season. the latest on orioles star manny machado's injuries. eyewitness news at 4:00 starts now. crisis over. the terrorists who attacked the mall in kenya are all dead. hi, everybody. i'm mary bubala. >> i'm kai jackson. here's what people are talking about. >> the four-day-long siege at that upscale shopping mall in kenya appears to be over. but it is unclear if all the hostages are safe and what the death toll will be. alfonsoalphonso van marsh is here with the latest on the situation. >> reporter: kenya's president says his forces have defeated the terrorists who attacked

nairobi's largest shopping mall, killing all the people. >> all the attackers wish to destroy the essential character of our society. they failed. kenya endured. kenya endures. >> reporter: he says 11 militants are in custody and five attackers are dead. this grainy security camera photo shows two of the gunmen who launched the attack on the westgate mall. kenyan authorities say at least six died on the fourth day of the siege. alshabab are calling it quits. >> we don't fear your appearance as americans because we're not weak. and you should tell the kenyans to stop their aggression if you want to be safe. >> reporter: those who escaped the mall massacre said at least one of the militants was a woman. kenya's foreign minister says the attacker is not only somali. >> two or three americans. >> reporter: u.s. officials did not confirm the claims.

>> reporter: the dead come from at least a dozen countries, including england, france and canada. kenyan authorities warn there will be more bodies. alphonso van marsh, wjz eyewitness news. >> kenya's president also says three floors of the mall have collapsed and bodies are still trapped in the rubble. he declared three days of mourning in the country. >> reporter: a graduate of johns hopkins university who was 8 months pregnant is among the victims killed in the attack. denise is in the newsroom with more on this tragic attack. >> 33-year-old elise yaboos and her husband were killed in the attack. yaboos was of turkish descent and grew up in the netherlands. she worked for the world bank and earned a doctorate in public health, focusing on malaria in east africa. she and her husband had just moved to east africa. >> she also earned a doctorate

degree from harvard university earlier this year. >> the investigation continues into a fiery and deadly crash in northeast baltimore. three people were killed in the accident, following a police pursuit. wjz has been on the story since it broke early this morning. mike schuh reports from the scene with the latest. >> reporter: police are very concerned about what happened here at york and northern parkway, as three people are now dead. following an attempted traffic stop, in which the suspects fled. >> reporter: this is what a neighbor sees when he walks out the front door. both cars on fire. paramedics trying to pull a woman out of the burning jeep. >> and that's when the whole thing unfolded. everything was like on fire. >> reporter: that crumpled ball behind the silver suv is a honda. police say they witnessed its driver commit a crime, at 25th and harford and tried to stop it. >> the officers followed the vehicle for sometime. which got them to the intersection of northern parkway and york. >> reporter: and it's here, the honda, north on new york,

broadsides this jeep. >> and they are also working on the jeep. they have like a crow bar. to open the door because they couldn't get the door open. and then, you know, the paramedics came. and everything unfolded from there. >> reporter: there were two people in the suspect's car, one seen here being worked on by firefighters. >> reporter: as a result of that collision, two individuals in the first vehicle that was initially observed by the officer, succumbed to the injuries of the traffic collision. >> reporter: but the driver of the jeep walks away. >> when i came out, he was just walking out. somebody was helping him walk from that area. >> reporter: police swarm the scene. investigators reconstructing what happened. keen to know if their undercover officers were chasing a suspect in violation of its restrictive pursuit policy. >> we have a lot of questions right now. and unfortunately, we have more questions than answers. what we do know is that tragically, three individuals lost their lives. >> reporter: police are not yet releasing the identities of

anyone involved in this incident. reporting from north baltimore, mike schuh, wjz eyewitness news. back to you on tv hill. it took nearly 10 hours for that intersection to be reopened at york and northern parkway. more on the investigation coming up all new at 5:00 and 6:00. the former anne arundel county government employee who sued former county executive john leopold settles her case. carla ham ner, who you see here, accepted a settlement. she sued leopold, alleging gender discrimination, sexual harassment and retaliation. in january, leopold was convicted of misusing county employees and resigned. making it official. maryland attorney general doug gansler is running for governor in 2014. he formally launched his campaign in montgomery county. part of a six-day, 17-stop effort to succeed governor o'malley.

he faces a crowd of challengers. well, we are waiting to find out the severity of the injury to orioles star third baseman manny machado. machado injured his knee, running at a ground ball in the 7th inning yesterday against the tampa bay rays. according to our media partner, the baltimore sun, an mri was done this afternoon. the orioles are not releasing any other information until the results of that mri comes back. manager buck showalter is about to hold a news conference. wjz will be live with the latest at 5:00. turning to weather. it's another delightful, early fall afternoon. let's take a live look outside. a little warmer than yesterday. but still below the seasonal average. meteorologist chelsea ingram is updating the first warning forecast. great day out there, chelsea. >> and it is just a great day.

