. rochelle? >> just behind me is the steel bridge, which has already undergone two phases of construction since june. the third phase will start this saturday. and you can definitely expect some traffic problems. >> reporter: on a daily basis, 71,000 drivers take interstate 895 through the harbor tunnel and across the steel bridge. well, come this weekend, traffic could come to a halt. >> delays at the baltimore harbor tunnel during this period of time could be up to an hour. >> reporter: the steel bridge construction project is moving full speed ahead into phase 3, which involves replacing wornout contreat on the -- concrete on the bridge. only one lane will be open in each direction. and that equals delays. >> we expect to have extensive backup. >> we are suggesting to use the key bridge, i-695 as the route. >> reporter: the one lane of traffic will operate for two

alex demetrick reports, while attacks are extremely rare, all kinds of sharks are common, along east coast beaches, including maryland. >> reporter: the bite marks went to the bone. but the man still managed to make it to the shore earlier this week in cape cod. >> he stated to me that it was a shark that had attacked his legs. >> reporter: and not just any shark. evidence points to a great white. along cape beach is a number of great whites because their favorite food is here, a massive congregation of gray seals. >> the presence of seals in the area, all of this adds up to the white shark being the most likely candidate. >> reporter: there is also the way it attacks what single. shark expert alex henning ton says the whites have a unique way of hunting and prey. >> they will come up from the bottom and strike their prey. in this case, [ inaudible ] and let them go. >> this guy is extremely lucky and probably should have gone and bought a lottery ticket because he dodged the bullet on this one. >> reporter: of the last great

white attack off new england was 1986 and it was fatal. in ocean city, great whites are not a concern because maryland sees few seals. but there are still plenty of other types of sharks. >> there are sharks off the shore. and lots of people in the summertime. but off the maryland waters, there's never been a reported case of unprovoked shark attack. but chances of getting attacked by any shark are very, very slim. less than being struck by lightning. >> reporter: alex demetrick, week eyewitness news. >> reporter: the swimmer who was bitdz -- bitten in massachusetts is expected to make a full recovery. another water main break making headache. around 11:00 last night. water did flood the basements of some homes in the neighborhood. the department of public works says it is another example of aging infrastructure giving way. no estimate how long repairs could take. a new poll shows marylanders support same-sex

marriage. political reporter pat warren looks at how opinions are changing. >> reporter: if polls are any indication, marylanders from marriage quality are looking to protect the campaign in the same-sex marriage bill. >> the momentum is shifting. according to the polls now. the numbers for support are higher. so, you know, we're ready. we're excited about it. >> reporter: same-sex marriage advocates are encouraged by the july marylanders for marriage equality poll that gives them a 14% edge over oppone entsdzs. 54 to 40%. the poll numbers have been shifting all year. a washington post january poll had 50% in favor, 44% opposed. within two months, a march opinion works poll registered a drop with 43% opposed. in may, public policy polling numbers reported supporting 57% with 37% opposed. the july poll shows a slight drop in support since may.

>> more shows that there is an increase in support for gay marriage. that is a small bit of good news for gay marriage. this is -- it is not this positive. i would not take this and say, i'm now confident as to how this is going to turn out. >> reporter: while the group of supporters were in the hundreds. advocates for traditional marriage heard from thousands. more than 162,000 marylanders signed a petition to repeal the law before it takes effect next year. >> marriage should be upheld between one man and one woman. we think it's going to be upheld one more time in maryland. >> reporter: but as polls go, it's better to be up than down. >> it's energizing to know that it could pass. >> reporter: i'm pat warren, reporting. now, back to you. >> the july poll was conducted by heart research, which also does polls for governor martin o'malley. if you like steamed crabs, you'll want to be in annapolis

it is just before 6:30. 84 degrees and partly sunny. good evening, everybody. thank you for staying with wjz. here are some of the stories people are talk being tonight. one year ago today, maryland native robyn gardner disappeared without a trace in aruba. authorities are coming to the u.s. soon to meet with the fbi as her family vows to find out what happened to her. it was last august that robyn gardner traveled with maryland businessman gary giordano. he said she disappeared while the two snorkeled off the case. two days after she vanished, giordano tried to collect on an accidental death policy he took out on her. all the while, robyn's family in frederick hasn't given up hope in finding her. and for the first time, robyn's family is speaking out publicly. >> my mother is still in

contact with the fbi and the aruban authorities. >> reporter: robyn's heartbroken family and friends gathered for a vigil to remember her. >> we're here to remember her and keep hope that maybe one day she'll come home alive. >> not to give up hope am i think there's still hope. >> reporter: since being released from prison in aruba, gary giordano has professed his innocence on national tv. and he's gotten arrested in an annapolis parking garage, for indecent exposure after police found him naked with a woman. >> he will fight that charge in court next friday. by the way, he's also fighting american express for failing to pay that $1.5 million death benefit. peterson is charged with killing his third wife, kathleen sabio, back in 2004. the judge considered a mistrial, after police suggested peterson left a bullet in his trial to

