this is wjz tv, baltimore. >> from the city to the counties the your neighborhood, now it's complete coverage. it's wjz, maryland's news station. caught on camera, maryland's attorney general at a beach party where there may have been underage drinking. >> he talks about what he was doing there and what he saw. could this compromising photo hurt his campaign for governor? hello, everyone. >> here's what people are talking about tonight. >> maryland's attorney general is in hot water again, this time for his actions at a party in delaware. was underage drinking going on while he was there? we have his response. >> reporter: white shirt center at a teenage house party in delaware where underage drinking was going on. >> there certainly was drinking

going on. if you look at the picture, not right where i was, but there are some kids holding red cups and generally, you know, there could be cool aid in the red cups, but there's probably beer in the red cups. >> reporter: he said he dropped in to see his son. the party was chaperoned, and he saw no evidence of alcohol when he was there. he says the primary race makes him a target. >> it's the dirty tricks and all the innuendo and stuff. we're more than a year away from an election and this stuff's going on now. i assume it's going to get more and more. >> reporter: what he won't do is quit. >> i'm a big boy. i've been doing this for a long time. when i'm wrong, i'm wrong. in this case, i could have done something differentliment.

>> reporter: he says he should have checked in with the chaperons. he does have a moral obligation to other people's children as well as his own. now back to you. >> that party took place at a south bethny beach rental house in june. the investigation into a police shooting in howard county is focused on shock trauma where both the injured officer and the suspect are being treated. wjz has been covering this story if the beginning and we have all of today's developments. >> reporter: after a 15-hour massive man hunt, he is in custody. >> we have a tremendous amount of work to do to find out why he chose to do what he did yesterday. and we have a tremendous amount of work to make sure he's accountable for that. >> reporter: drivers spotted him pacing with a gun around this red pickup truck. when officers approached, they say he opened fire. >> as the gunman jumped over the guardrail and ran into the woods. >> reporter: he was shot in the leg and likely hid in a storm

drain all night. thursday morning a witness spotted him and told police. >> he just put his hands up and went to them. >> reporter: he had a long criminal record. >> it's a lengthy one and it includes violent crimes. >> reporter: several arrests in maryland. in 2002 for vehicle theft. in 2004 for assault. in 2006 for attempted first degree murder and assault. in 2011, an arrest in north carolina for breaking and entering and more. he faces more charges after this shooting. >> officer hoake is now out of surgery. at last check he was listed in serious but stable condition. police are investigating a deadly shooting in west baltimore. police say a 24-year-old man was found shot in the stomach there. he was taken to the hospital where he later died. the victim's name has not been

released and so far no arrests have been made. if you have information, call city police. the first freeze warning of the season going into effect tonight. that means taking measures to keep warm like these people at the inner harbor with their heavy jackets and their winter hats and in north baltimore, the low temperatures did not keep everyone inside. those who braved the cold made sure they had extra layers on to night. right now we're at a low for the day. 38 degrees now. but more importantly, look at the dew point. it's still in the upper to mid 20s. it will probably drop around 30- 32 degrees. because of that, we have frost and freeze warnings all over the place. they've even extended them into southern maryland. this will not be happening at the inner harbor.

we'll probably see frost north of cold spring lane. how long will this weather last and will it warm up for the weekend? we'll have the forecast coming up. a warning from police tonight about car seat safety. it comes as a 4-month-old baby boy fights for his life after a car crash. officials say the child was not in a car seat. in fact, he was on someone's lap. wjz is live and we have more on what is becoming a nationwide problem. >> reporter: tonight charges are pending against the father of that 4-month-old after his son was seriously injured in that crash. police say matthew mitchell was behind the wheel of this crushed dodge caravan. he was driving down clark road wednesday when he veered across the center line and crashed head on into another car. mitchell's 4-month-old son in the lap of the front seat passenger. >> right now that i know of, he

has a fractured skull. he had bleeding on his brain. >> reporter: family members are furious the baby wasn't properly restrained. >> his father is drinking and driving with a child in the front seat, period. a child's not supposed to be in a front seat without a car seat. >> the child should have been in a rear-facing childseat in the rear of that vehicle. >> reporter: according to a new study, an alarming amount of parents admit they don't always put their child in a car or booster seat. in a survey of more than a thousand parents, safe kids worldwide found one in four admitted to driving without buckling up their children. >> they told us they were taking a short ride or if they were driving overnight with their kids or perhaps as a reward, they found that it was okay not to buckle up for that ride. >> reporter: wednesday's crash happened a block from mitchell's listed address. family members say they want him criminally charged.