it's 73 degrees and sungy -- sunny in central maryland right now. the complete first warning weather forecast is coming up. an horrific death in colton, california. a 2-year-old boy is killed after being mauled by a family dog. police say the toddler was attacked by the family dog. the boy was sent to the

hospital and later died from his injuries. officers say at least five dogs, all pit mull bullmix -- -- pit bull mixes were involved. the child's grandma was arrested on child endangerment. hundreds of firefighters are battling a fire. the blaze broke out in azusa, near los angeles. the wildfire is burning mostly in the angeles national forest. but it's close to? 20 homes -- to 20 homes at this time. an amazing rescue. the coast guard and a good samaritan saved two brothers thereof a boat capsized. todd quinones has the story. >> reporter: mayday, mayday. >> what's your position? how many persons on board? >> 39, 42, 087. 73, 56. 46. >> reporter: just after that call, the brothers' 31-foot boat capsized.

and time was not on their side. >> two members jumped in the water. they were not able to get any rescue equipment on themselves. so the rescue equipment was floating in the water. they were able to grab onto a life ring. >> the guys were in the water. they're tired, getting cold. >> reporter: cory rettinger and andrew gov received the stress call monday morning. you can listen again as they let the rescuers know their position just before they flipped over am. >> how many persons on board, over? >> 39, 42, 087. 73, 56. 346. >> and after that, the radio went silent. >> reporter: that call, along with the distress beacon the brother had most likely saved their lives. as this coast guard video shows, rescuers were able to get to the exact location. the crew from another boat, the jamaica 2 was in the area. and one brother was able to climb aboard. >> and one was too weak to pull

the middle east. as jarica dunk an reports, it comes as there are signs of a thawing with relations with iran. president obama had lunch with world leaders today. there was speculation, he might yoz paths or -- cross paths or even shake hands with iran's moderate president. but that didn't happen. the delegate skipped the lunch. he told the u.n. general assembly, his administration will pursue talks with iran. leaders of the two country have not met face to face for more than 30 years. >> the road blocks may prove to be too great. but i firmly believe the diplomatic path must be tested. >> reporter: iran's diplomat said rouhani skipped lunch because alcohol was being served. but other officials say a face-

along nairobi to end that siege. five of the terrorists were killed. another 11 suspects taken into custed ony. over the weekend -- custody. over the weekend, the armed men stormed them all, killing others and takingers hostage. several americans were among the dead and wounded. the attack was carried on by alshabab, which has links to al qaeda. >> the attackers say that the strike was retribution for kenyan forces' push into neighboring somalia. we have breaking news to tell but now. a trench rescue is under way in frederick. it is happening on eagle head drive. as you can see, a number of workers are on the scene, trying to extricate a trapped worker. right now, the man is trapped between those red boards you see there. and he's wearing a green shirt. you can see him sticking up out of the areas, as they're trying to remove him from that pit. we, of course, will keep you updated as we get more

information. new questions about how the washington navy yard shooter was able to get security clearance. he lied about a previous gun incident and failed to disclose thousands of dollars in debts, both of which would have prevented him from getting security clearance. the navy is changing the way background checks are done. >> gowr people are now charged in the mass shooting in chicago. all of the young men are charged with attempted murder and acr aggravated battery. last weekend police say they opened fire on a crowd watching a basketball game. police suspect the shooting was gang-related. up to five months of testimony, closing arguments begin today in michael jackson's wrongful death suit. jurors must decide whether a.e.g. live, which promoted jackson's comeback concerts is libel for the singer's death. casey nguyen reports.

a forest fire continues to rage out of control in northern spain. more than 1,000 firefighters are trying to put out 11 major fires. the flames are scorching through thick woodland and tearing through ravines. the fire has spread to neighboring portugal. hot winds are hampering the efforts of firefighters. twin sons are accused of standing in their father's house and blocking it on tire. >> reporter: well, vic, the two are being held on a million bail. and the father, who escaped are surprisingly understanding. thawrnl in business with him.

they charged with conspiracy to commit murder and arson. the 70-year-old doesn't blame his son. in fact, he's taking the blame. the senior bledsoe said he is not an easy person to work with or live with, and he will never abandon his son. >> william bledsoe was treated for minor smoke inhalation. a promising high school basketball player drops dead during a practice in florida. milo mates was rupping around the tracks, doing conditioning drills when he became l il. grief tourn counselors are working with students and teachers at the school. an autopsy will determine the cause of death. some of the -- teenagers are apologizing. when brian asked the teens to come help him clean up, only four showed up.

