life-changing surgery. captioning funded by cbs this is the "cbs morning news" for wednesday, september 25th, 2013. good morning. thanks for joining us. i'm susan mcginnis. we begin in washington where time is running short. if congress doesn't act, the government will run out of money next tuesday. the senate is about to begin preliminary voting on a house bill that would fund the government but defund president obama's health care law. senate democrats plan to strip that health care provision out of the measure, but senator ted cruz is doing all he can to delay a vote. the texas republican started speaking in opposition to the health care law on tuesday, and as of 4:00 a.m. eastern time today he was still going, occasionally yielding to questions from utah senator mike lee. ko im is in washington with all the details. ko, good morning. >> good morning, susan.

the senator started speaking against the health care act tuesday afternoon into the early wednesday morning hours to a largely empty chamber, but his efforts aren't sitting well with fellow republicans and will probably fail. >> i intend to speak until i am no longer able to stand. >> he wants the house to defund the affordable care act while trying to delay senate democrats to making changes to the bill that allows the health care law to go forward. >> when you have a law that is causing more and more people to lose their health insurance, you have a law that's not working. you have a train wreck. >> cruz calls the health care act a job killer that's expensive and bad for business. speaking at a forum with former president clinton, president obama said in states like new york the health care overhaul would save consumers thousands of dollars.

>> it turns out that their rates are 50% lower than what was available previously if you just went on the open market and tried to get health insurance. >> crews pressed on for hours. at one point he read tweets to anyone watching. to his daughters at home, he read a popular bedtime story. >> do you like green eggs and ham? i do not like them, sam i am. i do not like green eggs and ham. >> but in the end they will not allow the health care act to boo defunded and fel lowe republicans are worried they'll get blamed for a government shutdown. they say this is not a winnable battle. >> i just don't happen to think filibustering a bill that defunds obama care is the best route to defunding obama care. all it does is shut down the government and keep obama care funded, and none of us want that. >> a preliminary senate vote is expected today. the senate is expected also to send its funding bill, including

money for the affordable care act, back to the house this weekend. susan? >> ko im in washington. thank you. well, some in congress are skeptical of president obama's diplomatic overtures to iran. he signals he is open to talks on iran's nuclear program. jericka duncan reports. >> reporter: president obama had lunch with world leaders at the u.n. there was speculation that he might cross paths or even shake hands with iran's new moderate president hassan rowhani, but that didn't happen. the delegate skipped the lunch. earlier president obama told the u.n. general assembly his administration will assume talks with iran aimed at keeping its nuclear plans in check. leaders of the two countries have not met face to face for more than 30 years. >> the roadblocks may prove to be too great, but i firmly believe the diplomatic path must be tested. >> reporter: iran state-run news

agency says president rowhani skipped the lunch because alcohol was being served, but they say a face-to-face talk with president obama would have been too complicated for rowhani back home. president obama called for a security council resolution, forcing syrian president bashar al assad to make good on his promise to surrender his chemical weapons. >> if we cannot agree even this, then it will show that the united nations is incapable of enforcing the most basic of international laws. >> reporter: the president announced the u.s. will send nearly $340 million in additional aid to refugees in countries affected by the syrian civil war. jericka duncan, cbs news, united nation. today begins three days of mourning for kenyan victims of a terrorist attack on a nairobi mall. kenya's president says the siege which began saturday is over but the mall is still being

searched. at least 61 civilians were killed in the assault, but the death toll is expected to rise. charlie d'agata has the latest from nairobi. >> reporter: it was hard to tell the siege was over. gunfire and explosions rang out again. an army sniper kept his gun trained on the mall from a nearby construction site and kenyan troops were stationed on the perimeter and roof toops while helicopters flew overhead throughout the day. inside groups of kenyan soldiers continued to comb the 350,000-square-foot shopping complex floor by floor. kenya's president said in part of the mall three stories collapsed during military operations and he warned bodies are still trapped under the rubble. still he addressed the nation saying kenya had stared down evil and triumphed. >> we have shame and defeated our attackers. that part of our task has been

completed by our multi-agency security team. >> reporter: he said he could not confirm intelligence reports that suggested two or three americans may have been among the attackers. city morgues are preparing for the worst. we found volunteers who had been working round the clock since saturday's massacre. >> and the bodies were stacking up. actually they were building up a pyramid, and we had to do something, so we -- >> reporter: doorarmish, an engineer, told us the hardest part was when he had to tend to the body of a 9-year-old boy who died in his mother's arms. >> yes, i washed the boar cleaned him up wrapped him, put him in a cloth. >> reporter: the president said he couldn't confirm it but he suggested intelligence reports suggested that two or three americans may have been among the attackers, but he said he ordered forensic tests to be carried out on the remains to

help determine exactly who was responsible for the attack. charlie d'agata, cbs news, nairobi. one of the americans caught up in the terrorist attack is back in the united states. she arrived in washington yesterday. she works for the world bank in nairobi. she said she was having lunch in the mall when the assault began. >> i was eating on the terrace, and you heard an explosion and we started crawling out. we were in the back of this home goods story. it was really crazy. we saw a couple of people. one had jeans, one had a white thing on his face, but i don't really remember. >> she called it a really scary experience. five americans were wounded in the attack. rescue operations are under way in pakistan following a massive earthquake. it happened yesterday afternoon. at least 210 people were killed, hundreds more were injured.

most of the victims died when their houses collapsed. thousands are homeless. communications are spotty. the quake was so powerful it forced a new island out of the sea near the coast. in flood-ravaged colorado six people who were listed as missing have been found safe and well. eight people have been confirmed dead. only one person remains missing and is presumed dead. patricia goodwine. goodwine loved the big thompson river. she battled multiple sclerosis but worked at a library. when the waters started to rise her co-workers checked up on her. >> she had gotten a call from 911 and i called her, too, and wanted to reiterate. she said the bridge was already -- the bridge was already hard to get over and the last thing i said was get as high as you can. >> nearly 2,000 homes were damaged or destroyed. more than 3,000 people had to be airlifted to safety. coming up on the "morning news", breaking the silence. a deaf boy's emotional reaction to hearing his mother for the very first time.
