i'll see you in a few more minutes. >> thank you, tom. now to breaking news and tragic new details in an accidental shooting investigation in orange county. investigators now confirming a 13-year-old boy who was shot on sunday has died. >> the new developments coming in within the last couple of hours. news 6 reporter troy campbell just got back from speaking with the young boy's coach in ocoee. >> yeah, it's pretty tragic. friends and family members of 13-year-old levardo fisher you see right here, they say he died last night after being rushed to the hospital sunday night in had critical condition. new this afternoon, we've learned the boy's relative was holding a gun while riding on a hoverboard. the relative lost his balance and accidentally shot the teen in the head. he was an 8th grader at ocoee middle school and a quiet kid that excelled in academics and very well-liked by his

>> the kid is who you want to marry your daughter, the kid that you want to take your daughter to the prom, the kid you can trust to drive her to the prom. that's him. >> investigators say the gun does belong to one of his relatives. that's video of his uncle being arrested outside of the crime scene. at the time, he was just arrested for being a convicted felon in possession of a firearm. initially the people inside the house, they told investigators someone else shot the teen and took off running but later changed their story. a little later at 5:00, we'll hear more from the boy's football coach about what the team plans to do to honor his life. >> such a sad story. troy, thank you. >> just in at 4:00, a local high-profile attorney says he's now representing one of the 11 victims who was shot at an orlando nightclub over the weekend. he says he's investigating if the club did enough to protect the 300 people inside at the time. two people died at the shooting

universal boulevard in the heart of the tourist district, not far from international drive. news 6's erik von ancken is live in downtown orlando. you just talked with attorney matt morgan. what did he tell you? >> right, lisa. just within the past 45 minutes or so, o.p.d. still isn't telling us who those 11 people are who were shot over the weekend, but matt morgan says one of them now has come to him and he's taken the case. >> why do you believe this could be a negligence case? >> a nightclub has the duty to ensure the safety of the people that come into the club. >> attorney matt morgan says his client -- he won't identify the person -- was standing just feet away from the shooters when they opened fire inside the glitz ultra-lounge early sunday morning. the reason he's involved now is his client doesn't believe there was enough security at the club even though a police spokesperson said this sunday morning, just hours after the shooting. >> i want to say that the club really did everything that it's supposed to do.

we have to investigate that. we know that there were people that were able to bring guns into the club. we know that there was a security company that was hired to check for people bringing guns into the club. despite that, people were able to bring guns into the club. >> o.p.d. also had off-duty officers inside the club. three of them in full uniform, fully armed after two shootings in the parking lot here last year. the club also has cameras inside and out according to police and private security doing patdowns. but morgan and his client don't believe it was enough. >> and o.p.d. said again today that this was an isolated incident. the public does not need to be concerned. they know who the suspects are. so why aren't they telling us and why aren't they telling us who the victims are? lisa, answers when i see you again coming up at 5:00. >> all right. erik von ancken reporting live in downtown orlando tonight. thank you. >> also right now, new hampshire

winds of 100 miles per hour. now senator bill nelson is calling for an investigation to see if this ship should have sailed in the first place. eric sandoval is getting answers at port canaveral. what are you finding out today? >> well, you know, julie, the ship, anthem of the seas, should be right behind me right now. it should be here in florida, port canaveral, but as we know now, it had to turn around because it encountered the terrible storm out of the atlantic. i talked to the national transportation safety board today, they tell me they're seriously considering launching an investigation to see why the ship set sail when a vicious storm was lurking off the coast. >> the new cell phone video shows how hard it was for people to keep their balance as the anthem of the seas sailed through a storm this week. waves reached 30 feet, forcing passengers to stay inside their room until the storm passed. >> i'm sure there was a

the question is, why? >> senator bill nelson says he wants the national transportation safety board to find out why the cruise line cleared the anthem of the seas to sail through that storm. news 6 found out this afternoon, the ntsb is considering his request. >> that is pretty crazy. it's like, i don't know, i wouldn't want to go on a cruise after that. >> she says she's sailed to the bahamas before and couldn't believe the video she saw showing what happened on board the anthem. >> do you think that the cruise ship should have sailed, knowing that storm was out at sea? >> no. i think it was wrong for them to even go. they should have just held it off for a while until it was better. >> so why didn't the captain wait? well, we're actually hearing from that captain for the very first time. we just got ahold of some video of him explaining to passengers on board the anthem of the seas why he decided to set sail. we're going through that video right now. we'll have it for you coming up

for now, we're live at port canaveral, eric sandoval, news 6. >> thank you, eric. a valentine's staple possibly in jeopardy thanks to this out of whack weather. >> we're talking about the very important chocolate covered strawberries. news 6 meteorologist candace campos hit the local fields to find out what was going on. >> well, don't let these cute little faces holding all those strawberries fool you. it was certainly slim pickings when we went out to the strawberry fields and it looks like in oviedo, pappy's patch, it was pretty hard to find any of those strawberries. check this out. the patch was only able to be open about an hour this morning before the field was picked out completely. many folks who frequent pappy's each year told us they had to work extra hard to fill those buckets. they said it's been the worst year in strawberry history, at least for the 14 years she's been taking care of the patch.