>> reporter: ricky and michaela couldn't believe what they saw at the steven town hole. >> like i didn't know it was this damaged after the party. >> it was eating me alive. i didn't know what was going on. if i did, i wouldn't have came. >> reporter: they are two of 300 teenagers police say trespassed into brian holloway's home. damage is done. walls spray painted, broken windows and the floors ruined from scuff marks and urine. >> people were tweeting the address. wewe didn't know it was broken into. >> reporter: the two teenagers came to holloway's home to apologize. >> we brought him an apology card, put some money in it, to say sorry. >> reporter: the former football player wanted them to come for what he calls redemption. >> theyault need time to just talk together and work through this egregious offense. it was an offense to the entire

community. >> reporter: brian says the teenagers involved need to be held accountable and take responsibility for what they've done. >> being a leader, being responsible. being able to go and tell other people, look, i was one of the 300. i made a mistake. it was wrong. >> reporter: that's what ricky and michaela did, as they joined other community members volunteering to help clean up the mess that was left behind. >> what do you think ever all of this? was it worth it? >> no. not at all. not one bit of it was worth it. >> reporter: two teenagers are charged with trespassing. police say more arrests could follow. the girl born to kidnapper ariel castro and his victim, amanda berry, will be removed from all public court records. prosecutors idea the girl's name be deleted to protect her privacy. her mother kicked out the door of castro's home in may and yelled for help. she freed herself and two other women. castro committed suicide in jail earlier this month. for the second time of her life, the girl@center of a bitter custody dispute is

handed off to other parents. the three-year long custody dispute may now be over. >> reporter: late monday evening, veronnic's biological father, justin brown, handed her over to her adoptive parents. it's a culmination of a four- year battle that began shortly after the south carolina couple began the process of adopting veronica in 2009. her unmarried biological mother gave permission for her to adopt. though he had given up parental rights, as a cherokee, he cited native american law preventing children from being separated from their people and tribe. >> the only people that can give you your history is your family. >> reporter: the south carolina supreme court ruled in brown's favor, and since 2011, veronica

has lived with him and his wife robin. >> everybody needs to realize, she's happy. she's very happy with us. >> reporter: but the kappa biankos appealed. and this past june, the supreme court ruled against brown because he gave up his parental rights. then a south carolina court finalized the adoption. still, brown objected and tried appealing the decision in oklahoma, where he's raised veronica for the past two years. the oklahoma courts issued an order that kept her with brown and brought the two parties to mediation. when the talks broke down, the court dissolved the order monday. paving the way for the return to the kappa biankos. cherokee nation attorney general, who had been aiding the fight said veronica's return to the kappa bianko was peaceful, as he spoke to a crowd of brown supporters. >> it is a bad day for the cherokee nation. a bad day for native american

city. just delightful. low 70s. annapolis and kent island, coming in at 67, oddly enough. we do have a bit of a northwest breeze. continuing to bring in dry air. a big area of low pressure sitting over eastern portions of canada that is just dragging this nice, dry air mass croogzy across the region. we have that spin up to the northeast of us. because of that spin, the air is being drawn down to central canada, which is a long way from any water body. it's dry, cool. you can see, nothing around our region. or clouds southwest of us. these will pass south of the region tomorrow. there may be some clouds in the sky tomorrow afternoon. unlike we've seen the last couple of days. so you may have seen some clouds physically south of our region. where there might even be some sprinkles in our region. not talking about a lot of rain. maybe light sprinkle activity down in that region. for the most part, there's that area of low pressure that is going to move south of us. pleasant conditions, with big area of high pressure. see the model showing a little rain down there.

actually, one of the models has a low pressure developing on the east coast. somewhere there this weekend. will that happen? don't know at this point. but we'll keep watching for you. in the meantime, just dry, beautiful, pleasant conditions will continue. northeast winds on the bay at 5 to 10 knots. bay temp, 73 degrees. same as area temperature. tonight, then, clear. not quite as chilly this morning. 43 this morning. 46 or so. and tomorrow, mid-70s. may get up to 78 degrees. and certainly it will be sunny. could be a little patchy fog, as we saw in some spots this morning. this time of year, with the nights getting longer, do get a better chance of the fog. traditionally, the fog season in the fall. may see some of that. but it will burn off and be another day. and the leaves are starting, already to turn. a lot of trees have been stressed by the lack of rain. a lot of leaves have come down. it's all over the place. >> here we go. three bags in my front yard now. still to come on eyewitness