intimidate him. peterson is also suspected in the disappearance of his fourth wife but has never been charged. state of emergency in a small upstate new york town as a toxic fire rages in a building. monique grioago -- griego is following the story. >> reporter: witnesses report large explosions and a fire ball, rising hundreds of feet into the air. now, take a look at this scene. a rural area of south albany. dozens of homes are being evacuated. and residents within a 15-mile radius are being told to stay inside and shut their windows and doors. the fire is burning inside a transformer recycling company. and officials were sampling the air to see if the soot coming from the fire is hazardous. no injuries have been reported. vic? >> monique, thank you. firefighters are being scrubbed off and rinsed by hazmat teams. in tonight's consumer watch, toyota is recalling hundreds of thousands of vehicles. the recall involves 364,000 rav 4 suvs.

it also impacts 18,000 lexus hs215 models from 2010. toyota says the move is due to a suspension problem that could cause crashes. the automaker said it is working on a fix for the problem. it said dealers will repair the issues for free. five years ago today, tragedy in minnesota, a bridge collapses, dumping dozens of vehicles into the in mississippi river. 13 people died. and more than 100 people were hurt. rena talked with the survivor at the memorial for the victim. >> it's surreal. >> reporter: remembering the 35- w bridge collapse is one thing. having it be be part of who you are is quite another. >> i was just about off of the bridge, over at -- on the north end, when it started to shake. >> reporter: even 5 years later, justin mishler finds it hard to believe he was a part of what happened that day. a normally positive person was for the first time hit hard by his emotions. >> i feel horribly guilty that

i'm able to enjoy my life while so many others are coming down and looking at a pillar, rather than spending it with their family. and i think that that's unfortunate. >> reporter: justin said it's this time of year that is the hardest. it's the little things that trigger. >> the weather. at this time of year, certainly makes me feel like i did that day. >> reporter: he and his wife take the anniversary off every year to celebrate what he was given, in honor of what -- and honor what was taken away from 13 others. >> i almost exited on third street to go to the town hall brewery. and i didn't. so every year, we cherish life, and we take a trip to the town hall brewery and have lunch and enjoy our time together. >> and the ntsb cited a design flaw as the likely cause of the collapse and asserted that additional weight on the bridge at the time of the collapse, crbtszed to the-- contributed to the catastrophic failure.

like, no, it's just baseball cards. >> reporter: but these cards are worth more than $3 million. >> double the known population. collectors are excited. these are in the same condition that they were in when they were manufactured in 1910. >> reporter: chris ivy works for the auction house that had them appraised. tonight, they will be up for auction at the sports convention. >> who district buys these? >> good question. all walks of life. ceos of fortune 500 companies to postal workers. it runs the gamut. >> reporter: this 1910 hoinous wagner card will be auctioned off individually, with a starting bid of $180,000. >> a lot of collectors didn't bother. even though they were interested in the series, they didn't bother to collect it because it was difficult. >> anyone who has been a collector appreciates this probably more than all the babe ruth cards in the world.

tonight, mark is live with the wjz the fan sports report. >> i hope he isn't having too many stories about this today. >> we avoid the injury stories tuesday as we look at the quarterback. nfl camps across the league, the focus is most intensely on the quarterback. no different here in owings mills, where joe flacco is always under intense scrutiny. it comes with the job. ravens hope it's a fifth straight play-off appearance. the guys got to work out indoors today. coach john harbaugh gave them a respite from the heat. as far as leadership ability, constantly under attack from the critics. but coaches and teammates believe in flacco.

and the organization is negotiating a long-term contract to keep him in baltimore for years to come. flacco keeps talking about the focus of his work during training camp. >> i think it's my job to get everybody, you know, on the same page, so that when we go out there, there's no error. we're hitting on all cylinders. and if something goes wrong, it's because something crazy happened. i think if we can all get on the same page and you know, all see the defense the same way, we're going to be toughing this out. >> and the first dress rehearsal. the first preseason game, one week from tonight, when the ravens play the falcons in atlanta. other nfl news today. an ownership shuffle, within the ravens' division. it's the sale of the cleveland browns. owner randy lerner strikes the deal to sell the browns to jimmy hassler iii. who is a minority. hassler will pay a reported $1 billion to buy the browns. but sales still have to be

approved by a league of owners before it's complete. let's talk baseball. this is a day of rest for the orioles before they begin on the road at tampa bay tomorrow night. orioles remain despite the struggles of many of their young starting pitchers. that includes zach briton. he's the latest to falter. it happened yesterday at yankees stadium in a loss to new york. his outing has put the spot in the starting rotation in jeopardy. if briton gets the motive, he's going to follow young pitchers jake arrieta, and brian matusz to the minor leagues, where they're now, for minors in the inconsistencies at the level. manager buck showalter is dealting with growing pains here. >> i'm patient, to a fault sometimes. but at the same time, i think they and we want to win games. and we just hope that they're part of that. i'm not going to sit around here and whoa is me and the sky is falling. we're not going to cheat the process. and make sure that -- but at some point, you do have to get