>> happening today, a florida congressman john micah in our nation's capital where he got a bill passed to reopen the lake baldwin v.a. nursing center. earlier he visited lake baldwin where the v.a. nursing center will reopen its doors to veterans. the state has control over the 120-bed facility which sat empty for two years. he says more veterans are moving to florida so the space was needed again. there's another v.a. nursing home across the state. >> well, bold crooks, bundle up with quite the disguise during store. >> deputies want to get results and catch them. security cameras at the family dollar in marion oaks captured what appears to be men wearing mask, glasses, along with a scarf and gloves. they targeted two employees leaving through the night in the parking lot and forced them back in the business with guns to rob the place.

the 4-year-old police dog took a bullet to the neck while chasing after a man who shot his wife. >> i didn't see a handgun. endo was sent to apprehend him. he did just as he was supposed to do. he caught the guy and did physically apprehend the guy. that's when he was shot, we believe when he was on the apprehension on the bad guy's leg. >> the shooter turned the gun on himself. but even after the german shepherd was shot, endo never slowed down, determined to protect his fellow deputies. >> he definitely saved lives. had we not located him then, another person would have been tracking that guy. >> the sheriff ben johnson awarded endo with a purple heart and medal of valor, saying he's the most decorated police dog in their department. >> deputy woodson was also awarded for his calm reaction in the moment, ensuring the safety of all deputies on scene and

dealers even sign an agreement stating they will abide by all county ordinances. so whose job is it to enforce this rule? >> the local law enforcement jurisdiction is the one responsible for enforcing it. if the gun show is taking place within the sheriff's office jurisdiction, we will enforce it. we do occasional spot checks. we may do walk-thrus. but still, 40% of guns sold in this country are sold without a background check. >> no. it would not surprise me that you would be able to do that. we need to have universal background checks for all gun sales that happen in our state. >> john mar, a licensed gun dealer, disagrees. >> we don't need more restrictions on gun ownership. we've got enough already on the books. >> but even with an ordinance on the books, we found rules being ignored. >> the fairgrounds is the only location within volusia county sheriff's office jurisdiction

they really quickly, lisa, checked at my i.d. to see if i was 21 and then they gave me the gun without doing a background check or having me wait the three days. the onus, according to the sheriff's office, was on the seller, though it was a private seller, because they were selling the gun at that fairground at a public gun show, they were supposed to wait the three days and check a background check on me. >> so really the only way you wouldn't have to wait is if you have the concealed weapons license? >> correct. >> i know you've heard from a lot of people on both sides of this issue, including some gun owners. what are they saying about this? >> well, i did talk to some gun owners who contacted me. a lot of gun owners think there's too many laws on the books for guns. even though they say there's too many laws, they say the laws on the books are not being enforced and they say that's a problem and they're disappointed with that. >> we posted an extensive interview with a licensed gun dealer on our website. you can find it now by heading

hour, gusting even higher than that. making it feel a whole lot colder than it really is. here's daytona beach right now. don't see a lot of whitecaps out there. the wind is coming in from the west right now. west-southwest at 24 miles per hour in daytona beach. temperature reading, 57. humidity, 45%. it is 59 right now in orlando. the same in melbourne. leesburg, 58. check out all the winds. all of them, above 20 miles per hour or right at 20 or better. again, you see 59 degrees in orlando. let's move on past that and show you daytime highs today was only 57 in ocala. 55 in new smyrna beach and 60 out at the cape. right now, at the cape we're down to 59. same in orlando. 58 from sanford to leesburg. 57 from the villages all the way into ocala. here are the winds i was just talking about. all the major reporting stations are at 20 miles per hour or higher. the villages is at 14. look at new smyrna beach. 31-mile-an-hour wind. it's just crazy. crazy windy out there.

i can't think of anything from kite flying to whatever you want to do in the wind, you really can't enjoy it. it's too windy, too windy for even the fun stuff. the satellite and radar together are not showing any appreciable precipitation coming in. you can see the cloud cover from orlando to kills me to melbourne, those will -- from kissimmee to melbourne, those will peel away. it's going to be time before we can turn it around. overnight lows tonight are down to at least 33 in ocala. some of the outlying areas in marion county will go below that. temperatures of 31, maybe 32. for that reason, a freeze warning in marion county and ocala. the winds tonight keep right on pushing from the west, gusting up to 20. the overnight low in orlando can get as low as 39. here's tomorrow.

by noontime tomorrow, we're back to 52. only an 11 degree jump and up to 57 for the daytime high. keep in mind. a normal daytime high should be 72 degrees. we're not making that anytime soon. overnight low tomorrow night, 36. by thursday, 59 is the daytime high. friday, okay, it's getting better. 68 degrees for the daytime high on friday. saturday, sunday and monday, all kind of look alike. much better. back to the low 70's. >> thank you, tom. we want to get you to some breaking news. sky 6 is live over the casselberry wal-mart. you can see firefighters on scene. firefighters tells news 6 smoke forced them to evacuate shoppers. within the last couple of minutes, we're told the scene is clear. the fire is out. it turned out to be an a.c. unit on the roof that burned out. shoppers are now being allowed back in. we will keep you posted. >> ahead at 4:30, a record-breaking year for shark bites. where florida ranks on that list.