now they're just praying their baby cousin will pull through. and there is some good news to report tonight. we've spoken with hospital officials that tell us that baby's condition has been upgraded to good. >> thank you. investigators are looking into whether alcohol was a factor in the crash. the two other passengers are expected to survive. an investigation after a massive fire at a home in baltimore county. sky high chopper 13 over the scene tonight. flames were shooting through the roof of the home on running fox road. fortunately, no one was hurt. there is still no word on a cause. several school students sent to the hospital after ingesting marijuana. about five students from the reach partnership school fell ill yesterday morning. they tested positive for marijuana at the hospital.

they in the hot seat, the people who designed the government healthcare website are forced to answer tough questions from lawmakers. they want to know why so many people are having so many problems. >> reporter: government contractors came to capital hill to answer lawmakers questions about the problems with healthcare.gov. some lawmakers used personal examples to illustrate their point. >> i got this after 41 minutes -- please log in again. >> we're not excited, nor are we pleased with what we delivered on october 1, but in principle it worked. >> reporter: the contractors said the obama administration made the decision to go live with the website. >> more testing always helps projects like these succeed. >> reporter: republicans argue the bungled roll out points to

it is clear, 38 degrees in central maryland right now. the complete forecast is coming up. in australia, a plane fighting wild fires is involved in a deadly crash, killing the pilot. the aircraft went down in a remote area as it responded to

a fire. crews have battled infernos across the state for eight days straight. fires have destroyed more than 200 homes and ripped through more than 100,000 acres of land. an investigation found a military training exercise started some of those fires. police say several train cars ran off the track spewing the area with gravel. a worker at the site was pinned underneath gravel and a rail car. crews used heavy machinery to recover the man's body. a classmate says she overheard the victim, denver's high schoolteacher, asking the suspect to stay after school on the day she was killed. 14-year-old is accused of murdering her that afternoon. students are shocked by the killing saying chisum was soft

spoken and never appeared violent. accused of shooting two fellow members during a fight at a tennessee armory. police say he shot one victim in the leg and another in the foot before he was subdued and his weapon was taken away by other soldiers. he was a sergeant first class and a recruiter who had been relieved of duty. they were treated for injuries at a local hospital. a traffic cop is recovering tonight after being attacked by an escaped bull in romania. shocking video shows the man being tackled by the bull. the animal reportedly escaped from a farm. the bull was also caught on tape running through an alley as farm workers attempted to catch it, the officer was sent to a hospital with nonlife threatening injury. training service dogs from behind bars. inmates who are military veterans work with dogs who will help wounded veterans when

they come home. >> reporter: the maryland prison in hagerstownhouses inmates doing serious time for serious crimes. locked up doesn't necessarily mean shut off. >> for us who have done something wrong, it's something we can do to return, to try to do something right. >> reporter: it's the early training of service dogs. this is the first time veterans who have been convicted of crimes are raising the dogs to aid wounded veterans returning from afghanistan and iraq. >> this is an opportunity for you to step up to the plate and do something unselfish for somebody else. >> pay back to the people who help us so much. >> reporter: help flows both ways when a dog's in the middle. >> to be incarcerated and to have a dog, this is like no matter how bad my day is, that dog always wagging his tail. >> reporter: after a year of care and training, the first

three dogs graduated to the next step. the dogs now go on to new york to advance training. a good-bye that's not easy. >> it's like losing a friend. it's going to be very, very difficult. >> reporter: although the next recruits waiting outside the prison gates might help ease that loss. >> that advanced training could run 3-6 months before the dogs are matched with a disabled veteran. a man pulled off a scary stunt in colorado dangling from a hot air balloon. >> there is a hot air balloon on the north end of town and there's a guy hanging from it. i don't know if he's supposed to be or if he's in trouble. >> concerned residents dial 911, but it does turn out the man was never in danger. he was filming a video for his company's new workout equipment. the monkey bars can be used about anywhere. the video wasn't meant to go public until next year and he

or not. 41 up in cumberland and easton. some places will not even get near the freezing mark. outside of d.c., yes. outside of annapolis, yes. areas away from the water, eastern shore will probably see frost overnight. as long as you're away from a warmer body of water, the bay is now 62 degrees. still a bit of a breeze. if we have that wind that keeps turning the atmosphere over, it won't get quite as cold. as soon as the winds die down, temperatures will drop. 53, 30. that's where we're at right now. 64, 43 is the normal. 82 and 25 are the records. here in the east we still have cold high pressure dragging this chilly air in from canada. by the weekend, it starts to moderate. there were snow showers and rain showers. even a little bit down here in
