this is in northeast maryland up in cecil county. now all of these trees are located on the same private lot. all in a little bit of a cluster. there's about a does -p trees we counted that have received serious damage. the tops ripped off, some missing branches. some very high up and some down as low as 6 feet up from the ground. as you can see all of the pieces of trees that have been ripped off and are laying right there in that cluster. no word exactly what type of weather event this was but we do know it was association with the storms that passed through this afternoon. reporting live from sky high chopper 13. i'm captain jeff long, back to you. >> captain jeff, thank you. first warning weather team tracked these storms all day long. bob turk with more on the system that moved quickly through our state, bob. >> that looks like very strong down burst of winds, straight downwind of thunderstorms along this afternoon. we had some heavy stuff around here between 11:50 and 12:00 or

12:30. all that activity has moved off. we look around cecil county we did have heavy activity. that is all off to the east of us now. we're left with a lot of clouds maybe a couple of sprinkles. jersey now, southern delaware and low eastern shore. that will continue to move east of the area over the next several hours. as far as temperatures go, watches, this watch from the eastern shore the tornado watch just cancelled about 30 second ago. computer hasn 't quite updated it. we still have until 1:00 in the morning. those coastal areas because you've had southerly winds could up to 8 miles per hour till tonight. everybody is going to be cooling down over the next several days. look at that, shell -- chelsea is in the outback. chelsea. >> we're going to be cooling down. we'll see highs right around 70

government shut down started seven days ago. justin gates who works at one of the washington museums has also been furloughed. >> we want to be able to do our work. and we're hopeful that there'll be a resolution so that we can get back to work. >> reporter: speaking boehner and house republicans are doubling down on their position. they want to put conditions in the bill that will reopen the government and the bill needed to raise the debt ceiling. >> this morning the senior white house official said that the president would rather default than to sit down and negotiate. really? >> reporter: one thing both sides can agree on is getting federal employees back pay. this week, the senate is expected to pass a house bill reimbursing workers once the shutdown is over. and the markets did react to the ongoing shutdown. the dow is down 136 points

closing at its lowest level in a month. the s &p and nasdaq also closed down. denise has more on what they're saying about miriam carey's state of mind. >> reporter: miriam's family is now telling the media their sister was not delusional and suspect she was running from danger when she was killed. her sister was afraid and fleeing with her daughter says one sister. another sister suggests that her sister over reacted. officers then shot and killed her. the sisters also disputed officials accounts that miriam carey was under the delusion that president obama was spying on her. police arrest a man

suspected of stabbing two security guards outside the comedy factory downtown. kenneth bernard corporal allegedly had an argument about an unpaid bill inside the club he was in the process of being escorted out of the club on market street when police say he stabbed two of the officers. both are at the hospital recovering tonight. corporal has been charged with first and second degree assault. the government shut -- shutdown is keeping crews from investigating a metro accident. it happened on the red line. the transportation board said it was notified of the accident but decided against sending investigators. they say the accident didn't meet the criteria to pull people off of furlough. federal lawsuit is filed against the u.s. naval academy superintendent asking him to recuse himself from a sexual

assault including a naval shipman. rochelle richie has more on why he was asked to step down. >> reporter: this judge says she will not micromanage the military's judicial system. inside courtroom five via the united states courthouse, theshipman who says she was aped by these three navy football players will hope the they will order miller to recuse. they say his behavior would not grant their client a fair trial. >> i received a lot of hostility not even from the attackers. >> reporter: the victim says she was raped by the three. >> i was drinking, i had drank

a lot. from that point on i really don't remember what happened. i woke up the next morning with bruises and i knew something wasn't right. >> reporter: but her assailants tell a different story saying the sexcapade was consensual. but the judge says she doesn't believe she has the authority to interfere with the military's judicial system. and this isn't over just yet, on wednesday vice admiral miller is expected to testify in this federal hearing which will determine whether or not he is biased. but today this judge showed no indication that she planned to order a recusal. i'm rochelle richie. other officials are also expected to testify at the hearing. in anne arundel county police arrest a woman on

locally upper 50s to low to mid- 60s in the area. overnight tonight once again it's been a lot cooler than it has been recently. new jersey that's where the rain is. just about east of cambridge to about ocean city for the next two hours. it'll continue to rain at the beach. salisbury another 20 minutes. easton almost over. west of the bay generally that's it. one or two sprinkles. so drier air moves in tonight. tomorrow a lot of sunshine. much cooler day. only around the upper 60s to 87 degrees. the only fly in the ointment and it's going to be a big fly. this is going to go to the east coast. but what's left of remnants in central florida. that may come up off the carolina coast by wednesday and

thursday. and with big area of high pressure developing to our north you might start seeing easterly wind which could really bring up the clouds from the ocean. we have a chance late wednesday which could linger into the end of the week for clouds, damp rain possible. now we've been really deficit in the rain amounts so we can really use rain. right now if the front continues to push off to the east. a lot of dry air comes in. it may hold but we do have to let you know, we could see several days of dreary cooler and wet weather coming up next week. you see the models showing some rain into the carolinas by wednesday. it may get this far north by wednesday night. just keep that in mind. northwest winds 10 to 15 knots in the bay. the sunrises 7:10, sets 6:30. 50degrees overnight with clear skies overnight. then tomorrow back up near 70.

it is 5: 5:29. good evening everybody. thank you for staying with wjz. and today a documents reveal what a former police recruit's case will go. >> reporter: after authorities

say training instructor william kern used his own gun instead of a training weapon during a training exercise. kern's defense attorney will try to prove he was supposed to have a live weapon to ensure the safety of the officers and cadets. at least one person who is authorized to carry a firearm must be armed with a live weapon. court documents also reveal the training gun and the real weapon are roughly the same size, weight and measurement. the only difference is that the grip of the training weapon is blue. any individual gripping a training device in the same fashion as they would grip a live weapon would not see the entirety of the blue grip. the effective muscle memory and recall of an officer of 17 years such as defendant kern would cause that officer to engage in the same mechanics of withdrawing, aiming and firing a training device like they would a live weapon. eyewitness news found though other police departments used training weapons entirely

colored blue to avoid any confusion. >> william kern is charged with second degree assault and reckless endangerment. both are misdemeanors. meantime the recruit who was shot is out of the hospital. his family has filed a civil suit against kern and the city. a u.s. trooper remains under critical condition. sunday morning trooper jaquelin kline helped another trooper pull over a suspected drunk driver. she was hit by a car driven by 21-year-old enrique guzman as she was walking along the shoulder. charges are pending against guzman. a two car crash leaves one person dead and another injured in college park. the cars collided between i95 and new hampshire avenue early this morning. the incident closed all lanes for a short time.

the crash is under investigation. at least six more militants in kenya are wanted in last month's mall massacre. denise is live in the newsroom with more. >> reporter: police in kenya released new video of two suspects at the mall massacre. these two men entering a bank in nairobi were paying for a car that was used to take the terrorists to the west gate mall. the video indicates the deadly attack was planned weeks in advance. the mitsubishi was used -- survivors of the attack say terrorists first lobbed grenades into the interior of the mall to stun the guards. mary. >> all right, denise. thank you. so far six suspects have been identified in the the attack that left more than 60 dead. two u.s. special forces raids are conducted in russia. one is to erase the master mind of a terrorist attack.

another a leader. the military will only confirm capturing one of them. abu anas al-libi is now being questioned for his alleged role in the 1998 bombings in american embassies in africa. before american special forces captured him in libya on saturday, al-libi was on the most wanted list. and there was a bounty for his arrest. officials in libya call the operation an abduction. and said libyan nationals should be tried in their own country. traveling over seas, secretary of state john kerry defended the operation. >> the united states of america is going to do everything in its power that is legal and appropriate in order to enforce the law and protect our security. >> reporter: al-libi is expected to be transferred to new york where he will be put on trial. navy seals stormed a compound trying to capture the suspected

master mind of a massacre in a mall in kenya. it appears the suspect known as akrima was not killed or captured. the seals got into a fire fight and had to withdraw. in new york, wendy gillette. >> al-libi's family members said he had been living openly in libya and had no ties to terror crews. it's the same manhattan site where a crane collapsed during superstorm sandy last year. the crane is now secured and residents are being allowed back into their homes. fortunately no injuries were reported. taking the tack man private is in a bill being introduced in baltimore city council

following allegations of errors in sales tax. >> reporter: whether it's getting rid of the trash on firefighters, the city has to take care of its bills. but not all property tax are error free. some homestead properties have received incorrect bills. the city council has called to privatized tax collecting. it's a move that the city is trying to stave off saying the process has been improved. basically by using more computer power and less human handling. after the type of errors being made, according to the city's auditor. >> what the paper said the errors were causing properties to under pay their taxes. >> reporter: in an investigation by wjz's media

line in saturday's marathon. and a look at the scholar athletes amazing graduation rate. >> remember for the updated forecast from wjz's first warning weather team. the national aquarium in baltimore is welcoming some new animals after their dc home closed its doors for good due to renovations. wjz is live, monique griego is at the aquarium with a closer look at the changes. mononeck. >> reporter: this is just the first look of animals to come up here in baltimore. the national aquarium is going to receive at least 1,700 animals from dc. there were a lot of eels and fish. four wills isn't the way you would expect an eight arm octopus to travel. but packaged in cardboard is exactly the way that this guy arrived from washington, d.c. >> hi buddy. you okay? >> reporter: he's part of the

first group of animals to make the long some what stressful trip north from the recently closed aquarium in washington, d.c. >> everything went well. he was responsive when i opened the box. so everybody down in dc did an excellent job. >> reporter: the dc aquarium lost its space due to renovations. in all baltimore will receive 1,600 animals of their entire number. the fish were unloaded at a holding facility in fells point. >> it's a very intricate process. there's a lot of animals that we're moving that have specific habitats that we need to pay attention to. cold water versus warm water, reef systems versus not. >> reporter: all of the animals will spent 60 to 90 days in quarantine here at the holding facility. >> which means they come in, we check them for health issues. we make sure they're all clean with a clean bill of health.

>> reporter: trucks will continue bringing up animals from fish to turtle, frogs and even sea horses. this new octopus will make two at the aquarium but some of the animals will be some we've never seen before. >> having him come in is just going to be an added benefit for everyone. >> reporter: now the octopus and the other animals have to stay in those small containers for a few hours just so they can get used to their new surroundings before being moved to the holding tank. as of right now we're not clear when exactly they will go on display at the national aquarium here. monique griego. >> we will be patient, monique. the national aquarium will look at how they can keep a presence in dc but for now nothing official has been planned. we like that they're here in baltimore. >> yes, more octopuses.
